1. Ethics, Technology, and Standard Practice in Communication Centers: Proposing a Continuing Education Credit Program Based on Lessons Learned from Law, Business, and Healthcare

Abstract

Communication centers on university campuses can benefit from the experience of other disciplines with established norms and educational practices. This article examines the legal profession, the business profession, and healthcare with the intent to locate meaningful overlap that can be practically applied to communication centers. While different, each of the three fields promotes shared decision-making, ongoing training specific to ethical practice, and promotes technical adaptation. Examining service and training in these three professional fields led the authors to identify a framework for communication centers that focuses on the following areas: standard practice and education, ethics, and technology.

The books included in this bibliography were written by or about notable Americans from the 16th century to the present and were selected from the holdings of the Penfield Library, State University of New York, Oswego, on the basis of the individual's contribution in his field. The division into subject groups is borrowed from the biographical section of the "Encyclopedia of American History" with the addition of "Presidents" and includes fields in science, social science, arts and humanities, and public life. A person versatile in more than one field is categorized under the field which reflects his greatest achievement. Scientists who were more effective in the diffusion of knowledge than in original and creative work, appear in the tables as "Educators." Each bibliographic entry includes author, title, publisher, place and data of publication, and Library of Congress classification. An index of names and list of selected reference tools containing biographies concludes the bibliography. (JH)

At the basis of social control lies a conscious change in the social environment. Applied particularly to higher education this means that control of present tendencies in our colleges and universities and their proper direction toward the future must necessarily depend upon as complete knowledge as possible, on the part of college and university administrators, of what, the present tendencies are and how they have developed in the history of education Applied still more specifically, it means that changes in aims, methods, and particularly in curricula, if wisely made, must be made in the light of full knowledge of present tendencies and past, developments. This suggests at once that college and university administrators should have at their command complete information on such topics as the rise, growth, and present tendencies of college and university curricula, types of university and college control and government, methods of support, etc. Perhaps, most important of all for the practical purposes of an administrator who hopes to provide more adequate preparation of students for active participation in definite fields of work, is complete information as to what college graduates are actually doing, and how this differs from what they did in the seventeenth, eighteenth, sand nineteenth centuries. This, in brief, is what the present study aims to provide, by giving in detail the history through various professions in their relations to the alumni of 10 representative institutions, by comparing the development of these professions in 25, and by presenting in addition the combined statistics of 37 such institutions. 7. Socialization and Sport: A Paradigm of Institutional Socialization.

Abstract

This study applies a model of institutional socialization to the institution of college sport. Five variables were generated with reference to college sport as an agent of socialization and to the occupations of medicine, law, and business. The degree to which these five variables exist in the U.S. was investigated by means of a questionnaire survey eliciting the beliefs and perceptions of a sample of university students, an interview series designed to elicit the beliefs and perceptions of significant occupational allocators, and a library research phase generating evidence of cultural beliefs. The evidence gathered indicated that: (a) there is a normative belief in the socialization efficacy of participation in college sport; (b) there is a firmly supported belief in the existence of allocation linkages between college sport and specific occupational roles, but a firmly rejected suggestion of a socialization basis for such allocation linkages; (c) allocation linkages do not exist between college sport and specific occupational roles; (d) posited allocation linkages were overwhelmingly perceived as nonefficacious; and (e) the occupational end of points of posited allocation linkages of college sport are overwhelmingly perceived as nonelite. These results support the conclusion that institutional socialization effects, specific to the professions of medicine, law, and business are theoretically unlikely to occur through participation in college sport in either Great Britain or the U.S. (Author)

This is the sixth article in a series that explores the historical events surrounding the Wilk v American Medical Association (AMA) lawsuit in which the plaintiffs argued that the AMA, the American Hospital Association, and other medical specialty societies violated antitrust law by restraining chiropractors' business practices. The purpose of this article is to provide a brief review of the plaintiffs, lead lawyer, and the events immediately before the lawsuit was filed. This historical research study used a phenomenological approach to qualitative inquiry into the conflict between regular medicine and chiropractic and the events before, during, and after a legal dispute at the time of modernization of the chiropractic profession. Our methods included obtaining primary and secondary data sources. The final narrative recount was developed into 8 articles following a successive timeline. This article, the sixth of the series, explores the plaintiffs' stories. Because of the AMA's boycott on chiropractic, chiropractors were not able to collaborate with medical physicians or refer patients to medical facilities, which resulted in restricted trade and potential harm to patients' well-being. The plaintiffs, Patricia Arthur, James Bryden, Michael Pedigo, and Chester Wilk, came from different regions of the United States. Each had unique experiences and were compelled to seek justice. The lead lawyer, Mr George McAndrews, was the son of a chiropractor and had witnessed the effect that the AMA's attacks on chiropractic had on his father. It took several years to gather enough resources to file the suit, which was submitted in 1976. The conflicts that the plaintiffs experienced stimulated them to pursue a lawsuit against the AMA and other organized political medicine groups. [ABSTRACT FROM AUTHOR]

Smart contracts are increasingly popular in business and law. Smart contracts are also becoming increasingly complex. Advances in technology allow smart contracts to handle far more intricate transactions than the traditional--and simple--vending machine example. With increased complexity comes increased responsibility. When parties rely on an attorney to review or draft a smart contract, that attorney must understand what he or she is reading or writing. Smart contracts, however, are not written in a language most attorneys can understand, let alone write. While a general description of the contract may be translated into plain English, the contract itself is written in code. If an attorney cannot read the contract itself--and can only read a general description of the contract--can the attorney claim in good faith that he or she possesses the competence necessary to understand the terms of the contract? If the attorney cannot understand the contract, he or she can be held liable for malpractice if the contract leads to results contrary to what the attorney claimed could or would occur. The implementation of smart contracts is likely to give rise to specialized requirements for attorneys drafting and advising on smart contracts. Special requirements are not unheard of in the legal community. For example, to become a patent attorney, one must take and pass the Patent Bar Examination and fulfill other requirements, such as obtaining a bachelor's degree in specified fields of science or engineering. Similar requirements--either in the form of a smart contract certification or exam--should be developed not only as a measure of attorney competence, but also as a protection against malpractice suits brought forth by clients. Abstract

The benefits and drawbacks of diversity inside organizations have been the focus of attention for researchers and practitioners for several decades. In our article, we investigate the business case for racial diversity across different hierarchical levels. More precisely, we ask: How does racial diversity within organizations and its asymmetry across hierarchical levels affect their financial performance? From a sample of 143 US law firms from 2008 to 2012, we provide strong support for the business case and show that greater racial diversity for the entire organization is positively associated with firm financial performance. However, contrary to our initial expectations, the benefits of diversity are not more pronounced at the top of the organization, where its effects should arguably be more clearly observable. Diversity seems to have a similar effect across the three levels in law firms: associates, mid-level and partners. Furthermore, we find that the most profitable firms actually have their racial diversity heavily concentrated at the associate level. We discuss alternative explanations for this surprising finding and why the top-performing law firms have both overall higher degree of racial diversity and more concentration of its diversity at the lower level.
