On the question whether the Anglican Communion/The Episcopal Church has a theology of abortion, an important factor overlooked. It is the relationship between theology and law as understood in the Episcopal Church/Anglicanism. On reproductive choice, theologians, pastors, politicians, and activists rarely display an interest in the law, except on how to use it as a tool for a specific goals. I contend that the discourse on abortion (within the Church, and the body politic) would benefit from a more comprehensive understanding of the law. This practicing theology essay will introduce readers to the meaning and purpose of the law in a pluralistic and multiracial society. Through the work of William Stringfellow and Stanley Hauerwas and with special focus on the work and witness of Bishop Walter D. Este artículo es un panorama de las investigaciones publicadas en los últimos años sobre educación jurídica y su relación con la práctica profesional de los abogados en varios países de América Latina. El artículo examina la relación entre los proyectos sociopolíticos de esos países y la educación jurídica y el desarrollo profesional. A la vez, algunos rasgos son comunes por el aumento de la interacción entre las personas y países en el período estudiado. Tanto los rasgos comunes como las diferencias serán atendidas en el artículo. This overview of recently published research focuses on legal education and its relation to the professional practice of law in several Latin American countries. This article examines the relationship between these countries’ different socio-political projects and their legal education and professional development. Some commonalities are present because of the increased interactions between people and countries in the period being considered. Both commonalities and differences are highlighted in the article.

The "commons" have become a rallying point of social mobilization against privatization and a linchpin of collective civic empowerment and democratic renewal in several countries. What singles out the Italian "laboratory" of urban commons in recent years is the coalescence of pro-commons lawyers with activists, movements, and grassroots collectives. The central role played by law in the Italian commons network must be read in the light of the distinctive forms that regulations and rules assume in specific contexts. Drawing on ethnographic re- search conducted between 2018 and 2019, this article focuses on the case of Naples and the reinvention of the legal tradition of "civic use." Our account of the daily practices pursued by a Neapolitan community of commoners-L'Asilo-delves into the role played by the law and its representatives in a political context that has always been the subject of stigmatization. There is a spotlight on mental health, with government initiatives in Australia highlighting the importance of, and need for, greater focus on psychological wellbeing and on addressing psychosocial hazards at work. The growing body of evidence in Australia and internationally suggests that the mental health and wellbeing of lawyers is adversely affected by their work. This cross-disciplinary evidence highlights the need for mental health concerns to be addressed systemically to prevent psychosocial injury and for tailored, proactive psychological support services in the legal environment. In this article we present evidence derived from qualitative interviews with Victorian personal injury lawyers, which form part of a broader study of lawyers and mediators engaged in emotion-laden work. This study aimed to ascertain to what extent the legal system considers the emotional wellbeing and mental health needs of personal injury disputants, lawyers and mediators, identify ways to reduce stigma associated with help seeking and inform proactive prevention initiatives and tailored support services. Findings from this build on past research and continue to highlight themes around stigma, vicarious trauma and collegial support and call attention to the psychological impact of legal practice on Australian lawyers. Yair Furstenberg, in his article "The Rabbinic Movement from Pharisees to Provincial Jurists" (DOI: 10.1163/15700631-bja10070), draws parallels between the rise of the rabbinic movement and jurists in other Eastern provinces of the Roman Empire. This paper provides an overview of the contributions of the special issue, using these to arrive at an inventory of five ways in which we can critically approach the role of legal language in the systems of asylum determination in rich countries. It also draws out a series of broader lessons from the special issue and concludes by reflecting on the influence of scholarly work amongst the judges, lawyers, interpreters, and others involved in administering asylum processes. The article presents the discussion on lay professional followed by another 15 years in law studies and solo practice in trusts and estates. Topics include reflect on my own journey and experiences as they were stimulated by my reading, supplemented by current research and trends relating to Asian Americans; and overall numbers of Asian American lawyers still in service, further narrowing the small proportion of experienced mentors.

Abstract Background Little is known about the acceptance of specific populations of decision makers in Lebanon regarding surrogacy. This study aimed to explore the acceptance and attitude of Lebanese Lawyers and Medical Students regarding surrogacy. Methods In total 248 medical students and 204 lawyers completed a questionnaire to assess socio-demographic data, attitude toward surrogacy, and three different clinical scenarios to assess patterns of thinking. Finally, we validated a scale to assess the acceptance of surrogacy in these two populations. Results Concerning medical students, 54.8% reported they were supportive of surrogacy, 35.1% were neutral and 10.1% were against. For lawyers, 52.9% were supportive, 25% were neutral and 22.1% were against. Lawyers were more likely to be against surrogacy (p = 0.001). After conducting a multivariate analysis on the whole studied population to find predictors of acceptance of surrogacy, the best predictors were being single (OR 0.415; 95% CI 0.228, 0.753; p

Studies have sought to understand the experiences of litigants who use the court system. However, very few have looked at their specific interactions with court actors in Sub-Saharan African countries. In this study, we sought to explore the interactions that litigants have with lawyers, judges, and court workers during the process of civil litigation in Ghana. The study used a qualitative phenomenological design and a criterion sampling technique to select seventeen litigants involved in civil litigation in a Ghanaian court. Using thematic analysis, we found that litigants had confidence in the judicial system. In terms of lawyers and court actors, the participants were ambivalent about their interactions with them. Whereas some had been supportive, others drained their resources and were not altogether altruistic. We discuss these findings and make recommendations for improving litigant experiences.

This article delves into the relational realms between non-classical logics, legal practices, and legal education. Through a review of scientific literature, we particularly address intuitionistic, fuzzy, and paraconsistent logics, examining their challenges and contributions to the legal field. Despite obstacles, such as resistance to change, we observe significant progress in the adoption of these approaches. The article concludes by presenting the various perspectives used and advocating for a transformation in legal education, both in the official and the hidden curriculum of lawyer training, with the aim of more comprehensively addressing the complex, contradictory, and uncertain problems that characterize the present world. This paper presents a reading of Goethe’s problematic play Die natürliche Tochter (1803) in terms of the law–the specific ways in which French inheritance law treated illegitimate children before and during the Revolution, the legal status of the lettres de cachet, and the more general and ideological terms in which Goethe conceived of the law. Goethe’s source material was the memoirs of Stéphanie Louise de Bourbon-Conti. The most striking change Goethe made to the source material was to recast the husband forced upon her as a respectable bourgeois lawyer, and not a greedy minor royal official as he is in the memoirs. This shift and the play’s ending– in which the heroine Eugenie marries the lawyer and thus renounces her claims to high aristocratic lineage–have given rise to a tradition of reading the play as a celebration of the bourgeois legal sphere. This paper argues that the play is only weakly committed to bourgeois notions of legality and that ultimately it favours a proto-conservative theory of the law and legitimacy. [ABSTRACT FROM AUTHOR]

Existing theories exploring how companies interact with the law stop short of unveiling whether and why companies can differentially pursue, interact with, and benefit from a particular legal environment. We theorize that companies can use social structures—shared educational and professional affiliations—between lawyers and judges to strategically pursue specific legal jurisdictions, influence judges' discretion, and ultimately reap different legal outcomes from the same legal environment. Using data on such affiliations between lawyers and federal judges, we examine companies' choice of U.S. federal district courts and their legal outcomes in patent infringement litigation from 1990 to 2013. Our results reveal that companies strategically pursue courts in which their lawyers have past educational or professional affiliations with the courts' judges. If a desired judge is assigned to the case, a company leverages its lawyers' social structures to tailor any legal communication to match that judge's style. While such behavior results in a higher likelihood of winning a lawsuit, it also creates an inherent risk. In stacking their legal teams with lawyers who have connections to judges, companies often shortchange the human capital—lawyers' skillsets—required to win a case, which adversely affects legal outcomes if the desired judge is not assigned to the case. The article is a result of a qualitative empirical study designed to reveal whether personal injury lawyers in the State of Michigan implement compassionate counseling practices. The study contributes to a well-established body of research pertinent to the development of soft skills in legal practice, whilst also attempting to proliferate and highlight the benefits of out-of-court settlements. The research was designed to study the nature of compassionate counseling practices and its effect on mediated settlements. Consequently, the research analyzed how lawyers evaluate intangible and non-monetary interests of clients and whether those play a role on the dispute resolution continuum. The paper also elaborates on what lawyers do and do not do well in assessing intangible interests of clients. The study posits that if lawyers attend to those intangible interests, it is a form of compassionate practice. Therefore, the study has both theoretical and practical implications for lawyers and mediators. Last, the study suggests that alternative dispute resolution mechanisms, such as mediation, attribute to a speedier resolution of personal injury disputes.

Concerning the clinical scenarios, they showed that lawyers were more likely to oppose abortion regardless of the reason (p < 0.01). Also, in a case of gestational surrogacy, lawyers were more likely to give the right to the gestational carrier to keep the baby compared to medical students (p < 0.001). Conclusion: In conclusion, this study shows that only a minority of medical students and lawyers in Lebanon oppose surrogate pregnancy which warrants exploration of the perspective of other populations of decision makers in Lebanon to better guide legislations. The relevance of the study is conditioned by the presence of a large number of problems of the professional training of future lawyers and the great importance of the practical application of attributes of psychological readiness in matters of their effective professional training. The purpose of the study is to comprehensively analyse the phenomenon of psychological readiness, to identify its relationship with the professional training of future lawyers, and to find out the most effective measures for the development of psychological readiness of future lawyers as a component of professional training. The following methods of scientific cognition were used in the study: terminological, logical and semantic, system and structural, functional, logical and normative, and non-experimental quantitative method of data collection by survey. The results showed that the psychological readiness of students to study has characteristics depending on what specialisation the law student chooses in the future. It was found that although students’ psychological readiness for e-learning was high, they lacked technological and instrumental readiness. In general, the results obtained and the conclusions formulated on their basis have both theoretical and practical importance, which consists in improving scientific approaches to understanding the content of psychological readiness as a component of professional training of future lawyers. These results can be used in the future as a developed scientific base for investigating the prospects for studying the psychological readiness of law students, solving and developing problematic issues revealed in this study, and implementing them in the educational process.

In Switzerland, institutions through which legal knowledge and education are produced have systemi-cally enabled epistemic injustice through forms of silencing and the cultivation of active ignorance along individual and institutional dimensions. As such, we argue that an important form of intervention in the legal education system, which would not only provide instruments to address epistemic injustice, but also better equip lawyers as individuals and as members of a collective, epistemic community, is feminist critical theory. Providing access and engagement with critical legal methodology, throughout legal studies, is integral to the development of epistemic capacities. It would help prevent formation of insensitivities to experiences of injustice and interrupt the perpetuation of silencing and cultivation of active ignorance along individual and institutional dimensions.

Legal education tends to focus on teaching students federal law from hefty casebooks, inculcating the ability to "think like lawyers." In a sea of Socratic lectures and hypotheticals, students often take refuge in clinics as an island of practical skills-building, client centeredness, and individual fulfillment. Yet even clinics sometimes fail to highlight for students how the place where they practice, with its particular political context and history, shapes their clients' lives and legal problems. This Article describes the law school clinic as a site of grounded pedagogy: a teaching method that centers the connection between local history and the present to help students understand their individual clients' situations and the wider struggle for justice. Grounded pedagogy locates learning in the clinic's built environment, links past and present, and is supported with data. Among other benefits, grounded pedagogy guides students to understand the social context of their clients' communities, reduces ideological barriers to analyses of structural injustice, and deconstructs substantive silos in legal education. This Article demonstrates the utility of grounded pedagogy through the example of its implementation in a Juvenile Defense Clinic in Baton Rouge, Louisiana. Envisioning clinics as a site of grounded pedagogy situates wider struggles in local context and models for non-clinical legal education a method to tocalize law school curricula. Various activities are increasingly characterised as 'addictions', including within the law, and raise important questions. Do 'addicts' have agency? Do addictions shape social problems such as family and sexual violence? And how do those involved in legal systems perceive addictions? This paper explores these questions. Drawing on qualitative interviews with lawyers and decision makers (N = 48), it explores addiction in law. Lawyers and decision makers see themselves as playing important roles in making addiction and 'addicts'. Addiction is an effect principally of legal strategy, and other forces. Legal processes bring differing conceptions of agency and responsibility into being, problematising understandings of agency as an 'effect' of addiction, or as pre-existing legal processes. There are also important variations in approach regarding different addictions. Alcohol or other drug addiction is seen as 'genuine', and a major factor in family violence, while sex addiction lacks credibility. I explore some implications of these approaches. The main purpose of the study is to determine the principal ways of forming creative thinking among lawyers in their practice in modern conditions of development under the influence of COVID-19 pandemic. The importance of studying creative thinking and its formation is determined because the study of this problem creates the basis for the formation of a psychological attitude towards the creative development of a personality, which will be able to effectively solve non-standard problems of legal science and practice. The leading direction of training a future lawyer is the disclosure and activation of creative potential. In this process, focus on the attitudinal sphere of the personality is because it determines the activation of professional creativity and contributes to the disclosure of the creative potential of a specialist. As a result of the study and the application of the proposed methodology, the main stages were identified to promote the development of creative potential and thinking among lawyers in modern conditions of development, considering the impact of COVID-19 pandemic. Easements to the Care Act 2014 were introduced in England in Spring 2020 to support local authorities (LAs) who were dealing with the impact of COVID-19 on adult social care. They were adopted by a small number of LAs that only kept them in place for a very short period. This article draws on the limited literature covering easements and on a synthesis of the views of twenty key informants with professional experiences of social care policy, advocacy, practice and law. It covers the way they were introduced and the opposition which they attracted, as well as contrasting views on the nature and necessity of easements. It also records the perceptions of interviewees on the rationale for the decisions taken to adopt or not adopt them. The article examines the reasons why government thought they should be in place and the concerns of some of those in the voluntary, human rights and legal sectors who challenged their introduction and operation. Whilst the findings contain messages for how to approach the management of a similar crisis in the future, the study identified a lack of evidence of the impact of easements on those using social care as well as their carers. Long-standing debate over the Politicized Departure Hypothesis (PDH) asserts that federal judges tend to arrange to retire under presidents of the same political party as the president who first appointed them, thereby giving that party the right to nominate their successor. PDH is important for asserting political party agency by judges, who receive no consequent personal benefit, and for explaining the long-term political party orientation of courts. PDH studies inevitably suffer from absence of data on known and unknown determinants of retirement timing. To avoid these and other problems, we apply 11 sharp regression discontinuity (SRD) analyses to voluntary judicial departures before and after five elections that replace Republican presidents with Democrats, and six that replace Democrats with Republicans, 1920 to 2018. Results of difference tests, difference-in-differences tests, and others are as predicted by PDH, for 10 of 11 analyses, for pre-election and post-inauguration observation periods of 270 days. Although unexpected, we find stronger PDH effects for Republican appointees than for Democratic appointees. We offer a novel explanation of PDH based on normative reciprocity rather than ideology. Anthony Trollope (1815–1882) resides in the pantheon of nineteenth century English literature. While working full time in his postal position until 1867, he still managed to publish 47 novels, travel books, biographies, short stories, collections of essays, and articles on various topics. Trollope has been described as the novelist of the ordinary for his realistic description of English society. Law and legal issues flow through Trollope's fiction. The legal system held a special importance to him as the skeleton upholding the social and political framework of the country. Over one hundred lawyers appear in his work and eleven of his novels feature trials or hearings. The law intrigued and exasperated him. Along with the lawyers and legal issues he depicts are ideas of the law and legal system that are part of elaborate philosophical and jurisprudential traditions, which he recognized. This article examines Trollope's changing attitude toward lawyers. It describes the structure of the Bar in terms of class, status and reputation. Trollope believed the legal system should ensure justice, and those who labored in the law should be the vehicle of that pursuit. Justice for Trollope was the meting out of rewards and punishments as the consequence of a right or wrong decision. However, the law, as he depicted it, was often an impediment to this process, and lawyers were unreliable guides. Initially Trollope portrayed lawyers critically as caricatures as evinced by such names as Alwinde, O'Blather, Slow & Bideawhile, Haphazard, and Chaffanbrass. He was outraged that barristers (lawyers who appear in court) put loyalty to their clients ahead of the search for truth and justice. The adversary system was flawed as the enactment of laws in accord with the laws of nature assumes an inbuilt moral compass in humans that contains self-evident truths of right and wrong. Trollope felt there was no reason why a right-minded person could not intuitively recognize the truth, so criminal law's adversary system was unnecessary. The legal system sought not the discovery of the truth but was more interested in aiding the guilty defendant to escape punishment. As he matured as a writer and achieved success, Trollope's understanding and appreciation of the legal profession changed. He met and become friends with leaders of the Bar, and they influenced his descriptions of lawyers, who became realistic and often admirable human beings. Beyond the legal problems of its characters, Trollope's later novels incorporated the social, political, and jurisprudential issues of the times and engaged the Victorian legal culture in a broader sense of history, traditions, continuity and change. Natural law principles were challenged during the Victorian era by positivist notions that law is what the statute books say. These divisions lurk in the background of his later portraits of lawyers and the legal system. In his later period Trollope created a realistic characterization of the legal profession at the time that offered universal insights into human nature. [ABSTRACT FROM AUTHOR]

Lawyers have broad discretion in deciding how honestly to behave when negotiating. We propose that lawyers' choices about whether to disclose information to correct misimpressions by opposing counsel are guided by their moral character and their cognitive framing of negotiation. To investigate this possibility, we surveyed 215 lawyers from across the United States, examining the degree to which honest disclosure is associated with lawyers' moral character and their tendency to frame negotiation in game‐like terms—a construal of negotiation that we label game framing. We hypothesize that the more that lawyers view negotiation through a game frame—that is, the more they view negotiation as an adversarial context with arbitrary and artificial rules—the less honest they will be in situations in which honest disclosure is not mandated by professional rules of conduct. We further hypothesize that lawyers with higher levels of moral character will apply a game frame to negotiation to a lesser degree than will lawyers with lower levels of moral character, and that honesty when negotiating will be higher when lawyers have higher versus lower levels of moral character. Our study results support these hypotheses. This work suggests that focusing on game‐like aspects of negotiation can induce a less moral and ethical mindset. To the extent that teaching law students to "think like a lawyer" encourages them to adopt a game frame of negotiation, we can expect such training to reduce the likelihood of honest disclosure. The Americans with Disability Act sets forth the conditions under which management is compelled to respond to informal and formal requests for accommodations, one of which is that requests must relate to essential job functions. When requests do not relate to essential job functions, employer responsiveness becomes voluntary. The difference between compelled and voluntary management responsiveness to efforts by employees with disabilities to acquire workplace accommodations is import to the decision-making processes of employees with disabilitiess as is discussed here for the benefit of employees with disabilities, their supervisors, and advocates.
