The set of papers presented and introduced here reflects the dialogue established between three closely related concepts (vulnerability, care and rights) at the workshop of the same title held online in 2020. Starting from an understanding of vulnerability as a cross-cutting and universal phenomenon, several of the papers reflect on the very nature of the concept and from the point of view of the role of the state and the law in addressing the negative effects of vulnerability. Along with vulnerability, the other axis of the papers is that of care, both in its ethical and political dimensions and from a gender perspective. All of this from an Iberian perspective (related to the constitutional treatment and some legal aspects in Spain and Portugal), but which also encompasses the European perspective, and, in a broader sense, that related to human rights.

Care is an essential element in the development of social life. However, it is rather an invisible reality. The public debate about who and how should care - the family, the State, the market - is a crucial issue because the current model generates great inequalities. In addition, the gender imbalance marks all this discussion as care is socially attributed to women. Therefore, it is appropriate to approach care from a horizon of democratization of care policies in a rights-based perspective. In this context, the discussion about the articulation of a (human) right to care is especially relevant from the defense of the indivisibility and interdependency between political, civil, and social rights. This work aims, more than a technical or dogmatic analysis, to reflect in a general way about care policies and the construction of a more inclusive citizenship around this central issue for democracy and social development.

En este artículo, en homenaje a la figura del Catedrático de Filosofía del Derecho y Sociología Jurídica Manuel Calvo Garcia de la Universidad de Zaragoza, se realizan algunos apuntes y consideraciones acerca de su contribución a la introducción y consolidación de la sociología jurídica en España. En primer lugar, se señalan algunos aspectos destacados acerca de sus aportaciones teóricas sobre la naturaleza y el papel de la sociología jurídica en el estudio y análisis del derecho como fenómeno social. Después, se describen algunas de sus contribuciones en el campo desde dos espacios institucionales y académicos: el Instituto Internacional de Sociología Jurídica de Oñati y el Laboratorio de Sociología Jurídica de la Universidad de Zaragoza. Finalmente, se analizan algunos aspectos de su trabajo, tanto desde el punto de vista teórico como empírico, en relación con la violencia de género, que ejemplifican su concepción de una sociología jurídica crítica y transformadora.

Gender-based violence affects all kinds of women, including the older. In these cases two determining characteristics intersect: gender and age, which usually means greater vulnerability for the victims. In this paper both the benefits of a look at the issue from the paradigm of intersectionality and the need of an autonomous theoretical construction of the issue are discussed. The issue of gender violence against older women has characteristics of its own even it´s still connected to forms of violence like gender violence, as a broad category, or family elder abuse. Some public policies from the perspective of intersectionality are also analyzed. La violencia de género afecta a todo tipo de mujeres, incluidas las mujeres de edad avanzada. En esos casos interseccionan dos características determinantes: el género y la edad, lo que implica generalmente una mayor vulnerabilidad de las víctimas. Se analizan en este texto tanto los beneficios de una mirada al problema desde el paradigma de la interseccionalidad como la necesidad de una construcción teórica autónoma de este fenómeno con dinámicas y características propias aunque conectado con formas de violencia como la violencia de género, como categoría más amplia, o la violencia familiar contra las personas mayores. Son también abordadas en este texto algunas iniciativas desde la perspectiva de la interseccionalidad entendida en su dimensión de inspiradora de políticas y actuaciones públicas. En este texto proponemos una guía de lectura, a partir de la Victimología, de la película «El manantial de la doncella» (Jungfrukällan, 1960) dirigida por Ingmar Bergman. Se analizan, en primer lugar, las características de la obra que la convierten en un material docente óptimo para la enseñanza universitaria de la Victimología. En segundo lugar se realiza una síntesis crítica de la emergencia de la victimología como disciplina científica y del proceso de redescubrimiento de las víctimas en el Derecho penal y la justicia criminal analizando algunas de sus paradojas y contradicciones. En tercer y último lugar se aborda el análisis concreto de algunos temas presentes o sugeridos por la película en una lectura en clave victimológica conectándolos con tres emociones: la compasión, el deseo de venganza y el sentimiento de pérdida.

The intervention with children exposed to domestic inter-parental violence has changed in the last years. Nowadays, these children are perceived as victims needing a comprehensive social intervention, not only when they are direct victims of this violence, but also when they witness or are exposed to it. This change also reflects on Criminal Justice. In this paper, the main elements of the legal and theoretical framework reflecting those changes are analyzed in the Spanish context. At the same time, the main characteristics of the intervention model designed in the Comunidad Autónoma of Aragon (Spain) are exposed. Finally, a discussion follows based on the conclusions of the research by the Laboratory of the Sociology of Law (Universidad of Zaragoza), in collaboration with the Instituto Aragonés de la Mujer (IAM) about the response to this problem in Aragon (Spain).

Non-alcoholic fatty liver disease (NAFLD) is the hepatic manifestation of the metabolic syndrome. Most morbidity associated with the metabolic syndrome is related to vascular complications, in which endothelial dysfunction is a major pathogenic factor. However, whether NAFLD is associated with endothelial dysfunction within the hepatic vasculature is unknown. The aims of this study were to explore, in a model of diet-induced overweight that expresses most features of the metabolic syndrome, whether early NAFLD is associated with liver endothelial dysfunction. Wistar Kyoto rats were fed a cafeteria diet (CafD; 65% of fat, mostly saturated) or a control diet (CD) for 1 month. CafD rats developed features of the metabolic syndrome (overweight, arterial hypertension, hypertryglyceridemia, hyperglucemia and insulin resistance) and liver steatosis without inflammation or fibrosis. CafD rats had a significantly higher in vivo hepatic vascular resistance than CD. In liver perfusion livers from CafD rats had an increased portal perfusion pressure and decreased endothelium-dependent vasodilation. This was associated with a decreased Akt-dependent eNOS phosphorylation and NOS activity. In summary, we demonstrate in a rat model of the metabolic syndrome that shows features of NAFLD, that liver endothelial dysfunction occurs before the development of fibrosis or inflammation.

El presente trabajo tiene como objetivo contribuir a delimitar los contornos del maltrato hacia las personas mayores en el ámbito familiar una realidad caracterizada por su complejidad. Nos ocuparemos de algunas cuestiones en relación con la definición del fenómeno. Después hablaremos de los elementos esenciales del problema incluidos en su definición que nos ayuden a delimitar las difusas fronteras entre el maltrato familiar hacia los mayores con otras formas de violencia intrafamiliar. Por último planteamos una visión crítica del marco teórico sobre el fenómeno. Con este trabajo pretendemos aportar elementos a la discusión que nos permitan comprender mejor a qué nos referimos cuando hablamos de maltrato familiar contra las personas mayores y nos ayuden a diseñar respuestas eficaces. This paper’s aim is to help to delimitate the borders of elder abuse in the family, a very complex issue. We’ll raise some aspects around the definition. Then we’ll talk about the definition key elements that help us to fix the blurred line between elder abuse and other kinds of family violence. Finally we present a critical view of the theoretical framework. The goal of the paper is to provide elements to the discussion that allow us to better understand what we mean when we talk about elder abuse in the family and that help us to design efficient answers. OBJECTIVE: The transcription factor Kruppel-like factor 2 (KLF2) modulates the expression of multiple endothelial vasoprotective genes. In the absence of KLF2, the endothelial phenotype becomes dysfunctional. To date, blood-derived shear stress is the main physiological stimulus identified to trigger and sustain endothelial KLF2 expression. Portal hypertension is a common complication of cirrhosis. Sinusoidal distortion and endothelial dysfunction play a significant role in its pathogenesis. This study aimed to assess whether abnormal intrahepatic haemodynamics in cirrhosis could modify KLF2 expression and consequently its downstream transcriptional programmes. DESIGN: Rats received carbon tetrachloride or vehicle for two (acute injury), six (early cirrhosis) and twelve weeks (advanced cirrhosis). Systemic and hepatic haemodynamic parameters were measured in vivo. Hepatic expression of KLF2 and its vasoprotective targets were determined. Additionally, KLF2 expression was determined in liver sections, in freshly-isolated hepatic endothelial cells, and in livers from simvastatin-treated cirrhotic animals. RESULTS: Cirrhotic livers have increased endothelial KLF2 expression compared with controls. KLF2 elevation, observed at six weeks of cirrhosis induction, was accompanied by a parallel increase in portal pressure and an increase in the expression of its target genes eNOS, thrombomodulin and CNP. Simvastatin administration further increased hepatic KLF2 and target genes expression. CONCLUSIONS: This study shows an increase in the expression of the vasoprotective transcription factor KLF2 in the cirrhotic liver, accompanied by an activation of its downstream transcriptional programmes. These data suggest that the marked increase in KLF2 expression may represent an endothelial compensatory mechanism to improve the ongoing vascular dysfunction in the cirrhotic liver. Si la universidad ha de ser la “más clara conciencia de la época” —como en uno de sus trabajos acotaba Medina Echavarría28 — tendrá por fuerza que ser ella misma una parte de la inteligencia y compartir sus responsabilidades. Su misión será por consiguiente la de orientar en situaciones de crisis y comprometerse con la búsqueda de salidas que permitan superarlas. “La más alta entre ‘peculiares’ creaciones de occidente, la universidad, nació en cuanto ‘institucionalización de la inteligencia”’, (154) añadía Medina poniendo el acento en la estrecha vinculación existente —desde sus orígenes mismos— entre la universidad occidental y la inteligencia. Es precisamente esta particular relación —su índole y variaciones históricas— lo que se explora someramente en las notas que siguen, que no tienen otra pretensión que la de aportar elementos para una discusión. Si se acepta en algún grado la idea de Toynbee —tan gráficamente expresada con sus metáforas— de que los momentos de cambio son como “ríos revueltos” en que el proceso histórico va dejando “cabos sueltos”, y que para que haya una “salida” éstos deben ser anudados en torno a algún nuevo principio organizador capaz de servir de núcleo y cemento de una nueva fase histórica. Se advierte que en ella está implícita la importancia de la función intelectual en la resolución de estas crisis objetivas. Con Medina se podría agregar que la búsqueda de una salida constituye la responsabilidad primigenia de la inteligencia como razón histórica.
