En este trabajo se analiza la Sentencia del Tribunal Supremo de 19 de febrero de 2019, que ha venido a considerar que la falta de relación familiar manifiesta entre padres e hijos mayores de edad puede provocar la extinción de la pensión de alimentos, en caso de que dicha ausencia de relación familiar sea imputable, de modo principal y relevante, a los hijos. Se trata de una causa que ha sido alegada por los padres desde hace años como motivo para conseguir privar al hijo mayor de edad de la pensión alimenticia en instancias inferiores, sin embargo, nunca se había hecho valer ante el TS, por lo que interesaba conocer la opinión de nuestro Alto Tribunal al respecto. El propio TS reconoce en esta sentencia la necesidad de establecer jurisprudencia sobre el problema jurídico planteado, al ser un conflicto muy frecuente en la realidad social actual. This paper analyses the Supreme Court’s ruling of 19 February 2019, which considered that the manifest lack of a relationship between parents and their children of full age can lead to the extinction of the maintenance allowance, if this lack of relationship is mainly and significantly attributable to the children. This is a situation that has been put forward by the parents for years as a reason for depriving the adult child of maintenance at lower levels, but it had never been brought before the Supreme Court, so it was interesting to hear the opinion of our High Court on this matter. The Supreme Court itself acknowledges in this judgment the need to establish case law on the legal problem raised, as it is a very frequent conflict in the current social reality.
