This works aim to establish an analogy between Deliberative Democratic Theory from John Rawls and Jürgen Habermas through a comparative analysis. The conceptions developed by these two exponents theoreticians seek to give some thoughts to political pluralism using different justifications. This theme was chosen in order to feed into the discussion on the importance of the legitimacy of the Democratic State. John Rawl's theory sets out substantive democracy, whereas Habermas proposes the procedural one. This paper attempts to outline both theories, without making value judgments, however it intends to highlight points of convergence and divergence. The method used was the deductive bibliographic research relaying on major works from these two authors and on writings an articles from their commentators. In an attempt to shed some light on the debate, primarily this paper discusses Rawl's Theory os Justice as Equity from the point of view of Contractual Theory and its specials characteristics, the original position and the veil of ignorance, public reason and principles of justice. In a second moment, it presents Habermas Procedural Theory, communicative action, public sphere, equiprimordiality between public and private autonomy and Law Discursive Theory. Lastly, this works draws attention to the main points of agreement as well as disagreements emphasizing the importance of the deliberative democracy in democratic countries. [ABSTRACT FROM AUTHOR]

O objeto deste trabalho é o lugar das ações afirmativas na teoria de John Rawls. Para tanto, começa-se traçando a relação entre a justiça como equidade e a não discriminação. A partir daí, diante da falta de manifestações do próprio Rawls, apresenta-se a visão de diversos autores que já trabalharam a justificação rawlsiana das ações afirmativas. Dentre eles, foca-se na interpretação proposta por Robert S. Taylor, para quem a justiça como equidade não justifica a existência de cotas nem mesmo em condições não ideais. A tese aqui levantada é que o autor está equivocado em ambas as condições ideais e não ideais de justiça. No caso ideal, o cerne do problema surge na questão da superação (ou não) da opressão sistemática em uma sociedade bem ordenada. Como próprio Taylor, em texto posterior, mostra-se inseguro quanto à questão, seu argumento torna-se, no mínimo, inconclusivo. Além disso, defende-se que Taylor não compreendeu corretamente a prioridade lexical dos princípios, e que as cotas não entram em conflito com a igualdade de oportunidades formal. Sustenta-se, com isso, que as ações afirmativas são compatíveis com a teoria ideal de Rawls. Já em condições não ideais, são dois os argumentos centrais para justificar as ações afirmativas. O primeiro estabelece os limites de aplicação da justiça procedimental pura e reconstrói a noção de procedimentalismo puro em condições não ideais à luz do equilíbrio reflexivo. O segundo ventila a possibilidade de ações afirmativas com base em uma forma especial do princípio da diferença, sensível a desigualdades não apenas de renda e riqueza e tendo em vista os papéis da teoria não ideal. Ao final, tendo sido o projeto bem-sucedido, encontram-se argumentos favoráveis às ações afirmativas rawlsianas, sem perder de vista os valores essenciais do liberalismo de Rawls, como autonomia, individualismo e procedimentalismo. The subject of this work is the place of affirmative action in John Rawls's theory. To do so, we begin by drawing the relationship between justice as fairness and non-discrimination. Following, due to the lack of Rawlss manifestations on the subject, we present the views of some authors who have already worked out a Rawlsian justification for affirmative action. Among them, this work focuses on the interpretation proposed by Robert S. Taylor, for whom justice as fairness does not justify the existence of quotas even under non-ideal condition. The thesis raised here is that Taylor's reading is mistaken in both ideal and non-ideal conditions of justice. In the ideal case, the core of the problem arises from the question of the overcoming (or not) of systematic oppression in a well-ordered society. Since Taylor himself, in later text, seems uncertain about the matter, his argument becomes at least inconclusive. In addition, it is argued that Taylor did not correctly understand the lexical priority of principles, and that quotas do not conflict with formal equality of opportunity. Thus, affirmative action is supported by Rawls's ideal theory. Under non-ideal conditions, there are two central arguments to justify affirmative action. The first sets the limits of application of pure procedural justice and reconstructs the notion of pure proceduralism under non-ideal conditions in light of the reflective equilibrium. The second discusses the possibility of affirmative action based on a special form of the principle of difference, sensitive to inequalities not only of income and wealth and which considers the roles of non-ideal theory. In the end, if the project was successful, we state some arguments more favorable to Rawls's affirmative actions, attentive to the essential values of Rawls's liberalism, such as autonomy, individualism and proceduralism.

O objetivo deste artigo é analisar a crítica de Waldron a Rawls, feita no livro Law and Disagreement. Queremos saber se nessa crítica está implícita a ideia de que Rawls faz uma má idealização. Para fazer isso, teremos, em primeiro lugar, que esclarecer a relação entre “teorias ideais”, aquelas que estipulam os princípios de justiça que devem ser alcançados para tornar justa uma sociedade, e “más idealizações”, distorções conceituais ou falsificações de fatos que podem ser feitas por uma teoria. Falaremos sobre essas distinções na primeira seção do artigo. Waldron ataca a alegada incapacidade da teoria de Rawls de tratar seriamente os desacordos sobre os princípios políticos. A exposição dessa crítica e a análise de seu desenrolar vai ocupar as parcelas mais significativas do artigo, e será feita nas seções seguintes. Ao fim da análise, defenderemos que, apesar de a crítica de Waldron ser forte, ela não gera a implicação de que Rawls faz más idealizações. Our aim in this paper is to analyze Waldron’s critique of Rawls, made in the book “Law and Disagreement”. We want to know if, implicit in the critique, lies the idea that Rawls was making a bad idealization. To do this, we need first clarify what is an “ideal theory” (as opposed to a non-ideal theory) and what are good or bad idealizations. We’ll develop these distinctions in the first section of the text. Waldron attacks Rawls’s alleged inability to seriously address the problem of disagreements on political principles. Exposing and analyzing the many aspects of this critique will occupy us on the remaining sections of the text. At the end of the analysis, we’ll argue that, although Waldron’s attacks were strong, we nonetheless have no reason to conclude that implicit on them rests the idea that Rawls was making bad idealizations.
