"The State of Kansas is changing to a new functional eligibility and client assessment, referral, and evaluation (CARE) tool. The new tool is called the Medicaid Functional Eligibility Instrument-Level of Care (MFEI-LOC). This tool will replace the Functional Assessment Instrument (FAI) used in some Medicaid Long Term Services and Supports (LTSS) programs and CARE assessments used for nursing facility applicants. The MFEI-LOC will be used to determine functional eligibility for LTSS to meet federal Medicaid law eligibility requirements."

"The Kansas Department for Aging & Disability Services (KDADS) is making plans to comply with Center for Medicare and Medicaid Services (CMS) requirements known as the HCBS Settings Final Rule, or Final Rule. The rule sets required characteristics of settings where Home and Community Based Services (HCBS) are provided. Kansas is in the process of revising its Statewide Transition Plan, required by CMS to detail the state's plan to comply with these new requirements by March of 2019. A series of public comment meetings were held to educate stakeholders about the Final Rule and allow them to provide comment to KDADS as it moves forward. ... This summary is based on 135 individual comments collected during the public comment meetings and 41 completed surveys."

In order to be compliant with Section 1919(e)(7) of the Social Security Act, all individuals admitting to a Medicaid-certified nursing home need to have a valid proof of PASRR (pre-admission screening and resident review). ... The purpose of PASRR is to determine whether an individual with mental illness, mental retardation, or other developmental disability needs nursing facility services, or specialized mental health or mental retardation services. In Kansas, the PASRR assessment is the CARE assessment."

"This bill provides funding for four of the Home and Community Based Services Waivers which are administered by SRS. Those waivers are the HCBS-MR/DD waiver, which serves individuals with mental retardation or developmental disabilities, the HCBS-PD waiver which serves individuals with physical disabilities, the HCBS-TBI waiver which serves individuals who have sustained a traumatic brain injury and the autism waiver which serve children with a diagnosis of autism or an autism spectrum disorder. House Bill 2094 allocates, over a period of four years, specific amounts of state general funds to these waivers to reduce, eliminate or forestall the creation of waiting lists for the waivers. The bill also includes state general fund amounts specific to each waiver listed for the expressed purpose of increasing rates of payments to service providers."
