La presente investigación tiene por objeto realizar un análisis de la gestión de la crisis migratoria del Mediterráneo en el año 2015 por parte de la Unión Europea, momento en el que llegan al territorio comunitario más de un millón de personas solicitantes de asilo. Tras un primer recorrido histórico y legislativo para conocer el proceso de construcción del Sistema Europeo Común de Asilo, se abordará el enfoque hotspots presentado por la Unión Europea con el fin de hacer frente a la emergencia humanitaria. Desde un enfoque crítico se analizará cuál ha sido la afectación de las propuestas legislativas sobre los derechos de los migrantes, así como se intentará aportar una visión sobre las consecuencias sociales de esta crisis migratoria. This current thesis has the aim of analyzing the governance of the Mediterranean crisis in 2015 by the European Unión, the moment in which more than a million people arrived at the community territory seeking asylum. After a first historical and legislative review of the topic, in order to know well the construction and integration of the Common European Asylum System, the hotspots approach will be evaluated, it was presented by the European Unión with the purpose of tackle the humanitarian emergency. It will be analyzed, from a critical approach, how the different legislative proposals have affected the migrants’ rights, as well as this thesis will attempt to provide a view about the social consequences of this migratory crisis. Building on three theories of European integration – liberal intergovernmentalism, neofunctionalism and postfunctionalism – I offer an explanation to the process and outcomes of the development of the Common European Asylum System (CEAS) between 2008 and 2018. The process to establish the CEAS has been characterized by clashing actor preferences, which forced actors into negotiations. This thesis aims to analyze the dynamics of these negotiations surrounding the CEAS. My results show that liberal intergovernmentalism explains locked positions in interstate bargaining and highly compromised outcomes, and even non-decisions, of the CEAS. I also argue that neofunctionalism loses explanatory power when sensitive issues concerning automatic quota systems and national sovereignty are discussed, although many arguments by the involved actors in the policy process draw upon neofunctional assumptions. Postfunctionalism is argued to gain explanatory power during recent years, since identityrelated arguments and Eurosceptical and anti-immigrant ideas in European governments have increased.

I kölvattnet av den så kallade flyktingkrisen 2015 har allt fler röster höjts i Europa om att förändra asylrätten för skapa ett mer förutsebart och hållbart asylmottagande. Diskursen synliggör asylrättens centrala rättighetskonflikt där det allmännas intresse av reglerad invandring vägs mot den enskildes rätt till asyl. Denna uppsats utreder möjligheterna att ersätta EU:s nuvarande asylsystem med ett EU-gemensamt kvotflyktingsystem. Utgångspunkten för uppsatsen är ett förslag som Moderaterna under oktober 2017 antog i sitt partiprogram vars innebörd är att EU ska övergå till ett gemensamt asylsystem med enbart kvotflyktingmottagande. Frågeställningen är vilka hinder som föreligger för en sådan förändring med hänsyn till gällande rätt och ändamålen bakom asylrätten. Moderaterna föreslår alltså en ordning som skulle inskränka rätten att söka asyl. Rättighetsinskränkningar ska vara proportionerliga. Uppsatsen besvarar därför huvudfrågeställningen utifrån fyra delfrågor som påminner om en proportionalitetsbedömning för att avgöra om förslaget är möjligt eller lämpligt. Först diskuteras om dagens asylsystem behöver förändras med hänsyn till den så kallade flyktingkrisen 2015, sedan utreds andra brister i dagens system. Slutsatsen nås att det finns brister med dagens system som motiverar en förändring som exempelvis de höga dödstalen för migranter som reser över Medelhavet för att söka asyl i EU. Därefter undersöks vilka möjligheter en förändring till enbart ett EU-gemensamt kvotflyktingsystem skulle kunna medföra och det konstateras att förslagets största fördel är att vidarebosättning utgör en laglig och säker väg för asylsökande till EU. Kärnan i uppsatsen är utredningen av de praktiska och juridiska hinder som finns för en förändring till enbart ett EU-gemensamt kvotflyktingsystem. Där finner jag att det största hindret är svårigheten att organisera systemet på ett sätt som är förenligt med principen om non-refoulement enligt såväl folkrätten som Europakonventionen. Jag identifierar även andra allvarliga praktiska och juridiska hinder för en sådan ordning. Slutligen undersöks om det finns alternativa lösningar att tillgå som är mindre ingripande än förslaget om enbart ett EU-gemensamt kvotflyktingsystem. Jag finner att så är fallet. Till exempel kan medlemsstaterna öka sitt kvotflyktingmottagande, införa humanitära visum eller inrätta en EU-centraliserad asylprövning. Min slutsats är att rätten att söka asyl på plats i EU måste kvarstå och att de mindre ingripande lösningarna som tas upp i uppsatsen är att föredra framför ett asylsystem i EU med enbart kvotflyktingmottagande.

Ever since the the Dublin convention entered into force in 1997, asylum seekers have been given a common status in all of Europe: If an asylum application is rejected in one country, the persons right to apply for asylum in other European countries is revoked. For this system to be just, all participating countries would need to have common procedures for their handling of asylum applications: A condition that has repeatedly been proven not to be fulfilled. In order to solve these discrepancies, the European Union has implemented numerous directives and measures intending to harmonise European asylum procedures over the last decades: However, previous studies have found these efforts to be futile, with differences remaining largely the same or even increasing. This thesis sets out to conduct a more thorough study of the convergence of European asylum recognition rates, by seeing the results of quantitative convergence studies in light of the EU policy development process. It finds that the increased discrepancies of asylum recognition rates observed in previous studies are likely to be the result of \textit{unfinished convergence}, and concludes that EU directives implemented as a part of the Common European Asylum System are likely to cause a harmonisation of European asylum procedures in the long run. Compared to previous studies, this thesis thus argues for a less pessimistic interpretation of convergence of asylum recognition rates, finding indications that recognition rates are converging following the implementation of EU policies.

In the light of the current refugee crisis in the European Union, and the remarkably critical stance the East Central European states are taking in Brussels, this research contributes to a broader understanding of the Czech Republic, Slovakia, Hungary and Poland's policies towards refugees. By scrutinizing the process of developing refugee policies during the 1990s and 2000s, the research will demonstrate that the countries united in the V4 platform in their first years of transition generously contributed to international refugee protection. Steep increase of asylum applicants and negotiation talks with the EU in the late 1990s brought various changes to the refugee policies in the region, marked by more closely defining and the enhancing of asylum seekers' and recognized refugees' rights, but also by lower refugee recognition rates. Accession to the European Union ultimately resulted in more complete and comprehensive asylum policies in line with the Common European Asylum System (CEAS). However, the V4 states maintained rather restrictive interpretations of the European policy, explained by the pressure the CEAS places on the states at the EU's external border and lower economic capacity to accommodate large numbers of refugees. This thesis examines the difficulties encountered in the process of establishing the CommonEuropean Asylum System, taken from a discursive perspective. The focus of the study isthreefold; why are specific issues highlighted by the European Union Member States, how isthe discursive conflict expressed within the discourse on CEAS, and what definitions ofsolidarity are promoted by the Member States. In purpose of addressing these focuses,discourse theory, issue salience and solidarity through burden sharing are used as theoreticalframework. By applying critical method and discourse analysis, this study has managed toestablish that the security issues are among the most highlighted, whereas the geographicallocation of a Member State seems to be an explanatory factor to a Member State’s specificemphasis. Regarding the discursive conflict, the definitions of the concepts mutual trust, fairdistribution and cooperation are especially contested. Furthermore, the external dimension ofsolidarity is proven to be the precedent definition of solidarity.

El sistema europeo común de asilo (SECA) fue teóricamente pensado con la finalidad de asegurar el asilo como un derecho, articulando un estatuto uniforme de protección. Tras varios años, dicho sistema no sólo no se ha completado, sino que además en determinados Estados, como es el caso de España, los ataques que está sufriendo hacen que los solicitantes de asilo se encuentren en situaciones de extrema vulnerabilidad. Este artículo, a partir de las disposiciones europeas, evidencia, de modo crítico y razonado, las deficiencias iniciales en el acceso al estatuto de refugiado y las sistemáticas violaciones de derechos humanos que se producen en los movimientos mixtos en España. Se trata de reivindicar que las garantías frente a la persecución no pueden ser limitadas, ni los solicitantes de asilo pueden concebirse como un “numerus clausus”, porque cuando hablamos de asilo apelamos a un derecho humano conectado con la más elemental protección del género humano, The Common European Asylum System (CEAS) was theoretically designed with the aim of ensuring asylum as a right, articulating a uniform protection status. After several years, this system has not only not been completed, but also in certain states, such as Spain, said system is suffering attacks which are placing asylum seekers in situations of extreme vulnerability. This article, from the European guidelines, suggests, with critical and reasoned arguments, initial deficiencies in access to refugee status and to the systematic violations of human rights that occur in mixed movements in Spain. The focus of this paper is to demand that the guarantees from persecution not be limited and asylum seekers not be conceived as a “numerus clausus”, because when we discuss asylum we appeal to a human right connected to the most basic protection of human beings, 1.
