Afrikanische Staaten werden oft mit einem ideal-typischen westeuropäischen Nationalstaat verglichen und unweigerlich für unzureichend befunden. Diese Arbeit begegnet diesem theoretischen Missstand, indem sie eine neue Typologie des territorialen afrikanischen Nationalstaats in Abgrenzung vom europäischen Model entwickelt. Die Typologie fungiert als theoretisches Prisma für eine ausführliche Analyse des Südsudan für die Jahre 2005-2014. Gleichzeitig liefert der Vergleich mit dem Sonderfall Südsudan neue Erkenntnisse zum Wandel von Staat und Nation in Afrika. Ausgehend von einer historisch-philosophischen Querschau auf Staat und Nation in Europa, werden die grundverschiedenen Umstände von Nationalstaatsbildung im postkolonialen Afrika dargestellt. Der Autor schöpft aus einer umfangreichen Literatur, die fast sämtliche Staaten in Sub-Sahara Afrika abdeckt, um typisierte Aspekte von Staat und Nation herauszuarbeiten. Für den afrikanischen Staat sind dies der hybride Quasi-Staat, der illegitime Staat, der privatisierte neopatrimoniale Staat und der aufgedunsene Zentralstaat. Die Typologie der afrikanischen Nation besteht aus inklusivem Staatsnationalismus, dem Wiedererstarken politischer Ethnizität sowie dem ausgrenzenden neuen Nationalismus. Auf der Basis von Primär- und Sekundärquellen sowie Feldforschung, haben sich südsudanesischer Staat und Nation als überwiegend kongruent mit der Typologie erwiesen. Abweichungen bestehen jedoch im Ausmaß der Übernahme von Dienstleistungen durch ausländische NGOs, in der Struktur der neopatrimonialen Netzwerke sowie in der Rolle, die Sprache für die nationale Identität spielt. Zudem weist der Südsudan sämtliche Entwicklungstrends des postkolonialen Nationalismus parallel zueinander und nicht aufeinander folgend auf. Dies deutet darauf hin, dass sich die Bedingungen für Nationenbildung im heutigen Afrika dank Urbanisierung, moderner Kommunikationswege und dem Vorherrschen von Bürgerkriegen sehr von der Vergangenheit unterscheiden. African states are often judged by comparison to an ideal-typical Western European nation-state, which inevitably finds the African state wanting. This thesis challenges this theoretical drawback by developing a novel typology of the African territorial nation-state in juxtaposition to the European model. The typology is then applied as a theoretical prism for an in-depth analysis of the case of South Sudan, the world’s newest state, for the period 2005-2014. At the same time, comparison to the anomalous case of South Sudan provides new insights into the changing nature of statehood and nationalism in Africa. Starting out from a historical-philosophical overview of state and nation in the European context, the very different circumstances of nation-state formation in postcolonial Africa are depicted. The author then draws on a large body of literature covering almost all of Sub-Saharan Africa to distil typified facets of state and nation. For the African state, these components are the hybrid quasi state, the illegitimate state, the privatized neopatrimonial state and the swollen centralized state. The typology of the African nation consists of inclusive state-nationalism, the resurgence of political ethnicity and exclusionary new nationalism and the politics of autochthony. Based on primary and secondary sources including fieldwork in South Sudan, the empirical reality of South Sudan’s nascent nation-state is shown to largely match the typology. Important divergences exist however in the degree of service delivery by foreign NGOs, in the dispersed nature of the neopatrimonial networks, and the role of language in nationbuilding. Crucially, South Sudan exhibits all three trends of postcolonial African nationalism at the same time rather than in successive periods. This indicates that in contemporary Africa rapid urbanization, modern communications and the prevalence of civil wars create very different conditions for nationbuilding than in decades past.

Anerkennung wird heute sozialphilosophisch diskutiert. Dabei wird übersehen, sie hat auch eine politisch-philosophische Geschichte und darin mehrere Wandlungen durchlebt. Der Auftakt liegt in der politischen Philosophie des 19. Jahrhunderts. Die erste Wandlung durchläuft die Diskussion im Übergang von Hegels Realphilosophie zur Phänomenologie des Geistes im Jahr 1807. Schlagartig stand nicht mehr der Topos der Anerkennung im Zentrum der Diskussion, sondern das Herr-Knecht-Verhältnis. Die ökonomisch-philosophische Wendung in den unversöhnlichen Gegensatz von Kapital und Arbeit dominiert die Herr-Knecht-Diskussion seit den 1840er Jahren bis zur Veröffentlichung der Jenaer Frühschriften Hegels. Die Dissertation eröffnet mit einem Forschungsstand der wichtigsten seit 1931 in Deutschland veröffentlichten Diskussionsbeiträge. Als Resultat wird die Debatte aus der Sozialphilosophie in die politische Philosophie getragen. Nicht der sozialphilosophische Kampf um Anerkennung, sondern die politisch-philosophische Bewegung der Anerkennung ist der methodische Leitfaden durch die letzten zwei Jahrhunderte. Sie ist ein konflikttheoretisches Mehrstufenmodell, das zum Untersuchungsinstrument für vier prototypische Denker_innen von Demokratisierungs- und Gleichstellungsbewegungen wird. G.W.F. Hegel, Karl Marx, Frantz Fanon und Simone de Beauvoir sind bis heute Kronzeug_innen, wenn es um Rechtsbegründung, eine klassenlose Gesellschaft und eine Menschheit geht, in der weder Hautfarbe noch Geschlecht bestimmend für soziale und politische Stellung sind. Sie haben ihre politische Philosophie mit dem Denken einer Bewegung der Anerkennung konzipiert. Im Ausblick wird die Bewegung als detailreiches Denkwerkzeug politischer Analyse und Konzeptbildung beschrieben. Die Arbeit ist für politische Theoretiker_innen und Praktiker_innen, die sich ohne große Vorkenntnisse die Anerkennungsdiskussion als wichtigen Quellcode der europäischen politischen Philosophie gewinnbringend aneignen wollen. Recognition is discussed today predominantly in social philosophy. But it also has a political-philosophical history and it is going through several changes. The prelude is the political philosophy of the 19th century. The first conversion passes through the discussion in the transition from Hegel''s Realphilosophie (1806) to his Phenomenology of Spirit in 1807. Abruptly was no longer the topos of recognition in the center of the discussion, but the master-servant relationship. The economic- philosophical turn in the irreconcilable opposition between capital and labor dominates the master-servant discussion since the 1840s until the publication of the Jena Hegel''s early writings. In practical politics it dominated until the collapse of the Soviet Union. The thesis begins with a state of the most important research published in Germany since 1931 discussion posts. As a result, the debate is carried out of the social philosophy in political philosophy. Not the socio-philosophical struggle for recognition, but the political and philosophical movement of recognition is the methodological guide through the last two centuries. It is a conflict-theoretical multi-stage model, which is here the investigation instrument for four prototypical thinkers of democratization and equality movements. G.W.F. Hegel, Karl Marx, Frantz Fanon and Simone de Beauvoir are still key witnesses, when it comes to legal reasoning, a classless society and humanity in which neither color nor sex are decisive for social and political position. Hegel, Marx, Fanon and de Beauvoir have designed their political philosophy with the thought of a movement of recognition. In the outlook, the movement is described as a highly detailed political analysis tool for thinking and concept formation. The work is for political theorists and practicians without much prior knowledge who want to acquire the recognition discussion profitable. It is one of the most important sources of European political philosophy.

Die Dissertationsschrift stellt die erste systematische Studie des transatlantischen Konflikts über den Internationalen Strafgerichtshof (IStGH) aus politikwissenschaftlicher Perspektive dar. Der Fall des IStGH wird häufig als ein Beleg für transatlantische Spannungen im Hinblick auf das Völkerrecht und die Arbeit internationaler Organisationen zitiert bzw. als ein Indikator für eine zunehmend unilaterale Außenpolitik der USA aufgefasst. Obwohl der IStGH somit einen prominenten Platz auf der Agenda der transatlantischen Beziehungen einnimmt, wurden die Umstände, die zu dem Konflikt über seine Errichtung zwischen Europa und den USA führten bis dato noch nicht eingehend wissenschaftlich untersucht. In dieser Hinsicht betritt die eingereichte Dissertation Neuland. Sie geht über die vage Klassifikation von US-amerikanischem Unilateralismus versus europäischem Multilateralismus hinaus, indem sie sich systematisch den folgenden Fragen zuwendet: Was sind die Gründe für die unnachgiebige Opposition der USA gegen den IStGH? Warum gaben sowohl Großbritannien als auch Frankreich ihre Allianz mit den USA hinsichtlich des Gerichtshofs auf und unterstützten schließlich einen unabhängigen IStGH? Die Hypothese der Dissertation lautet, dass die wesentlichen Ursachen für den transatlantischen Konflikt über den IStGH in unterschiedlichen Auffassungen von Kernnormen der internationalen Beziehungen liegen, insbesondere in voneinander abweichenden Interpretationen des Prinzips der Souveränität und des Konzepts der Menschenrechte., The dissertation provides the first systematic study of the transatlantic conflict about the International Criminal Court (ICC) from an international studies point of view. Although the case of the ICC has often been quoted as an example of increasing US unilateralism or as an indicator for a growing divergence in US-American and European approaches to international law and international organisations, it has been rarely analysed on its own. The book therefore makes a contribution on a pertinent and timely topic in the field of transatlantic relations. It aims to go beyond the rather sketchy classifications of US unilateralism versus European multilateralism by systematically addressing the following questions: What accounts for the US’ unrelenting opposition to the ICC? Why did both France and the United Kingdom abandon the alliance with the US with respect to the ICC and eventually opted for a strong and independent Court, thereby aligning themselves with the other EU member states? The hypothesis of the book is that the main reason for the transatlantic differences in the positions towards the court lies in divergent understandings of core norms of international relations, most importantly sovereignty and human rights.
