BACKGROUND: This study explores the impacts of attacks perpetrated in the context of armed conflict, to female health workers in three Colombian territories. METHODS: We conducted a document review of the reports and databases of the Colombian Truth Commission, 17 in-depth semi-structured interviews with experts on the national and regional armed conflict and the medical mission, and 26 female health workers who were victims of attacks. RESULTS: Experts and female health workers reported attacks to health activities, facilities, equipment, and personnel, including attacks to traditional doctors belonging to indigenous communities. The most frequent attacks were threats and retention of health personnel; theft of supplies and medicines; damage and use of infrastructure and means of transport for purposes other than health care; and hinderance of health service provision. The attacks occurred in a framework of structural violence that intersects with poverty, racism, and gender bias. The impacts of these attacks include gender-based violence, significant disruption of the lives of health workers, and physical, emotional, psychological, social, and economic effects on the victims and their families. The government response to protect victims and populations has been absent or insufficient. CONCLUSIONS: Attacks to health care were reported in all the studied territories obstructing adequate health care. Impacts of these attacks affect negatively the professional and personal life of the workers and are aggravated by structural violence and absent or little institutional response.

The article is devoted to the analysis of the provisions of international human rights law and international humanitarian law regarding the protection of the right to property, in particular the permitted limitations of this right, the relevant practice of international human rights courts and international criminal tribunals, the connection between the institution of derogation and the law of armed conflicts, as well as problematic issues of the protection of the right to property damaged during the russian-Ukrainian armed conflict. The author considers the provisions of some international treaties, which provide for the protection of the right to own property in peacetime, as well as the case-law of the European Court of Human Rights related to the violation of the right of applicants to own their property in accordance with Protocol No. 1 to the Convention on the Protection of Human Rights and Fundamental Freedoms in connection with an international armed conflict or a situation of occupation. The author also analyzes the provisions of some sources of international humanitarian law regarding property as an object that must be protected during armed conflicts, in particular in occupied territories, and also provides examples of cases of international criminal tribunals, in whose decisions the destruction of property was recognized as a component of crimes against humanity. The author examines the question of the relationship between the sources of international human rights law and international humanitarian law in the context of the protection of the right to peaceful possession of property. The peculiarities of the institution of derogation in the context of the right to property in the conditions of an international armed conflict are analyzed. Ukraine's derogation from its obligations under international human rights treaties, including the right to peaceful possession of property, in the conditions of russian armed aggression, is studied. In addition, in the context of the armed conflict between Ukraine and russia, the objects of property rights and the interested subjects of the right to property, which is violated or limited as a result of military operation, are singled out, and the collective dimension of the right to property, which was damaged during the russian-Ukrainian armed conflict, was investigated. BACKGROUND: Colombia has experienced decades of conflict between the government and non-state actors. Attacks on healthcare have been a grave but regular facet of that violence. In response, the Misión Médica (MM) program was developed to support, protect, and defend healthcare. Sporadic violence continues, with many recent attacks perpetrated not by armed actors but by residents. Given the history of conflict and ongoing violence, we sought to capture the perspectives of both healthcare workers (HCWs) and community members (CMs) regarding the characteristics and impacts of attacks on health in Colombia to gain insight into how to better prevent violence and mitigate its impacts. METHODS: A cross-sectional survey was conducted from January to March 2021 in seven departments in Colombia in regions that witnessed attacks on healthcare. Questionnaires were administered to HCWs and CMs via purposive sampling, probing their experiences with attacks on health with both closed and open-ended questions. The categorical responses were stratified by health worker vs. non-health worker and descriptively analyzed. Narrative responses were analyzed via a hybrid deductive/inductive thematic approach. RESULTS: Seventy-three individuals participated in the study (36 HCWs and 37 cm). Approximately 77% of HCWs believed that attacks on healthcare impacted health outcomes while 68% of CMs did not see a direct connection between violence against healthcare and poor health outcomes. Awareness of the MM program was significantly different between HCWs (83.3%) and CMs (37.8%). The survey responses explored the characteristics of attacks on health, compounded impacts of violence on the health system, personal impacts, and perspectives on mitigation efforts. CONCLUSIONS: The study demonstrates that: (1) attacks on healthcare are context-dependent and require a local lens for mitigation and management; (2) both HCWs and CMs have critical perspectives that must be considered, (3) the impacts of violence against healthcare are complex and compounded and (4) that awareness of the legal protections of the Geneva Conventions must be combined with education on the health impacts for robust protection strategies. Critically, Both CMs and HCWs experience fear and psychosocial ramifications of these attacks, suggesting the need for stronger protections and resources to support the health workforce and the local community.

The article is devoted to the analysis of the institute of control in international law as one of the elements for attributing the behaviour of a separatist entity or other anti-governmental organisation to the state in the process of bringing the latter to international legal responsibility for internationally wrongful acts, primarily massive human rights violations. The author emphasises the growing importance of the issue of control in the context of modern armed conflicts, where ‘proxy’ forces are increasingly used, acting formally independently but in fact controlled by states. This raises new challenges for international law, especially in the area of human rights protection, including during armed conflicts, and State responsibility. The article examines the provisions of some international instruments relating to the responsibility of States for internationally wrongful acts, and in particular those provisions which provide for attribution of conduct of individuals or groups of individuals acting ‘at the direction’, or ‘under the direction’, or ‘under the control’ of the State. The article discusses three main concepts of control, namely: strict control, effective control and general control. The authors analyse in detail the history of the emergence and development of each concept, as well as explain the main differences between them, and reveal their strengths and weaknesses. It is argued that strict control requires complete dependence of the organisation on the state, while effective control allows for autonomy of the organisation, but requires a certain influence of the state on its actions. Overall control emphasises the importance of structured interaction between the state and the group. The authors provide examples of the application of these concepts in the practice of international justice bodies, including the International Court of Justice, the European Court of Human Rights, and the International Criminal Tribunal for the Former Yugoslavia, highlighting the difference in approaches to assessing control and responsibility of states. These examples demonstrate the difficulty of proving a certain level of control, which affects the resolution of disputes in international courts. [ABSTRACT FROM AUTHOR]

In 2022, for the first time in some while, the public around the world was confronted with an armed conflict between states, which directly involved a nuclear facility, specifically a nuclear power plant in operation. Unfortunately, the situation following Russia's armed attack on Ukraine on 24 February 2022 and the acts of war around the Zaporizhzhya nuclear power plant once again draw attention to the need to protect nuclear facilities during armed conflicts. Therefore, this paper reviews the relevant rules of public international law and scrutinizes the norms that have been established through international legislation and soft law mechanisms to protect and guarantee the nuclear safety and security of nuclear installations. Using the development of the last decade of the current century as a temporal reference point, this study tackles the urgent task of understanding and promoting an effective implementation of IHL (International Humanitarian Law) within the context of the armed conflict in the Colombian Caribbean region. Based on this analysis, there's an identified need for a harmonious approach grounded in participatory premises, considering both local residents and actors directly involved in the conflict. It's worth noting that this analysis particularly highlights the case of the Gulf Clan as an example. Employing a primarily qualitative methodology, in line with its nature, this study aims to provide a refreshed and contextual perspective that can guide future research and public policies in the realms of IHL. The article emphasizes that protecting the rights and interests of children is the most important task of any democratic state. International human rights law and international humanitarian law regulate the rights of children and their protection, as well as the respective obligations of states and non-state institutions in this area. The universally recognized mechanism for the protection of children's rights remains almost unchanged, but in the conditions of martial law, new circumstances arise in which children's rights may be violated, especially the right to protection from violence and ill-treatment. The main violations of children's rights are: recruitment of children, use of prohibited weapons to wage war, obstruction in the provision of humanitarian aid, deprivation of citizenship, illegal deportation of children, murder and mutilation, damage to health care facilities, educational institutions, which leads to the impossibility of realizing the rights of the latter. The article describes the peculiarities of the legal regulation of the status of a child who suffered as a result of hostilities and armed conflicts. The legislation of Ukraine does not contain a uniform approach to the protection of children during the violation of certain types of rights and freedoms. In addition, some of the existing guarantees have no practical application due to the lack of a mechanism for their implementation or inconsistency with the realities of today. The international community, together with Ukraine, implemented a mechanism to protect and restore the rights of Ukrainian children. The violated rights of children during a full-scale invasion must be protected and restored through both national and international institutions. In this context, the Children of War platform created in Ukraine plays an important role. This is the only platform that collects information about children affected by war. [ABSTRACT FROM AUTHOR]

The article is dedicated to exploring the legislation of Ukraine in the sphere of regulating war crimes. The research is based on the analysis of normative acts of international humanitarian and criminal law, which have established serious violations of the laws and customs of war and equated them with serious international crimes. Additionally, attention is focused on the longstanding experience of international institutions dealing with the regulation of the mechanism of punishment for war criminals. For Ukraine, the issue of war crimes has become relevant in the conditions of armed conflict caused by the aggression of the Russian Federation. Currently, the number of these crimes is gradually increasing. By the end of 2023, over 109,000 instances of war crimes committed by the Russian armed forces had been documented. Alongside, the number of criminal proceedings for violations of the laws and customs of war is increasing. It was further noted that deficiencies in the legislative definition of war crimes and the lack of necessary legal practice in such a specific category of offenses lead to difficulties in qualifying war crimes. The basis for qualifying a crime is the composition of a criminal offense. In Ukraine, there is a single provision providing for criminal liability for violations of the laws and customs of war -- Section 438 of the Criminal Code of Ukraine. This article lacks both a definition of war crime and a clear objective aspect of the offense, and the punishment is less severe compared to other general criminal statutes. Section 438 of the Criminal Code of Ukraine is generic. Due to such wording of war crimes in Ukraine, the practice of additional qualification of violations of the laws and customs of war under articles on torture, intentional grievous bodily harm, intentional moderate bodily harm, intentional minor bodily harm, coercion to testify, etc., has spread. Avoiding difficulties in qualifying war crimes can be achieved through access to sources of international humanitarian and criminal law. The Rome Statute of the International Criminal Court is one of the most important legal acts that has codified the entire range of elements of war crimes and detailed them. The Russia-Ukraine war demonstrates the crucial role of technology in modern warfare. The use of digital networks, information infrastructure, space technology, and artificial intelligence has distinct military advantages, but raises challenges as well. This essay focuses on the way it exacerbates a rather familiar challenge: the "civilianization of warfare." Today's high-technology warfare lowers the threshold for civilian participation in the war effort. A notable example is the widespread use of smartphone apps by Ukrainian civilians, who thereby help the armed forces defend against Russian aggression. Through the lenses of international humanitarian law, conventional just war theory, and revisionist just war theory, this essay evaluates the normative dimensions of such civilian participation. The analysis shows that civilians can lose their legal protections when they use these apps to directly participate in hostilities, and this loss of immunity can be justified by Michael Walzer's conventional just war theory. Revisionism, however, puts the justness of the war at the forefront, and so sheds doubt on the moral liability of Ukrainian civilians. Considering the broader implications, including the blurring combatant-civilian distinction, indicates that such civilianization of warfare should not be welcomed; the risks will often outweigh the benefits. At a minimum, states ought to exercise restraint in mobilizing civilians and inform them of the implications of their actions. [ABSTRACT FROM AUTHOR]

Since commencing its illegal invasion in 2022, the Russian military and authorities have committed numerous war crimes against the people of Ukraine. These include the mutilation and execution of combatants; the torture, kidnapping, forced expulsion, rape, and massacre of civilians; and indiscriminate attacks on densely populated areas. In this essay, I evaluate the strategic implications of this misconduct, focusing exclusively on Western responses. I argue that war crimes can and often do negatively impact the strategic goals of the perpetrator, but whether and how this occurs is rarely governed exclusively by the offending action. Western perceptions of battlefield atrocity, shaped as they are by identity, race, and politics, may radically shift from one context to another. In the case of the Russia-Ukraine war, the status of both the participants and the conflict itself has helped inculcate a particular sensitivity among Western actors to the battlefield criminality of Russia. Drawing on evidence from the 2022 Bucha massacre and the ongoing bombing of Ukrainian civilians, I argue that Russian misconduct has consolidated Western support for the Ukrainian military effort, politically, diplomatically, and materially. The use of social network analysis (SNA) during the War on Terror has been a topic of significant political and academic discourse. SNA is an empirical method that graphically and mathematically represents interactions or relationships between nodes (eg, individuals, organizations) and the ties that connect them. The nature and degree of interdependence among nodes are believed to provide insights into the relationships and behaviour of members within a social network. The scarcity of precise and comprehensive data on the structure, functioning, and activities of terrorist groups has prompted some states to incorporate SNA into their intelligence efforts and rely on its data for counterterrorism activities, including lethal operations. However, the compatibility of SNA with international law remains underexplored. In this article, we adopt a legal-empirical approach to elucidate SNA in accessible terms and examine the challenges it presents for international law. We contend that SNA is fundamentally incompatible with international humanitarian law (IHL) targeting rules, as the data it provides do not pertain to legally relevant criteria. Nevertheless, SNA offers valuable insights for IHL by illuminating intra-group dynamics to facilitate conflict classification, identifying legally relevant characteristics in armed groups' internal networks, and determining the strength of relations between armed factions. The article seeks to raise awareness about the non-application of the norms of international humanitarian law (IHL) of international armed conflicts in situations of so-called internationalised armed conflicts – namely, when a non-state armed group (NSAG) that is engaged in an armed conflict against the territorial state enjoys a degree of support from another state. Debates in academic circles and international case law have focused largely on the appropriate test and threshold for establishing the relationship between the NSAG and the supporting state. Practice, however, shows that regardless of the legal test, the foreign state support to the NSAG in a (or an initially) non-international armed conflict is so politically charged that it leads to a complete non-application of the law of international armed conflict by the relevant actors. The article demonstrates its conceptual findings through four case studies: the armed conflicts in Donbas, Nagorno-Karabakh, Democratic Republic of the Congo, and Yemen. Regardless of strong indications of foreign state support to the NSAG in these armed conflicts, no relevant actors applied the IHL norms of international armed conflict. Recently in June 2022, the United Nations Special Representative of the Secretary-General for Children and Armed Conflict expressed that the ongoing use and recruitment of children in armed conflict globally warrants "international concern". Notwithstanding the existence of proscriptive norms in terms of international humanitarian law (IHL) and international human rights law (IHRL), international legal violations are nevertheless committed by states and non-state actors. A systematic analysis of the respective normative systems identifies a lacuna between specific provisions thereof. Consequently, violations are committed in armed conflicts for the purposes of IHRL but not IHL, it is contended that this inconsistency in the law perpetuates ongoing child soldiering. It is further contended that this inconsistency establishes a genus of children who are legally unprotected as they fall between the cracks of international law. Based on recent progressive jurisprudence of the International Court of Justice, an approach which will bridge the lacuna between these norms is proposed. Contrary to the view of the International Committee of the Red Cross and with due consideration for the lex specialis principle, it is proposed that the IHL and IHRL instruments should apply in a complementary fashion, as opposed to the separate legal regimes under which they have developed.

In contemporary parlance, the environment and its preservation have emerged as a principal focus and concern for the global populace. This phenomenon is known to escalate during times of armed conflict. Armed conflicts directly impact the environment (such as destroying natural resources or pollution resulting from military operations). The investigation into the ecological destruction inflicted upon the natural world during the two world wars demonstrates that the emphasis on safeguarding the environment is no longer a theoretical notion but a concrete actuality encapsulated within the framework of legal doctrines. The protection of the environment encompasses a diverse array of International Humanitarian Law (IHL) and International Criminal Law (ICL). This study scrutinized the safeguards and preservation of environmental rights in times of armed conflicts, whether domestic or international, through the lenses of ICL and IHL. This article takes up the significant yet understudied issue of belligerent rights regarding submarine communication cables in armed conflict. The article takes up three key questions that have persistently evaded clarity. First, what actually is the law applicable to cables in wartime? Second, how is this law to be applied in practice? And third, is it fit for purpose? The article concludes that, as a matter of lex lata , no lex specialis rules have emerged specific to the protection of submarine cables in armed conflict, either in treaty or customary international law. However, this does not MEAn that belligerents are free to target submarine cables in times of armed conflict. Instead, important international law constraints are to be found in general IHL principles, the law of neutrality, and law of the sea protections that persist in times of armed conflict. Applied to the technical configurations of submarine cables as currently deployed and used, it is far from clear that these rules and principles permit the targeting of submarine cables in wartime. The issue of protection of cultural property during armed conflict has long been considered in the doctrine of international law of Ukraine under the prism of the bitter experience of destruction in Yugoslavia in 1990, Afghanistan and Iraq in 2000, Syria and other countries. However, starting in the spring of 2014, we began to receive our own examples of the consequences of the armed conflict that began with the annexation of Crimea and the taking of control of several areas of Donetsk and Luhansk regions. Much of the scholarly work on the protection of cultural property during armed conflict usually contains a general analysis of international and national legal acts in this area, but there is insufficient attention to the applied aspects and the issue of international responsibility for such offenses. The purpose of the article is to determine the basic rules of international humanitarian law applicable to the protection of various types of cultural property in the armed conflict between Russia and Ukraine, and also the rules determining the degree of responsibility for the offenses and crimes in this area. It is established that, first of all, the protection of cultural property during an armed conflict is regulated by international law, and the norms of national legislation specify certain provisions. The key document is the Convention for the Protection of Cultural Property in the Event of Armed Conflict of May 14, 1954, which enshrines the protection of cultural property in two classical aspects: positive protection, which imposes on the State the obligation to prepare for the protection of cultural property in peacetime, preparing it for the potential consequences of armed conflict, and negative protection - respect for cultural property - prohibition of the use of cultural property for military purposes and prohibition of attacks on such property. In the armed conflict between Russia and Ukraine there are two main areas of cultural property protection: taking appropriate measures in the territories where active hostilities are taking place, as well as protecting cultural property located in the occupied territories and returning illegally exported property from these territories. The trend toward the "humanization" of international law reflects a greater emphasis on individuals rather than simply states as objects of concern. The advance of human rights law (HRL) has been an important impetus for this trend. Some observers suggest that humanization can be furthered even more by applying HRL rather than international humanitarian law (IHL) to hostilities between states and nonstate armed groups, unless a state explicitly declares that it is engaged in an armed conflict. This essay argues, however, that a court should not defer to a state's characterization of hostilities, but should base its analysis on whether hostilities meet the criteria for an armed conflict. Applying HRL to hostilities that effectively are an armed conflict but not acknowledged as such risks diluting the legitimacy and normative force of HRL. On the one hand, if a court applies conventional stringent HRL standards, this body of law may be seen as unrealistic and is likely to be ignored. On the other hand, a court that adapts HRL standards to armed conflict may need to take a consequentialist approach at odds with HRL's deontological foundations. This article outlines and evaluates the US perspective on how treaty and customary international law protect the natural environment during international armed conflict. It surveys the relevant treaties to which the United States is a party and examines US views on their pertinent provisions. It then assesses claims that the environmental obligations residing in the 1977 Additional Protocol I to the 1949 Geneva Conventions have attained customary status, outlines the United States' rejection of those claims, and evaluates the reasonableness thereof. In 2020, the International Committee of the Red Cross's work on the protection of the natural environment under international humanitarian law (IHL) produced the Committee's Guidelines on the Protection of the Natural Environment in Armed Conflict (ICRC Guidelines), an update of their 1994 predecessor. The ICRC Guidelines consist of thirty-two rules and recommendations under IHL, each accompanied by a commentary explaining their legal basis and providing guidance for interpretation. This article presents an overview of the context surrounding the Guidelines, certain key legal content, and practical implications for the conduct of parties to armed conflict as they fight. Protected areas safeguard biodiversity of global ecological importance, even throughout armed conflicts. The International Law Commission's Principles on Protection of the Environment in Relation to Armed Conflicts propose that certain ecologically important areas could be designated as protected zones during armed conflicts. This article uses a geospatial analysis of armed conflicts and Key Biodiversity Areas and three case studies to inform recommendations on how the protection of ecologically important areas could be enhanced through visibility, local actors and international stakeholders as part of a broader interpretation of a protected zone. The protection of the environment during warfare attracted significant attention in the 1990s, especially after the 1990–91 Gulf War. It became clear at that time that the few rules provided by international humanitarian law (IHL) aimed specifically at protecting the environment were insufficient. Various studies have since been undertaken with the aim of strengthening that protection from an IHL perspective. It is only recently that scholars and institutions like the International Law Commission have started to reflect on how to better protect the environment in armed conflict through the lens of another branch of international law, namely, international environmental law (IEL). Such an approach has involved examining the interplay between IHL and IEL, and scholars have subsequently proposed and then elaborated on frameworks in that respect. This paper intends to identify common trends of those frameworks and to critically appraise them, with the aim of providing a suitable approach to the interplay between IHL and IEL. Actors engaging in a diverse set of environmental protection activities are experiencing serious difficulties executing their mandates during armed conflict, leading to environmental harm that could otherwise have been mitigated. This article examines to what extent the international legal and policy framework can ensure the protection of environmental protection actors during armed conflict. It is argued that environmental protection actors can be seen either as part of civil defence organizations or as humanitarian relief actors, and are therefore covered by special protections under international humanitarian law. However, two main challenges remain: (1) despite these existing provisions, environmental protection actors may still face access and safety issues during armed conflict, and (2) within this framework, environmental protection activities must be linked to civilian needs and cannot be conducted based on ecocentric motivations. To overcome these challenges, the article introduces the concept of "environmentarian corridors". Environmentarian corridors would allow for the unimpeded movement of environmental protection workers and resources through contested territory and into emergency areas to protect the environment. They would also serve to increase awareness about obligations to protect the environment and would help to ensure the safety of environmental protection actors during armed conflict, as the role and mandate of these actors is explicitly accepted by stakeholders. Additionally, environmentarian corridors offer potential for conducting environmental protection activities on ecocentric grounds. The article concludes by advocating for stakeholders to employ the provisions and concepts articulated herein as a means to further promote and strengthen initiatives aimed at protecting the environment during armed conflict. Both gender and the environment have traditionally been positioned at the periphery of international humanitarian law (IHL). In recent decades, there has been important progress in moving both concerns closer to its centre; to date, however, an understanding of the intersection of gender and the environment in the legal regulation of armed conflict remains largely underdeveloped. Nevertheless, as the present article documents, there are important similarities in strategies pursued to advance both gender and the environment from the periphery to the mainstream of IHL, namely: first, a focus on sources of IHL, in particular concretizing arguably limited specific treaty content with interpretive guidance and implementation frameworks; second, a conceptual critique of prevailing definitions of "harm" in IHL; and third, advancing, through close empirical documentation and household-level analysis of conflict's effects, understandings of harm that capture so-called "second-round" effects of conflict. Recognizing these important affinities between gender and environment work in IHL, this article draws on these insights to propose a typology of gendered environmental harm in conflict. INTRODUCTION. In recent decades, there has been an escalation of armed clashes in the territories of African states, the states of the Middle East and Central Asia with the participation of military formations, international terrorist groups that everywhere use the practice of attacking and looting cultural property as a military strategy. In this regard, of scientific and practical interest is a comprehensive study of the legal and organizational foundations of international legal regulation of the protection of cultural property during armed conflicts, evaluation of their effectiveness and identification of promising tasks for the development of additional measures and strategies for the preservation of cultural heritage, taking into account new challenges and threats.MATERIALS AND METHODS. This paper examines the provisions of key international treaties, decisions of the main bodies and specialized agencies of the UN, which together form the existing international legal regime for the protection of cultural property in armed conflict. The author also analyzes the jurisprudence of international criminal justice bodies on bringing individuals to justice for deliberate attacks on cultural sites as part of hostilities. Special attention is paid to the study of scientific works of both domestic and foreign scientists, within which international legal concepts are formed, designed to resolve existing problems in the current international legal regulation of the issue under study, as well as to form promising concepts in the framework of the development of the doctrine of international law. The methodological basis is made up of general scientific and special research methods.RESEARCH RESULTS. According to the results of the study, it was found that during the XX century states have consistently developed norms for the protection of cultural property from threats associated with armed conflicts, while the XXI century was marked by best practice in the application of the rules on liability for attacks on cultural property in situations of armed conflict in the activities of international justice bodies. In addition, it was determined that for the first time in the history of UN peacekeeping, the UN Security Council tested the mandate of the Multidisciplinary Integrated Stabilization Mission in Mali, in which the peacekeeping contingent, among other things, performed the tasks of protecting, safeguarding and restoring cultural heritage sites together with UNESCO. It seems significant to identify and generalize the prospects for the development of new international legal measures for the preservation of cultural heritage for future generations, taking into account the changing nature of armed conflicts, the intensification of the activities of international terrorist groups and the growing practice of destroying the centuries-old cultural heritage of peoples in the framework of the so-called “cultural cleansing". The topical aspect of the study was the establishment of new approaches of states to the protection of cultural heritage as a means of ensuring international peace and security.DISCUSSION AND CONCLUSIONS. The publication presents the author's objective assessments of the established international legal framework, judicial practice of international criminal justice bodies, as well as doctrinal approaches of both domestic and foreign scientists on the issue of international legal regulation of the protection of cultural property during armed conflicts. Separately, the forms of international legal cooperation of states at the UN site within the framework of the UNESCO profile organization for the development of modern regulatory and organizational foundations for the interaction of the competent authorities of states to prevent and suppress the destruction of cultural heritage, as well as the looting and illegal export of cultural property in the event of an armed conflict, especially terrorist groups.

The article concerns the convergence of international humanitarian law and international human rights law in armed conflicts. International humanitarian law and human rights law converge and permeate each other because both these disciplines of public international law are founded on natural law. Although international humanitarian law constitutes a lex specialis, the general rules on the interpretation of treaties clearly indicate that international human rights law must be interpreted in the context of other rules of international law, and its derogations, if any, must be compatible with other international obligations of the state, including with humanitarian law. Where a conflict arises between international humanitarian law and international human rights law, the mechanism for resolving conflicts between norms has been supplemented by the International Court of Justice by applying an interpretation based on the principle of systemic integration, resulting in the “humanization” of international humanitarian law. As regards the application of universal and regional instruments of international human rights law, we face a “humanization” of them. That is why more and more attention is paid in practice to the complementarity of international humanitarian law and international human rights law, and this is confirmed in United Nations discussions and resolutions on the situation in armed conflicts.

BackgroundAttacks on health care in armed conflict, including those on health workers, facilities, patients and transports, represent serious violations of human rights and international humanitarian law. Information about these incidents and their characteristics are available in myriad forms: as published research or commentary, investigative reports, and within online data collection initiatives. We review the research on attacks on health to understand what data they rely on, what subjects they cover and what gaps exist in order to develop a research agenda going forward.Methods and findingsThis study utilizes a systematic review of peer-reviewed to identify and understand relevant data about attacks on health in situations of conflict. We identified 1479 papers published before January 1, 2020 using systematic and hand-searching and chose 45 articles for review that matched our inclusion criteria. We extracted data on geographical and conflict foci, methodology, objectives and major themes. Among the included articles, 26 focused on assessment of evidence of attacks, 15 on analyzing their impacts, three on the legal and human rights principles and one on the methods of documentation. We analyzed article data to answer questions about where and when attacks occur and are investigated, what types of attacks occur, who is perpetrating them, and how and why they are studied. We synthesized cross-cutting themes on the impacts of these attacks, mitigation efforts, and gaps in existing data.ConclusionRecognizing limitations in the review, we find there have been comparatively few studies over the past four decades but the literature is growing. To deepen the discussions of the scope of attacks and to enable cross-context comparisons, documentation of attacks on health must be enhanced to make the data more consistent, more thorough, more accessible, include diverse perspectives, and clarify taxonomy. As the research on attacks on health expands, practical questions on how the data is utilized for advocacy, protection and accountability must be prioritized.

The promotion of international humanitarian law is one of the main objectives of the external security policy, by assuming the commitment to ensuring the protection of an international system based on rules, which have the role of contributing to stability, respect for universal human rights and strengthening the rule of law. In this context, it became necessary to harmonize the legal instruments in the military field for the new categories of missions, which include clear criteria for the use of military force and which guarantee compliance with the objectives of national defense, without contravening to international law and treaties.

The presented paper discusses the convergence of international humanitarian law and international human rights law in armed conflicts. International human rights law and the human rights law converge and interact with each other because natural law is at the core of both these disciplines of public international law. Although international humanitarian law is a lex specialis , the general rules regarding the interpretation of treaties clearly indicate that international human rights law must be interpreted in the context of other rules of international law, and its possible derogations must be compatible with other international obligations of the state, including humanitarian law. In the event of a conflict between international humanitarian law and international human rights law, the mechanism for resolving conflicts between the standards was supplemented by an interpretation based on the principle of 'system integration' of the International Court of Justice which results in the 'humanization' of international humanitarian law. The evolution of the case-law of the European Court of Human Rights, which takes into account the international humanitarian law as the reference norm that should be referred to, demonstrates the close relationship between these areas of law. Through the idea of asking what I describe as 'jester's questions' that are comfortable with paradox, this Afterword to the Special Issue reflects upon the value of critical, multi-disciplinary approaches for international law, the parallel binaries and pluralities in international law, and the relevance and capabilities of international humanitarian law regarding legal identity under insurgencies and unrecognised states. I suggest that the critique offered by the multi-/inter-disciplinary approaches in this Special Issue highlights international law's limits given the realities of the issuance of identity documentation by non-state entities. At the same time, precisely by illuminating those practical realities, this collection alerts us to the accompanying nuances existing in the law. Through this entry point, we are encouraged back, better-equipped, to international law and to better understand where and how it can already cope with greater complexity and compromise than might often be assumed. It allows us to place real demands on the law to prove itself as relevant and capable of protecting people, somehow holding together that paradox of universal principle and grounded application. In recent decades, various armed conflicts have created threats to the marine environment. The Gulf War of 1990-91, the Israeli attacks on The Jiyeh Power Station in 2006, and the massive oil spill in the Persian Gulf and the Mediterranean Sea have all caused serious damage to the marine environment. The need to prevent, reduce and control pollution of the marine environment as a result of armed conflict is an important task for international humanitarian law. The purpose of this study is to explain the challenges faced by international humanitarian law in the protection of the marine environment. The findings of the paper show that international humanitarian law faces significant normative gaps in this field that seriously affect its ability to protect the marine environment. The appropriate responses to maritime environmental challenges during armed conflict include: adoption of precautionary measures, applying the Martens clause, updating pertinent provisions, explaining the scope of existing norms and conclusion of new provisions governing armed conflicts as regards maritime environmental protection. This article invites the reader on a journey through the legal arguments that would confirm the application of the United Nations (UN) climate change regime to belligerent occupations. Although the regime is silent on this issue, its application should not be limited to peacetime due to the seriousness of global climate change and its adverse effects on the environment and living entities. A harmonious interpretation and application of the UN climate change regime and the law of occupation would allow Occupying Powers to ensure the safety and well-being of the civilian population and contribute to the protection of the Earth's climate system. This article argues that the growing involvement of civilians in activities on the digital battlefield during armed conflicts puts individuals at risk of harm and contributes to the erosion of the principle of distinction, a cornerstone of international humanitarian law (IHL). The article begins by outlining the ongoing trend of civilianization of the digital battlefield and puts forward brief scenarios to illustrate it. It then examines the narrow circumstances under which such forms of civilian involvement may qualify as direct participation in hostilities under IHL, and discusses what this means for the individuals concerned, particularly from the perspective of their loss of protection under the law. The analysis shows that certain types of State conduct which put civilians in harm's way by inducing them to directly participate in hostilities may constitute standalone violations of IHL and human rights law obligations. Beyond these specific prescriptions, the encouragement of civilian involvement undermines the principle of distinction, with dangerous ripple effects on the interpretation of those rules of IHL that flow from it. Accordingly, the article concludes that States should act to reverse the trend of civilianization of the digital battlefield and refrain as much as possible from involving civilians in the conduct of cyber hostilities. Armed conflicts leave populations vulnerable to organ trafficking, a criminal enterprise with little international regulation when viewed separately from human trafficking. The Council of Europe's Convention against Trafficking in Human Organs is the only instrument to contemplate the responsibility of actors involved in organ trafficking, but traffickers may go unpunished due to its limited scope. Yet in armed conflict, international humanitarian law offers additional protection. The rules protecting the living and the dead against ill-treatment provide the basic level of protection necessary to consider the international responsibility of organ trafficking networks and the individual criminal responsibility of their members. The US drone strike programme has prompted debate between pro- and anti-drone lawyers over interpretations of self-defence and the laws of war. The debate frequently neglects the effects of drone technology on interpreting these laws. This article argues that drone strikes are best understood as techno-legal assemblages that combine technoscience and law to make killing lawful. The argument proceeds in three parts. Part one analyses the formal legal debate concerning drone strikes. The seeds of the debate are in the US’s response to terrorism in the 1980s, when it developed legal strategies to overcome the obstacles of territorial sovereignty and the ban on assassination. The contemporary debate on the law of self-defence divides into supporters and critics of the US’s legal position. However, the debate neglects what critical drone scholars have argued is an essential link between drone technology and legal ambiguity. Part two analyses the technoscientific practices of drone strikes and how they interpret and implement the laws of war. Armed drones are part of a widespread surveillance system that converts people into information, which the US uses to target individuals. The thresholds that distinguish between military and civilian objects, and that delineate the spaces, temporal order, and legal subjects of conflict, are all interpreted through the lens of the surveillance system. These techno-legal practices become a legal justification for drone killing that goes beyond positive law. Part three argues that drone strikes are techno-legal assemblages that are part of a general collective of assemblages of control. The enmeshing of law and technology in drone strikes reflects the expansion of the law to cover more subjects and more areas. Drone strikes, then, are not a radical break from the law, but a techno-legal continuation of patterns of colonial warfare.

Gerard Quinn is the United Nations (UN) Special Rapporteur on the rights of persons with disabilities. A graduate of Harvard Law School, he founded and directed the Centre for Disability Law & Policy at the National University of Ireland for many years. He sat as a member of the Council of Europe's treaty body on social rights and served as a civil servant in the European Commission, where he drafted European Union disability policies. He has conducted many large studies for the UN, including a 2002 Study that helped launch the drafting of the UN Convention on the Rights of Persons with Disabilities. He led the delegation of Rehabilitation International during the drafting of the treaty. He has received many lifetime awards for his work on international disability law from the US International Council on Disability, the European Association of Service Providers for Persons with Disabilities and Rehabilitation International. He was conferred with an honorary doctorate for his worldwide disability law work by Lund University in 2022. He has held honorary positions at the National Academy of Legal Studies and Research (NALSAR; Hyderabad, India), Wuhan University (China), Fudan University (Shanghai), University of New South Wales (Sydney), Deakin University (Melbourne), Harvard Law School and Haifa University (Israel). In armed conflicts and crises, children with disabilities face serious threats to their lives and safety, including those related to their inability to flee attacks, risk of abandonment, lack of access to assistive devices, lack of access to basic services and denial of education as well as experiences of stigma, abuse, psychological harm and poverty. Children with disabilities experience multiple and intersecting forms of human rights violations based on their disability and age. Since 2015, Human Rights Watch has documented the impact of armed conflict on children with disabilities in Afghanistan, Cameroon, the Central African Republic, the Gaza Strip in the Occupied Palestinian Territory, South Sudan, Syria and Yemen. While international human rights specifically call for the protection of children with disabilities in situations of armed conflict, the United Nations, governments, parties to the conflict and humanitarian actors have long neglected their specific rights and needs. There is an urgent need for the United Nations and governments to increase efforts to protect children with disabilities as part of their international commitments to protect all children impacted by hostilities. Their attention and investment in those most at risk of violence during armed conflicts will in turn enhance protection measures for everyone. [ABSTRACT FROM AUTHOR]
