International audience; By deciding that article 460 of the Civil Code, which subordinates the marriage of a ward to an authorisation, in conformity with the Constitution, the Constitutional Court has conceived marriage solely as a status, comprising personal and property obligations, without particularly protecting its personal aspect. The loss of control over financial realities by a protected person, is apt to constitute, in civil caselaw, a dertermining factor in the appreciation of the capacity to consent to marriage, contrary to some other European laws. The internal approach to matrimonial liberty and the limitations to matrimonial liberty of a person under partial guardianship, call for a confrontation with the European Court of Human Rights' approach, in the field of right to marriage and the protection of vulnerable persons due to mental disorders.; En déclarant conforme à la Constitution l’article 460 du Code civil qui subordonne le mariage d’une personne en curatelle à une autorisation, le Conseil constitutionnel a appréhendé le mariage seulement comme un statut comportant des obligations personnelles et patrimoniales, sans en protéger particulièrement la dimension personnelle. La perte de maîtrise des réalités financières par une personne protégée est susceptible de constituer dans la jurisprudence civile un élément déterminant de l’appréciation de l’aptitude à consentir au mariage, à l’inverse de certains droits européens. L’approche interne de la liberté matrimoniale et des restrictions à la liberté matrimoniale de la personne en curatelle appelle une confrontation avec l’approche par la Cour européenne des droits de l’homme du droit au mariage et de la protection des personnes vulnérables en raison de troubles mentaux.
