4. Assessing Discrimination in Correspondence Studies

Abstract

Correspondence studies are popular tools for assessing discrimination against minorities, for example, in the labor market. Typically, two fake "Curriculum Vitae" (CVs) are sent to multiple job openings. The CVs are equivalent except for a mark identifying the disadvantaged. While it is straightforward to establish discrimination from minorities' lower response rates, it is often unclear what its source may be. Discrimination may result as much from employers' aversion toward a minority, as from perceptions that members have lower or more dispersed abilities that are unstandardizable in a CV. We refine existing methodologies to propose a wider-scope method capable of disentangling these three sources of discrimination and establish its face validity applying it to a correspondence study aimed at assessing labor market discrimination against ex-convicts in a local market.

Abstract

Labour market discrimination against individuals with criminal records may be unfair, ineffective and counterproductive. This article describes a field experiment designed to indicate whether job applicants disclosing a criminal record in the British labour market have a lower probability of success than equivalent applicants not disclosing criminal records. The research also provides insights into the potential effects of introducing a Ban-The-Box (BTB) policy in the United Kingdom, which would prohibit questions on prior convictions in the first stages of the recruitment process. The results confirm the existence of criminal record discrimination and suggest that introducing a BTB policy would increase job prospects for White applicants with criminal records, but not for members of ethnic minorities. Abstract

In this article, we highlight the existence and expansion of so-called 'collateral consequences' (CCs) of criminal records in Europe to challenge the prevalent view that these are features of the claimed 'American exceptionalism' within the penal field. First, we consider how CCs have been widely presented as a quintessential example of American penal exceptionalism within extant scholarship before problematising the adoption of such a framework from a European perspective. Second, we demystify the issue of CCs within Europe by highlighting the deleterious effects which CCs have on the lives of European people with a criminal record. Third, we consider precisely what can be regarded as 'exceptional' about CCs in the United States as compared to Europe by analysing key areas of possible differentiation. We conclude by cautioning against the view that European penality is necessarily – and always homogeneously and consistently – 'progressive' in relation to its treatment of criminal records and criminal record subjects. We also suggest that far greater attention and vigilance is required from criminologists and criminal justice scholars regarding the expansion and operation of CCs in Europe. [ABSTRACT FROM AUTHOR]

Abstract

The use of criminal background checks (CBCs) – requests for information on previous convictions during the employment recruitment process – is growing worldwide. This article seeks to explain the proliferation in CBCs by examining whether novel legislation introducing mandatory requests for some jobs also leads to an increase in requests for CBCs for jobs outside the scope of the law. The present research makes use of survey data collected from individuals requesting criminal records certificates before and after the introduction of new CBC regulation in Spain – EU Directive 93/2011/EU – which established the obligation to request a criminal record certificate covering sexual crimes for jobs involving frequent contact with children. The analysis detects only a small and unsustained growth in non-mandatory checks following introduction of the new law. However, the results suggest that the danger of the new legislation lies in employers requesting certificates with a higher level of disclosure than is required for the positions on which checks were made mandatory by the new law. In addition, the growth in non-mandatory CBCs observed during this period seems to be related not to the new legislation but to the emergence of tech companies, raising alarm regarding the role of novel forms of policy mobility and the new collaborative economy in limiting the re-entry of individuals with criminal records to the labour market. Abstract

Objectives: This study examines whether former police officers are stigmatized in the labor market, particularly following social unrest from lethal police violence. Methods: We conduct an experimental audit study, both before and after heightened unrest from police violence. For service-related job openings, we compare the likelihood of getting an affirmative response from a prospective employer to a job application from a fictitious former police officer (the treatment condition) to the response to one of two control conditions: a former firefighter or a former code enforcement officer. Results: We do not find evidence that former police officers are discriminated against in the labor market. This finding holds in periods characterized by relatively little social unrest due to police violence as well as periods of heightened protest activity. Conclusions: At least with respect to the labor market for certain service-related professions, former police officers do not appear tainted by any stigma associated with their prior profession. This study uses an experimental audit design, implemented both before and during the heightened unrest following the murder of George Floyd, to gauge the impact of Black Lives Matter and associated protests against police brutality and anti-Black racism on racially disparate hiring practices. We contrast treatment of fictitious Black and White job applicants in the labor market for service-related job openings, specifically applicants with prior experience as a police officer, firefighter, or code enforcement officer. Results reveal that the White advantage in employer call-backs and requests for an interview receded during the protests and unrest following the killing of George Floyd, even to the point of producing a Black advantage. Abstract

This article aims at analysing the differences between European countries in the obstacles ex-offenders face due to having a criminal record. First, a comparative analytical framework is introduced that takes into account all the different elements that can lead to exclusion from the labour market by the dissemination of criminal record information. This model brings together social norms (macro level), social actors (meso level) and individual choices (micro level) in the same framework. Secondly, this model is used to compare the different impact of having a criminal record in Spain and the Netherlands. This comparison highlights three important findings: (1) the difference between norms of transparency/privacy and inclusive/exclusive ideals, (2) the significant role of social control agents, such as probation agencies and the ex-offenders' social network, in shaping the opportunities that they have, and (3) self-exclusion seems to be a key mechanism for understanding unsuccessful re-entry into the labour market.
