La exposición pretende una valoración crítica de la pena de prisión permanente revisable, introducida en el Código Penal español en 2015. Tras resumirse brevemente su regulación, se repasan, entre otras cuestiones, los argumentos que ponen en cuestión su conformidad a la Constitución española, a los fines de la pena y a los límites a la potestad punitiva del Estado propios de un Estado democrático de Derecho, llegándose a la conclusión principal de que, incluso si la pena no se considerara contraria a la Constitución, no es adecuado ni conveniente mantenerla. The presentation aims at a critical assessment of the permanent revisable prison penalty (revisable life imprisonment), introduced in the Spanish Criminal Code in 2015. After briefly summarizing its regulation, we review, among other issues, the arguments that call into question its conformity with the Spanish Constitution, the purposes of punishment (goals of sentencing) and the limits to the punitive power of the State typical of a democratic State of Law, reaching the main conclusion that, even if the penalty is not considered contrary to the Constitution, it is not appropriate or convenient to maintain it.
