An Amendment of the 1996 LLMC Protocol to the Convention on Limitation of Liability for Maritime Claims, 1976 was adopted at the ninety-ninth session of the IMO Legal Committee held in London 16 - 19 April 2012, increasing the global limits of liability related to Article 6(1)(a) and 6(1)(b) of 1976 LLMC by 51 % on the present limits set out in Article 3 of the 1996 LLMC Protocol. Limits set out in Article 7 of LLMC 1976 have remained unchanged. In accordance with the Article 8(8) of the 1996 LLMC Protocol, these amendments shall enter into force on 8 June 2015. The paper analyses the reasons that have led to the increase of the limits of liability and to the justification of such an increase, taking into account that in only 1.34 % of incidents damages have exceeded current limits of liability established by the 1996 Protocol. It analyses the legal and economic consequences of the increase of the limits of liability and its immediate impact on other international conventions relying on the global limitation of liability, such as the 2001 Bunker Convention and the 2007 Convention on the Removal of Wrecks. It warns, however, that the tendency leading to excessive limits of liability may cause a loss of interest of states to ratify the 1996 Protocol and thus have a negative impact on the unification of law in relation to this matter. Therefore, this paper discusses some of the possible solutions that would provide fair compensation for victims, but would not jeopardise the unification efforts and the purpose of the limitation of liability. This symposium comprises an abridged transcript of an event held to mark the retirement of Professor Philip Allott from his chair at the University of Cambridge on 30 September 2004. On 28-29 May 2004, a small gathering of his colleagues from several universities and various disciplines attended the one and a half day event in Cambridge. The focus of the workshop was on Professor Allott's work and the central theme, 'this cannot be how the world was meant to be'. The event commenced with an outline by Professor Allott of his recent work and thoughts on the state of the world, summarized in his Seven Theses. Papers were then delivered by four leading jurists in international law, Professor Iain Scobbie (University of London), Professor Karen Knop (University of Toronto), Professor Martti Koskenniemi (University of Helsinki) and Professor Tom Franck (NYU). Dame Roslyn Higgins concluded the event with final remarks. Each of the speakers analysed and critiqued Philip's work, particularly Eunomia (1990, 2nd ed., 2001) and The Health of Nations (2002). The World Engineering Partnership for Sustainable Development has been formed to provide leadership, develop constructive relationships, coordinate projects and programs, and work closely with public and private decision makers. This paper is taken from a talk given by the author during the September 26–30, 1993 Joint Triennial Conference in London and Maidstone, Kent, U.K., during a session entitled, “The Environmental Challenge for Engineers.” The writer begins by defining the word “environment” as “being surrounded,” then describes how the civil engineer's efforts at service to the public are surrounded on at least five sides, namely the public's desires, national governmental laws and regulations, the legal profession, local officials' needs, and the development of increasingly sensitive analytical instruments that seem to take on a life of their own. The writer then addresses the need for civil engineers to adapt to changing conditions, feelings, and philosophies. The paper ends by indicating that the environmental challenge is the civil engineer who has the technical knowledge, a diverse range of expertise, and experience with those entities within a community directly affected by our work, and who must be the leader of professional teams facing today's complex projects and those in the future.
