An open letter that was originally shared on openmod and LinkedIn calling for open data licensing wherever possible. &nbsp

This slidedeck was presented to the Free Software Foundation Europe (FSFE) Legal Network (LN) Legal and Licensing Workshop 2022 (LLW‑2022) on 18 May 2022. The LLW series are annual events organized by the LN community, which comprises mostly intellectual property lawyers and software engineers working with free and open source software (FOSS). The focus of this presentation is European Union law. And specifically the novel data producers right in the proposed Data Act and the definition of "re‑use" contained in the Open Data Directive 2019/1024. Also examined is the legal status of information under statutory reporting and the special needs of information of public interest.

This presentation was part of an online seminar titled "The ability to use and re-use published data for which the copyright or license is missing or unclear". The event was hosted by the Danish Centre for Environmental Assessment Aalborg University, Denmark on 1March 2022. The seminar itself was not recorded based on the wishes of participants. The abstract for this presentation starts (truncated by about half): Energy system analysts working in Europe and elsewhere have begun the long journey toward establishing a knowledge commons for the energy sector. The advantages of having a single, virtual, maintained, shared, and coherent bedrock of data for integrated system analysis are self‑evident. The entire undertaking is nonetheless predicated on being able to source legally unencumbered public data from official sources. This presentation examines the legal status of public data in Europe under current conditions. Key legislation like the database directive 96/9/EC, the open data directive 2019/1024, and prevailing copyright law are examined in the context of this emerging knowledge commons. And the picture that emerges is far from encouraging. Despite its name, the open data directive does not support genuinely re‑usable data, the database directive remains an impediment, the legal status of material under statutory reporting is in general compromised, and it can be difficult to discern the conditions under which pivotal public sector entities should release their information. The solution advocated here is to press for public information providers to deploy Creative Commons CC‑BY‑4.0 licenses on primary data and CC0‑1.0 public domain dedications on the associated metadata and cataloging information.

Online presentation to Seminar – Introduction to Software Licensing in Europe, Chair of Civil Law, Technology, and IT Law, Humboldt University, Berlin, Germany, 16 February 2022.

These slides present examples of normal price separation, reserves market abuse under nodal pricing, and simple rent seeking. The events described occurred in New Zealand in 2011 and 2012. The material is intended as a topical illustration for the phenomena described in Harvey and Hogan (2000) (reference given at end). In mid���2012, Meridian Energy, a state���owned vertically integrated generator/retailer, allegedly exercised market power in the New Zealand Electricity Market. It did so by pricing up reserve services while the HVDC inter���island connector (Cook Strait cable) was at reduced capacity during an engineering upgrade. In March 2011, Genesis Energy capitalized on its market power and temporarily raised prices by a factor of 120��. The New Zealand regulator subsequently reduced this to a 17�� increase. This technical note provides some general guidance on the selection of open licenses for datasets arising in the domain of energy systems analysis. Slides accompanying one hour webinar run by Energy Systems Catapult (ESC) based in Birmingham, United Kingdom: https://es.catapult.org.uk The main theme concerns the legal context of energy sector datasets— principally from the perspective of European and United Kingdom law — and the use of open licenses to enable maximum use and re‑use. Abstract Suitably licensed open data together with relevant open standards can contribute to better public policy for the much needed energy transition, through more open science and improved public interest analysis. This talk covers the legal context for such data, the role of public licensing, the role of open standards, the need for a collective agreement on semantics and metadata in particular, and benefits of community curation. The talk is limited to non‑personal data that may be made public legitimately, thereby avoiding matters of personal and commercial privacy.
