Türk Hukukunda evlilik birliğinin getirdiği yükümlülüklerden biri de eşler arasındakinafaka yükümlülüğüdür. Kanun koyucu ahlaki ve sosyal düşüncelerin etkisiyle TürkMedeni Kanunun 175. maddesinde düzenlediği yoksulluk nafakası kurumu ile eşlerarasındaki bu yükümlülüğün boşanmadan sonra da devamedebileceğini öngörmüştür. Bu çalışmada öncelikle yoksulluk ve kadın yoksulluğukavramları ile birlikte yoksulluk nafakasının hukuki niteliği ve amacı saptanmıştır.Ayrıca öğreti ve yargı kararları ışığında, yoksulluk nafakasının koşulları, başlangıcı,miktarı, ödeme şekli, süresi, sona erme halleri ve yargılama usulü incelenmiştir.Özellikle yoksulluk nafakasının süresiz uygulanmasından dolayı kamuoyunda ortayaçıkan rahatsızlıklar ve güncel tartışmalar, bu yönde yapılan çalışmalarla birlikte elealınmıştır. İfade edilen bu rahatsızlıklar neticesinde bugün gelinen noktada yoksulluknafakasına dair olası bir kanun değişikliği nedeniyle, toplum yapımız da gözetilerekkarşılaştırmalı hukuk eşliğinde eleştiri ve tavsiyelere yer verilmiştir.Anahtar Sözcükler: Güncel Tartışmalar, Nafaka, Süresiz Nafaka, Yoksulluk,Yoksulluk nafakası. One of the obligations of the marriage union in Turkish Law is the alimonyobligation between the spouses. The legislator envisaged that the poverty alimonyobligation between the spouses, which is regulated by Article 175 of the TurkishCivil Code, may continue after divorce due to ethic and social considerations. In thisstudy, first of all, the legal nature and aim of poverty alimony are determinedtogether with the concepts of poverty and women poverty. In addition, in the light ofthe doctrine and judicial decisions, the conditions, beginning, amount, form ofpayment, duration, termination and judicial proceedings of poverty alimony areexamined. In particular, disturbance and current debates in society due to theindefinite implementation of poverty alimony are discussed together with otherstudies related to the issue. As a result of these disturbances in society, a possiblechange in the legal regulation of poverty alimony may come into force. Temel işlevi taşınmazları, üzerlerindeki ayni haklarla birlikte alenileştirmektir. Bu, oldukça önemli bir işlevdir çünkü, kural olarak bu bilgilere iyiniyetli güven sonunda elde edilen kazanım korunacaktır (MK md. 3, 712, 1023, 1024, 1025/11); kimi hallerde de devletin kusursuz sorumluluğu söz konusu olabilecektir. Bu bakımdan tapu sicilinin gerçek hak durumunu yansıtması önemlidir. MK esas olarak `yolsuz tescil'in düzeltilmesini öngörmüştür. Gerçek hak durumunu yansıtmayan tescil yolsuzdur. Tescil, ayni hakların tapu kütüğüne yazımı demektir. Oysa tapu kütüğünde, ayni hak yazımı türünden olmayan yazımlar da bulunmaktadır. Şerhler, beyanlar, taşınmazı tanıtıcı bilgiler, tescil niteliğinde olmayan yazımlardır. MK md. 1024-1027 maddeleri hep `tesciP'in yolsuzluğu ve düzeltilmesi ile ilgilidir. Diğer kayıtların düzeltilmesi ile ilgili bir düzenleme yoktur. Kişisel hakların şerhleri (MK md. 1009) ile eski hukuktan gelen ayni hakların beyanı, maddi bakımdan tescile benzedikleri için bunların düzeltilmesinde tescillerin düzeltilmesine ilişkin kurallar uygulanabilir. Tasarruf sınırlamalarına ilişkin olan şerhler (MK md. 1010) genellikle belirli bir resmi makamca verildikleri için yine aynı usul içinde düzeltilmeleri yapılabilir. Geçici tescil şerhleri bakımından da bunların kurulmasına karar veren mahkeme nezdinde aynı usul içinde düzeltmenin yapılabileceği söylenebilir. Diğer şerh ve beyanlar için genel bir düzeltme yolu belirlemek kolay değildir. Çünkü bunlar homojen bir yapıya sahip değildir. Her biri ayrı ayrı değerlendirilmelidir. Bu çalışmanın ilk bölümünde tapu sicilinin yapısı ve içeriği hakkında genel bilgi verildikten sonra `yolsuz tescilin tanınılan tartışılmış, önemli yolsuz tescil halleriincelenmiş, `yanlış yazım` ile `yolsuz tescil` kavramları karşılaştırılmış; yolsuz tescilin sakıncaları belirtilmiştir. İkinci bölümde, tapu sicilinin düzeltilmesi en geniş anlamıyla ele alınmıştır. Yolsuz tescillerin yanısıra, yanlış yazımlar da bu kapsamda incelenmiştir. Bu bölümün ilk paragrafında (§ 5) `basit düzeltme yollan` adı altında, MK md. 1025 'deki düzeltme davası dışında kalan tüm düzeltme yolları incelenmiştir. Bu paragrafın `basit düzeltme yolu` olarak adlandırılmasının nedeni, burada yer alan düzeltmelerin genellikle yazım yanlışlıklarına ilişkin olmalarındandır. Basit düzeltme yolu kapsamında, MK md.l027'ye göre anlaşmayla düzeltme, tapu memurunun dava açması, tapu memurunun re'sen düzeltmesi; MK md. 1026'ya göre sonradan hükümden düşen bir tescilin düzeltilmesi (MK md. 1026), 3402 sayılı Kadastro Kanunu md. 41 'e göre düzeltme yolları incelenmiştir. 6. paragraftan itibaren de `tapu sicilinin düzeltilmesi davası` (MK md. 1025) ele alınmıştır. Bu konu, düzeltme yollarının ağırlık merkezini oluşturmaktadır. Kısaca düzeltme davası dediğimiz bu dava, ayni nitelikte bir taşınmaz davası olup, kural olarak zamanaşımına tabi değildir. Aslında var olan ayni hak durumunu tesbit eder. Davadan önce de hak vardır ancak şekil ile maddi gerçeklik arasında görünüm farkı vardır. Dava ile bu fark giderilir. Baskın görüşe göre bu dava bir tesbit davası olarak kabul edilmekle birlikte, eda davası niteliğinde olduğu da güçlü gerekçelerle savunulmaktadır. Bu dava ile birlikte, sicil zilyetliğinin yanısıra ayrıca bir istihkak, elatmanın önlenmesi ya da zilyetliğe dayanan bir dava açmaksızın fiili zilyetliğin sağlanıp sağlanamayacağı da tartışmalıdır. Tüm bu konular ilgili bölümlerde tartışılmıştır. In this dissertation it was held and studied. The land registry is a public record which is produced and kept by the special officer who is called as the `registrar (of land register)`. These are the public documents that creates a presumption on the existence of the rights shown there. Those records are open to the public and anyone who is interested in the register can see it and ask copies. Any right on an immovable exists without being registered, or is incorrectly registered or incorrectly cancelled or if any caution or objection that has a function and affect similar to the entries in the land registry, that should have been cancelled has not been cancelled, the person affected by the incorrect state of the register may apply for a rectification of the register, and may compel any person whose rights would be affected by the incorrect state of the register may apply for a rectification of the register, and may compel any person whose rights would be affected by such rectification to give his assent thereto, and to procure any registration required for the purpose of making such assent effective. This dissertation as a whole, consists of two main chapters. In the first chapter, the basic principal of entry İn the land register in Turkish Civil Law, its exceptions provided by the Turkish Civil Code and the other codes and the reasons which cause wrong entries were exposed. The entry which never contains the correct real right situation is called as a `wrong entry` (injustice entry). It should soon be rectificated because it is necessary for both individual and the public interest. In the second chapter, rectification solutions were classified. First of all the secondary ways for the rectification of the register are in three different solutions that are provided in the Art. 1026 and 1027 of The Turkish Civil Code and as an exceptional way in the Art. 41 of The Cadastre Act. IllIn the final part of the second chapter major rectification way (Turkish Civil Code Art. 1025) was in detail discussed and explained. It is both theoretically and practically most important and widely applied solution for the purpose of rectification in the land register. It directly affects the real right on an immovable property. The rectification through a jurisdiction is the most popular way in Turkish legal practice. The other rectification ways are used in limited frequency in the legal practice. This practice cause more work and effort in the courts. IV 277

ÖZET Kira, bir nesnenin kullanma hakkının, bir bedel karşılığında karşı tarafa bırakılması olarak tanımlanmaktadır. Kira sözleşmeleri konusu bakımından adi kira sözleşmesi ve hasılat kirası olarak ikiye ayrılabilir. Konumuzu teşkil eden gayrimenkul kiraları adi kiranın özel bir şeklini teşkil etmektedir. Ülkemizde, adi kira sözleşmeleri, Borçlar Kanunu ve 6570 sayılı Gayrimenkul Kiralan Hakkında Kanun ile düzenlenmiştir. Kanun koyucu, konut ve işyeri niteliğindeki gayri menkullerin ihtiyaca yeterli bir şekilde cevap verememesini göz önünde bulundurarak, 6570 sayılı Kanunla, Belediye teşkilatı içerisindeki musakkaf gayrimenkullerin kiralanmasını özel olarak düzenlemiştir. Kanun 1' inci maddesinin son fıkrasında BK hükümlerinin ancak bu Kanuna aykırı olmayan hükümlerinin tatbik olacağını belirtmiştir. 6570 sayılı Gayrimenkul Kiraları Hakkında Kanun 7. maddesinde ve 12'inci maddesinde kira sözleşmesinin sona erme nedenleri tek tek ve sınırlı nitelikte sayılmıştır.. Mesken ve işyeri hacmi bakımından, gelişmiş ülkelere göre, ülkemiz gerilerdedir. Bundan dolayı, 6570 sayılı Kanunun gayesi itibariyle, sosyal içerikli, kiracıları korumaya yönelik hükümler içerdiği görülmektedir. Kiracıların bu şekilde korunması ise, kiralayanın, kira akdini sona erdirme nedenlerinin sınırlandırılması ile gerçekleştirilmeye çalışılmıştır. Ancak, kiralayanın mülkiyet hakkını da yok sayacak şekilde kiracı korunmamalıdır. Tahliye davalarında hakimin, menfaat içtihatçılığı doğrultusunda tarafların menfaatlerini ve somut olayın özelliklerini gözeterek karar vermesi 6570 sayılı yasaya uygun olacaktır. Biz bu tezimizde 6570 sayılı Kanununun 7'inci ve 12'inci maddelerinde öngörülen tahliye sebeplerini Yargıtay içtihatlarından da yararlanarak incelemeye çalıştık. Çalışmamızın en sonunda, Gayrimenkul Kiralan Hakkında Kanununun öngördüğü tahliye sebepleri hususunda ulaştığımız sonuçlar belirtilmiştir. III ABSTRACT Lease is defined that one party conveys the right ofthe exclusive use and enjoyment of a thing to anotherparty in exchange for a price. Contracts of lease canbe separated in two parts which are ordinary lease andusufructuary lease according to their subject. Leaseof real property which is subject of our thesis is special one of the ordinary lease. In our country,ordinary lease has regulated by the Code ofObligations and the Statute Concerning Real Propertyno: 6570. The legislator, considering that real estate which is residence and place of employment can't servet he need enough, with the Statute no: 6570, has particularly regulated renting real estate within the district of municipality. In the last paragraph of its article 1, this Statute has clarified that the provisions ofthe Code of Obligations which isn't contrary to this Statute can be applied. In the articles 7 and 12 ofthe Statute Concerning Real Property no: 6570, reason's of termination of lease contract has been counted one by one and limited with these ones. Our country is underdeveloped according to developed countries from point of view of capacity of residence and place of employment. For this reason,the Statute no: 6570 has contained provisions which are social and protecting tenant. The protection of tenant has been tried to carry out via restricting lessor's reasons of termination of lease contract. However, tenant shouldn't be protected in a way that eliminates lessor's property rights. In action of ejectments, making decision of judge by means of considering interest of parlies and special features of the case which he examines will be appropriate for the Statute no: 6570. In our thesis, we have tried to examine the reasons of ejectment counted in articles 7 and 12 of Statute no: 6570 benefiting from the opinions of The Supreme Court of Appeals. In the end of our study, conclusions we have reached about the reasons of ejectment regulated in the Statute Concerning Real Property have been explained. IV 91

SUMMARYThe procedural intensity that the service performances have evolved being parallel to the legal life in the last 150 years, has made an increase in the importance of "the contract of simple mandate" as "the model contract". In this framework the careless performance of the mandatary's performance obligation, comes often before us as a breach of contarct in the law of mandate and that has given rise to the settling down of the article 390/I-II of the Obligations Act.As a rule the article 386/II of the Obligations Act, does not foresee a numerus clausus principle for the contracts with sercice performances; and it does not draw limits to the conglusion of the above said contracts against the rule of "type freedom". Art. 390/I-II, as a "general liabilty and care measure provision", does find an obligatory field of application even for the service performance contarcts that can not be accepted as any other contarct types.Care is a criteria of a humanistic behaviour, as a synthesis of extarnal behaviour and an internal period that obliges a person to perform a certain act.In both contractual and tortious liabilities field, "the duble nature" that it possesses for it's determination of both contractual breach and faulty behaviour, is the last point that the liability concept may reach. The breach of contract just as in the incongruousness of law, appears as a breach of the performance obligation that is determined by taking the highest extarnal and internal care into consideration; the care that is desired when fixing the fault's level, is determined according to the avarage behaviour of an avarage person. Professional fault, as a breach of contarct, is a deviation from the medical science and application rules that are generally accepted. The care obligation that is regulated in the Art. 390/II of the Obligations Act is a special appearance of "care obligations" that function in all of the performance obligations. Mandatary's care obligation is added to the labour or service obligation that rises from ordinary mandate contract and it maintains it's full performance.Article 390/II is a breach of contract just as Article 321/I. On the contrary Article 390/I is a "fault" norm altogether with Article 321/II. And being as a breach of the mandatary's performance obligation, objective care obligation is determined by deviation from the highest external and internal care.As a rule, it is not possiple to qualify, the performance with the breach of the mandatary's care obligation, as the non-performance of mandate. However if the berach of contract that is caused by the careless act turns out to be "a mojor breach of contract"; and the acceptance of the action directed towards the consequence can not be anticipated, the mandatary's performance obligation turns into a compensation dept. Art. 390/I refers to Art. 321/II which regulates the workers liabilty. Art. 321/II accepts the subjective care measure for the worker's negligance as fault provision. However for today, in order to blame the worker for the breach of the service contract, the subjective care measure can not find an application for mandate contract and a higher, even an objective leveled behaviour (the avarage behaviour of a professional avarage mandatary's) is desired. The avarage behaviour of a proffesional avarage mandatary's measure, is "the lowest care standart". If a mandate has ability, quality, knowladge and experience above this standart, then he has to deviate from the typicalism of the current profession and he has to perform according to the care measure that is required by his expertism and talend. The abstract care measure is applied to the concrete happening by personalization. The non-liability agreements that the parties will conclude in ordinary mandate contract will be valid, if they are in the frame of the Art. 99. Although the care concept creates difficulties because of it's double nature, the mandator has to prove the mandatary's berach of the objective care measure as a breach of contract in the frame of Art. 96; The mandatary has to prove that he does not have fault in the level of objective negligence measure. The obstacle that arises from the proff liabilty of the mandator, can be solved with the proof easiness that are related to the reversing of the first appearance proof and proof liability.

Beden tamlığının ihlâlî ve Ölüm Hallerinde Doğan Maddi Zararların Hesaplanması ve Tazminatın Tayini isimle tezimiz iki bölüm halinde hazırlanmış olup, birinci bölümde; bedensel zararlar, ikinci bölümde maddi zararların hesaplanması ve maddi tazminat kavramı ve tayini üzerinde durulmuştur.İnsanın beden ve ruh sağlığı ve yine yaşam hakkının kutsallığına saldırı teşkil eden gerek sözleşmeye aykırı hareketten doğan gerekse haksız fiilden doğan zararların tam olarak tazmini hukuk sistemimizde her zaman tartışılan güncelliğini kaybetmemiş bir konudur.Zarar görenin gelecekteki gelirinin hangi oranda arttırılacağı ve hangi oranın gerçek reel artışı temsil ettiği istatistiki veriler yardımı ile ortaya konulmuştur.Geleceğe yönelik bir zararın tazmininde matematik ilkeler ön plana çıkmaktadır. Tazminatın sermaye olarak hüküm altına alınacağı hallerde, sermayeleştirme işleminin hangi yöntem ile yapılacağı, bu yöntemlerin farklı sonuçlara vermesi nedeniyle önem kazandığından, sermayeleştirme teknikleri üzerinde durulmuştur.Yine meydana gelen zararın tam olarak tazmin edilebilmesi için, zarara yol açan eylem nedeniyle, meydana gelen faydalardan hangilerinin indirilip indirilemeyeceği sorunları incelenmiştir.Maddi tazminat kavramı ve özellikle, destekten mahrum kalma ve destekten yoksan kalma tazminatı incelenmiştir.Tazmin borcunu doğuran sorumluluk çeşidine göre olaya uygulanacak zamanaşımı sürelerin hangileri olduğu üzerinde durulmuştur.Tazminat borcunu sona erdiren sebepler üzerinde durulmuştur.Our thesis is prepared in two parts; one of the part is named " Infringement (corrupting) of the Body -complete and Calculating of the Corporal(material) harms that occur because of the Death and The Appointing of the Indemnification "In the first period the harms that occur in the body and in the second period the Calculating of the Corporal(material) harms and the Appointing of theIndemnification are studied. The Indemnifying of the harms of the attack to the body-health and to the spiritual-health of the human-being and also to the holy-life of the human -being and the Indemnifying of all these harms which occur from an unjustice or an illegal action against the contract have always been very important and current. The rising-rate of the credit or income of the harmed-person in the future and the amount of the rate to be increased and the real increasing rate of the income are given according to the statistic data. In the indemnifying of the harms to be occured in the future the mathematical principles are to be performed and the methods of the capital-performing implementation has become very important since all these methods give different results in the positions where the indemnification is to be resoluted as the capital and thus the techniques of having capital have become very important. And also to indemnify the harm to be seen complately , the problems of deciding on the decreasing art and amount of the occured and performed profit or income has been examined because of the action which caused to the harm. The concept of the Corporal(material) indemnification and especially the lack of supporting indemnifying have been examined deeply. Also the law prescriptions which cause the indemnifying obligation of the period to be performed in such an event about this subject is examined mainly. The reasons which cause to end the obligation of the indemnification wasVery imported and studied on them.
