When federal government agencies and programs lack budget authority after the expiration of either full-year or interim appropriations, they experience a "funding gap." Under the Antideficiency Act (31 U.S.C. §§1341 et seq.), they must cease operations, except in certain circumstances when continued activities are authorized by law. When there is a funding gap that affects many federal entities, the situation is often referred to as a government shutdown. In the past, there have occasionally been funding gaps that led to government shutdowns, one of which lasted 21 days, from December 16, 1995, to January 6, 1996. A shutdown occurred at the beginning of FY2014 (October 1, 2013) and lasted for a total of 16 days. Subsequently, two comparatively brief shutdowns occurred during FY2018, in January and February 2018, respectively. The longest shutdown occurred in FY2019-beginning at the end of the day on December 21, 2018, and lasting 35 days. The relevant laws that govern shutdowns have remained relatively constant in recent decades. However, agencies and officials may exercise some discretion in how they interpret the laws, and circumstances that confront agencies and officials may differ over time. Consequently, it is difficult to predict what might happen in the event of a future shutdown. Still, information about past events may offer some insight into possible outcomes and help inform future deliberations. This report provides an annotated list of historical documents and other resources related to several past government shutdowns. The Constitution grants Congress the power to borrow money on the credit of the United States-one part of its power of the purse-and thus mandates that Congress exercise control over federal debt. Control of debt policy has at times provided Congress with a means of raising concerns regarding fiscal policies. Debates over federal fiscal policy have been especially animated in the past decade, in part because of the accumulation of federal debt in the wake of the 2007-2008 financial crisis and subsequent rec ession. Rising debt levels, along with continued differences in views of fiscal policy, led to a series of contentious debt limit episodes in recent years. On August 2, 2019, the Bipartisan Budget Act of 2019 (BBA 2019; P.L. 116-37; H.R. 3877), which modified discretionary spending limits, was enacted, suspending the debt limit until July 31, 2021. Once that suspension lapses, the Treasury Secretary can employ extraordinary measures to meet federal financial obligations. Several factors could make debt limit projections more uncertain in 2021. A 2011 debt limit episode was resolved on August 2, 2011, w hen President Obama signed the Budget Control Act of 2011 (BCA; S. 365; P.L. 112-25). The BCA included provisions aimed at deficit reduction and allowing the debt limit to rise in three stages, the latter two subject to congressional disapproval. Once the BCA was enacted, a presidential certification triggered a $400 billion increase. A second certification led to a $500 billion increase on September 22, 2011, and a third, $1,200 billion increase took place on January 28, 2012. Federal debt again reached its limit on December 31, 2012. Extraordinary measures were again used to allow payment of government obligations until February 4, 2013, when H.R. 325, which suspended the debt limit until May 19, 2013, was signed into law (P.L. 113-3), which reset extraordinary measures. On October 16, 2013, enactment of a continuing resolution (H.R. 2775; P.L. 113-46) resolved a funding lapse and suspended the debt limit through February 7, 2014. On February 15, 2014, the debt limit was suspended through March 15, 2015 (P.L. 113-83). On November 2, 2015, the Bipartisan Budget Act of 2015 (BBA2015; H.R. 1314; P.L. 114-74) was enacted, which suspended the debt limit through March 15, 2017, and relaxed discretionary spending limits. On March 16, 2017, the debt limit was reset at $19,809 billion, which triggered the use of extraordinary measures. On September 8, 2017, P.L. 115-56 was enacted, which included a continuing resolution and suspended the debt limit through December 8, 2017. Once that suspension lapsed-with a new debt limit set at $20,456 billion-Treasury Secretary Mnuchin again invoked authorities to employ extraordinary measures. The Bipartisan Budget Act of 2018 (BBA 2018; P.L. 115-123), enacted on February 9, 2018, suspended the debt limit through March 1, 2019. The limit was then reset at $21.988 trillion to accommodate federal obligations incurred during the suspension period. U.S. Treasury Secretary Steven Mnuchin invoked extraordinary authorities on March 4, 2019. As noted above, enactment of BBA 2019 on August 2, 2019, resolved the debt limit episode. Total federal debt increases when the government sells debt to the public to finance budget deficits, which adds to debt held by the public, or when the federal government issues debt to certain government accounts, such as the Social Security, Medicare, and Transportation trust funds, in exchange for their reported surpluses-which adds to debt held by government accounts; or when new federal loans outpace loan repayments. Options related to expired tax provisions in the 115th Congress include (1) extending all or some of the provisions that expired at the end of 2017 or (2) allowing expired provisions to remain expired. This report discusses FY2018 appropriations (discretionary budget authority) for the Bureau of Economic Analysis (BEA) and Bureau of the Census (Census Bureau), historic components of the Economics and Statistics Administration (ESA) in the U.S. Department of Commerce. This report will be updated as legislative developments warrant. The Administration’s FY2018 budget request assumes the termination of ESA and proposes $97.0 million for BEA, $6.8 million (6.6%) less than the $103.8 million enacted for FY2017. The FY2018 request for the Census Bureau is $1,497.0 million, $27.0 million (1.8%) more than the FY2017-enacted $1,470.0 million. The FY2018 request is divided between the bureau’s two major accounts: $246.0 million for Current Surveys and Programs, $24.0 million (8.9%) less than the $270.0 million enacted for FY2017; and $1,251.0 million for Periodic Censuses and Programs, $51.0 million (4.3%) more than the $1,200.0 million approved for FY2017. The foremost program under this account is the 2020 Decennial Census, with an $800.2 million FY2018 request that is $32.9 million (4.3%) above the $767.3 million enacted for FY2017. A second key program is the American Community Survey (ACS), with an FY2018 request of $213.6 million, $8.0 million (3.6%) below the $221.6 million FY2017-enacted amount. The House Committee on Appropriations reported H.R. 3267, the Commerce, Justice, Science, and Related Agencies Appropriations Act, 2018 (CJS), on July 17, 2017. Committeerecommended funding for BEA in FY2018 is $96.0 million, $1.0 million (1.0%) less than requested and $7.8 million (7.5%) less than enacted for FY2017. The Census Bureau would receive $1,507.0 million in FY2018, $37.0 million (2.5%) more than enacted for FY2017 and $10.0 million (0.7%) above the FY2018 request. The $256.0 million recommended for Current Surveys and Programs is $14.0 million (5.2%) below the FY2017-enacted amount and $10.0 million (4.1%) more than requested for FY2018. Periodic Censuses and Programs would receive the requested $1,251.0 million, $51.0 million (4.3%) more than enacted for FY2017. H.R. 3267, as reported, became Division C of H.R. 3354, which the House passed on September 14, 2017. The Senate Committee on Appropriations reported its FY2018 CJS appropriations bill, S. 1662, on July 27, 2017. It continues to recognize ESA and recommends funding it at $99.0 million in FY2018, $8.3 million (7.7%) below the $107.3 million enacted for ESA in FY2017, $2.0 million (2.1%) more than the FY2018 request for BEA, and $3.0 million (3.1%) more than the Housepassed BEA funding level. The Census Bureau would receive $1,521.0 million in FY2018, $51.0 million (3.5%) over the FY2017-enacted amount, $24.0 million (1.6%) above the request, and $14.0 million (0.9%) more than the House recommendation. The Senate committee recommends $270.0 million for Current Surveys and Programs in FY2018, identical to what was enacted for FY2017, $24.0 million (9.8%) more than the FY2018 request, and $14.0 million (5.5%) above the House-passed level. Periodic Censuses and Programs would receive $1,251.0 million in FY2018, which matches the requested and House-passed amounts and is $51.0 million (4.3%) above the FY2017-enacted level. FY2017 ended without enactment of final FY2018 CJS appropriations legislation. Four continuing appropriations acts provided federal agencies with FY2018 funding at FY2017 appropriations levels, reduced by 0.6791%, through February 8, 2018. The Census Bureau, however, could apportion the funds for Periodic Censuses and Programs “up to the rate for operations necessary to maintain the schedule and deliver the required data according to statutory deadlines in the 2020 Decennial Census Program.” A fifth act, H.R. 1892, P.L. 115-123, continues these provisions through March 23, 2018, with an additional $182.0 million for the 2020 census.
