- Abstract
The background of the problem in this research is the tivona Golbal Indonesia company which applies a detention system for workers' original certificates for workers who apply for jobs at their company, either with the return time of the original certificates determined or not determined by the employer. . The main problem in the research is how is the implementation of diploma deposit as work guarantee in a certain time work agreement at PT. Tivona Global Indonesia and how is the legal protection of diploma deposit as work guarantee in a certain time work agreement at PT. Tivona Global Indonesia. The research method used is a type of observational research, namely research that observes and describes things that occur, both social and natural phenomena, within a certain time span, and researchers cannot control these phenomena. In obtaining data, the authors used data collection methods in the form of interviews, questionnaires and documentation. The results of the study that the implementation of the safekeeping of diplomas as job security in a certain time work agreement at PT. Tivona Global Indonesia basically does not have a law that explicitly regulates the right for employers/employers to keep their workers' original diplomas. However, in the implementation of the safekeeping of the workers' original diplomas, it is carried out with an agreement with the workers at the stage of signing the contract, the purpose of the company holding the diplomas is for the workers to obey the rules and the agreed term of the work agreement. And legal protection for the deposit of diplomas as work guarantees in a certain time work agreement at PT. Tivona Global Indonesia. The Civil Code and Law Number 13 of 2003 concerning Manpower do not regulate whether or not companies may hold employees' securities, such as diplomas.
