O objetivo do texto é justificar o direito de propriedade como direito fundamental individual e explicitar seu conteúdo. Locke, Hegel e Rawls são referidos como fontes históricas consagradas para esse intuito. Locke, pela tese de que o trabalho fundamenta a propriedade; Hegel, pela estreita vinculação entre propriedade e liberdade; Rawls, por ter enumerado a propriedade entre os direitos fundamentais que compõem o primeiro princípio de sua concepção política de justiça. Justifica-se, com isso, ser o direito de propriedade um elemento constitucional essencial.

Um Estado democrático de Direito fundamenta suas bases em princípios de justiça universalizáveis. Aplicados a uma Constituição, objetivam-se nos direitos e liberdades fundamentais dos cidadãos. O dever de obedecer a leis injustas, a desobediência civil e a objeção de consciência pressupõem senso de justiça e uma concepção do bem, capacidades morais de uma “pessoa ética”. Applied to a constitution, such principles are objectivied in the fundamental rights and liberties of the citizens. The duty of obeying unjust laws, civil disobedience and consciousness objection presuppose a sense of justice and a conception of the good, that is, moral capacities of an “ethical person”. This paper aims to explain the conception of justice in Hegel's Philosophy of Right. It binds the conception to the idea of freedom in its different ways of determination. It starts from the notion of person of right and indicates the fundamental rights that derive from the expression of this legal capacity. It highlights the right of necessity as a right to make an exception in favor of itself aiming at the realization of justice. It shows how the administration of justice takes place through the Law in civic society.
