The social service sector in New Zealand is undergoing significant change with the Minister responsible for introducing a new Ministry for Vulnerable Children (now Ministry for Children) signalling a commitment to practice being child-centred and trauma-informed in the new era. There is no shared understanding of these terms or what they will mean for practice. This paper focuses on child-centred practice, beginning with a brief overview of events since 1989 when the Children Young Persons and their Families Act (now renamed the Oranga Tamariki Act) was introduced. Two dominant discourses shaping approaches to care and protection are outlined before posing child-centred practice as a third option addressing the shortcomings of these positions. Three components of child centred practice are discussed: an understanding of power dynamics; a child's rights perspective and cultural competence. The paper concludes with an overview of what will be needed to embed culturally appropriate child-centred practice and consideration of implications in a global context.

Since all policies address problems, they necessarily include implicit or explicit constructions of these problems. This paper explores how child maltreatment has been constructed in New Zealand's child protection policies. It questions the underlying assumptions of this problem construction and seeks to shed light on what has been omitted. Utilizing a qualitative content analysis of eight key policy documents, this study reveals the construction of child maltreatment has been dominated primarily by a child-centric, risk-focused approach. This approach assigns blame and shifts responsibilities onto parents and families. In addition, the vulnerability discourse and social investment approach underpinning this perspective have allowed important structural factors, such as poverty and inequality, to remain unaddressed. This paper also highlights the one-dimensional focus on the lower social class to control future liabilities. We suggest that the harm inflicted by corporations on children's well-being is another form of child exploitation currently omitted from the problem construction. We suggest that child abuse should be defined and understood in policy as harm to children's well-being and argue that the state should prevent and mitigate harm by addressing structural forces of the problem as well as protecting children against corporate harms. The Signs of Safety approach to child protection has been gaining prominence around the world and this approach has developed through learning from good practice. Generally, examples of good practice are derived from adults who pose a risk to children, while this paper outlines an example of good practice that engages an adolescent in building a safety plan. It addresses the balance needed to be struck between the complex nature of addressing concerns and developing a rigorous safety plan while not shaming the young person and creating resistance or avoidance. This paper therefore sets out how the Signs of Safety approach can be synthesised with narrative practice to create an effective approach in working with young people. Using the externalising process along with re-membering conversations, positive alternative stories can be created about the young person's identity that support desistance and promote engagement with the authorities. A case example is used to demonstrate this synthesis where a young person has displayed harmful sexual behaviour towards a child. Consideration is given as to how this approach reduces shame-inducing practice often associated with statutory child protection processes. It concludes with the potential for such an approach to be applied more widely to working with young people.

Jonathan Boston provides an insightful analysis of the emergence and persistence of child poverty in New Zealand (Boston, 2014, "Educational Philosophy and Theory"). His remarks on why child poverty matters are brief but, as he reports, "there is a large and robust body of research on the harmful consequences of child poverty" (Boston 2014, pp. 10-11). One cost he does not explicitly mention is the increased risk of maltreatment faced by children living in poverty. Given the clear correlation between risk of abuse and poverty, Boston's recommendations might be expected to go some way to addressing New Zealand's appalling child maltreatment statistics. However, Boston himself identifies both fiscal and political barriers to the implementation of his proposed strategy. "Fundamentally", he observes, "without adequate multi-party agreement, it will be hard to reduce child poverty on a durable basis" and "currently, such agreement is lacking" (Boston, 2014, p. 21). Even if we accept Boston's strategies for child-poverty reduction, then, it is prudent to consider other responses to the consequences of child poverty. Significant and controversial aspects of New Zealand's 2013 White Paper for Vulnerable Children can be read in this light, and one of them--the proposal to use predictive risk modeling (PRM) to identify children at risk of maltreatment--is the focus of this commentary.

Recent social policy discourses in Aotearoa New Zealand focus on vulnerable children's well-being and the detrimental, long-term and costly impacts of child poverty. The discourse pervading much of the policy labels children and young people as "vulnerable" or "at risk" or "in crisis", a view, which we argue, is both disempowering and marginalising. We propose a shift in focus which views children and young people as agentic, capable and competent. Drawing on several small-scale research projects and reports we demonstrate how, when asked, children and young people can participate effectively in discussions about policy matters that concern them (Article 12, United Nations Convention on the Rights of the Child, 1989 [UNCROC]). We have much to learn from the insights children share with us when asked, but very often existing structures, at both government and community level, do not include adequate processes to hear their voices, let alone act on what has been communicated.

This paper uses Positioning Theory, a theoretical framework within Discursive Psychology, to explore the positioning of children with special educational needs in the legislation of Britain, New Zealand and the Republic of Ireland. In terms of positioning the child with special educational needs as a person, the human rights legislation in all three countries ascribes person status, as does, in general, their Child Welfare legislation. Influenced by the Warnock Report of 1978, the education legislation positions the child first as a person having a special need, thus conferring person status. In terms of positioning the child as having a voice, all three countries affirm such positioning within their general legislation, but Ireland positions the child most strongly as an active partner with a voice within its recent education legislation. Finally, in terms of positioning with the right to appropriate education, all three countries confer strong rights to education and have now moved beyond the early numerous Warnock caveats to inclusion, with the wishes of parents and the best interests of the child, as remaining positive caveats.

Objectives: To describe the outcome of referral to the statutory authorities for infants under 2 years with non-accidental head injury (NAHI), and to establish whether the authorities held sufficient information to develop a risk profile for these cases. Methods: Retrospective review of cases admitted to hospital in Auckland, New Zealand from 1988 to 1998. Records from the hospital admission, child protective services and Police were reviewed, up to 19 years from diagnosis. Results: Of 39 infants, 33 survived to leave hospital. Documentation of risk factors was erratic, and sometimes incongruent between agencies. Inter-agency case conferences took place in 17/39 (44%). The Department of Child, Youth and Family Services (CYF) used an informal family agreement to secure safety in 15/33 survivors (45%). Family Group Conferences occurred in 17/33 (52%). Nine of 33 were placed permanently outside the home (27%), two (6%) with unrelated caregivers. Charges were laid in 18/39 cases (46%). Fifteen cases came to trial, with 14 convictions (36%). Of the survivors, 44% were later renotified to CYF. There was no obvious relationship between type of intervention and re-notification. Conclusions: Ensuring the safety of an infant with NAHI, and identifying and taking appropriate action with regard to the offender, are complex tasks. In New Zealand, data collection is often incomplete and inter-agency practice and collaboration is variable. Although the rate of prosecution was relatively high by international standards, many children were later notified again for further concerns of abuse or neglect, suggesting that our interventions have been only partially successful. Practice implications: This paper suggests that all infants admitted to hospital with non-accidental head injury should become part of a prospective inter-agency research study, using a standardised data collection instrument. This should include the systematic collection of all data known or suspected to be associated with risk of child abuse, and incorporate long-term prospective follow-up, regardless of child protective or legal outcomes. Without large numbers followed prospectively and according to sound methodology, it is difficult to prove which forms of intervention are better than others at reducing the risk of further abuse. Attachment theory and resilience theory have developed as two separate bodies of knowledge with their own genealogy. In this paper it is argued that the concepts of attachment and resilience should be regarded as complementary and that each is strengthened by such an approach. The cultural implications are discussed with particular reference to the indigenous population of Aotearoa New Zealand and a case is made for the importance of attachment as a crucial factor in minimising risk and maximising resiliency for children in need of care and protection.

This paper explores the issue of teacher vulnerability at a time of "child panic". It does so by first elaborating risk-consciousness as a powerful social and cultural rationality for producing moral climates and organisational identities, and then investigating how this rationality works through the fraught issue of teacher touch. Empirical data is drawn from two studies of teacher work in Australian and New Zealand schools to demonstrate that the relatively recent historical phenomenon of heightened teacher vulnerability to allegations of abusive touch is an effect of a new regime of truth that constitutes child protection. It is a regime that produces new tyrannies for the teacher at the same time that it works to eliminate tyrannies for the child.

Article 5 of the UN Convention on the Rights of the Child recognises the importance of parents and wider family members in ensuring that children are given appropriate directions on their rights in the UN Convention on the Rights of the Child. This paper analyses the wording of Article 5 and four New Zealand case studies to test the possible interpretations of Article 5. The paper builds on the work of Landsdown and Kamchedzera (Landsdown, 2005; Kamchedzera, 2012) who have done previous comprehensive analyses of the ambit and significance of the wording in Article 5. Article 5, like all international instruments, is not designed to provide prescriptive answers to challenging problems where there is a clash of which rights should prevail for children in particular situations. The central theme of this paper is that where there is a clash of a child's rights, the tiebreaker should be which right in the particular situation will best enhance the unique identity of a particular child. The paper draws on the work of Ronen (Ronen, 2004) which argues that the purpose of a child's rights framework is so the child can construct their individualised identity which is authentic and real for that particular child. The New Zealand case studies have been chosen to exemplify particular aspects of Article 5 and see how they are played out in particular court settings and whether the outcome enhances or inhibits the child's opportunity to develop their unique identity. INTRODUCTION: Reproductive justice in Aotearoa must be centred in Indigenous reproductive justice, challenging social and government systems that seek to maintain control of wāhine Māori¹ bodies in contradiction to our role as "he whare takata"², the house of humanity. This paper seeks to answer the question: What is the relationship between Indigenous women's reproductive justice rights and child removal in the Aotearoa New Zealand child protection system? APPROACH: Through centring our atua wāhine pūrākau knowledge, I look at the shift from wāhine as the holders of whakapapa³, through birthing practices and knowledge keepers, to the focus of the Aotearoa4 colonial project where women and children are controlled and punished. This article is a reflective, historical and contemporary analysis of complicit social work and settler state intervention on Māori bodies, with particular focus on wāhine and the child protection system. CONTRIBUTION: The article draws on the research and knowledge collected by wāhine researchers in the last 30 years, alongside my doctoral study locating Kāi Tahu wāhine narratives, post-child-protection system. Attention is paid to the colonial agenda which started prior to Te Tiriti o Waitangi (te Tiriti) in the clearly scripted story that usurped wāhine and continues today in multiple forms, including the child-protection system. There is a growing interest in English-speaking jurisdictions, including Australia, North America, Canada, the United Kingdom and New Zealand, about the prevention of sexual abuse perpetrated by children against other children. The aim of this review was to identify opportunities for research, policy and practice which could enhance the prevention agenda relating to the perpetration of sexual abuse by children through conducting a Critical Interpretive Synthesis. Eleven electronic databases were searched in the period from 22 April to 23 May 2013 and included: SocINDEX, Social Services Abstracts, Applied Social Sciences Index and Abstracts, Family and Society Studies Worldwide, Project Muse, PsychINFO, Family and Society Plus, Jstor, Expanded Academic ASAP, Web of Science and Google Scholar. Key individual journals were also searched, including Child Abuse and Neglect and the Journal of Interpersonal Violence, as well as the grey literature. The search was guided by the research question: How could the prevention agenda relating to sexual abuse perpetrated by children be enhanced? The systematic literature search yielded 3323 titles, and 34 of these papers were included in the final synthesis. The authors identified five domains operating in the evidence base: characteristics, causes, communications, interventions and treatments. A synthesising construct emerged from the review: prevention-enhancing interactions. This construct referred to the potential for enhancing the prevention agenda which exists as the evidence domains interact with one another, and with the public health model of prevention. The authors consider this review to be a timely contribution to the current agenda pertaining to sexual abuse perpetrated by children. It provides researchers, policy makers and practitioners in the field with an evidence-informed conceptualisation of opportunities for enhancing prevention work. [ABSTRACT FROM AUTHOR]

Social work aspires to empowerment ideals, including taking a 'non-expert' position of professional curiosity, and validating the perspectives of people in contact with services. Yet in child protection, social workers are involved in practice that refutes the views and opinions of people and are positioned by their role as an identifier of abuse and risk manager. Social workers and people who are subject to child protection services can be locked into meaning battles regarding the effect of parental behaviour and the representation of risks to children. These negotiations over meanings are especially difficult in the pre and perinatal period, where who controls the representation of the baby's voice or best interests is fundamental to decision outcomes. Using Fricker's concept of 'testimonial injustice' as an analytical lens, this article draws on studies in two different contexts: Aotearoa New Zealand and Scotland, to examine the implications of the intense mediation of meanings that affect child protection practice. We find that concepts relating to the importance of mothering, love for children, and extended family relationships were sources of mother's disagreements with professional views of risk, but that through qualified agreement or advocacy from community workers, a shared risk narrative could be constructed. This article reviews the political and ethical dimensions of technology applications in social work by focusing on a descriptive case study. The case study is of an initiative undertaken by the New Zealand government between 2011 and 2015 to develop an algorithm that would allow child protection services to predict future child maltreatment at the point of birth and to pre-empt it before it occurs. The paper explores the new threats to human rights and social justice associated with the rise of algorithmic governance and explores the sources of algorithmic injustice. New Zealand is undergoing major change in service delivery to children and families. A new Ministry for Children Oranga Tamariki has been established to oversee 5 work streams, one of which provides intensive intervention with families requiring a statutory response to child protection concerns. The government minister responsible promised that the service would be child‐centred and trauma‐informed. To date, these terms remain undefined, and there is no shared understanding of their meaning. Practice frameworks to support the work of the new ministry are still being developed, creating something of a vacuum in the meantime. The focus of this paper is the challenge of implementing trauma‐informed practice in the child protection service provided by the Intensive Intervention work stream. Limited research or commentary on trauma‐informed practice in this context currently exists. Drawing on the relevant available literature, the concept and its application in child protection social work is explored. An ecological framework is used to discuss the changes needed to achieve this. Particular attention is paid to the impact of historical trauma for indigenous people due to New Zealand's colonial history and their over‐representation in care and protection services. The White Paper on Vulnerable Children before the Aotearoa/New Zealand parliament proposes changes that will significantly reconstruct the child welfare systems in this country, including the use of a predictive risk model (PRM). This article explores the ethics of this strategy in a child welfare context. Tensions exist, including significant ethical problems such as use of information without consent, breaches of privacy and stigmatisation, without clear evidence of the benefits outweighing these costs. Broader implicit assumptions about the causes of child abuse and risk and their intersections with wider discursive, political and systems design contexts are discussed. Drawing on Houston et al. (2010) this paper highlights the potential for a PRM to contribute to a neo-liberal agenda that individualises social problems, reifies risk and abuse, and narrowly prescribes service provision. Introduction: Violence within families is a complex problem which significantly impacts health and wellbeing. Despite the ubiquitous call for integrated family violence service delivery, integrated approaches vary significantly and challenges to implementation remain. This scoping review explored how integrated approaches to family violence service delivery are conceptualised within international and Aotearoa New Zealand literature. Methods: Following a documented scoping review process identified from literature, dynamic interplay between system agents within integrated family violence service delivery were mapped with the assistance of a complexity theory lens. We analysed characteristics of included studies, agents involved, how they interacted and the methods and mechanisms of integration among them. Results: Seventy-two published reports were included. The most common interactions occurred between statutory agencies such as police and child protection. While health care service providers were included within 55 studies, their engagement was often peripheral. Qualitative analysis elucidated three broad pathways to service delivery impact underpinned by systems-centred, person-centred, or Indigenous-centred worldviews. Discussion and Conclusion: Integrated approaches to family violence service delivery are highly variable. Despite a strong assumption that integration leads to improved safety, health, and wellbeing for care-seekers, most studies did not include evidence of such impact. Examining the concepts underpinning the reasoning processes of social worker's decision‐making provides important insights into how social work practice is undertaken. This paper examines one of the major discourses used by social workers in decision reasoning in a non‐governmental organization child protection context in Aotearoa/New Zealand: family maintenance. This study found that family maintenance as a concept was strongly privileged by social workers. This resulted in attempts to preserve families and created a hierarchy of preferred decision outcomes. A preference for family maintenance was supported by legal, moral, psychological and Māori cultural concepts. This pattern of constructs underpinned the ‘weighing up of harms’ when considering removal, and generally reflected a child welfare orientation. In addition to this, it was found that ‘family’ was broadly defined, and could include people who had a relationship with the children, or Māori definitions of extended family, in addition to legal ones. Little is known about how mental health services consider the parenting role and the well‐being of children when assessing parents with acute mental illness. This paper investigated how crisis mental health services addressed child well‐being in the Wellington region, New Zealand. This mixed‐method case study included: (i) an audit of the electronic clinical records of all adults presenting to the crisis assessment team; (ii) interviews with 22 key informants; and (iii) a documentary review. We found that data about children were not systematically collected. Less than half of (49 of the 104) the records of patients who were parents included information on their child's well‐being; only six (6%) contained a specified plan for action. The focus for services was the adult patient. Key informants were unclear about their role. They identified inadequate training and institutional support, inflexible funding models and limited availability or inappropriateness of referral services as problems. They saw a need for children to become more visible, for collaborative working to improve the use of existing services and for new funding models, resources and roles. Existing national policy documents contained little guidance and no practice guidelines were in use. This paper reports on the qualitative phase of a New Zealand study of young people who had been exposed to "risky" environments from a young age. These young people had experienced traumatic events such as abuse, violence, addictions, mental health issues, and many had been excluded from school. The young people (aged between 13 and 17) were users of multiple services (statutory and nongovernmental services including: child welfare, juvenile justice, remedial education, and mental health services). Qualitative interviews (n = 109) explored young people's experiences in their families, communities, education, and their perspectives on support provided by services and their own support networks. Three thematic clusters emerged as central motifs in young people's experiences and are the focus of this article: navigating "risky" environments; services and support; and, working to find different pathways. This article draws on the findings of the qualitative phase of a New Zealand longitudinal study on vulnerable young people’s transitions to adulthood. The young people were aged between 12 and 17 years at the time of the first interview. The paper focuses on one key finding, how youth enact agency through their relationships with significant others: families, social workers, teachers and care workers. These youth had experienced sustained exposure to harm including abuse, violence, addictions, disengagement from school and mental health issues. The qualitative interviews focused on young people’s experiences with services (child welfare, juvenile justice, mental health and education support services) their key transitions, and the strategies they used to locate support and resources. The thematic analysis of the interviews indicated that a search for agency was a central motif in young people’s experiences. This paper compares and contrasts child death review (CDR) structures and processes in six countries - Australia, New Zealand, the United States, Canada, England and Wales. It presents findings from a comparative study based on analysis of data from 18 case studies. Data were collected through a combination of documentary analysis, interviews and observations. The study found that CDR processes vary according to: where the function is located and whether review is undertaken at state, local or national level; whether review is rooted in legislation; the focus of review; whether dedicated funding is provided; whether families are involved in the process; and whether structures are supported by useful data systems. It was not possible to evaluate the effectiveness of different review systems but the findings suggest that structure makes little difference in terms of determining the extent to which CDR findings inform prevention effort and activity. While factors such as lack of funding, lack of national data, or lack of legislation may hinder the work of CDR teams, CDR findings have informed prevention initiatives despite such barriers. The article discusses the use of economic and fiscal arguments in the creation of social service and child welfare policies under the administration of New Zealand Prime Minister John Key in 2012. The results of a government cohort study of people born in Dunedin New Zealand are presented, which linked early childhood experience to later education and life performance. Early intervention programs for at-risk children are recommended, and infometric analysis of the poor are mentioned.

This paper presents a way of thinking about and doing child protection work using community development (CD) principles to guide practice. It suggests that a useful addition to CD can be found within the rights of the child provisions in Human Rights conventions. Using examples from the authors' three countries to illustrate the work that practitioners do in their work with children at risk, we argue that social work practice can be enhanced by the inclusion of these principles and practices which are essentially core generic social work practice. However, much of social work with the protection of children is bound by ‘risk’ perceptions which result in investigatory approaches being used as a first action, often to the exclusion of preventive approaches. This article demonstrates that in very different situations from different environments, CD in concert with the principles of the rights of the child can assist good outcomes with children at risk. Over the past two decades, engaging families in decision-making has grown in popularity across child welfare systems internationally. The family group conference in particular has generated interest as a practice model that facilitates broader family engagement in care and protection. As the practice has flourished, research has been undertaken to strengthen the knowledge base and to support the introduction of family engagement strategies across jurisdictions. This paper examines the recent research relating to family engagement strategies in child welfare and explores the ways in which family involvement in decision-making can be incorporated into emerging protective practices. This paper investigates the reasoning processes of social workers in child protection social work as they make decisions. Within this interpretive process, they assign meaning to clients' behaviours in a context containing a multitude of competing discourses relating to the nature and cause of clients' problems. The study used a qualitative approach, specifically a critical incident framework. It asked workers to describe cases they felt ‘pleased with’ and explain the reasoning processes they used in those cases. It also asked clients their views of decisions made about them. This article draws on social constructionist theorising to describe and analyse the discourses used to frame the aims of practice and the causes of clients' problems. It found that workers valued family maintenance and sought to bolster this while managing potential risk. In the cases selected by workers, they constructed the causes of clients' problems in non-blaming but individualised ways, viewed clients as being capable of change and honest in their dealings with workers. It is proposed that these ways of viewing contributed to maintaining relationships with clients despite the challenges of balancing risk, care, control and power. [ABSTRACT FROM PUBLISHER]

Access to protection orders for women experiencing domestic violence has recently been identified as a problem in New Zealand, and ways of addressing this problem are now being developed. Police-initiated protection orders, called safety orders, have been proposed to provide immediate protection to women who experience domestic violence and to overcome some of the evidential difficulties that can arise through representation in the Family Court. This discussion paper was commissioned to provide a review of the literature relating to safety orders. The paper uses a conceptual framework to identify the implicit assumptions associated with safety orders initiated by the police, and then compares these assumptions with the relevant research findings relating to police interventions, the actions women take to protect themselves and the court's responses to breaches of protection orders. Finally, conclusions are drawn about the ongoing need for education of the police and court personnel, and the need for compassionate involvement of women and their advocates in new initiatives. This paper discusses the development of a practice framework for child welfare in New Zealand. A practice framework is defined as a conceptual map that brings together, in an accessible design, an agency's approach to social work practice with children and families. Designed as a tool for practitioners, the New Zealand practice framework integrates three perspectives: child-centred; family-led and culturally responsive; and strengths and evidence-based. The practice framework establishes a vision for New Zealand child welfare work that is grounded in the realities of practice, supported by research and embedded in a set of principles and values that are essential to the work. As a concept, it provides a clear understanding of what underpins the work, and how this informs our interventions with children and families. Aim: This study aims to provide an overview of the association between being in the custody of the chief executive of Oranga Tamariki (the child welfare agency of the New Zealand (NZ) government) and all‐cause hospitalisation and mortality. Methods: This was a national retrospective cohort study using linked administrative data from the Integrated Data Infrastructure. Data were obtained for all 0–17 year‐olds living in NZ on 31 December 2013. In‐care status was ascertained at this point. Outcomes of all‐cause hospitalisation and all‐cause mortality were assessed between 1 January 2014 and 31 December 2018. Adjusted models incorporated age, sex, ethnicity, level of socioeconomic deprivation and rural/urban status. Results: There were 4650 in‐care children and 1 009 377 not‐in‐care children in NZ on 31 December 2013. Of those in care, 54% were male, 42% lived in the most deprived areas and 63% identified as Māori. Adjusted models showed that in‐care children were 1.32 (95% CI 1.27–1.38) times more likely to be hospitalised than not‐in‐care children and 3.64 (95% CI 2.47–5.40) times more likely to die. Conclusion: This cohort study highlights that the care and protection system prior to 2018 was not preventing children in its care from experiencing severe adverse outcomes. Overseas research has previously been relied on when making practice and policy decisions around child care and protection in NZ, so this research will provide valuable insight into best practice in an NZ context. Julian Le Grand has argued that a key component of welfare reform involves changes in the assumptions about human behaviour which are embedded in social policies. Policy assumptions have been transformed from espousing a belief that social service providers act as well-intentioned knights and recipients as passive pawns, to a stance in which all participants are regarded as self-seeking knaves. These ideas are particularly pertinent to policy developments concerning financial obligations for children, and this paper examines these issues in relation to child support policy in New Zealand. It highlights the evident and inevitable failure of this policy to meet its primary stated aim of revenue generation. In New Zealand this failure is compounded by the creation of parallel systems for dealing with children and families, one for financial obligations and the other for care and development, which are founded on diametrically opposed assumptions about human behaviour and capabilities. This paper questions the extent to which New Zealand children have benefited from New Right economic policies and argues that the invisibility of children, the role of public concern about children and the social construction of childhood are factors which have facilitated implementation of these changes. Attention is drawn to the ways in which the personal and the political spheres intersect in children's lives. Rather than focusing on either the micro level of intervention in the lives of individual children or the macro level of societal change it is argued that the dualism itself must be transcended in order to move forward from the current position. The mental health consumer movement initiated the development of the recovery approach, in which self-determination, human rights and the living of a hopeful life superseded merely symptom management for people living with mental illnesses and addictions. To what degree has this reimagined path to recovery shaped social work practice? In this paper we analyse the perspectives of eleven social workers doing child protection work in Aotearoa New Zealand. We examine also the accounts of thirteen parents living with mental illness or addiction who have been involved in child custody investigations in Aotearoa New Zealand. We ask whether the social workers understand recovery as possible for such parents, and if so, how they see it occurring. We found that there is a substantial difference between the way the social workers and the parents conceived of such ‘recovery’. While parents' descriptions of recovery reflected those of the mental health consumer movement, social workers tended to operate with a focus on clinical intervention, symptom and risk management. Internationally, child welfare services experience chronic workforce shortages and high rates of staff turnover. One strategy adopted to fill critical workforce gaps is the international recruitment of social workers. Child welfare employers in Australia, New Zealand and the United Kingdom have a shared tradition of recruiting transnational social workers to address ongoing labour shortages in the Northern and Southern Hemisphere. This raises questions about the impact of this practice for those migrating social workers and about practice with indigenous populations. This paper scoped publications to identify emerging themes about social work movement between these countries, with a focus on knowledge that can prepare transnational social workers for the unique Australian context, including working with Aboriginal and Torres Strait Islander communities. The review found that international recruitment to statutory child welfare in Australia is not well researched, with limited evidence about the profile of recruits, the effectiveness of this strategy and retention rates. The demographics and experiences of overseas qualified social workers in child welfare over the past 40 years in the various Australian jurisdictions remain relatively unknown. There are major gaps in knowledge about the ways international recruitment affects outcomes for children, and their families, in Australia's statutory child welfare services delivery. During the last decade the New Zealand Family Court has been central to the transformation of key aspects of Family Law. It has provided a forum for conciliation, thus enabling the resolution of family conflict without recourse to the formal adjudicative process. Conciliation, coupled with a diminution in the use of adversarial techniques by lawyers, have combined to take the bitterness and recrimination out of family breakdown. It is now firmly established that the overrepresentation of tamariki Māori within the Aotearoa New Zealand child protection system is largely a consequence of colonisation. However, at least as far as the Crown is concerned, the contention that decolonisation is a necessary step in reversing those trends remains a more controversial issue. Drawing on my doctoral research into this topic, this article argues that the child protection system must be decolonised, and that efforts towards reform which do not prioritise decolonisation are likely to perpetuate long-standing harms. The article has four goals. First, I examine why decolonisation provides the best framework through which to enact child protection system reform. Secondly, I identify three overarching themes within the current legal framework, but argue that the presence of these themes does not mean they are all given equal weight. Thirdly, I outline a theory of reform I have termed "kaupapa Māori legal theory", which seeks to enable legislative change based on tikanga Māori in a way which pays heed to the risks of doing so from a Māori perspective. Finally, I apply that theory to child protection law, identifying six tikanga principles which could provide the basis of a decolonised system: mana, rangatiratanga, wānanga, whānau, whakapapa and whanaungatanga. This article is a critical analysis of the legislative implementation of the Hague Convention on the Civil Aspects of International Child Abduction in New Zealand. Many other implementing states used the formula method, but New Zealand used the wording method to implement that Convention into domestic law. The true meaning of Convention terms was distorted in the process. Therefore, the terms of the Convention have a different meaning in New Zealand than they do in other implementing states. The article presents a paper which discusses, issues related to relocation disputes in New Zealand and England that were presented during the Law Faculty Seminar at Otago University in Dunedin, New Zealand. It notes the deviation of New Zealand courts from the English approach on the basis that it proceeded on a flawed interpretation of the welfare of children. It depicts the development of relocation law in New Zealand and in England, citing the similarities and differences at various periods.

Broad international comparisons of paid parental leave often leave New Zealand's policies looking less than adequate. This paper compares current policies in New Zealand and the United Kingdom. The extent to which either country has been able to implement maternity and parental leave policies has been comparatively limited, but the UK's relationship with the European Union has led to more comprehensive policies than those found in New Zealand. New Zealand will not be forced to comply with a regional or international standard, and it is unclear if there is sufficient momentum for change without such compulsion. The New Zealand state developed from a treaty between the British Crown and hapū (sub-tribes) in 1840. The te Reo (Māori language) text and the English version of the agreement are fundamentally different. Breaches of this treaty and tension over how the political relationship between Māori and the Crown should proceed are ongoing. In 2019, the Cabinet Office issued a Circular instructing bureaucratic advisers of the questions they should address when providing advice to ministers on the agreement's contemporary application. In this article, we use Critical Tiriti Analysis (CTA) – an analytical framework applied to public policies – to suggest additional and alternative questions to inform bureaucratic advice. The article defines CTA in detail and shows how using it in this way could protect Māori rights to tino rangatiratanga (a sovereignty and authority that is not subservient to others) and substantive engagement, as citizens, in the formation of public policy. This article's central argument is that the Circular reflects an important evolution in government policy thought. However, in showing how the Circular privileges the English version (the Treaty of Waitangi) over the Māori text (Te Tiriti o Waitangi), the article demonstrates how Māori political authority remains subservient to the Crown in ways that Te Tiriti did not intend. We show through the conceptual illustration of the care and protection of Māori children, despite the significant evolution in government thought that it represents, these rights are not fully protected by the Circular. This is significant because it was Te Tiriti, with its protection of extant Māori authority and sovereignty, that was signed by all but 39 of the more than 500 chiefs who agreed to the British Crown establishing government over their own people, but who did not agree to the colonial relationship which may be read into the English version. An increasing concern of families caring for children living with disabilities is related to planning for their future care. This qualitative study explores how the country contexts shape the plans for future care provision of Korean parents in New Zealand and Korea. Data were collected using semi-structured interviews with parents (n = 18) and professionals (n = 18). The study revealed that there are differences and similarities regarding the social reality of future care planning among Koreans in different national contexts. The paper presents the author's opinion on the article Choosing Between Child Protection Programmes by Freda Briggs and Russell Hawkins which appeared in the 1994 issue of Child Abuse Review. Only three statements in the Briggs and Hawkins' paper are surprising. There are now child protection programmes in most western countries. As might be expected, each programme is claimed by its creator to be unique and superior to all other existing programmes. The reality is that no one knows for certain if these programmes are helping to reduce the incidence of abuse. Children have the right to information which might keep them safe and the best way to teach them is with age-appropriate material presented through teacher commitment and parental support. It was therefore no surprise that Briggs and Hawkins found that the New Zealand programme was more effective because of the teacher commitment, parental support and age-appropriate material. The most important conclusions of the article are that child protection programmes appear to be most effective when they are designed for a particular culture, are part of a curriculum, develop children's self-esteem and are adopted by the entire school. Messages about preventative strategies for children need to be reinforced by a variety of approaches.

Aim: To describe the multi‐disciplinary child protection teams which administer the National Child Protection Alert System in District Health Boards in New Zealand and the understanding and perceptions of that system held by team members. Methods: This is a mixed‐method observational study. In December 2016 and January 2017, all child protection alert system multi‐disciplinary team members were invited to participate in an online survey. Quantitative data were expressed with simple descriptive statistics. Qualitative findings were analysed using thematic analysis. Results: Ninety‐one (56.9%) of 160 team members nationwide completed the survey. All 20 District Health Boards and multiple disciplines were represented. Most respondents agreed that they received good information to make decisions (74/90, 82.2%), that it was usually easy to reach consensus (82/91, 90.1%), that the system helped to keep children safe (72/91, 79.1%) and that it did not stigmatise families (49/91, 53.9%). Qualitative analysis identified considerable variation in understanding of the system and a need for more training to support more consistent implementation of the system. Conclusions: Overall, health professionals responsible for the child protection alert system regard it positively but express a need for more training for team members and front‐line staff to maximise the system's potential and minimise any risk of stigmatisation. Children's perspectives rarely appear at strategic levels in public health. Policy‐makers can hold adult‐centric assumptions about children, and may be uncertain about how to interpret and apply children's perspectives in policy. Yet how children experience and perceive health interventions can shape the success of services. What, then, might child‐centred approaches to health policy consider? Through ethnographic work in New Zealand, I document how children engage with a school rheumatic fever prevention service, and provide a framework of three lenses through which policy‐makers can more meaningfully consider children's perspectives on health: (a) The embodied‐child; (b) the social‐child, and (c) the public‐child. New Zealand typifies countries that were colonized in that its indigenous population has long remained disproportionately affected by child protection services and their periods of doctrinaire practices, despite decades of reviews, reforms and promises to change. The very broad scope of child welfare services and their complexity require strong means of holding them to account. Diverse operational practices, as well as differing views of the science and received wisdoms are just some of the elements which create a system which is disconnected for those who engage with it. Public agency performance measures and transparency are not sufficient to bring about the degree of accountability that will meet the needs of public legitimacy when there are diverse communities with different histories with child welfare services to take account of. Strong independent oversight is needed to determine what might make it possible for trust to be properly placed, and legitimacy to be sufficiently established at a system level in order to support social workers in their difficult work amongst all communities. The problems for child welfare services in establishing political legitimacy have significant parallels in how agency and system accountability needs to be established across many unrelated forms of public administration.
