This article deals with a relevant constitutional issue. The existence of an interim Government in office at the time of the general elections raises the question of whether the activity undertaken by the interim Government is subject to the control and monitoring of the Congress of Deputies and the Senate once constituted. This issue is not directly clarified by the Constitution, as Articles 101.2 and 108 are not at the same level since the former is considered to be a singular rule and the latter a general clause. The ruling of the commented Constitutional Court concluded that if there is any activity of the interim Government, this can be audited. El presente artículo se refiere a una cuestión constitucional relevante. La existencia de un Gobierno en funciones al celebrarse las elecciones generales plantea la pregunta de si ese Gobierno está sometido, mientras dure la situación de gobierno en funciones, al control y fiscalización de su actividad por parte del Congreso de los Diputados y del Senado, una vez constituídos. Esta cuestión no está directamente resuelta en la Constitución, pues los artículos 101.2 y 108 no se encuentran situados en el mismo nivel, al considerarse el primero como una norma singular y el segundo como una cláusula general. La sentencia del Tribunal Constitucional que se comenta concluyó que si existe actividad del Gobierno en funciones esta puede ser fiscalizada.
