The paper points out the unconstitutionality of the law, which is adopted on the basis of rational arguments, but is not constitutionally non-compliant. At the same time, the aim of the paper is to bring de lege ferenda considerations as to how to help streamline enforcement proceedings even without the use of this, in our opinion, unconstitutional law. In this paper, we also address the justification of the conflicts in terms of compliance with the law on the cessation of old executions with the Constitution of the Slovak Republic, especially with the rule of law, the right to own property and the right to a fair trial.
