Abstract

The residents of Ecuador's Oriente region have filed a class action suit against Texaco in a US court for damaging their rainforest environment and increasing their health risks. The American oil giant is claiming that the case should be resolved in Ecuador because all the interested parties are there. However, the plaintiffs argue that a US court is fitting because all of Texaco's technical decisions were made in its US offices.

U.S. Federal Judge Leonard Sand on March 11, 2010 ruled in favor of Chevron in its bid to seek arbitration in The Hague over its dispute with Ecuador on the environmental cleanup of a former Texaco producing site in that country. Chevron in September 2009 had filed for international arbitration of the dispute before the Permanent Court of Arbitration in The Hague.
