O presente artigo tem como objetivo abordar os direitos humanos e analisar a realidade dessa área de estudo por meio de uma pesquisa detalhada sobre sua evolução e desenvolvimento ao longo dos séculos. É notório que o instituto jurídico dos direitos humanos foi e continua sendo fundamental para o desenvolvimento da sociedade contemporânea. Ao longo da história da humanidade, esse instituto contribuiu de maneira significativa para organizar e estabelecer limites quanto ao que deve ou não ser aceito quando se trata de violações de direitos e garantias fundamentais. Ademais, na atualidade, torna-se imprescindível discutir sobre os direitos humanos, uma vez que tal instituto é assegurado não apenas pela cidadania, conforme disposto na Constituição Federal de 1988, mas também por diversas leis, dispositivos esparsos, jurisprudências e tratados internacionais, como o Pacto Internacional sobre Direitos Civis e Políticos e o Pacto Internacional sobre Direitos Econômicos, Sociais e Culturais, que demonstram a importância fundamental por trás dos direitos humanos. Ressalta-se que tais dispositivos frequentemente sofrem violações, especialmente no que diz respeito aos direitos que deveriam ser protegidos e resguardados, por serem inerentes à pessoa humana. Neste artigo, serão descritas as origens, a expansão e os desafios encontrados na efetivação prática de tais direitos. Também serão discutidos os principais problemas, benefícios e aprimoramentos ocorridos ao longo dos séculos, além de como os direitos humanos impactam a humanidade como um todo, considerando um mundo que, inicialmente, foi moldado sem esse instituto e como sua chegada proporcionou mudanças significativas na forma como a humanidade se comporta em relação à dignidade humana.

O presente artigo analisa a relação que fora estabelecida, ao longo do tempo, entre os conceitos de direitos naturais e direitos universais. Elegendo Locke como representante do conceito de direitos naturais, pretendemos apresentar o distanciamento localizado entre os dois conceitos previamente citados. Por fim, temos por pretensão encontrar um caminho que fundamente os direitos humanos enquanto direitos universais a partir da compreensão de Estado e, com isso, se desvinculando da noção metafísica atribuída aos chamados direitos naturais em Locke.

http://dx.doi.org/10.5007/2177-7055.2015v36n71p133 This article intends to identify the metaphysical roots of projects of the foundation of human rights which incorporated genetically the doctrines of natural rights and call for an individual and anterior state to life in society to justify rights that not positivized in law. Based on the contractarian model of thinkers like Thomas Hobbes, the present article investigates the notion of “nature” contained behind the laws governing the natural state of men while questioning the methodological assumption of the individual – the free and rational human being – to legitimize the formulation of moral judgments and, especially, the enunciation of rights as human rights. The paper intended to show, in the end, that it makes no sense to approach human rights from the traditional notion of “nature”, as human nature is constituted from a collective context, and not from the individual – although the contemporary discussion about human rights is completely contaminated by the metaphysics of natural rights.

The objective of this text is to reflect about the evolution of human rights as well as to discuss it including the concept and the actual understanding had of it. It is defended that the natural right overlaps the one known as positive right, understanding that the right to life is an universal right to be defended in any context. Although it is defined by the Universal Declaration of Human Rights, of the Modern Age, it is an old concept and it was fed by the previous ideas from Rousseau, Montesquieu and others. It is discussed the born of the Declaration of Human Rights and it’s break in the Brazilian scene, looking for an understanding of the ways to which it points.

The present paper partly explores the debates on men's natural rights which took place in the public sphere in mid-nineteenth century Latin America. In Colombia, as in many other countries in the region, such debates were related to civil wars between liberals and conservatives which started around the year 1848. Romantic poet Julio Arboleda Pombo (1817-1862), military chief and catholic thinker, was a central figure of such doctrinal debates and of such civil wars. In his poetic and journalistic works it is possible to trace the emergence of a post-republican conservatism that would gravitate over the public sphere and academia in Nueva Granada, during the second half of the nineteenth century. This articles aims at examining the several stages of time on the basis of François Ost's contribution and its connection with the hermeneutic proposal of Martin Heidegger and Hans-Georg Gadamer Franste. Time is presented as a privileged space where tradition meets the experience resulting from the history of Law, and the way this context helps to sustain the development of human rights, as a space for discussion and construction - with a certain degree of utopia - of the basic conditions for full human flowering.
