Through documentation of the archives of notarial protocols and the Royal Chancery of Granada, the biography of the matriarch of the family Hinojosa Granada, a branch of the illustrious Granada Venegas lineage, can be outlined. This study analyses the important rural heritage acquired in a community property marriage regime of six agricultural properties of the fertile valley of Granada bordering the city. The large state consisted of 224 plots of arable land, orchards and olive groves, with more than 1,500 marshes of land, some of which were purchased from the Moriscos before 1570, and most of which from. the Royal Treasury through public auctions of confiscated and purchased Moorish assets over a period of three decades. This type of acquisition can be considered a representative example of the actions performed by the Granada oligarchy with the aim of gaining possession of these requisitioned properties. This analysis also details the income generated by this large state at the end of the sixteenth century, accounts for an increase in the number of Moorish that were either expelled from or that remained in the city of Granada and studies the agricultural landscape according to the information obtained on this large property A partir de documentación de los archivos de protocolos notariales y de la Real Chancillería de Granada se delinea la biografía de la matriarca de la familia Hinojosa Granada, rama por vía femenina de la ilustre estirpe Granada Venegas, y se analiza el importante patrimonio rústico que adquirió, en régimen de gananciales, en seis pagos agrícolas de la Vega de Granada, aledaños a la ciudad. Heredad integrada por 224 fincas −hazas, huertas y olivares− con más de 1.500 marjales de tierra, compradas una parte a moriscos antes de 1570, y la mayoría a la Real Hacienda en subasta pública de bienes moriegos confiscados y vendidos −ramo de censos sueltos− a lo largo de tres décadas. Un ejemplo representativo de la actuación de la oligarquía granadina para hacerse con la posesión de estos bienes requisados. Asimismo, se detallan las rentas que generaban a finales del siglo XVI, se amplía la nómina de moriscos expulsos o que permanecieron, y se considera el paisaje agrario a partir de la información que proporciona esta gran propiedad

To do so, initially, this study intends to explain how asset disposition works in a judicial reorganization process, both in the form of art. 66 of Federal Law no. 11,101/2005 and under the terms of the plan of reorganization. In addition, it discusses the choice between the different modalities of asset sales provided by arts. 142, 144 and 145 of Federal Law no. 11,101/2005, the inexistence of successor liability of the purchaser in the obligations of the seller, the problem of overturning the court order authorizing the sale and the problem of submitting bids lower than the asset valuation price. Based on the premises established for the sale of assets in judicial reorganization, the study analyzes the stalking horse agreement in light of the American experience, with the layout of its common stipulations. Thereafter, it deals with the possibility of signing atypical contracts, the legal nature of the judicial reorganization process and the appropriate time for the conclusion of the stalking horse agreement. Finally, the study lays out a proposal for the adoption of the stalking horse for asset disposition in the judicial reorganization process, through a process of internalization of the institute for Brazilian Law that respects and conforms to the legal order of the country, the prevailing case-law and the negotiating customs. O presente trabalho tem por objetivo examinar a venda de ativos na recuperação judicial e a utilização do contrato de stalking horse no Direito Brasileiro. Para tanto, inicialmente, pretende-se explicar como funciona a alienação de ativos no processo de recuperação judicial, tanto na forma do art. 66 da Lei nº 11.101/2005 como nos termos do plano de recuperação. Além disso, discute-se a escolha das modalidades de venda de bens e direitos previstas nos arts. 142, 144 e 145 da Lei nº 11.101/2005, a ausência de sucessão do adquirente nas obrigações do devedor alienante, o problema da reforma da decisão judicial autorizativa da venda e o problema da apresentação de ofertas inferiores ao preço de avaliação de ativos. Com base nas premissas estabelecidas para a venda de ativos na recuperação judicial, passa-se ao exame do contrato de stalking horse na experiência norte-americana, com a exposição dos seus contornos. Em seguida, trata-se da possibilidade de celebração de contratos atípicos, da natureza jurídica do processo de recuperação judicial e do momento adequado para a celebração do contrato de stalking horse. Por fim, busca-se apresentar uma proposta de adoção do stalking horse para a alienação de ativos na recuperação judicial, em um processo de internalização do instituto para o Direito Brasileiro que respeite e se ajuste ao ordenamento jurídico pátrio, à jurisprudência predominante e aos costumes negociais.

The acquisition of failing companies is a frequent practice in the modern commercial traffic. One of these modalities is to purchase companies immersed in an insolvency proceeding, either through the purchase of the operating business or the purchase of credits in order of its capitalization. The colombian regime insolvency has the tools to enable these type of operations although they do not achieved the desire objective. La adquisición de empresas en crisis es una práctica frecuente dentro del tráfico mercantil moderno. Una de esas modalidades es la compra de empresas inmersas en proceso de insolvencia, ya sea a través de la compra del negocio en marcha o de la compra de créditos con miras a su capitalización. El régimen de insolvencia colombiano cuenta con herramientas para permitir este tipo de operaciones aunque las mismas no han alcanzado la profundidad deseada.

At the request of the Colombian authorities, the bank resolution regime was assessed against the Key Attributes of Effective Resolution Regimes for Financial Institutions (KAs). The assessment was conducted by staff of the Financial Stability Board (FSB), International Monetary Fund (IMF) and World Bank utilizing the draft KA Assessment Methodology (AM). The assessment reviewed the resolution regime as of October 2015, and was limited to the banking sector, considering only those elements of the AM that directly relate to bank resolution without assessing those addressing the resolution of insurance firms, investment firms and financial market infrastructures (FMIs). As a draft methodology was used, the findings of the assessment should be viewed as preliminary. A central goal of this assessment was to test the draft AM, and a future revision of the AM might yield different results with respect to the adherence of the Colombian bank resolution regime to the KAs. In this light, no ratings were assigned in this review. This assessment was the first one undertaken in a country that is not a member of the FSB, or home to a Global Systemically Important Financial Institution (G-SIFI).

International mutual funds are one of the main channels for capital flows to emerging economies. Although mutual funds have become important contributors to financial market integration, little is known about their investment allocation, and strategies. The authors provide an overview of mutual fund activity in emerging markets. First, they describe international mutual funds' relative size, asset allocation, and country allocation. Second, they focus on fund behavior during crises, by analyzing data at the level of both investors, and fund managers. Among their findings: Equity investment in emerging markets has grown rapidly in the 1990s, much of it flowing through mutual funds. Collectively, these funds hold a sizable share of market capitalization in emerging economies. Asian, and Latin American funds achieved the fastest growth, but are smaller than domestic U.S. funds and world funds. When investigating abroad, U.S. mutual funds invest more in equity than in bonds. World funds invest mainly in developed nations (Canada, Europe, Japan, and the United States). Ten percent of their investment is in Asia, and Latin America. Mutual funds usually invest in a few countries within each region. Mutual fund investment was very responsive to the crises of the 1990s. Withdrawals from emerging markets during recent crises were large, which squares with existing evidence of financial contagion. Investments in Asian, and Latin American mutual funds are volatile. Because redemptions, and injections are large, relative to total funds under management, fund's flows are not stable. The cash held by managers during injections, and redemptions does not fluctuate significantly, so investors' actions are typically reflected in emerging market inflows, and outflows.
