My aim is to elucidate Habermas' pragmatic theory of language as presented in the first chapter of Between Facts and Norms, by relating the theses presented in this part of the book to some theses presented above all in the second part of Post-Metaphysical Thinking in order to elucidate how the discourse theory of law and democracy presented in 1992 is supported by a specific conception of language. Then, I intend to present a critique of Habermas' pragmatic theory of meaning, by showing that the thesis according to which "we understand a speech act when we know what makes it acceptable" is false insofar as it makes the acceptability of the validity claims of a speech act the condition for its understanding.
