CONTINGENCIES in finance , *PUBLIC companies , *DECISION making - Abstract
Before making an investment decision, investors analyze the economic and financial situation of a company through financial statements, observing its provisions and contingent liabilities. This research sought to analyze the composition of provisions and contingent liabilities of Brazilian publicly traded companies for 2019. To this end, the financial statements and explanatory notes of 391 companies were analyzed, segregating provisions and contingent liabilities into labor, tax, civil, and environmental. The results show that most Brazilian companies disclose some type of contingency. Despite disclosing labor provisions in the period studied, most provisions refer to the civil scope. The chemical and electrical sectors were the ones to disclose the greatest amount of provisions, although not statistically significant according the Kruskall-Wallis, indicating that the sector is not decisive for recognizing provisions. The amounts of disclosed contingent liabilities were substantially higher than those of provisions, with tax contingencies and the financial sector being the most prevalent. This work contributes to the understanding of the provisions and contingent liabilities of Brazilian companies, supporting users in decision-making. [ABSTRACT FROM AUTHOR]

The aim of this research is to identify characteristics that influence the change in the probability of provisions and contingent liabilities of Brazilian companies. This has been widely observed in specific industries that disclose more information on provisions and contingent liabilities, namely: oil, gas and biofuels, non-cyclical consumption and public utility. The data consisted of 6,194 observations, of which 2,058 lawsuits were mentioned in more than one period, and there were 228 changes in the probability of loss in the period from 2010 to 2016. A logistic regression model with panel data was applied, counting on 11 explanatory variables for the change in the probability of loss, which are divided into two perspectives: (a) characteristics of the companies and, (b) characteristics of the lawsuits. The results indicate that companies listed as ‘New Market’, ADR issuers, change the audit firms, respond to environmental, labor and civil lawsuits with large amounts in dispute, and have financial materiality in terms of risk expectation regarding losses and the duration of the legal process – are more likely to affect the change in the probability of loss. Conversely, the lawsuits in the first or superior instances are more likely not to change the probability of loss.

Provisions allow firms to defer the funds in times when they reach positive results, for the periods, in which they assume higher costs or for less economically successful periods. Similarly to allowances they are accounting items, which do not overestimate assets and revenues, and vice versa underestimate the costs and liabilities. It requires taking of all risks of loss that are known at the time of compiling of the financial statements into accounting. Reserves represent accruals in a broader sense, as they assign to the revenues generated today associated costs in order to record these revenues again in the future with the aim to eliminate the costs actually incurred. This is the way how enterprises can preclude the risks of financial distress that could arise from lack of resources needed to cover future expenses and they help to strengthen the material substance, since the creation of reserves reduces the possible distribution of the apparent profits to owners. Procedures for the creation and using of reserves are governed by Czech accounting legislation, which allows enterprises a broader application in the form of a general requirement of establishing reserves for risk and loss, while banks cannot create reserves for general banking risks and other unforeseeable risks. Differences are also among Czech and international rules on creation of reserves. In addition, there are different procedures in terms of fiscal (tax) reserves. The aim of this contribution is therefore to analyze methods of the creation and using of reserves from accounting and tax perspective, especially in terms of their eligibility and entitlement and to propose modifications to enable the unification of the theoretical approaches.

- Abstract
This article aims at identifying if the quantitative and qualitative disclosure of provisions and contingent liabilities is related to the market value of Brazilian open companies and which factors are related to this disclosure level. In order to carry out the present research, accounting statements from 65 Brazilian open companies listed in Ibovespa Index were analyzed, the period for analysis was from 2010 to 2013 and for the analysis conduction, descriptive statistics, factor analysis, logistic regression and panel data were used. The results also indicate that companies which disclosure the most belong to Data and Software sector. The companies which present lower items of disclosure of provisions, assets and contingents liabilities are from the sectors of Chemical, Transports and Services and Construction, respectively. The compulsory average level of disclosure for provisions and contingents liabilities in explanatory notes was 54,2%, that is, companies are not completely publishing what is required in CPC 25. It was also verified that the higher the market value of companies, the lower is the level of disclosure of information related to provision and contingent liabilities. Therefore, these results indicate that investors don't consider relevant for the process of investment decision making in the analyzed open companies the information of qualitative and quantitative disclosure about provision and contingent liabilities. With the changes introduced by Laws No. 11,638/07 and 11,941/09, the convergence of Brazilian accounting standards with the international standard became indispensable. Among the changes showed were the accounting treatments of provision and contingent liabilities. Thus, the present study aims to analyze the disclosure of the contingent liabilities and provisions of the largest agribusiness companies in Brazil that operate in the meat and derivatives segment in accordance with CPC-25 and the information presented in the CVM between the years of 2012 and 2016. For this, a qualitative, descriptive and documentary research was carried out. The study examined the financial statements and explanatory notes of the three largest companies in the meat and derivatives segment listed in B3. The data collection and analysis was based on a checklist prepared in basis of data from CPC 25 - Provisions, Contingent Liabilities and Contingent Assets. The research results demonstrate that organizations are correctly applying the requirements for recognition, measurement and disclosure of provisions. However, the disclosure of contingent liabilities by companies is not unanimous. It was verified that the most publicized item was the one of labor nature, followed by the one of tributary and civil nature. It can be concluded that the companies studied do not follow fully what is recommended in CPC-25 and should mainly improve the disclosure of their contingent liabilities.

Nowadays, trade has gained an international dimension with the impact of globalization. The international nature of trade transactions requires the use of a common language in the preparation of financial statements. The information contained in the financial statements for those, who will make investment decisions, is extremely important. The fact that the information contained in the financial statements is objective and comparable is an indispensable element for international trade.Turkey has not fallen behind the efforts of standardization in the world and has set up Turkish Accounting Standards in line with international standards. It is extremely important to understand and apply these standards in terms of the existence of Turkey in the international arena. In this context, among the Turkish Accounting Standards, TAS 37 Provisions, Contingent Liabilities and Contingent Assets have been analyzed and detailed information on this issue has been provided. It aims to make it more understandable by referring to the details of how these concepts are reflected in the financial statements and supporting them with sample applications. In order to make the work more understandable, the transactions of an enterprise that is obliged to obey the Accounting Standards of Turkey have been done with a sample application and financial statements have been presented in accordance with the standards at the end of the period.

Purpose: This paper aims to examine pricing differences regarding contingencies presented in statements of financial position or notes, which are considered an area for creative accounting. Design/methodology/approach: The authors have chosen two countries with different cultural environments to test the exploratory study. The sample includes companies using the International Accounting Standard (IAS) 37, which requires recognition of provisions while contingent liabilities are only disclosed, implying different impacts from underlying judgement related with contingencies. The authors apply a regression model based on the Ohlson equity-valuation framework. Findings: The most important conclusion is that market participants in both countries follow different patterns when incorporating information about provisions and contingent liabilities. More precisely, the results suggest that provisions are value-relevant, but incrementally less negative in Portugal. Contingent liabilities seem to have no value relevance. However, an exception exists for Portuguese companies having a risk committee board, in which case a significant market valuation of contingent liabilities is found and discounted in share prices. The existence of a risk committee corroborates the value relevance of this board, which is positively valued by market participants in both national cultures. Practical implications: The findings may make a contribution to the IASB research project on the IAS 37 and possible amendments to it (suspended until the revisions to the conceptual framework are finalized) and to the IASB prioritization of communication effectiveness of financial statements to all users. Originality/value: Value relevance of contingencies differentiating countries from two different national cultures and firms with a risk committee on the board of directors. info:eu-repo/semantics/acceptedVersion

At the present, accounting is aimed at the promotion of useful information, both quantitative and qualitative, for the decision-making of the different types of users – Stakeholders. Globalization and technological improvements allow for fast interactions between the companies and the society, and so, correct, clear and precise information needs to be constantly produced and renewed. As a result, capital markets have been subject to numerous regulatory requirements aimed at the promotion of harmony between the needs of the different parties. However, not all matters are easily measurable and explained, especially in the case of contingent (not exact) disclosures, as is the case of the ones required in IAS 37. Provisions, Liabilities and Contingent Assets undoubtedly depend on the judgement of who elaborates them, through future expectations and/or past experiences. In this master's dissertation, the main stock indexes of the Netherlands (AEX), Belgium (BEL20), Spain (IBEX 35) and Portugal (PSI 20) were analyzed. Throughout this analysis it was found that companies only publish, on average, 60% of the disclosure requirements, required by the international standard on this subject. Additionally, through the application and interpretation of a Linear Regression Model, it was concluded that whether the company belongs or not to a country of the Euronext, its EBITDA value and accounting tradition, significantly impacts its Information Disclosure Index.

This study compares the compliance level of Brazilian and French companies in relation to the disclosure requirements defined by IAS 37/CPC 25 - Provisions, Contingent Liabilities and Assets. The total sample was subdivided into two groups: the 50 largest Brazilian and French (revenue-based) companies with shares traded on the US over-the-counter market in the form of American Depositary Receipts (ADRs), and the 50 largest traded only in local stock market. The level of disclosure was determined based on the reading of the Balance Sheets and Explanatory Notes for the fiscal year of 2016, with the support of a checklist of the disclosure items required by the standard. A first interesting result refers to the difference in behavior in relation to the provisioning of contingencies: in France, 87% of the contingencies are provisioned, while in Brazil this amount is only 21%, or 79% of the contingencies reported in the financial statements of Brazilian companies are not recognized in the Balance Sheet, but only disclosed in the Explanatory Notes. Regarding to the level of disclosure, the results indicated a higher level of disclosure by the French companies in relation to the Brazilian companies (an average of 56.0% against 48.9%, significant at 1%), consistent with the hypothesis that listed companies in most economically developed countries tend to disclose more. In addition, the behavior of disclosure among French companies proved to be much more consistent with that expected from the literature: French companies with ADRs traded in the US over-the-counter market tend to disclose more than those traded only in the local market; larger companies tend to disclose more and companies with larger amounts of provisions for contingencies also tend to disclose more. In Brazil, on the other hand, evidence of a higher level of disclosure was found among companies traded only in the local market than in ADRs in the over-the-counter market, and a weak correlation was found between the level of disclosure and the two quantitative variables analyzed: size of the company and materiality of the contingencies provisioned.

JEL class system: M41 – Accounting; Z19 – Cultural Economics-Other The main objective of this dissertation is to compare companies from Portugal and UK concerning disclosure of contingent liabilities and recognition of provisions, since these are considered a source of creative accounting and to drive a parallel between differences found and the culture system of each country. Data was retrieved from databases and hand collected from financial statements of listed companies covering 2010 to 2013. Findings reveal that there are statistically significant differences on the amounts disclosed as contingencies or recognized as provisions by Portuguese versus British companies. However, they do not confirm the tendency for higher recognition in Portugal or a preference for disclosure in UK as Grays’ hypotheses for high secrecy (transparency) and high conservatism (optimism) in countries with high (low) uncertainty avoidance as Portugal (UK) suggest, giving rise to practices more associated with creative accounting in Portugal. Furthermore, findings expose that provisions and contingencies have a negative association with share prices, yet only statistically significant for contingencies. However, provisions reveal to be statistical significant after adapting the model to comprehend the effect of a risk committee on board of directors. Besides, the existence of this committee is value relevant to investors but this relevance is notwithstanding mitigated when considering Portugal against the total sample. Lastly, the study concludes that investors do value provisions differently from contingencies, yet this is not applicable when companies have a committee for risks, in which case they place a similar trust to both recognized and disclosed items assuming less creative accounting practices.

Verslo apskaitos standartai turi būti parengti remiantis Europos Sąjungos teise ir Tarptautiniais apskaitos standartais. Todėl renkantis, kokiais standartais bus vadovaujamasi tvarkant apskaitą, svarbu žinoti Verslo apskaitos standartų ir Tarptautinių apskaitos standartų skirtumus. Straipsnyje analizuojamos ir lyginamos 19-ojo verslo apskaitos standarto „Atidėjimai, neapibrėžtieji įsipareigojimai ir turtas bei pobalansiniai įvykiai“ ir 37-ojo tarptautinio apskaitos standarto „Atidėjimai, neapibrėžtieji įsipareigojimai ir neapibrėžtasis turtas“ sąvokos, struktūra, taikymas. Users of the financial reporting of a company are expected to receive large amounts of information on the financial state of the relevant company. The reliability of this information depends on the evaluation and indication of contingent economic operations and events in financial accountability. These economic events and operations are provisions, contingent liabilities and contingent assets. Most liabilities can be reliably estimated, i.e. the debt to suppliers for the delivered goods is inscribed in the invoice, the amount of the loan is recorded in the credit contract, etc. However, some liabilities can be evaluated only by prediction. These liabilities are called provisions. It is also important to present contingent liabilities and contingent assets correctly. The purpose of the publication is to compare BAS 19 "Provisions, Contingent liabilities and Contingent assets, and events after the balance sheet" and IAS 37 "Provisions, Contingent liabilities, and Contingent assets". BAS 19 was prepared and approved in Lithuania by the Authority of Audit and Accounting in 2003. The objective of this Standard is to set out how provisions, contingent liabilities, contingent assets and events after the balance sheet date shall be measured, accounted for and presented in financial statements. IAS 37 was approved by the International Accounting Committee in 1998. The objective of this standard is to ensure that the appropriate recognition criteria and measurement bases are applied to provisions, contingent liabilities and contingent assets and that sufficient information is disclosed in the notes to enable users to understand their nature, timing and amount. In comparison with the Business Accounting Standard, the International Accounting Standard is more detailed although nothing is mentioned about the events after the balance sheet date. However, due to the performed comparative analysis, it can be stated that there are no essential differences between the standards.
