Abstract

The article discusses Community trademarks, European Union (EU) law, and the EU General Court's ruling in the 2012 case Jackson International Trading Co. v. Office for Harmonisation in the Internal Market (Trade Marks and Designs) which deals with the unfair advantage trademark principle. The author argues that the court's decision will be welcomed by owners of reputable trademarks which are considered to be one of a kind.
