Both in the United States and in Europe, there is a debate on methodology in legal research. Doctrinalists and multidisciplinarians appear to be in different camps fighting over the 'true nature' of legal scholarship. We wonder where this renewed attention for methodology is coming from and what is behind it. Should European legal scholars follow certain colleagues in the United States who believe that doctrinal research is dead and should we all engage in law and ... research now? If not, does this imply that there is nothing wrong with mainstream European doctrinal legal scholarship? We believe the latter is not the case. Our hypothesis is that an ongoing instrumentalisation of law and legal research decreases the attention for methodology, for theory building, and for keeping enough professional distance to one's object of research. This threatens to result in a creeping process of herd behaviour, in copy pasting the methodology of judicial lawmaking to legal scholarship and in a lack of transparency and methodological justification in scholarly legal publications. Annotation. The article is a continuation of the analysis, aforementioned on the pages of the legal journal «Law of Ukraine», of the problem of philosophic-methodological self- determination of legal science: what must and can it be -- science in the literal sense of the word or any other kind of cognition of legal reality? The problem is outlined directly, can the scientific non-classic cognition of law be possible? With this purpose there is given a substance of non-classic standards of the scientism and, therewith, are comprehended the most essential results of non-classic cognition of law by means of cognitive tradition of a regenerated natural law. There is grounded the conclusion that the scientific non-classic cognition of law is possible, while the resume by M. Tarasov «epistemological model of natural-legal cognition cannot be applied to jurisprudence» in the context of non-classic standards of scientism is non- authentic. [ABSTRACT FROM AUTHOR]

The author indicates that national Legal Journal «Law of Ukraine» has strengthened its positive impact on the further development of the national legal doctrine significantly over the last period. Strategic orientation of the editorial policy for the near future is suggested in the article: updating publications, raising awareness and effectiveness of journal publications, their «Europeanization» in particular. The article focuses on the court case Mohamed v. Jeppesen Dataplan, Inc. with reference to the article "Intolerable Abuses: Rendition for Torture and the State Secrets Privilege," by Jeremy Telman published in the previous issue of the periodical. We gratefully acknowledge their invaluable contributions in sustaining and improving the journal. As each editor stepped down, a new editor stepped in. Connie Rosati (Professor of Philosophy, University of Arizona) began work as an editor in the fall of 2016.
