This article is a first partial research product within the project Analysis of new trends in Contemporary Tort Law. It includes preliminary discussions related to the concept, types and legal significance of the category genetic damages. A general objective for this first phase of the research is to identify, analyze and assess how the expression genetic damages has been defined or described, as well as other equivalent concepts. It also intends to determine the principal problems to solve in order to clearly determine its legal meaning and limits. The main conclusion is related to the ambiguous meaning and various limitations imposed to the concept genetic damages and the existence of different forms of it that will demanding also different legal regulation, requiring the revision of significant legal structures. The article discusses the U.S. Genetic Information Nondiscrimination Act of 2008 (GINA). GINA aims to protect patient privacy and confidentiality while preventing discrimination against individuals based upon their genetic conditions. GINA's primary focus is the prevention of discrimination related to health insurance status and employment.

The article reports that France's regulatory Biomedicine Agency has called for government guidance for passing on genetic information to relatives of patients diagnosed with a serious genetic abnormalities. The regulatory agency, the 2004 Bioethics Act, presented evidence to an inquiry from the French health minister Roselyne Bachelot-Narquin. Patient confidentiality and public welfare are addressed.
