Background: The Dangerous Dogs Act (DDA) is considered among the most controversial pieces of legislation ever passed in the UK. Its effectiveness and how it works in practice, up until a dog and its owner are charged, has been subjected to considerable analysis. However, there has been little examination of how the DDA works after charging, nor of how courts are interpreting it., Method: We accessed legal cases from 1992 to 2019, the period in which the DDA has been in force. Each case was examined from a legal and ethical perspective, using doctrinal legal methodology and the principlism approach to ethics described by Beauchamp and Childress., Results: Analysis showed that while improvements to the function of the act have been made, substantial legal and ethical failings remain, particularly with Section 1 and the therein breed specific legislation (BSL)., Conclusion: Legal failings could be partially resolved by removing the reversed burden of proof placed on dog owners and allowing a change of ownership for banned breeds. However, ethical failings could only be resolved through the abolition of BSL. Further study into whether judicial bias exists against certain breeds found to be dangerously out of control is warranted., (© 2021 The Authors. To own a television, you have to have a licence, and to drive a car, you have to pass a test. However, there are no such limitations on owning a pet. Should this be changed, and what can be done to encourage more responsible pet ownership? This topic was discussed at the BVA Congress at the London Vet Show on November 21. Georgina Mills reports.

Judicial approaches to stored (cryopreserved) human embryos, in western jurisprudence, tend not to reflect approaches within systems of moral ordering or particular religious traditions, which differ among themselves. The emerging judicial approach is pragmatic, protecting individuals' rights of control and their interests in parenthood. Embryos are approached instrumentally, not by reference to any inherent characteristics that may be attributed to them outside the law. Political legislatures may adopt religious approaches, such as by prohibiting embryo preservation and limiting how many may be created in an IVF treatment cycle. Legislatures may alternatively set time limits on embryo preservation, however, on expiry of which they must be left to natural degeneration. In treating human embryos as property, courts recognize owners' powers of voluntary disposition, for instance by gift, but have held back from making financial assessments of their value, for instance on loss, consistently with legislation prohibiting their exchange for payment., (Copyright © 2010 International Federation of Gynecology and Obstetrics. Background: In the past, many surgeons could practise their craft with little or no knowledge of patent law. But in the world of robotic and computerized surgery, this is increasingly a myopic approach, because the principle means of protecting high-tech surgical instruments is through the application of patent law. The issue is: does the Brookhill-Wilk patent, which covers the performance of remote robotic surgery, impede the growth of cybersurgery?, Methods: Review of the Brookhill-Wilk patent and relevant law., Results: Patent law, which first took its form in the Middle Ages, attempts to balance the rewarding of innovation with the stifling of market growth. Using US patent law as a model, it would appear that the Brookhill-Wilk patent, a particular example of a medical process patent, could inhibit the growth of cybersurgery, as potential sums of money could be demanded by the patent holder from anyone who practises cybersurgery. However, two recent US Supreme Court cases appear to have seriously undermined the validity of a number of medical process patents, including the Brookhill-Wilk patent., Conclusion: Based on recent changes in patent law, it is not expected that Brookhill-Wilk patent will hinder the growth of cybersurgery.

The use of the newly dead to teach procedures is widely practiced in training institutions. This model allows a realistic opportunity both to become more familiar with lifesaving maneuvers before they are actually necessary and to maintain proficiency. Whether to notify the next of kin first has been an issue of ethical debate. Some argue a "don't ask, don't tell" policy is justified, while others mandate open consent by family members prior to the practice. Several medical studies have found that patients and families are likely to consent to the procedures but prefer to be asked permission first. Multiple legal cases have addressed the issue of usage of cadavers postmortem without expressed permission. Earlier cases emphasized the concept of "pseudo-property" rights and declared that the next of kin do not have constitutional ownership of the deceased person's body. More recent legal cases are declaring that families do, in fact, possess these rights. In this day and age of increasing recognition of personal autonomy, it is probably prudent to approach the next of kin for permission before performing procedures on the newly deceased.
