This paper maps out the shifting and restrictive nature of immigration laws on the wives of resident Indians moving to South Africa. The turn of the century witnessed a gradual entry of women seeking to join their spouses in South Africa. However, on arrival some discovered that they were ‘prohibited’ immigrants, as Indian customary marriages came under intense scrutiny from immigration officials, Appeal Boards and courts. This paper argues that immigration and judicial officials, at times, became a law unto themselves by becoming official gatekeepers determining who was really a ‘wife’ and who could therefore enter the country. It shows how immigration officials, through a system of documentation and verification procedures, carefully scrutinised and monitored the entry of resident Indian wives into the Union. Thus, ‘what is the meaning of the word “wife”’ became a highly contested and complex issue at the turn of the century. The shifting and restrictive nature of immigration laws limited citizenship rights to resident Indian wives. This article adds to current debates on gender and citizenship in historical migrations amongst non-indentured, free Indian women immigrants to South Africa - a topic that is yet to be fully explored. This paper argues that immigrant civic activism, which may at first glance seem to focus on diasporic ties and ethnic community building, becomes often a lever for transcultural capital and transcultural community building. The study is explorative of new repertoires and forms of transnationalism among sub-Saharan African immigrant activists in Europe. The findings suggest that immigrant civic activism, even if limited in size, proposes new types of transcultural societal networks and new forms of transcultural expression. In the first part of the study I discuss the theoretical background of transnationalism in migration studies and propose the notions of transcultural capital and transcultural community as working concepts. The second part of the study concentrates on the qualitative analysis of life story interviews with sixteen sub-Saharan African immigrants in Europe. [ABSTRACT FROM AUTHOR]

Over the past three decades, relations between African emigrants and their home-states have been changing from antagonism to attempts to embrace and structure emigrant behaviors. This transformation in the conception of emigration and citizenship has hardly been interrogated by the growing scholarship on African and global migrations. Three of the most contentious strategies to extend the frontiers of loyalty of otherwise weak African states, namely dual citizenship or dual nationality, the right to vote from overseas, and the right to run for public office by emigrants from foreign locations are explored. Evidence from a wide range of African emigration states suggests that these strategies are neither an embrace of the global trend toward extra-territorialized states and shared citizenship between those at 'home' and others outside the state boundaries, nor are they about national development or diaspora welfare. Instead, they seem to be strategies to tap into emigrant resources to enhance weakened state power. The study interrogates the viability and advisability of emigrant voting and political participation from foreign locations, stressing their tendency to destabilize homeland political power structures, undermine the nurturing of effective diaspora mobilization platforms in both home and host states, and export homeland political practices to diaspora locations. This article examines trans-local trade circuits associated with African cities. While Africans have struggled to implant themselves across different territories and to incorporate themselves within the ambit of citizenry and rights, African urban 'implantations' are also a means of configuring an extraterritorial mobility that prevents any easy identification of the African city as a diasporic site. Through an examination the experience of African migrants in the Bangkok Banlieue, the article's conclusion is that such extensions to the African city suggest a capacity to act in concert - a capacity that cannot be framed in any analytical language.
