Abstract

The article presents a letter focused on a study which determines the rate of appeal by the elderly against compulsory detention under the Mental Health Act 1983 of the United States. The authors of the letter pointed out that use of the Mental Health Act to detain compliant incapacitated patients may result in the inability of this patient group to exercise their right of appeal due to their incapacity.
