Abstract

Tarihin bütün dönemlerinde ve bütün medeniyetlerde insanlar, daha güvenli ve huzurlu olacağı ideal bir yaşam biçimini arzulamış ve bunun ancak adil bir yönetimle mümkün olacağını düşünmüştür. Fakat bu adil yönetim şeklinin ne olduğu ve nasıl uygulanacağı hususunda bir ittifak sağlanamamış, herkes kendi inanç, mizaç ve kültürünün etkisi ile çeşitli yöntemler önermişlerdir. Arzu edilen bu ideal yaşam biçimini gerçekleştirmek ve adil bir düzeni sağlamak üzere dinler ve hukuk sistemleri belli düzenlemeler getirmişlerdir. Getirilen bu düzenlemeler, insanların haklarını koruduğu ve onlardan zararı giderdiği oranda adil kabul edilmiş ve toplum tarafından memnuniyetle karşılanmıştır. Adalet konusu tarih boyunca hukuk felsefesi alanında daima canlılığını korumuş ve adeta insanlara yol gösteren bir kutup yıldızı olmuştur. Biz de bu çalışmamızda bir makalede ele alınacak boyutta Kur’an’da adalet mefhumunun ne olduğunu ve adaletin en somut uygulama sahası olan İslam muhakeme hukukunda adil yargılama usulünün nasıl işlediğini göstermeyi amaçlamaktayız. Böylece İslam hukukunun ilk kaynağı olan Kur’an’ın, adaletin tesisine yönelik prensiplerinin ve adil yargılama bağlamında İslam muhakeme usulünde adaleti temine yönelik ilkelerin neler olduğunu ifade etmiş olacağız.

Abstract

Este trabajo corresponde al estudio de investigación realizado por un periodo de 7 años, en el que se analiza el postulado del principio constitucional “orden justo”, aplicado en las relaciones que se supeditan entre el Estado y los particulares, principalmente en los contratos que se orientan por el régimen de la Ley 80 de 1.993. Bajo este entendido, se realiza un estudio desde el derecho constitucional, desde el derecho administrativo y en este; se abarca la selección objetiva para determinar la forma como el Estado puede alcanzar un orden justo a partir de la aplicación de procesos de selección de contratistas regulados por la Ley 80 de 1993 y la Ley 1150 de 2007. Señalando como fundamental la existencia de una responsabilidad del Estado, de tipo extracontractual bajo la protección del principio neminen laedere en aquellos casos en los cuales se transgreda la selección objetiva en desarrollo de una selección de contratistas. Bajo este contexto, la Tesis Doctoral sustenta las preguntas de investigación y con ello, la demostración de la hipótesis a partir del estudio de 20 procesos de contratación adelantados por diferentes entidades del Estado, a partir de los cuales se crea un Test de cumplimiento de reglas derivadas de la selección objetiva para determinar si un proceso de selección de contratitas permite el cumplimiento del orden justo que como mandato constitucional debe ser acatado por las autoridades administrativas competentes. This work corresponds to a research study carried out over a period of 7 years, in which the postulate of the constitutional principle "just order" is analyzed, applied in the relations that are subordinated between the State and individuals, mainly in the contracts that are guided by the regime of Law 80 of 1993. Under this understanding, a study is carried out from constitutional law, from administrative law and in this; Objective selection is covered to determine the way in which the State can achieve a just order from the application of contractor selection processes regulated by Law 80 of 1993 and Law 1150 of 2007. Noting as fundamental the existence of a responsibility of the State, of a non-contractual nature under the protection of the neminen laedere principle in those cases in which the objective selection in development of a selection of contractors is violated. Under this context, the Doctoral Thesis supports the research questions and with it, the demonstration of the hypothesis from the study of 20 hiring processes carried out by different State entities, from which a test of compliance with the rules is created derived from the objective selection to determine if a contractor selection process allows compliance with the just order that, as a constitutional mandate, must be followed by the competent administrative authorities.
