Este trabajo, a través del método deductivo, explora la relevancia de la aprehensión constitucional del asilo político como mecanismo de protección de los derechos humanos, examinando la interacción jurisprudencial y casuística internacional en conflictos entre estados relacionados con el asilo político, como los casos de Haya de la Torre, Alan García, la embajada de Colombia y el incidente de Evo Morales. Además, se busca aclarar los criterios para la utilización de mecanismos internacionales según la doctrina constitucional, la regulación del asilo político y los factores internos que influyen en esta cuestión, generando un replanteamiento de las ideas predominantes en la doctrina contemporánea debido a las opiniones divergentes en la academia y la persistente subjetividad en la definición de persecución política.

Este artículo indaga sobre los ataques a la política de asilo en El Heraldo de México por parte de un grupo de periodistas que expresaban opiniones conservadoras. Se pretende saber ¿cómo funcionaba el rechazo a los asilados políticos en la prensa de los años setenta en la Ciudad de México, para el periodo echeverrista que por un lado reprimía y, por el otro, brindaba ese tipo de protección? Esto aportaría un mayor conocimiento sobre la coerción mexicana que daba matices al asilo político, es decir, ese rechazo de algunos grupos que acompañaba a la política humanitaria en este país. Dicho de otro modo, si bien los conosureños fueron aceptados oficialmente, no estaban libres de la virulencia de la represión realizada desde el Estado a todo aquel que disintiera con los designios oficiales.

Con el propósito de analizar la regulación normativa respecto a las figuras del asilo político y la extradición en Ecuador en la última década, se realizó el presente estudio, abordando sus conceptos, la normativa nacional e internacional y su trascendencia, puntualizando en los conflictos entre ambas figuras jurídicas. Se ha utilizado un diseño metodológico transversal no experimental, el cual permitió evaluar la justificación aplicada hacia los asilos políticos otorgados a exfuncionarios públicos, lo cuales enfrentan procesos de extradición por diversos actos ilícitos, juzgados por la justicia ordinaria. Se trata el tema por la notoria falta de mecanismos ante el conflicto que se suscita entre ambas instituciones jurídicas. Los acusados y sentenciados se amparan bajo el asilo para no regresar al país de origen y evitar sus condenas. En ese sentido, por también se ha estudiado las causas por las cuales estas situaciones ocurren, para así evaluar las alternativas que optimicen el marco jurídico actual en cuanto a esta problemática.

En este artículo se documentan dos casos peculiares de asilo político concedido en situaciones excepcionales por el gobierno de México a brasileños perseguidos por el régimen militar. En el primer caso, el gobierno de Gustavo Díaz Ordaz asiló, entre septiembre de 1969 y marzo de 1970, a una veintena de presos políticos cuya liberación y envío inmediato al exilio fue forzado por organizaciones revolucionarias en Brasil a cambio de liberar a dos funcionarios diplomáticos, de Estados Unidos y de Japón, que habían sido previamente secuestrados por ellas. El segundo caso se dio en 1973, cuando en el contexto del golpe de estado que derrocó al gobierno de Salvador Allende en Chile y de la gran solidaridad que el gobierno de México ofreció al pueblo chileno, se concedió asilo diplomático a un grupo de 43 brasileños que fueron perseguidos en ese país, pero una vez en México se les negó el asilo territorial, obligándolos a buscar otro país de asilo. Se trata de casos sui generis de asilo político, pues se dieron en situaciones que no se habían registrado antes con ninguna otra comunidad de exiliados y, por lo tanto, resultan ilustrativas y reveladoras de las variaciones que se dieron en la aplicación de la política de asilo en México, particularmente durante la segunda mitad del siglo XX.

La guerra de Siria ha aumentado en casi 6 millones el número de refugiados en el mundo (UNHCR), a la vez que ha sacudido la adormecida conciencia de los europeos recordándonos que tales fenómenos no nos son tan ajenos, ni nos quedan tan lejos como quisiéramos. Dos entrevistas a refugiados sirios, de posiciones encontradas respecto a Bashar, bastan para dejar patente que la guerra afecta a todos por igual pero que sus albores se fraguan en la segregación y la instrumentalización de lo humano. “Si esto es un hombre” se abría con una exhortación, o acaso un desafío a nuestra indiferencia y pasividad cuyo testigo parecen haber recogido los refugiados de hoy. Tal vez sean ellos los que han venido a salvarnos.

L’accesso alla casa in Italia è particolarmente complicato per chi “parte da zero”, come i giovani e gli immigrati, a maggior ragione se presenti da poco nel paese come i richiedenti asilo e titolari di protezione internazionale in uscita dai progetti di prima e seconda accoglienza nel sistema SPRAR o dai CAS. Il sistema abitativo italiano è infatti caratterizzato da un alto tasso di abitazioni in proprietà, una bassa quota di edilizia pubblica, un basso livello di protezione sociale nel mercato in affitto, un importante ruolo della famiglia nella produzione e riproduzione sociale dell’accesso alla casa. Tutte caratteristiche che – unite all’esistenza di discriminazioni nel mercato abitativo - rappresentano un fattore di esclusione per chi non ha una famiglia da cui ereditare l’accesso alla casa o non ha reddito sufficiente, o sufficientemente stabile, per poter accedere a un mutuo o pagare un affitto dando le garanzie richieste. Dopo aver approfondito questo quadro di sfondo, il paper presenta alcune iniziative promosse e gestite da enti pubblici e/o enti del terzo settore per facilitare l’autonomia abitativa di richiedenti asilo e titolari di protezione internazionale in Italia: accoglienza in famiglia, cohousing e altre iniziative di housing sociale. Vengono poi presentate nelle conclusioni alcuni possibili insegnamenti che si possono trarre dall’analisi di queste iniziative.

Casi ningún lugar del mundo ha sido ajeno al desplazamiento forzado por distintos motivos en algún momento de su historia.Los latinoamericanos, particularmente, somos dueños y dueñas de una historia reciente de desplazamiento forzado.Sin embargo el 2009 encuentra al sur de Sudamérica como un espacio humanitario de solidaridad con el resto del mundo y de respeto por los derechos humanos para todas las personas que lo habitan.Sin lugar a dudas hoy Uruguay y la mayoría de los países vecinos están comprometidos con el respeto de los derechos de las personas refugiadas, de las personas que huyen de una persecución internacional, quizás de una manera única a nivel global,

Nel corso della Seconda Guerra Mondiale, la Confederazione elvetica si trova posta di fronte a un crescente afflusso di rifugiati civili e militari che cercano asilo all’interno delle sue frontiere. Durante il conflitto, complessivamente 300.000 persone – in gran parte francesi, polacchi e italiani – vengono internate nei campi gestiti dall’esercito.

La migración internacional se entiende, generalmente, por las dinámicas de otredad cultural, en las que el país de origen representa un “retraso” en términos de democratización de roles e identidades de género y de las orientaciones sexuales. Este artículo intenta visibilizar estas dinámicas, a partir del análisis de los procesos de migración desde México a los Estados Unidos de hombres que tienen sexo con otros hombres. Siguiendo el trabajo de Lionel Cantú, quien muestra cómo se intenta reproducir una diferencia cultural en los procesos legales de la solicitud del asilo político, se explora el proceso de construcción de una representación de género opuesta entre ambas naciones. Este argumento ofrece una visión alternativa de las articulaciones entre género, nación y ciencia como ejes de la creación de dicha diferencia, donde la sexualidad aparece como un terreno de debate contemporáneo.

This paper addresses the asylum as a central affair of international law. The objective is to analyze the discursive dimension that contains this legal institution from two central elements: at) the exhortation to get approval of the reader, and b) the will of rectify the order of events. For this end, it points the main currents out that integrate the discourse of Political Asylum, emphasizing the techniques and strategies most used by legal literature. Ifedinma Dimbo was born in Nkwelle-Ezunaka, in the Igbo-speaking region of eastern Nigeria. She studied Sociology and Anthropology at the University of Nigeria Nsukka. She first went to Ireland as a graduate student in 1995 to obtain an MA in Sociology of Development from University College Cork, and during that period in Ireland her son was born. They went back to Nigeria in 1998, but the Dimbo family decided to return to Ireland in 2002, thinking that being parents of an Irishborn child gave both Ifedinma and her husband residency rights. However, they had to experience the Irish Direct Provision system first-hand while they maintained a legal battle with immigration for three years. It was during her experience as an asylum seeker that she had her literary calling. One of her stories appeared in the 2008 publication Takinga the Wise Man, a book published by SPIRASI, an Irish organization set up by the Congregation of the Holy Spirit that works with asylum seekers, refugees and other disadvantaged migrant groups, with special concern for survivors of torture. In 2010, her short story "Grafton Street of Dublin" appeared in the Irish Writers Exchange's compilation titled Dublin: Ten Journeys, One Destination. This anthology includes ten short stories, the common factor of which is that they revolve around the city of Dublin and they are written by writers who live in Ireland. Some of the authors are Irish-born, like the critically acclaimed writer Nuala ní Chonchúir, while others were born in places as diverse as Sweden, Germany, the US or, as in the present case, Nigeria. In her short story, Dimbo tackles the issue of deprivation while in Direct Provision, with a walk through one of the most commercial streets in Dublin, Grafton Street, as seen through the eyes of a Nigerian female asylum seeker who has to live on the institutionally granted allowance of 19.10 euros per week. In 2012, the Irish Writers Exchange published Ifedinma Dimbo's first novel, She Was Foolish? Once again, the protagonist, named Gift, is a Nigerian woman who seeks asylum in Ireland. However, the length of the novel allows the author to delve in Gift's past and how she got to her current situation as an asylum seeker, including an abusive partner who led her to become a prostitute in Italy, all of which takes its toll in the protagonist's emotional and psychological well-being. Ifedinma Dimbo currently lives in Dublin, where she works and researches for her PhD in Medical Sociology. The Nigerian-born, Irishbased writer was kind enough to answer my questions via e-mail between the months of August and October 2014, with some final elaboration in January 2015. Ifedinma Dimbo's writing, as well as her answers in this interview, are an invaluable testimony to a reality that is currently taking place in Ireland and has often been silenced. Now that Irish society is beginning to be aware of the unfair treatment that refugees and asylum seekers receive at the hands of the Irish system, it is high time to let people who, like Ifedinma Dimbo, have made Ireland their home, have their voices heard in the field of Irish Studies. In this article you find a study about the historical precedence of the political crimes with relation to the peace in the framework of the Colombian Constitution (1991). The article is structured mainly in four aspects: first you find a part that makes a historical summary of political crime in the history of the Colombian constitutions. Later referred to peace as a right in the process of creating of the Constitution in force (1991). Then you find an analysis of the articles about a special treatment for political crimes. In this article you will find a study about political crime as a classic in the field of criminal law. The article is structured mainly in two aspects. On the hand you will find a reflection on the general theoretical aspects of political crimes. On the other hand, there is a review of comparative political crimes in the legal system of both Colombia and Germany. In this respect, the article is divided into three sections. First, it presents a brief history on the genesis of political crime. The second part deals with general concepts to clarify and outline the various theories of political crime, especially the theory of politically motivated criminal. Finally, a normative comparison is made between political crimes in the Colombian penal code and the German StGB. Based on recent and different work experiences combined with the memories of Uruguayans who sought asylum in the Mexican Embassy, as well as other sources, this article addresses new facets of analysis regarding content and methodology. Starting from a study prepared by the authors, dedicated to enhancing the memory elaboration and reprocessing carried out by those involved in the diplomatic asylum related to Mexican Ambassador Vicente Muñiz Arroyo, a new analytical approach is attempted 30 years after the testimonial facts in order to recover the different aspects of this man's personality who had a leading role in one of the major expressions of protection granted by using interamerican instruments of asylum. He is studied from different angles: the memory of the refugees he afforded asylum to, his extended family environment and the municipality of Michoacan (Churintzio) where he was born; and some methodological novelties are incorporated to our study of diplomatic asylum, like resorting to free memory within groups through workshops or collective interviews. We confronted the results obtained with the memory recorded through semi structured questionnaires individually applied, and incorporated new social subjects to the memory content: second generation, family and group memory in the local cultural context alien to the central role of the objective of our study. The experience allowed us to recover the personage as a memory and identity backbone and verify that the conflict had displaced from the political arena to the memory of an entire generation. La finalidad del artículo es demostrar las grandes dificultades que originan los refugiados políticos y sus actividades revolucionarias, así como la constitución de "Gobiernos en el exilio". Estas dificultades las han conocido muchos países a raíz de la Segunda Guerra Mundial. En los Estados Unidos, estas dificultades son, tal vez, mayores debido a las muy amplias libertades que garantiza la Constitución de ese país y a las dificultades de conciliarlas con disposiciones del Derecho Internacional y los Tratados. En el caso de Cuba, Estados Unidos, como la mayor parte de las naciones del mundo occidental, no verían, sin duda, con desagrado un cambio del régimen cubano debido a sus ya conocidas tendencias comunistas y a los abusos cometidos contra la vida y la dignidad del hombre. De allí la tolerancia -justificada, además por el carácter de defensa propia del Estado- de que se benefician esos refugiados. El autor estima que dicha tolerancia puede, sin embargo, llegar a crear serias dificultades y que le corresponde al Derecho Internacional y a las Naciones Unidas intervenir para evitar tales conflictos que, como lo hace notar, comienzan generalmente, en pequeñas naciones para extenderse al Mundo entero.
