From the analysis of the historical timeline of mediation in Brazil, it appears that the practice of the institute does not follow the legislative evolution. This evolution, in turn, still remains, in a way, in the ideological field, with little effectiveness in the application of the norms that deal with mediation. Despite the commendable concern of public policies to encourage the practice of mediation and other consensual means of conflict resolution, the initiative lacks investment, whether in the improvement of civil servants assigned to sectors that promote judicial or pre-procedural mediation, or in the amendment of labor legislation to provide for the suspension of proceedings for referral of the dispute to mediation, when this measure becomes appropriate. When it comes to labor mediation, it is important to emphasize the importance of its regulation, which still does not exist in Brazilian legislation, given the constant obstacles encountered in its practice due to the unavailability of labor rights, the hyposufficiency of the worker, the culture of litigation and of the belligerent actions of lawyers. Only with the systematic investiture of the disclosure of the mediation procedure and of the benefits resulting from self-determination, will it be possible to disseminate this practice. A philosophical approach to Hans Kelsen's fundamental concepts is able to clarify how the subsumption of these concepts in the context of mediation contributes to a better understanding of the essence and purpose of this medium, including within the scope of labor law and the labor process. job. Using the deductive method from the reading of doctrine and specific legislation, the objective is to propose ways to intensify the practice of mediation in the resolution of labor disputes in Brazil and make it effectively complicit in the constitutional right of access to justice and social peace. Da análise do cronograma histórico da mediação no Brasil se depreende que a prática do instituto não acompanha a evolução legislativa. Esta evolução, por sua vez, ainda permanece, de certa forma, no campo ideológico, pouco se encontrando de efetividade na aplicação das normas que tratam da mediação. Apesar da louvável preocupação das políticas públicas em incentivarem a prática da mediação e de outros meios consensuais de resolução de conflitos, a iniciativa carece de investimento, quer seja no aperfeiçoamento dos servidores lotados em setores que promovem a mediação judicial ou pré-processual, quer seja na alteração da legislação trabalhista para trazer previsão da suspensão de instância para encaminhamento do litígio à mediação, quando esta medida se fizer adequada. Em se tratando de mediação laboral, há de se ressaltar a importância da sua regulamentação, ainda inexistente na legislação brasileira, haja vista os constantes entraves encontrados para sua prática em razão da indisponibilidade de direitos trabalhistas, da hipossuficiência do trabalhador, da cultura do litígio e da atuação beligerante dos advogados. Somente com a investidura sistemática da divulgação do procedimento da mediação e dos benefícios decorrentes da autodeterminação, será possível disseminar esta prática. Uma abordagem filosófica a respeito dos conceitos fundamentais de Hans Kelsen é capaz de esclarecer de que forma a subsunção destes conceitos no âmbito da mediação contribui para o melhor entendimento acerca da essência e finalidade deste meio, inclusive no seio do direito do trabalho e do processo do trabalho. Utilizando o método dedutivo a partir da leitura da doutrina e da legislação específica se objetiva propor formas de intensificação da prática da mediação na resolução de conflitos laborais no Brasil e torná-la efetivamente cúmplice do direito constitucional de acesso à justiça e da paz social.

In this research, the socio-psychological dimensions of the phenomena such as haste, prejudice, stigmatization, and discrimination, which are very common in social life and disrupt social peace, were examined from the perspective of the Qur'an. In the research, the qualitative research method based on the literature on the subject was used and the data were obtained within the framework of text analysis. According to the data obtained as a result of the literature review, the absence of a study that examines the relationship of haste, prejudice, stigma and discrimination from the perspective of the Qur'an and examines it together with its socio-psychological dimension reveals the importance and originality of this research. To treat harmful behaviors such as haste, prejudice, stigmatization, and discrimination, which disrupt social peace, the Qur'an raises awareness that individual differences are manifestations of divine wisdom, young people, good thoughts, correct knowledge, judgment, patience, brotherhood, familiarity, and trust promotes tolerance and justice. Because organizing social life based on peace, brotherhood, unity and solidarity can only be possible possible by applying the moral principles envisaged by the Qur'an. In this research, a socio-psychological analysis of attitudes and behaviors that destroy social peace in the light of the universal messages of the Qur'an has been made, contributing to the literature and humanity, and an interdisciplinary perspective has been presented., Bu araştırmada toplumsal hayatta çok yaygın bir şekilde karşımıza çıkan ve sosyal barışı bozan acelecilik, ön yargı, damgalama ve ayrımcılık gibi olguların Kur'ân perspektifinde sosyo-psikolojik boyutu incelenmiştir. Araştırmada konuyla ilgili literatüre dayalı nitel araştırma yöntemi kullanılmış olup veriler, metin analizi çerçevesinde elde edilmiştir. Literatür taraması neticesinde ulaşılan verilere göre yerel alan yazınında acelecilik, ön yargı, damgalama ve ayrımcılık ilişkisini Kur’ân-î perspektiften ele alıp sosyo-psikolojik boyutuyla bir arada inceleyen bir araştırmanın mevcut olmaması bu araştırmanın önemini ve özgünlüğünü ortaya koymaktadır. Sosyal barışı bozan acelecilik, ön yargı, damgalama ve ayrımcılık gibi zararlı davranışları tedavi için Kur'ân-ı Kerim, bireysel farklılıkların ilahi hikmetin tecellisi olduğunun bilincini, teenni, hüsn-ü zan, doğru bilgi, muhakeme, sabır, kardeşlik, ünsiyet, güven, hoşgörü ve adâleti önermektedir. Zira sosyal hayatı barış, kardeşlik, birlik ve beraberlik esası üzere tanzim etmek ancak Kur’ân’ın öngördüğü ahlakî ilkeleri uygulamakla mümkündür. Bu araştırmada toplumsal barışı ifsat eden tutum ve davranışların Kur’ân’ın evrensel mesajları ışığında sosyo-psikolojik analizi yapılarak, literatüre ve insanlığa katkı sağlanmış, interdisipliner bir bakış açısı sunulmuştur.

Bu makalenin odak noktası, makro ekonomik bir bakışa açısıyla iktisadi düşünce tarihi boyunca geliştirilen iktisat teorilerini, bunları şekillendiren düşünürlerin toplumsal refahın ve barışın sağlanmasındaki rolünü ve bu süreçteki iktisadi gelişmeleri karşılaştırmalı bir analizle değerlendirmektir. Bu doğrultuda iktisadi düşünce ekollerinin ortaya çıkışı ve teorisyenlerin yaklaşımı değerlendirilmiştir. Böylece küreselleşen dünyada ve COVID 19 pandemisinin gölgesinde karşılaşılan ekonomik sorunlara çözüm bulunmasında bilim insanlarının ve araştırmacıların çalışmalarına katkı sağlamayı amaçlamaktadır. Bu bakımdan teorik düşünce ekollerinin nasıl ve hangi koşullar altında ortaya çıktığı bu çalışmada daha açık bir şekilde ortaya konmuştur. Bu bağlamda “klasik ekonomi”, “ulusal ekonomi” ve “küresel ekonomi” kavramları ve bu yaklaşımları geliştiren ve sınıflandıran iktisatçıların çıkış noktaları karşılaştırmalı bir analizle incelenmiştir. Klasik iktisat, ulusun teorik olarak ele alınmasının ve farklı ulusların ekonomik etkileşim yoluyla etkileşiminin başlangıcıdır. Adam Smith'in "Ulusların Zenginliği" genel olarak ekonomik teorinin kökenlerinin ve ekonomik eylem anlayışının bilimsel tartışması olarak anlaşılmaktadır. Adam Smith'ten sonra Ricardo, Marx ve Keynes gibi sosyal bilimciler bu alana önemli katkılarda bulunmuşlardır., The focus of this article is to evaluate the economic theories developed throughout the history of economic thought from a macroeconomic perspective, the role of the thinkers who shaped them in ensuring social welfare and peace, and the economic developments in this process with a comparative analysis. In this respect, the emergence of schools of economic thought and the approach of theorists have been evaluated. Thus, it aims to contribute to the work of scientists and researchers in finding solutions to the economic problems encountered in the globalizing world and in the shadow of the COVID 19 pandemic. In this respect, how and under which conditions the schools of theoretical thought emerged as a result of forcing it has been revealed more clearly in this study. In this context, the concepts of "classical economy", "national economy" and "global economy" and the starting points of the economists who developed and classified these approaches were examined with a comparative analysis. Classical economics is the beginning of the theoretical treatment of the nation and the interaction of different nations through economic interaction. Adam Smith's "The Wealth of Nations" is generally understood as the scientific discussion of the origins of economic theory and the understanding of economic action. After Adam Smith, social scientists such as Ricardo, Marx and Keynes made important contributions to this field.

Bu çalışmanın temel çıkış noktası “farklılıklar değerimizdir” kurgusunun nasıl ve hangi yollarla toplumun tamamına yayılacağı ve yönetim sistemimizin bu alanda etkili bir biçimde faaliyet gösterebilmesi için nasıl daha iyi bir şekil alması gerektiği sorunsalının tartışılması ihtiyacıdır. Bu sayede farklılıklar ayrışmanın bir unsuru değil, bütünleşmenin bir aracı haline dönüşebileceklerdir. Aynı zamanda farklılıkların iyi bir biçimde yönetilmesi sonucunda idealize edilen toplumsal huzur kurgusu sağlanmış olacaktır. Bu çalışmanın temel amacı bir ideal olarak görülen toplumsal farklılıkların yönetimi olgusunu “farklılıklar değerimizdir” kurgusu üzerinden yeniden tanımlamaktır. Bu amaçla çalışmada yabancı ve yerli literatür kullanılarak ve toplumsal huzurun sağlanması adına girişilen faaliyetler kapsamında toplumsal farklılıklar olgusu ve devlet ile sivil toplum kuruluşları üzerinden farklılıkların yok sayılmadan yönetilebilmesi için yapılması gerekenler vurgulanacaktır. The other point is about administration system. The administration system needs to operate effectively but there is a problem and it needs to be discussed how to take shape the administration system for operating it effectively. Thanks to this conception, the diversities will be able to transform a means of integration instead of being a component of disintegration. At the same time, as a result of governing the differences ably, idealized social peace will be provided. The main aim of this study is to redefine the phenomenon of managing of social diversities by using the fiction of “the diversities are our value” which seems to be perceived as an ideal. To that end, in this study, ensuring social peace within the scope of the activities which is undertaken on behalf of the phenomenon of managing of social diversities will be highlighted what have to be done to govern the diversities without ignoring by means of state and non-governmental organization. The expected outcome of this study is to highlight to find ways for living together in the context of state and non-governmental organization, population of Turkey in which lives together without ignoring the diversities of religion, different language which is spoken and different cultures in which lived in a geography such as Turkey, instead of being stereotyped the whole society, have to be accepted as a value.

Trata-se de uma pesquisa quali-quantitativa baseada em um estudo exploratório de caráter teórico com foco na construção social e ambiental do indivíduo. O objetivo geral que norteia a pesquisa é entender quais são as percepções que jovens do ensino médio de duas escolas públicas do estado de São Paulo e internos da Fundação Casa, em regime socioeducativo, têm a respeito do fenômeno violência e identificar uma possível influência desses fatores no processo de ensino-aprendizagem e nas próprias relações interpessoais entre professor e aluno. Participaram da pesquisa 79 jovens, na faixa etária entre 14 e 20 anos. Eles responderam a um questionário. Foram realizadas duas entrevistas com dois professores de matemática que atuam na área há mais de vinte anos a fim de entender como eles percebem e lidam com a questão da violência durante as aulas. E, uma entrevista com um representante da Secretaria de infraestrutura e Meio Ambiente do Estado de São Paulo que trouxe à tona a questão da violência ambiental para esta pesquisa. Na análise quantitativa foram utilizados gráficos de colunas e análises de diferentes categorias para cada variável abordada nos questionários aplicados. A análise qualitativa apoiou-se nas ideias teóricas do Prof. Dr. Ubiratan D`Ambrosio, no Programa Etnomatemático e na abordagem Transdisciplinar. Os resultados dessa análise indicaram: a violência como um fator que interfere no aprendizado dos alunos; a educação escolar como um fator que minimiza a violência; a importância da aplicação da Etnomatemática numa perspectiva de tolerância, respeito, diálogo e coletividade; a importância da educação matemática como um instrumento para a cultura da PAZ. Ao final do trabalho propõe-se uma Educação Matemática voltada para a PAZ. The research entitled: “Mathematics Education, Society and Environment: reflections on social and environmental violence. A transdisciplinary and critical study in an Ethnomathematics research” aims to promoting a reflection on social and environmental violence within the scope of Mathematics Education. It is a qualitative and quantitative research based on an theoretical exploratory study focusing on the social and environmental construction of the individual. The general goal of the research is to understand the perceptions that high school students from two public schools in the state of São Paulo and young inmates in a socio-educational measures of the Fundação Casa have of the phenomenon of violence and identify a possible influence of these factors on the teaching-learning process and on the interpersonal relationships between teacher and student. The participants were 79 young people, aged between 14 and 20 years old. They answered a questionary. Two interviews were carried out with two mathematics teachers who have been working in the area for more than twenty years in order to understand how they perceive and deal with the issue of violence during classes. An interview with a representative of the Secretaria de Infraestrutura e Meio Ambiente do Estado de São Paulo that brought up the issue of environmental violence for this research. In the quantitative analysis, it was used column charts and analyses of different categories for each variable addressed in the applied questionnaires. The qualitative analysis was supported by the theoretical ideas of Prof. Dr. Ubiratan D`Ambrosio, in the Ethnomathematics Program and in the Transdisciplinary approach. The results of this analysis indicated: violence as a factor that interferes in students' learning; school education as a factor that minimizes violence; the importance of applying Ethnomathematics in a perspective of tolerance, respect, dialogue and collectivity; the importance of mathematics education as an instrument for the culture of PEACE. At the end of the work, a Mathematics Education focused on PEACE is proposed.

O presente estudopropositivotrata sobre a instrumentação da Ouvidoria Pública da Universidade Federal do Tocantins no tratamento de conflitos interpessoais através de soluções pacíficas na relação professor/aluno no contexto da Universidade Federaldo Tocantins. O objetivo principal do trabalho foi analisar de que forma a atuação da Ouvidoria poderia contribuir com a concretização do direito à educação por meio de um novo arranjo e instrumentação institucionalcom vistas a dirimir conflitos interpessoais nas relações acadêmicas, com foco no contexto pedagógico. Neste sentido, a pesquisa realizada se propôs a apresentar uma proposta de criação e minuta de normatização de uma Câmara de Tratamento Consensual dos Conflitos, vinculada à Ouvidoria Pública da Universidade Federal do Tocantins,gerida pelo Ouvidor Geral,que possa atender a toda comunidade acadêmica, mas que foque suas ações no tratamento das questões relacionadas à relação de discentes e docentes, área mais afetada no contexto de conflitos, conforme veremos na investigação. A pesquisa foi realizada a partir da abordagem qualiquantitativa,através de análise documentaldos dados das manifestações realizadas pelos cidadãos na Ouvidoria Pública da UFT, no período de 2015 a2018, com foco nas que tinham como partes antagônicas professorese alunos. Foram utilizados também, para suportes no levantamento dos dados, informações dos Relatórios Anuais de Ouvidoria nos anos de 2015 a 2018, além de informações retiradas dos sites oficiais da Universidade Federal do Tocantins e plataforma “Resolveu?”do Governo Federal. Como forma de fundamentar nossa pesquisa, realizamos estudo pormenorizado do instituto das Ouvidorias Públicas, identificando historicamente o surgimento e explorandoem especial as inseridas nas Instituições Públicas de Ensino Superior no Brasil. Com alicerce na definição e estudo do conflito interpessoal e suas consequências, pudemos ainda, através da análise dos meios adequados de soluções pacíficas de conflitos, definir a utilizaçãoem casos de divergênciasda mediação e conciliação, conforme recomenda o novo Código de Defesa do Usuário do Serviço Público. The present propositional study deals on the instrument of the public ombudsman’s Office of the Federal University of Tocantins in the treatment of interpersonal conflicts through peaceful solutions in the professor/student relationship in the context of the Federal University of Tocantins. The main aim of this study was to analyze how the actions of the ombudsman might contribute to the implementation of the education right through a new arrangement and institutional instrument aiming to resolve the interpersonal conflicts in academic relationships, with a focus on the pedagogical context. The present research aimed to present a proposal for the establishment and standardization draft of a consensual conflict treatment chamber, connected to the public ombudsman’s Office of the Federal University of Tocantins. The chamber should be operated by the general ombudsman, which might attend to all the academic community, but with a particular focus on the treatment of the questions related to students and teachers, which represent the most affected areas by the conflicts, as the investigation will display. The research was performed with a qualitative and quantitative approach, by the document analysis of the statements data of the citizens in the public ombudsman’s Office of the UFT from 2015 to 2018. The analysis focused on the statements presenting an antagonism between professors and students. The pieces of information of the 2015-2018 annual reports of the ombudsman supported the data gathering. The study also analyzed the data from the official websites of the Federal University of Tocantins and the platform “Resolveu?”of the Federal Government. To substantiate our research, we performed a comprehensive study of the institution of the public ombudsman’s Offices, identifying its birth historically, and exploring in-depth the public ombudsman’s Offices inside the public institutions of higher education in Brazil. Through the analysis of the adequate media for theresolution of conflicts, we can define the definition of the use in case of divergence in the mediation and conciliation, as suggested by the new Public Service User defense Code, basing on the definition and study or the interpersonal conflict and its consequences.

MA (Ethics), North-West University, Potchefstroom Campus The Democratic Republic of Congo (DRC) is endowed with natural resources to the extent that it could be one of the richest countries in the world. Nonetheless, this country is one of the poorest (in the world) with more than 70% of its population living in abject poverty. Economists, political scientists and sociologists have all been puzzled by how a country that is so rich in resources can be so abysmally underdeveloped and conflict stricken. Is a scramble for the country’s resources to blame for the conflict; or are incipient inequalities and economic injustice the primary cause; or perhaps the two are related in some way? Slants such as “greed versus grievance” or “the paradox of plenty” have animated the literature and caught the public’s imagination. This study argues that the lack of ethics in this country is the reason why all attempts to stop the organized plunder of Congolese riches and to address the economic and political crises in order to alleviate the hopeless situation always fail. A thorough consideration of the country’s history reveals the depth of this problem. Christian ethics can lead to sustainable liberation of the entire Congolese society. As such, the Christian tradition and biblical revelation should be the primary source that is tapped during the process of building new Congolese citizenship and leadership. Christian principles aiming at peaceful living and working together remain the answer to sustainable salvation of people and the social transformation of this country. Masters

A família está inserida num ambiente de desigualdade, sendo utópico imaginar que esta não refletiria a realidade que a cerca, ou seja, a sociedade como um todo em que são comuns os conflitos. A pesquisa tem como objetivo principal reduzir a carga de jurisdição, com responsabilidade de pacificador, através de outras especialidades que tenham enfoque no cuidar, restabelecer equilíbrio psicológico das partes no intuito de reduzir os danos que um litígio sempre causa, buscando restabelecer a paz. A pesquisa se justifica pela possibilidade de ampliar reflexões de interesse social, pois todos indivíduo, família e sociedade, são beneficiados com a promoção de uma cultura da paz e com a resolução de conflitos de modo humano, com equidade. A metodologia adotada para tanto foi do tipo qualitativa com viés fenomenológico, que é um referencial filosófico, criada por Edmund Husserl, (século XIX), que deu cientificidade, ou seja, transformou a filosofia em ciência e a buscamos por se mostrar mais adequada aos estudos em Ciências Sociais/Jurídica, vez que esta é voltada para a pessoa como centralidade, na sua essência, nas relações com o meio, crenças, espiritualidade, visando tornar a conciliação mais humanizada, respeitando o homem em sua dignidade, seus valores, com o escopo final de apaziguamento nas relações familiares. Desse contexto surge o problema de pesquisa: Como trabalhar as técnicas de mediação e conciliação na resolução de conflitos familiares, de modo a contribuir para amenizar os sofrimentos das partes envolvidas em litígio e para promoção de uma cultura de paz social? Em relação aos procedimentos técnicos a pesquisa é bibliográfica e documental, valeu se também da pesquisa empírica com aplicação de questionários para coleta de dados. A partir das análises e estudos temos que a mediação e a conciliação, institutos similares, mas distintos, devem utilizar técnicas e meios alternativos para que as partes envolvidas em litígios retomem um diálogo e busquem uma solução justa para a lide que é apresentada, e principalmente seja buscada a pacificação. Deve ser buscada uma gestão positiva na forma de tratar conflitos familiares, valendo-se de ambiente acolhedor, exclusivo, escuta respeitosa, conhecimento dos limites impostos pela lei, vocação e formação humana para atuar como pacificador, com metodologia inter/multi e transdisciplinar contribuir para cultura da paz social. The main objective of the research is to reduce the burden of jurisdiction, with the responsibility of peacemaker, through other specialties that focus on caring, restoring the psychological balance of the parties in order to reduce the damages that a litigation always causes, seeking to restore peace. The research is justified by the possibility of expanding reflections of social interest, since all individuals, families and society are benefited by the promotion of a culture of peace and the resolution of conflicts in a humane way, with equity. The methodology adopted for this was of the qualitative type with a phenomenological bias, which is a philosophical reference, created by Edmund Husserl, (19th century), which gave scientificity, that is, transformed philosophy into science and seek to be more appropriate to studies in Social / Legal Sciences, since it is focused on the person as a centrality, in its essence, in relationships with the environment, beliefs, spirituality, with a view to making reconciliation more humanized, respecting man in his dignity, his values, the ultimate scope of appeasement in family relationships. From this context the research problem arises: How to work the techniques of mediation and conciliation in the resolution of family conflicts, in order to contribute to soften the suffering of the parties involved in litigation and to promote a culture of social peace? In relation to the technical procedures, the research is bibliographical and documentary, also validated by the empirical research with the application of questionnaires for data collection. From the analysis and studies we have that mediation and conciliation, similar but different institutes, should use alternative techniques and means for the parties involved in litigation to resume a dialogue and seek a just solution to the dispute that is presented, and especially peace be sought. Positive management should be sought in the form of dealing with family conflicts, using a warm, exclusive environment, respectful listening, knowledge of the limits imposed by law, human vocation and training to act as a peacemaker, with inter / multi and transdisciplinary methodology to contribute to culture of social peace.

With the end of the Cold War, a dramatic increase in the number of conflicts that have erupted for various reasons has prompted both statesmen and academics to develop methods and approaches to prevent, control and eventually transform such conflicts into a lasting peace. These quests have helped to create a wider knowledge about the causes, dynamics and phases of the conflicts, as well as paved way for an understanding that appropriate methods must be applied for each phase of a conflict according to its dynamics. The development of effective conflict management and analysis mechanisms requires a deep understanding of the causes and characteristic of a conflict and the application of appropriate methods to those causes. Otherwise, misreading the conflict and linking it to the wrong causes can have a great influence on the transition of the conflict from a level of non-conformity to a level of violence. Therefore, the aim of this thesis is to elaborate the various approaches to conflict transformation and examine that to what extent and in which conditions these methods are effective in transforming the conflicts. Bu tezde, belirli bir insan doğası düşüncesinden hareketle geliştirilen toplumsal barışı sağlama önerilerinin barındırdığı sorunlar T. Hobbes ve J. J. Rousseau’nun düşüncelerinden hareketle gösterilecektir. İki düşünür de, insan doğası, doğa durumu, toplum sözleşmesi, egemenlik gibi kavramlar üzerinde durmalarına rağmen farklı yönetim şekillerini savunurlar. Hobbes, insanın doğası gereği bencil ve şiddete meyilli olduğu düşüncesinden yola çıkarak iktidarın mutlak bir güce sahip olması gerektiğini savunur çünkü ancak mutlak güçteki bir iktidar savaşı sonlandırıp toplumsal barışı sağlayabilir. Bu şekilde sağlanan barışın bedeli, özgürlüğün yitirilmesidir. Rousseau ise, insanın doğal halinin iyi ve merhametli olduğunu ama toplumsallaşmayla birlikte bu durumun değiştiğini, insanın doğasındaki masumiyeti yitirerek yozlaştığını savunur. Toplumsallaşmayla birlikte ortaya çıkan yozlaşmaya özgürlüğün yitimi de eşlik eder ve bütün bunlar, insanlar arasında savaşlara neden olur. Rousseau, insanın tekrar özgürleşmesi ve toplumsal barışın sağlanması için genel iradeye dayalı bir yönetimi savunur. Her ne kadar insan doğasının tarihsel olarak değiştiğini söylese de, Rousseau’nun genel iradeye dayalı yönetimi, insanın özünde merhametli ve işbirliğine eğilimli olduğu düşüncesine dayanmaktadır. Rousseau’ya göre, genel iradeye dayalı bir yönetim, toplumsal barışı sağlayabilecek temel güçtür. Fakat değişen insan doğasına rağmen gerçekleştirilen bu eğitim, özel iradeyi biraz da zorlayarak genel irade içerisinde eriten bir eğitim olma tehlikesini barındırır., In this thesis, the problems of the social peace proposals which are developed from the idea of a certain human nature will be demonstrated with the ideas of T. Hobbes and J.J. Rousseau. Although both philosophers dwell on concepts such as human nature, the state of nature, social contract and sovereignty, they defend different forms of government. Hobbes asserts that power must have the absolute power, based on the idea that people are naturally selfish and inclined to violence. Because, only an absolute power can end the war and ensure social peace. The price of peace provided in this way is the loss of freedom. Rousseau, on the other hand, argues that the natural state of man is good and compassionate, but this situation has changed with socialization and man has lost the innocence in his nature and corrupted. The degeneration associated with socialization is accompanied by the loss of freedom and all this leads to wars among people. Rousseau defends an administration based on the general will for human freedom and social peace. Although Rousseau asserts that human nature has changed historically, his idea of government which represents the general will is based on the idea that man is naturally compassionate and inclined to cooperation. According to Rousseau, a general will-based administration is the basic power that will ensure social peace. As the human nature changes with socialization and the general will cannot be formed by itself, Rousseau applies to citizenship education. However, applying to citizenship education despite the change in human nature, has the danger of dissolving particular will in general will.

Bu araştırmanın amacı, sınıf eğitimi programı öğrencilerinin barışa yönelik tutumlarını bazı değişkenler ışığında değerlendirmek ve öğrencilerin barışa ilişkin görüşlerini ortaya çıkarmaktır. Araştırmada yakınsayan paralel karma desen modeli kullanılmıştır. Araştırmanın her alt problemine uygun ayrı çalışma grupları / örneklemler belirlenmiştir. Araştırmanın verilerini, Türkiye'de eğitim fakültelerinin barış ile ilgili ders içerikleri, kişisel bilgi formu, araştırmacı tarafından geliştirilen `Barış Tutum Ölçeği` ve görüşmeler aracılığı ile toplanan veriler oluşturmaktadır. Toplanan nicel ve nitel veriler ayrı ayrı analiz edilmiştir. Nicel verilerin analizi yapılırken ağırlıklı olarak istatistik paket programından yararlanılmış ve belirlenen değişkenlerin öğrencilerin barış tutumlarına etkisinin görülebilmesi için ikili grupların karşılaştırılmasında ilişkisiz örneklemler için t testi, ikiden fazla grubun karşılaştırılmasında ise tek yönlü varyans analizi kullanılmıştır. Elde edilen nitel veriler ise içerik analizi ile analiz edilerek nicel sonuçlar ile birlikte değerlendirilmiştir. Araştırma sonuçlarına göre sınıf eğitimi programı öğrencileri için cinsiyet, annenin eğitim düzeyi, yaşanılan coğrafi bölge, siyasi görüş, haber kaynağı türü sayısı, haberleri takip süresi değişkenlerinin barış tutumunu anlamlı düzeyde etkilediği ortaya çıkmıştır. Ayrıca nicel ve nitel verilerden elde edilen bulguların ortak değerlendirilmesi sonucunda, kendini sol görüşlü olarak tanımlayan ve siyasi görüşünü belirtmek istemeyen öğrencilerin barış tutumlarının kendini ülkücü veya muhafazakâr olarak tanımlayan öğrencilerin barış tutumlarına göre anlamlı düzeyde yüksek olduğu sonucu elde edilmiştir. Kendini ülkücü olarak tanımlayan öğrenciler, barışı sağlayacak olan farklılıkların, zarar potansiyeli taşıdığını, kendini muhafazakâr olarak tanımlayan öğrenciler ise herkesin özünde aynı olduğu, özellikle din konusunda aslında farklılıkların olmadığı düşüncelerine sahiptirler. Araştırmada, sınıf eğitimi programı öğrencileri için cinsiyet, annenin eğitim düzeyi, yaşanılan coğrafi bölge, siyasi görüş, haber kaynağı türü sayısı ve haberleri takip süresi değişkenlerinin barış tutumunu anlamlı düzeyde etkilediği ortaya çıkmıştır. Çalışma sonunda, akademik gelişimin ve yükseköğretim mezunu olmanın, çocukların barışa ilişkin tutumunu düşürecek hangi ebeveynlik biçimlerine neden olduğu; yaşamının büyük bölümünü Akdeniz bölgesinde geçirmiş öğrencilerin barış tutumlarının yaşamının büyük bölümünü Marmara, Ege veya İç Anadolu bölgelerinden birinde geçirmiş olan öğrencilere göre; haberleri tek tür kaynaktan takip eden öğrencilerin barış tutumlarının, haberleri birden çok türde kaynaktan takip eden öğrencilerin barış tutumlarına göre ve haber takibine günde 1 saatten fazla zaman ayıran öğrencilerin barış tutumlarının, haber takibine 1 saatten az zaman ayıran öğrencilerin barış tutumlarına göre neden düşük olduğu konularının araştırılması önerilmiştir. The aim of this research is to assess the attitudes of the primary education program students towards peace in the light of some variables and to uncover the students' views on peace. In the research, an exploratory sequential mixed design model has been used. Separate working groups/samples are determined for each sub-problem of the research. The data of the research are collected with the course contents of the education faculties in Turkey related to Peace Education, personal information form, interviews, and `Peace Attitude Scale` developed by the researcher. The reliability coefficient of Cronbach's Alpha of the developed Peace Attitude Scale is calculated as 0.89. Quantitative and qualitative data have been analyzed separately during the research period. During the analysis of quantitative data, statistics package program is mainly used and t-test is used for independent samples and one-way analysis of variance is used for independent samples in order to see the effect of determined variables on students' peace attitudes. Qualitative data are analyzed by content analysis and evaluated with quantitative results.According to the results of the research, it is found that gender, mother's level of education, geographical region, political opinion, the number of news source types, and the follow-up time of news significantly affect the peace attitude. In addition, as a result of the joint evaluation of the findings obtained from the quantitative and qualitative data, it is concluded that each political view has a rational basis, but students who define themselves as left-winger are more peaceful than students who define themselves as nationalist or conservative. Students, who define themselves as nationalistic, consider the differences that will bring peace to be dangerous because of the potential for harm. Conservative students do not accept differences. It is thought that these situations of not accepting differences and considering the differences hazardous adversely affects the attitudes of peace. At the end of the research, it is recommended that a multiculturalism and peace education, which considers the conflict as a rational action as well as an emotional one and is planned considering universal values and social problems, should be mandatory for all primary education program students and for a more peaceful society, it is recommended that women should have more say in all areas of society. 202

Türk milletinin hukuk düzeni töre adı verilen kanunlarla belirlenmiştir. Türk örf ve adetleri İslam esasları ile birleşerek, Trükün kainata bakış açısını zenginleştirmiştir. Bu anlayış toplum hayatına da aktarılmıştır. Makalede bu düşünceyi destekleyecek çeşitli argümanlar sunulmaktadır., The Turkish state tradition is based on the survivability of the state and the prosperity of the nation. This principle is identical to the concept of justice. The Turks have made the concept of justice an indispensable element of social life and of all institutions, and they are known for their qualities. The legal order of the Turkish nation is determined by laws called customs. That Turkish customs combined with Islamic principles have enriched the point of view of the Turks to universe.This understanding has also been passed on to the life of the society. Several arguments are presented to support this idea in the article.

Çatışma sonrası bir ortamda barışçıl bir düzenin oluşturulması, yalnızca çatışma ve şiddete son vermeyi değil, aynı zamanda toplum içinde eşitliğin sağlanmasını da gerektirir. Bununla beraber, insan toplumunun bütünleşmesi, toplumsal cinsiyet eşitliğini, insani gelişmenin önemli bir boyutu olarak görmekte ve yokluğunu insani gelişime karşı büyük bir engel olarak değerlendirmektedir. Ayrıca, barışı koruma görevinin genişleyen rolü, kadınların bu operasyonlardaki genişletilmiş rolüne yol açmıştır; bu da kadınların çatışma sonrası bir toplumda yeniden yapılanma sürecine dahil edilmesinin kolaylaştırıcısı haline gelebilir. Bu çalışmada, barış operasyonlarında toplumsal cinsiyet duyarlılığına daha az önem verildiği dönem olan 1325 sayılı karardan önceki dönemi temsil eden bir vaka olarak, Mozambik ve 1325 sayılı karardan sonraki döneme ait bir vaka olan Sierra Leone, cinsiyet odaklı yaklaşımın barış sürecine etkisini karşılaştırmak seçilmiştir. Bu çalışma, kadınların seçilen operasyonlardaki rolünün kadınların siyasi ve ekonomik katılımı üzerinde somut bir etkisi olmadığını, ancak toplumsal cinsiyete dayalı güvenlik sektörü reformları üzerinde önemli bir etkiye sahip olduğu sonucuna varmıştır. Toplumsal cinsiyet eşitliği konusuna açık bir şekilde odaklanan bu çalışma, toplumsal cinsiyet eşitliğinin anlaşılması olgusunu sürdürülebilir pozitif barış için kilit bir faktör olarak da geliştirebilecektir. Formation of a peaceful order in a post-conflict environment requires not only an end to conflict and violence, but also the provision of equality within society. Hence, the integration of human society considers gender equality to be a crucial dimension of and its lack as a major obstacle against human development. The enlarged role of peacekeeping has given rise to the expanded role of women in these operations, which can also become a facilitator of the women's inclusion in the reconstruction process in a post-conflict country. In fact, many scholars posit that there are many benefits of women's presence in peacekeeping operations such as improving the reputation of peacekeepers among local populations, establishing better relationships with locals, and providing role models in the local community. But, the literature so far does not cover empirical studies that will test these arguments. This thesis aims to contribute to this discussion by focusing on the possible role that the presence of women in UN peacekeeping operations can play in the living conditions (economic, social and political) of women in post-conflict orders. In this study, Mozambique as a case from the period before the resolution 1325, when much less attention was given to gender sensitivity within peacekeeping operations; and Sierra Leone as a case from the period after the resolution 1325 are selected to compare and contrast the impact of gender focused approach on the peace process. This study concludes that the role of women in the selected missions did not have a solid effect on the political and economic participation of women, however it had a significant influence on the gender mainstreamed security sector reforms. With a clear focus on gender mainstreaming, this study can be able to improve the understandings of gender equality as a key factor in sustainable positive peace. 142

Kolombiya Hükümeti, Kasım 2016'da solcu gerilla grubu FARC (Kolombiya Devrimci Silahlı Kuvvetleri) ile bir barış anlaşmasını resmen onayladığı zaman, 220.000 kişinin hayatını kaybetmesine ve yaklaşık 8 milyon insanın yerinden olmasına yol açan 50 yıldan fazla süren bir anlaşmazlığın sona ermesine söz verdi (Guardian, 2016). Kolombiya'daki barış umutları, Ulusal Kurtuluş Ordusu (ELN) Ekim 2017'de 102 gün süren bir ateşkes olarak adlandırılan benzer bir anlaşmanın erken belirtilerini umut ederek daha da güçlendi (Al Jazeera, 2017a). Kolombiya barışının istikrarlı ve uyumlu bir toplumun yeniden inşasında başarılı olması için hem iç hem de uluslararası düzeyde barış inşası ve yönetimine yönelik ortak politik çabalar olması gerekiyordu. Uzun süredir devam eden bir sivil çatışmada bu önemli barış komisyonculuğu ışığında, bu yazının amacı, 20. yıl dönümünde Kuzey İrlanda barış sürecinin yanı sıra ortaya çıkan Kolombiya barış anlaşmasının karşılaştırmalı bir analizini sağlamaktır. Son yirmi yıldır Kuzey İrlanda, birçok uluslararası barış inşası stratejisinin ve çatışma araştırma programlarının odak noktası olmuştur ve bu nedenle, sadece Kolombiya'da yeni başlayan çatışma dönüşümü yolculuğuna karşı ayrıntılı karşılaştırmalı analiz olanağı sunmaktadır. Uzun süren çatışmalar, sivil toplum üzerinde etnik veya politik hatlar boyunca bölünmeyi yaratan kalıcı bir etkiye sahiptir ve bu, devlet yönetim yapıları için düşük düzeyde destek anlamına gelmektedir. When the Government of Colombia formally ratified a peace accord in November 2016 with the left-wing guerrilla group FARC (Revolutionary Armed Forces of Colombia)it promised an end to more than 50 years of conflictwhich claimed the lives of 220,000 and displaced nearly 8 million people (Guardian, 2016). The hope for peace in Colombiawas further strengthened by promising early signs of a similar agreement forming as the National Liberation Army (ELN) called a 102 day truce in October 2017 (Al Jazeera, 2017a). If Colombian peace is to be successful in the rebuilding of a stable and cohesive society, it will take concerted political efforts towards peacebuilding and governance on both the domestic and international levels. In light of this significant peace brokerage in a protracted civil conflict, the aim of this paper is to provide a comparative analysis of the nascent Colombian peace agreement alongside the Northern Irish peace process on its 20th year anniversary, in order to identifysome of the key challenges faced and methods of peacebuilding which have proven successful in increasing social capital and structural stability. Over the last twenty years, Northern Ireland has been the focus of many international peacebuilding strategies and conflict research programmes, and as such offers opportunity for detailed comparative analysis against the conflict transformation journey which has only just started in Colombia. Protracted conflicts have a lasting impact on civil society creating division along ethnic or political lines, and this translates into low levels of support for state governance structures. Indeed, there is significant evidence to suggest that without government social integration interventions these divisions can become trans-generational conflicts. By using World Bank governance indicators to measure the changes in civil society after peace, acknowledging that positive performance against governance indicators correlates with a reduced capacity for conflict (Fearon, 2010), this paper identifiesthe challenges faced by post-conflict societies and proposes several effective frameworks for long-term development and peacebuilding. Several common themes emerge, including: the necessity of international stewardship during peace negotiation to lend legitimacy to the process, the need for development models focusing on conflict transformation, and lastly the use of spatial planning to combat development duality and as a long-term strategy towards social cohesion 60

Bu tez, siyasal sembollerin barış süreçlerinde kullanımının pozitif barışa etkilerini (negatif ve pozitif anlamda) Kuzey İrlanda ve Güney Afrika örnekleri eşliğinde incelemeyi amaçlamaktadır. 1990'lara kadar semboller ve sembolik unsurlar hem barış görüşmelerinde hem de bir bütün olarak barış süreçlerinde ikincil konular olarak görülmüş ve bu konuyla ilgili anlaşmazlıklara yeteri kadar ilgi gösterilmemiştir. Ancak birincil konular olarak değerlendirilen silahsızlanma, çatışan örgüt üyelerinin topluma yeniden entegrasyonu ve sivilleşme gibi makro amaçlı meseleler çözüme kavuşturulduğu halde çatışmanın hala devam etmesi kültürel şiddeti ve bunun en etkili aracıları olan sembol ve ritüelleri barış ve çatışma çalışmalarının temel tartışma konularından biri haline getirmiştir. Bu tezin kuramsal temelini oluşturan ve Simon Harrison'ın kuramsallaştırdığı sembolik çatışma kuramı, özellikle barış süreçlerinde sembollerin esas çatışma alanlarına dönüştüğünü göstermektedir. Kuzey İrlanda ve Güney Afrika barış süreçlerinde bu kültürel birimlerin kullanımının barışın sürdürülebilmesindeki etkisi açık bir şekilde görülmektedir. Bu durumda barış sürecinde yeni ve pozitif barış sembollerinin kullanılması pozitif barışı olumlu yönde etkilerken eski ve tarafgir sembollerin kullanılması ise pozitif barışı olumsuz yönde etkilemektedir. This thesis aims to examine the effects of the use of political symbols in peace processes (negative and positive sense) in the context of Northern Ireland and South Africa. Until the 1990s, symbols and symbolic elements were regarded as secondary issues both in peace negotiations and in the peace process as a whole, and disagreements about this issue have not been of much interest. However, although macro-related issues such as demilitarization, disarmament and the collective reintegration of the members of the conflicting organization, which are considered as the primary issues, have been resolved, there has been seen that the potential violence continues. After that, the cultural violence and its most influential intermediaries, the symbols and rituals have became one of the main debates of peace and conflict studies. The theoretical basis of this thesis is the symbolic conflict theory, theorized by Simon Harrison, shows that in the process of peace, symbols are transformed into the main areas of conflict. The effect of the use of these cultural units in the peace process of Northern Ireland and South Africa is clearly visible. It is one of the conclusions of this thesis that when the groups insist on using the sympathetic symbols of the conflict period in the peace process, the violence among the groups is potentially ready and observable at any moment. In this case, the use of new and positive peace symbols in the peace process affects positive peace positively whereas the use of old and biased symbols affects positive peace negatively. 272

For offences that harm private interest or have a limited social impact, the Criminal Code of 1969 provided the withdrawal of the initial complaint and the settlement by the parties. The draft of the Romanian Criminal Code, submitted for approval to Parliament, tacitly repeals the institution of the settlement of parties, which, as the founder of Romanian criminal law argued, “may be more useful for restoring legal order and prevent other disturbances that may have stemmed from the lingering resentments of the two subjects of the litigation.” In most modern criminal laws we can no longer find the explicit settlement by parties, but rather the presumed settlement inferred from the withdrawal or abandonment of the criminal complaint. In Romanian criminal law, over time, offences for which settlement was possible have varied from one era to another. In the Sturdza Codex, settlement was possible and considered as mitigating. In the proposed Criminal Code bill of 2004, settlement by the parties also existed. The will to reach a settlement by the parties may be determined by Christian reasons. Forgiveness of one's fellow man is a commandment of the Lord Christ, which He himself fulfilled on the cross and preached. What is the contribution of Christian teaching to the emergence, development and application of the criminal law institutions of withdrawal of initial complaint and settlement by parties?

Çalışmanın ilk bölümünde, çatışma ve nedenleri, çözüme içkin yöntemler ve izlenen yolun barış ve adalet ile olan ilişkisi Galtung özelinde ele alınmıştır. Galtung'un kavram haritası belirlenip, yapısal şiddet, temel ihtiyaçlar, aşmak, dönüştürmek, barış, adalet gibi kavramlar çerçevesinde kalıcı, adil bir barışın mümkün olup olmadığı, tezin bu bölümünde cevabını aranan temel sorunsal olarak tercih edilmiştir. Diğer yandan siyasal alanda içkin olarak değinilen uzlaşı kavramının Galtung dizinindeki yeri de ele alınmaktadır. Tezin ikinci bölümünde, Mouffe özelinde, antagonizma, agonizma ve 'siyasal olan' ayrımı bu pasajın temel çizgilerini belirlemiştir. Fiziksel şiddet içermesi bağlamında antagonizma şiddetin başlangıç noktası olarak ele alınmıştır. Antagonizmanın kökenlerine dair yaptığımız tasnifte Derrida, Wittgenstein ve Kant'ın felsefe literatürüne kazandırmış olduğu 'kurucu dışarısı', 'dil oyunları' ve 'evrenselcilik' kavramları tercih edilmiştir. Modernitenin bütünlükçü tavrının antagonizmaya neden olduğunu iddia edilen pasajın ardından, şiddet içermeyen agonizmaya dönüştürülmesi bahsinde post-modernitenin parçacıklı yapıları öngören tavrına vurgu yapılmaktadır. Bu bölümün son kısmında ise siyasal olanın barışın tesis edilmesindeki rolü ve adalet ile olan bağlantıları ele alınmaktadır. Galtung ve Mouffe'un siyaseti kavramsal olarak kavrayış biçimleri, bu önkabullerin neticesinde ortaya çıkan yöntemsel farklılıklar ve nihayetinde tüm bu düşüncelerin siyasal alana yansımaları bağlamında bir karşılaştırma, tezin üçüncü bölümünün ana omurgasını oluşturmaktadır. Galtung'un yapısalcı bir barış-çatışma teorisyeni ve Mouffe'un post-yapısalcı bir siyaset felsefecesi olduğunu gözden kaçırmadan kavramsal/metinsel temelde bir karşılaştırma tercih edilmiştir. Her iki düşünürün ontolojik ve epistemolojik kabüllerinin adil bir barışın, kalıcı uzlaşıların siyasal olan'daki yerini belirleme çabası bu bölüm içerisinde etraflıca ele alınmıştır. In the first part of the thesis, the conflict and its causes, the methods of solving, and the relationship of the way followed with peace and justice are considered in the context of Galtung. Subsequent to identification of Galtung's conceptual map, possibility and impossibility of a lasting fair peace was chosen as the fundamental problematic for which we have sought to answer within such concepts as constructive violance, fundamental needs, transcension, transformation, peace, justice. On the other hand, the place of consensus concept which is discussed as relation to political sphere, in Galtung context is also discussed. In the second part of the thesis, antagonism, agonism and their political distinction determine the basic lines of this passage in the context of Mouffe. Within the context of physical violance inclusion, antagonism is considered as the starting point of violance. In our classification of antagonism's origins, 'constructive externality', 'language games' and 'universalism' that Derrida, Wittgenstein and Kant brought in literature were preferred. In the context of transforming non-violent agonism after the passage we claim that integrity attitude of modernity causes to antagonism, the emphasis is placed on the attitude of post-modernist participle structures. In the last part of this chapter, the role of political one in the establishment of peace and its links to justice are dealed. Galtung and Mouffe's conceptual comprehension of politics, methodological differences that arise as a result of these presuppositions, and finally the comparison of all these reflections to the political arena constitute the main vertebra of the third part of our thesis. A comparison on a conceptual/textual basis was preferred, noting that Galtung is a structuralist peace-conflict theorist and Mouffe is a post-structuralist political philosopher. The attempt of both philosophers' ontological and epistemological acceptances to determine the place of permanent compromises in political one has been thoroughly examined within this section. 167

Labour relations are characterized by strong (existential) conflict of interest between the employee and the employer. Therefore, labour relations must represent a legal term of the balance of interest of its entities, in order to be stable and have perspective. In other words, there is reciprocity of rights and obligations of the entities in labour relations. However, the employer is a stronger party, both legally and factually. The traditional task of labour law is to mitigate that legal and factual inequality of the employee and the employer to the extent necessary to ensure social security of employees and the employer himself, and social milieu and stability of the society as a whole. To this effect, appropriate limitations of the employer's authority are incorporated into the labour relations and appropriate principles for the operation of the system of labour relations are determined.

The modern European concept of collective labour relations is based on the social dialogue, which represents an opportunity for ensuring permanent social peace. The social dialogue is regulated by the provisions of the primary European law, conducted at the supranational level by the social partners functioning in the European social area. It is also an important model for conducting dialogue by the social partners in the EU Member States and for establishment by the authorities of particular EU Member States of the principles and procedures for the social dialogue in the labour law systems. The freedom of association, collective bargaining, social dialogue and quality of collective labour relations are the fundamental elements of the European social model. The collective bargaining as being a part of this model should promote workplace democracy, redistribution of resources, and efficiency of employment relations. However, collective agreements that may be concluded at the European level are still a novelty in the legislative system of European labour law and they do not play a role as the alternative sources of European labour law., Moderni Europos darbo santykių koncepcija grindžiama socialiniu dialogu, kuris sudaro prielaidas socialinės taikos užtikrinimui. Socialinį dialogą reglamentuojama Europos teisė, virš-valstybiniu lygiu įgyvendinama socialinių partnerių, veikiančių Europos socialinėje erdvėje. Šia koncepcija grindžiamas ir ES šalių narių socialinis dialogas bei nacionaliniai teisės principai, reglamentuojantys nacionalinio socialinio dialogo principus ir procedūras. Asociacijų laisvė, kolektyvinės derybos, socialinis dialogas ir kolektyvinių darbo santykių kokybė yra pamatiniai Europos socialinio modelio elementai. Kolektyvinės derybos, kaip vienas iš svarbiausių modelio elementų, turi skatinti darbo vietos demokratiją, išteklių perskirstymą bei efektyvius darbo santykius. Deja, kolektyvinės sutartys, kurios gali būti sudaromos Europiniu lygiu, vis dar netampa įprastine Europos darbo teisės sudėtine dalimi ir neatlieka alternatyvaus Europos darbo teisės šaltinio funkcijos.

This study aims to analyze access to justice through the Small Claims Courts, which consist in an appendix in the Brazilian judicial system, to solve conflicts of minor economic importance and should offer a quick adjudication and focused on reconciliation as conceives Article 2 of Law n. 9099/1995. However, currently, due to the heightened litigation and lack of structure, the reality proves different. It is argued here, the quality and efficiency of the Small Claims Courts, suggesting as tweaking this, ensuring the presence of a Public Defender in your audience, or a fine of imposing the suppliers of products or services, which has repeatedly They are demanded for the same cause, recurrent convictions, mitigating this legalization environment you are in Brazilian society. The objective was to demonstrate how litigation affects the Courts, preventing the application of its principles. The methodology used was deductive method by bibliographic and documentary technical procedures., O presente estuda visa analisar o acesso à justiça através dos Juizados Especiais Cíveis, que consistem num apêndice dentro do sistema judiciário brasileiro, para a solução de conflitos de menor expressão econômica e devem oferecer uma prestação jurisdicional rápida e voltada à conciliação, tal como concebe o artigo 2 da Lei n. 9.099/1995. Contudo, atualmente, em razão da litigiosidade exacerbada e de falta de estrutura, a realidade se mostra diferente. Discute-se aqui, a qualidade e eficiência dos Juizados Especiais Cíveis, sugerindo- se como aprimorando deste, a garantia da presença de um Defensor Público em suas audiências, ou a imposição de multa a empresas fornecedoras de produtos ou serviços, que, reiteradamente, são demandadas pelos mesmos fatos, recorrentes condenações, mitigando esse ambiente de judicialização em que se encontra a sociedade brasileira. Objetivou-se demonstrar como a litigiosidade afeta os Juizados, inviabilizando a aplicação de seus princípios. A metodologia utilizada foi o método dedutivo através dos procedimentos técnicos bibliográficos e documental.

Dissertação de Mestrado em Estratégia A manutenção da paz social é um objectivo fundamental da governação dos Estados que saíram da guerra civil. Para o alcançar, é necessário conhecer os factores estratégicos, adaptados à dinâmica das circunstâncias sociais de cada país, que contribuem para que a paz não fracasse e a guerra regresse. Na abordagem ao tema, depois de estabelecer o enquadramento teórico básico, acrescido do essencial sobre duas teorias pacifistas de referência, apresenta-se um modelo de análise estratégica da paz social, que considera como factores estratégicos relevantes: a promoção da cultura da paz; o estabelecimento da relação de alteridade; o fomento da solidariedade; a primazia do diálogo; e a prática da não-violência. Por fim, testa-se esse modelo nos grupos estratégicos socio-profissionais dos roboteiros, zungeiros e taxistas do distrito urbano da Maianga (Luanda), de forma a percepcionar como é que os factores estratégicos relevantes, por incorporarem as aspirações dos três grupos estratégicos socio-profissionais, são determinantes da paz social. Desta forma, espera-se tirar lições que permitam inferir sobre a eventual aplicabilidade, a outros grupos sociais angolanos mais vastos, do modelo de análise estratégica concebido nesta dissertação. The maintenance of social peace is a fundamental objective for the governance of states that emerged from civil war. To achieve this objective, it is necessary to acknowledge the strategic factors, adapted to the dynamics of social circumstances of each country, for a sustainable peace, able to avoid war to return. In the approach to the topic, after establishing the basic theoretical framework, followed by the essential on two pacifists theories of reference, it is presented a model for strategic analysis of the social peace, that considers: the promotion of the culture of peace; the establishment of the relationship of otherness; the enhancement of the culture of solidarity; the primacy of dialogue; and the practice of the non-violence. Finally, this model is tested on the roboteiros, zungeiros, and taxi drivers strategic socio-professional groups, from the Maianga urban district (Luanda), in order to perceive how those relevant strategic factors are determinant of social peace, due to the fact they are part of these socio-professional groups aspirations. This way, we hope to learn some lessons witch enable us to deduce about an eventual applicability, to other wider angolan social groups, of the strategic analysis model conceived in this academic work. An ethical approach of this will be made, so, this article will use the method of ethical discernment (Mifsud, 2012)., El artículo intenta describir lo ocurrido la noche del 26 de septiembre al 27 de septiembre de 2014 cuando tuvo lugar la desaparición forzada de 43 estudiantes normalistas en el estado de Guerrero, en México, y su significado como ausencia de paz social en este país. Bu çalışmada televizyon spor haberlerinde kullanılan haber dilinin hangi oranda nefret ve ayrımclık barındırdığı ortaya çıkarılmaya çalışlmıştır. Not only aimed to concieve of news productor's practices but also aimed that the heros of the news who mentioned in the news. All findings examined in content analysis. 3 different Tv sport channels has been examined and all of them converted to the table. The findings can be read seperatly and also examine comparatively. All this tables and findings can give us what we desired to reach that we predicted before study.
