In the Brazilian legal system some tensions are visible in the intersystemic relationship between culture, power and politics. Describing the positions of authors such as Michel Foucault and Mario Vargas Llosa, when discussing the existence of security devices created by governments for control and manipulation of cultural systems in Latin America. Parallel to this, interpreting the mentions of contemporary writer Nicholas Carr and the philosopher Byung-Chul Han, we analyze the potential of the instruments and mechanisms of technological innovation mechanisms used as a form of mockery to the improvement of culture in neoliberal times, new power technique and used as knowledge propagation. On the basis of these premises, the present essay goes beyond interdisciplinary legal analysis, exploring the question of the trivialization of the operant culture system, now seen as entertainment, or disseminated knowledge, within the current Democratic State of Law. The work methodology is of the hypothetical-deductive method, a descriptive study with essentially bibliographical references. [ABSTRACT FROM AUTHOR]

This article addresses the issue of the three cultural discourses that can be found on the web, the psycho, bio and necropolitics. This process is known as sociodicies: vast narrative structures that are being dramatized in the digital society and represent the critical self-awareness of our times. In Civilization and its discontents Freud sought to present a discussion about the gains and losses of civilization, and specifically about the discontent caused by its limitations. For Elias, civilization, as a practice, involves the control of conduct, the regulation of modes and the subordination of emotions. The torment brought by civilization results from the way in which it limits freedom, overcoming impulses, imposing cultural tasks above individual wills. Civilization is social repression becoming a constant internalized demand as discontentment. In this article I seek to articulate sociologically, in opposition to several authors of social theory, the set of hypotheses raised by Han about psychopolitics, in order to rethink the directions and transformations of discontentment in a society that is not repressive (founded on negativity) but affirmative (founded on positivity). The main ideas of Han's thought are built against concepts of Foucault's philosophy: psychopolitics as overcoming biopolitics, transparency as a non-perspectivist panopticon and self-care as the most effective technique for dominating individuals who submit voluntarily while believing that they are free. In this paper I evaluate this reading, underlining the imprecisions on which his reading of Foucault is based: he does not understand the inciting character of biopolitics and forgets the importance of perspective in the panopticon and the impossibility of escaping from power relations. Resumen En este artículo se analiza el rol de la ciencia ciudadana como dispositivo postbiopolítico (psicopolitíco) de dominación y subjetivación en las prácticas científicas ciudadanas en el marco de las sociedades neoliberales del siglo XXI. En tal sentido, analiza cómo la convergencia NBIC (nano, bio, info y cogno) establece un presente histórico tecnocientífico en el que se definen nuevas articulaciones para las relaciones de control y poder. Los autores concluyen considerando que la psicopolítica se revela como un paradigma de dominación propio de las sociedades del rendimiento, que incentivará modelos de desarrollo afines a la ciencia abierta o ciudadana. Resumo Neste artigo se analisa o papel da ciência cidadã como dispositivo posbiopolítico (psicopolítico) de dominação e subjetivação nas práticas científicas cidadãs no marco das sociedades neoliberais do século XXI. Em tal sentido, analisa como a convergência NBIC (nano, bio, info e cogno) estabelece um presente histórico tecnocientífico em que se definem novas articulações para as relações de controle e poder. Os autores concluem considerando que a psicopolítica se revela como um paradigma de dominação próprio das sociedades do rendimento, que incentivará modelos de desenvolvimento afins à ciência aberta ou cidadã. Abstract This article analyzes the role of citizen science as a post-biopolitical (psychopolitical) dispositive of domination and subjectivation in citizen scientific practices within the neoliberal societies of the 21st century. In this sense, it analyzes how the NBIC (nano, bio, info, and cogno) convergence establishes a technoscientific historical present in which new articulations of power and control relations take form. It concludes with the consideration that psychopolitics is revealed as a paradigm of domination within performance societies, which would encourage development models related to open or citizen science.

Resumen Con este escrito se pretende ofrecer razones para sospechar que el Nudge es una herramienta del regulador para intervenir en el comportamiento de las personas, llevándolas a actuar de forma predecible para evitar el error y mejorar su bienestar, sin prohibir la libertad de elección y sin cambiar sus incentivos económicos (Sunstein y Thaler, 2008). Al ser combinada con los Big Data, un instrumento psicopolítico usado en la sociedad de la comunicación que permite un conocimiento de múltiples aspectos de la vida de los individuos esencialmente, a partir de la información personal que estos aportan a la red, da origen a una nueva herramienta psicopolítica que anula o limita, en cierto grado, la posibilidad de los individuos de resistirse al uso que de ella haga el regulador. Abstract It is intended in the following lines to offer reasons to suspect that the Nudge is a tool used by the regulator to influence people's behavior by guiding them, if you will, to act in a predictable way in order to avoid mistakes and improve their welfare, without restricting free will and avoiding the usage of economic incentives. Combined with the Big data, a psychopolitical instrument used in communications society, which essentially allows access to multiple aspects from the life of individuals, gathered from the own personal information that they upload to the web, originating a new psychopolitical tool devised to restrain the possibility of individuals to resist to the use that the regulator makes of it.

Para Elías, la civilización, como práctica, implica el control de la conducta, la regulación de los modos y la subordinación de las emociones. El tormento provocado por la civilización es el resultado de la forma en que limita la libertad, vence los impulsos, impone tareas culturales por encima de las voluntades individuales. La civilización es la represión social convirtiéndose en una demanda constante e internalizada como malestar. En este artículo busco articular sociológicamente, en oposición a varios autores de teoría social, el conjunto de hipótesis planteadas por Byung-Chul Han sobre la psicopolítica, con el fin de repensar las direcciones y transformaciones del malestar en una sociedad no represiva (fundada en la negatividad), pero afirmativo (basado en la positividad). O tormento trazido pela civilização decorre do modo pelo qual ela limita a liberdade, se sobrepondo aos impulsos, impondo tarefas culturais acima das vontades individuais. A civilização é a repressão social se tornando uma cobrança constante e internalizada como mal-estar. Nesse artigo busco articular sociologicamente, em contraposição a diversos autores da teoria social, o conjunto de hipóteses levantadas por Byung-Chul Han (2018b) sobre a psicopolítica, de modo a repensar os rumos e as transformações do mal-estar em uma sociedade não repressiva (fundada em negatividade), mas afirmativa (fundada em positividade).

Este trabajo tiene como objetivo analizar el pensamiento del filósofo Byung-Chul Han, en especial su concepto de psicopolítica, a partir de las herramientas conceptuales propuestas por Javier Echeverría, prestando especial atención a la génesis del fenómeno tecno como fundamento de la sociedad digital. Para ello, dedicaremos unos breves –pero necesarios– capítulos a la descripción o contextualización filosófica de la época histórica en la que se enmarca la “sociedad tecnológica”, heredera del pensamiento moderno y, consecuentemente, de la lógica totalizadora de la técnica. Posteriormente desvelaremos las tesis de Echeverría para acercarnos a la constitución de los tecnoentornos y, en ellos, de las tecnopersonas; todo ello para llevar a cabo, con propiedad, una lectura tecnopolítica de Han que descubra los mecanismos de poder y vigilancia neoliberales. The aim of this work is to analyse the thought of the philosopher Byung-Chul Han, especially the concept of psychopolitics, based on the intellectual tools proposed by Javier Echeverría, paying special attention to the genesis of the techno phenomenon as a foundational reality of digital society. To this end, we will devote a few brief –but necessary– chapters to the description or philosophical contextualisation of the historical time in which the "technological society" is framed, heir to modern thought and, consequently, to the totalising logic of technology. Subsequently, we will unveil Echeverría's thought in order to approach the constitution of techno-environments and the technopersons; all of this in order to carry out, with propriety, a technopolitical reading of Han that uncovers the mechanisms of neoliberal power and surveillance. 14. Postdisciplinary theories and the challenge of describing a new technology of power

Situándose en el marco de las teorías del poder foucaultianas/postfoucaultianas, y asumiendo el desafío de la continua reactualización de sus herramientas analíticas, el objetivo del presente artículo es aportar a la caracterización de lo que implicaría una nueva tecnología del poder (psicopolítica/noopolítica). La misma ha tendido a ocupar un lugar de centralidad ascendente hasta el comienzo de la tercera década del s. XXI, donde la pandemia del COVID-19 vuelve a dar cierto protagonismo a los dispositivos y técnicas de la biopolítica. Antes de emprender el estudio en torno a las transformaciones del poder en curso –los nuevos imbricamientos entre las distintas tecnologías de poder– es necesario arrojar algunas luces nuevas en torno a la caracterización de lo que representaría el núcleo conceptual de una caja de herramientas mixta para las analíticas del poder del hoy. La conjunción de Lazzarato y Han (Cerruti, 2017) nos permite integrar los registros del ciberespacio, los signos, la memoria, con aquellos que atañen a una perspectiva centrada en la psique, el inconsciente y las políticas del deseo. Previo a esto, insistiremos en el repaso pertinente del marco teórico común (postdisciplinario) que brindan Foucault y Deleuze., Placing itself within the framework of foucaultian/postfoucaultian theories of power, and assuming the challenge of contributing to the continuous updating of their respective analytical tools, the objective of this article is to contribute to the characterization of a new technology of power (psicopolítics/noopolítics). It has tended to occupy a place of ascending centrality until the beginning of the third decade of the s. XXI, where the COVID-19 pandemic once again gives a certain prominence to the devices and techniques of biopolitics. Before undertaking the study of the ongoing transformations of power –the new overlaps between the different technologies of power– it is necessary to shed some new light on the characterization of what the conceptual core of a mixed toolbox would represent for the analytics of the power of today. The conjunction of Lazzarato and Han (Cerruti, 2017) allows us to integrate the records of cyberspace, signs, memory, with those that concern a perspective centered on the psyche, the unconscious and the politics of desire. Los cuerpos del verano (2012) de Martín Felipe Castagnet y Kentukis (2018) de Samanta Schweblin, recientes novelas argentinas de ciencia ficción, pueden interpretarse como textos que cuestionan y evalúan las implicancias del capitalismo tardío en las sociedades actuales. En el presente artículo me pregunto específicamente por la identidad, blanco productivo de este sistema económico, y planteo que en ambas novelas se configuran subjetividades neoliberales controladas por el consumo, la proliferación del mercado y la tecnología: factores que restringen o anulan cualquier posibilidad de agencia en sus personajes. Esta perspectiva se aborda desde el entendimiento de que estas novelas son representativas de dos fases específicas del capitalismo tardío, a modo de genealogía, donde Castagnet da cuenta de los mecanismos biopolíticos de control y Schweblin visibiliza su devenir psicopolítico. Los cuerpos del verano (2012) by Martín Felipe Castagnet and Kentukis (2018) by Samanta Schweblin, two recent Argentinian science fiction novels, can be understood as texts that question and evaluate the implications of late capitalism in today's societies. In this article I specifically examine identity, a productive target of this economic system, proposing that both novels portray neoliberal subjectivities controlled by consumption, product proliferation and technology: factors that limit or suppress any form of agency in its characters. This perspective is approached from the understanding that these novels represent two specific phases of late capitalism, genealogically, in which Castagnet makes biopolitical control mechanisms visible and Schweblin shows its psychopolitical transformation. Los cuerpos del verano (2012) de Martín Felipe Castagnet i Kentukis (2018) de Samanta Schweblin, recents novel·les argentines de ciència-ficció, poden interpretar-se com a texts que qüestionen i avaluen les implicacions del capitalisme tardà en les societats actuals. En el present article em pregunto específicament per la identitat, objectiu productiu d'aquest sistema econòmic, i plantejo que a ambdues novel·les es configuren subjectivitats neoliberals controlades pel consum, la proliferació del mercat i la tecnologia: factors que restringeixen o anul·len qualsevol possibilitat d'agència en els seus personatges. La vida social está sometida a formas variadas de control. Mecanismos explícitos que se mueven en el conjunto de prevenciones, incentivos y sanciones saltan a la vista en la interacción social cotidiana. Normas sociales, reglas informales o costumbres recrean el escenario de la conducta encadenada. Este objeto de estudio es terreno promisorio para lograr aproximaciones conjuntas entre los saberes humanísticos. Resumo Este estudo pretende estabelecer uma conexão entre as práticas de governo neoliberais, os modos de controle e gestão da vida que lhes são correlatos e sua vinculação com os processos capitalísticos característicos da contemporaneidade. Por isso, suscita uma discussão sobre formas de controle psicopolíticas e biopolíticas mediante o modo como se configuram, respectivamente, por meio de um permanente sistema de absorção e monitoramento de dados - o Big Data - e de processos de molecularização e reconfiguração da vida orientados pelas finalidades de uma indústria farmacopornográfica. Trata-se, assim, de compreender a forma como “bios” e “psique” funcionam como matéria-prima e campo de incidência para um capitalismo cuja forma utópica de poder é a produção de estados de automatismo - o que constitui em fenômeno correlato ao ideal de transparência total e que toma corpo em três principais dispositivos: a avaliação permanente e multilateral, a delação premiada e a exposição de si mesmo. Resumen Este estudio tiene como objetivo establecer una conexión entre las prácticas de gobierno neoliberales, los métodos de control y gestión de la vida que están relacionados y su relación con los procesos capitalistas característicos de la contemporaneidad. Por lo tanto, plantea una discusión sobre las formas de control biopolíticas y psicopolíticas por medio de su configuración a través de un sistema permanente de absorción y monitoreo de los datos - el Big Data - y a través de procesos molecularisation y reconfiguración de la vida guiados por los efectos de una industria farmacopornográfica. Por lo tanto, es de entender cómo "bios" y "psique" constituyen materia prima y campo de incidencia de un capitalismo cuya forma de poder utópico es la producción de estados de automatización - fenómenos correlativos a ideales de transparencia total y que se materializa en tres dispositivos principales: la evaluación permanente y multilateral, la delación recompensada y la exposición en sí. Abstract This study intends to establish a link with the neoliberal practices of government, the control mode, and the management of the life that are related and its linking with the characteristics capitalistic process of contemporaneity. For that reason, it raises a discussion about the control modes of psycopolitics and biopolitics by the way of how it's configured, respectively, throughout a permanent system of absorption and the monitoring of data - The Big Data - and throughout the process of molecularization and reconfiguration of life oriented by the purposes of an industry pharmacopornographic. It's about comprehend in the ways how "bio" and "psyche" work as feedstock and field of incidence for a capitalism which the utopian way of power is the production of states of automatism - which consists a correlated phenomenon to the ideal of total transparency and that consists in three main devices: the permanent evaluation and multilateral, the awarded deletion, and the exposition of itself.

RESUMEN Las principales ideas del pensamiento de Han se construyen frente a conceptos de la filosofía de Foucault: la psicopolítica como superación de la biopolítica, la transparencia como un panóptico no perspectivista y el cuidado de sí como la técnica de dominación más eficaz, propia de individuos que se someten voluntariamente creyendo que son libres. En este trabajo evalúo dicha lectura subrayando las imprecisiones sobre las que se asienta su lectura de Foucault: no comprende el carácter incitador de la biopolítica y olvida la importancia de la perspectiva en el panóptico y la imposibilidad de escapar de las relaciones de poder. ABSTRACT The main ideas of Han's thought are built against concepts of Foucault's philosophy: psychopolitics as overcoming biopolitics, transparency as a non-perspectivist panopticon and self-care as the most effective technique for dominating individuals who submit voluntarily while believing that they are free. In this paper I evaluate this reading, underlining the imprecisions on which his reading of Foucault is based: he does not understand the inciting character of biopolitics and forgets the importance of perspective in the panopticon and the impossibility of escaping from power relations.
