Abstract

The Supreme Court will decide on a 1988 case filed by carlines against Oregon involving discriminatory taxes against railroad properties. The court's decision should establish a firm rule against the creation of anti-railroad taxes. It should reaffirm that any taxes that single out railroads for harsher treatment are illegal. In addition, the states should be given the chance to justify the imposition of such taxes and if the taxes are not justified, the taxes should be reduced but not totally cancelled.
