12. 보증인과 물상보증인의 지위를 겸하는 자의 변제자대위

Abstract

타인 채무의 담보를 위하여 보증인이 되거나 물상보증인이 된 자가 채무를 변제한 경우 채무자에 대하여 구상권을 취득한다. 그 구상권을 확보하기 위하여 채권자를 대위하여 다른 담보제공자에 대한 채권 및 담보권을 행사할 수 있다. 이를 ‘변제자대위’ 또는 ‘변제에 의한 대위’라고 한다. 그리고 이들은 ‘변제할 정당한 이익이 있는 자’에 속하므로 당연히 채권자를 대위한다. 다만 타인 채무의 변제자로서 다른 담보제공자에게 채권자를 대위하는 범위는 그들 사이의 부담부분을 한도로 한다. 그 중 보증인과 물상보증인이 각각 여럿 있는 경우 그들 사이의 부담부분을 확정하기 위하여 민법 제482조 제2항 제5호는 두 가지 기준을 제시한다. 그 본문은 다수의 보증인과 물상보증인 사이에는 인원수에 비례하고(인원수 비례), 단서는 그 중 다수의 물상보증인 사이에는 보증인의 부담부분을 제외한 잔액에 대하여 그들이 담보로 제공한 재산의 가액에 비례하여 채권자를 대위하는 것으로 규정한다(담보가액 비례). 그런데 어떤 경우에는 보증과 물상보증이 경합하는 경우도 있다. 예를 들어 다수의 보증인과 물상보증인이 있는 상태에서 그 중 보증인이 채권자에게 자신의 재산으로 담보를 제공하거나 물상보증인이 채권자와 보증계약을 체결할 수도 있다. 이와 같이 이중지위자가 있는 경우 민법은 변제자대위를 통한 부담액 산정에 관하여 어떠한 기준도 제시하지 않고 있다. 판례는 이중지위자에 관하여 단지 1인으로 본다는 결론만 제시하고 있을 뿐이다. 학설은 일본민법학계의 영향을 받아 여러 가지로 나뉜다. 그러나 어떤 견해에 의하더라도 공평한 부담액을 결정하는 기준으로 미흡하다. 생각건대 부담액 산정의 기본원리는 보증인, 물상보증인, 이중지위자의 공평한 분담이며, 이를 위하여 고려해야 할 요소는 채무에 대한 그들의 담보의사이다. 변제자대위의 취지에 맞도록 담보제공자 전체가 부담해야 할 금액에서 각 담보제공자가 부담해야 할 금액이 차지하는 비율로 계산하는 것이 산술적으로 가장 공평하다. 구체적으로 우선 각자의 기준금액을 정하고 그 합계액으로 각자의 기준금액을 나누는 산정방식을 제안한다. ①단순한 보증인은 보증채무액을 기준금액으로 한다. ②단순한 물상 보증인은 제공한 담보물의 가액을 기준금액으로 한다. 그러나 담보물 가액이 보증채무액을 초과하더라도 보증채무액을 기준으로 한다. ③이중지위자는 제공한 담보물 가액이 주채무액에 미치지 못하거나 그 이상이더라도 주채무액을 기준금액으로 한다. 그 후 ④각자의 기준금액을 합산하여 그 합계액으로 각자의 기준금액을 나눈 비율에 따라 부담액을 산정한다. 이러한 제안은 해석론을 넘어선 민법의 개정으로 이어져야 한다.

Abstract

A novel ultraviolet (UV)-assisted imprinting procedure that employs photosensitive tin(II) 2-ethylhexanoate is presented for the facile size-tunable fabrication of functional tin dioxide (SnO2) nanostructures by varying annealing temperatures. These imprinted SnO2 nanostructures were also used as new masters for size reduction lithography. SnO2 lines down to 40 nm wide were obtained from a silicon master with 200 nm wide lines by simply performing size reduction lithography twice. This leads to 80 and 87.5% reduction in the width and height of imprinted lines, respectively. An imprinted pattern annealed at 400 degrees C demonstrated transmittance greater than 90% over the range of 350-700 nm, which is high enough to make the pattern useful as a transparent SnO2 mold. This demonstrated approach allows the accessibility to size-tunable molds, eliminating the need for conventional expensive imprinting masters with very fine structures, as well as functional SnO2 nanostructures, potentially useful in applications where ordered surface nanostructures are required, such as photonic crystals, biological sensors, and model catalysts.

44. Topology optimization of reactive material structures for penetrative projectiles

Abstract

Recently, reactive materials have been developed for penetrative projectiles to improve impact resistance and energy capacity. However, the design of a reactive material structure, involving shape and size, is challenging because of difficulties such as high non-linearity of impact resistance, manufacturing limitations of reactive materials and high expenses of penetration experiments. In this study, a design optimization methodology for the reactive material structure is developed based on the finite element analysis. A finite element model for penetration analysis is introduced to save the expenses of the experiments. Impact resistance is assessed through the analysis, and result is calibrated by comparing with experimental results. Based on the model, topology optimization is introduced to determine shape of the structure. The design variables and constraints of the optimization are proposed considering the manufacturing limitations, and the optimal shape that can be manufactured by cold spraying is determined. Based on the optimal shape, size optimization is introduced to determine the geometric dimensions of the structure. As a result, optimal design of the reactive material structure and steel case of the penetrative projectile, which maximizes the impact resistance, is determined. Using the design process proposed in this study, reactive material structures can be designed considering not only mechanical performances but also manufacturing limitations, with reasonable time and cost.
