Abstract Global rates of terrorism have skyrocketed since 9/11, yet the aggregate increase tells us very little about the distribution of attacks across different regime types. Contrary to the traditional scholarly view and popular perceptions in the West, reasonably high-quality democracies enjoy a robust and growing "triple democracy advantage" in facing the scourge of post-9/11 terrorism. Not only are liberal democracies and polyarchies less prone to terrorist attacks than all other regime types, but the rate of increase in the number of attacks among these democracies is substantially lower in comparison to other regime types, and they are significantly better at minimizing casualties. The article offers a succinct conceptual and analytical framework for approaching the 'great rule of law debate' currently unfolding in the EU (European Union) and the contending positions of the various EU institutions embroiled in it. It addresses the challenge of conceptualization imbued in the notion of the rule of law, and critically examines the definition of the concept provided by the EC (European Commission). It then demonstrates that over the course of modern European integration, the rule of law emerged as a central dimension in four distinct core areas of EC/EU identity and activity. Should the contemporary crisis of foundational values persist or deepen, each of the four is expected to be adversely affected. The article focuses on the concept of the rule of law of the U.S. and its promotion abroad. It cites the need of the legal scholar and practitioners to make reorientation of their approach to the concept of the rule of law. It also explores the emerging literatures on applied development in democracy as well as the impact on domestic political, legal, and institutional change.
