Having recently registered the 500th dispute at its docket, the WTO dispute settlement system is as prolific and relevant as ever. By almost any measure, it is a great success; it has contributed to bolstering the WTO’s legitimacy, increased the judicialisation of WTO Members’ trade relations, and promoted the scientification of public international law. With regard to the latter phenomenon, part of the empirical turn in WTO law is manifested as increasing reliance on economic theory and method, and econometric evidence in dispute settlement. Positive as that development may be due to the promise it holds for diminished judicial discretion, it increases complexity and poses questions as to the system’s capacity to administer WTO law in an efficient and effective manner, with implications for its legitimacy. Despite economics’ increased relevance, WTO law has not devised a way to implement a suitable response and its approach seems ambivalent. By contrast, EU competition law has undergone (arguably, successfully) a conscious transition to a 'more economic approach'. Could its experience provide guidance for the implementation of a more economic approach to WTO law, despite the two systems' institutional differences? This monograph compares WTO law and dispute settlement’s approach to economics with EU competition law’s more economic approach. The applied method is normative comparative law and economics and the relevant benchmarks adopted are administrability, effectiveness, and efficiency, taking into account legal certainty, predictability, consistency, coherence, clarity, deterrence, capacity, and the effects of judicial mistake. Three broad aspects of the two systems are compared: market definition and 'likeness', theories of harm and trade effects, and quantification in sanctions and remedies. Through detailed description of the two systems’ features and thorough evaluation according to the benchmarks, WTO law is shown to be less administrable, effective, and efficient than EU competition law. Explanations unrelated to the more economic approach are sought, but the majority are rejected. The monograph makes normative conclusions for WTO law’s improvement through the correct implementation of a more economic approach. Most importantly, it suggests increased capacity for all key actors in WTO dispute settlement and innovative ways to understand fundamental WTO concepts such as 'likeness', 'less favourable treatment', trade harm, trade effects, and the level of permissible countermeasures. I avhandlingen undersöks tillämpningen av en mer ekonomisk metod i WTO rätt och WTO tvistlösning, i jämförelse med EU konkurrensrätts utförande av en ekonomisk metod baserad på utförliga marknadsdefinitioner, skadeteorier och effekter, och kvantifiering av konkurrensskadan. WTO rätt och dess tvistlösningsmekanism är i allmänt mycket framgångsrika. Rättspraxisen från WTO:s tvistlösningsorgan har bidragit till WTO:s legitimitet och lett till ökad rättssäkerhet i handelsrelationer mellan WTO:s medlemsstater och ett mer vetenskapligt och mindre godtyckligt förhållningssätt till WTO rätt och internationell handel. Det sistnämnda fenomenet manifesteras genom ökat användande av ekonomisk teori och metod samt ekonometrisk bevisning i tvistlösning. Även om det kan anses vara positivt, i med att det minskar juridisk diskretion, det medför emellertid några risker, eftersom det ökar komplexiteten i rättspraxisen och sätter höga krav på systemets kapacitet att administrera WTO rätt på ett effektivt sätt; resultatet må vara att legitimiteten snarare minskar än ökar. WTO rätt har hittills inte tänkt ut ett tillfredställande sätt att angripa problemet och dess förhållningssätt är fortfarande mycket ambivalent. Däremot har EU konkurrensrätt genomgått med framgång en medveten metamorfos från ett system fixerat på syftesöverträdelser och per se missbruk av dominerande ställning till ett system som tar hänsyn till ekonomisk teori och metod. Med den bakgrunden och baserat på ostrukturerade iakttagelser i de två rättsystemen uppstår frågan: Kan EU konkurrensrätts tillämpning av en mer ekonomisk metod instruera WTO rätts förhållningssätt till ekonomisk teori och metod? Den metod som tillämpas i avhandlingen är normativ komparativ rättsekonomisk analys och är en kombination av komparativ rätt och rättsekonomi. De riktmärken som används för att utvärdera EU konkurrensrätt och WTO rätt är administerbarhet och effektivitet, vilka inbegriper bl.a. rättsäkerhet, förutsägbarhet, följdriktighet, koherens, klarhet, avskräckning från att begå överträdelser, kompetens av inblandade aktörer, samt effekterna av juridiskt misstag. Tre breda aspekter av WTO rätt och EU konkurrensrätt jämförs: marknadsdefinition och ’likhet’, skadeteorier och handelseffekter, samt kvantifiering av sanktioner och åtgärder. Varje aspekt behandlas i en separat del. Marknadsdefinition och ’likhet’ inleder (Del I), följd av skadeteorier och handelseffekter (Del II) och kvantifiering av sanktioner och åtgärder (Del III). Varje del innefattar tre kapitel, ett som beskriver EU konkurrensrätt (kapitel 2, 5, och 8), ett som beskriver WTO rätt (kapitel 3, 6, och 9), och ett som jämför de två rättssystemen (kapitel 4, 7, och 10). Varje jämförande kapitel innehåller fyra avsnitt: först fastställs möjligheten för funktionell komparation, därefter jämförs WTO rätt med EU konkurrensrätt, sedan sökes alternativa förklaringar för de två rättssystemens likheter och skillnader, och till sist utvärderas WTO rätt. I avhandlingens sista del (Epilog) samlas slutsatserna från komparationen och WTO rätt utvärderas holistiskt (kapitel 11). WTO rätt och WTO:s tvistlösningsmekanism visas vara mindre administerbara och mindre effektiva än EU konkurrensrätt. De två rättssystem delar slutmål (konsumentnytta och välfärd), vilket möjliggör normativa slutsatser att dras. Dessa berör, å ena sidan, tolkningen av nyckelbegrepp i WTO rätt, t.ex. vilka faktorer ska tas hänsyn till för att bevisa ’likhet’, vad är ’ofördelaktig behandling av utländska produkter och tjänster’, vad är ’skada’ i WTO-rättslig mening, och vilken skada kan räknas in i tillåtna motåtgärder. In the strive towards a highly competitive market, the European Commission has long promoted an extensive use of so-called private enforcement, where individuals claim their rights, as guaranteed by the acquis communautaire, before national courts. The incentive to litigate is, mostly, the right to receive damages for loss suffered due to another private party’s violation of the EU antitrust rules, established by the CJEU in its famous ruling in Courage, in 2001. Lately, the Commission seems to believe that the aim of a more effective private enforcement of antitrust law justifies rather extensive intrusions into the internal legal systems of the Member States. In a White Paper of 2008, the Commission proposed several measures aimed at enhancing the possibilities for individuals to be awarded with compensation for having suffered from a breach of the antitrust rules. These measures include the harmonization of certain national procedural laws, to facilitate inter alia damages claims at a national level. One year later, in 2009, an internal document with a draft for a directive was leaked out from the Commission, which suggests that there are advanced plans for issuing a harmonizing legislation. Extensive critique has been aimed at the Commission’s proposal, mainly on the basis that procedural rules should be left unaltered by the European Union. Procedural rules are often considered to be the result of careful considerations of specific domestic characteristics and problems, which over time have resulted in a well-balanced internal system based on legal traditions and culture. Even though national rules would still apply in purely domestic situations, it is said that the internal balance of the national procedural systems would be undermined if certain procedural rules were to be harmonized throughout the Union. This thesis aims at analysing whether the aim of an effective private enforcement of Union competition law does justify a harmonization of procedural rules that could facilitate inter alia private damage claims before national courts. In the case of a confirmative answer, the work also aims at answering to the question of what form such a harmonization should take: should the Commission initiate a legislative process or should it be left to the CJEU to continue developing the state of law through sporadic rulings on the matter? Recourse is made throughout the work to several important general principles of Union law, such as the principles of national procedural autonomy, subsidiarity, and equality. I sin strävan efter att åstadkomma en marknad med hög konkurrenskraft har Europeiska kommissionen länge förespråkat ett mer extensivt nyttjande av så kallad private enforcement (ung. privat genomförande) där individer åberopar sina rättigheter, som följer av acquis communataire, inför nationella domstolar. Incitamentet för att driva processer består i dessa fall mestadels av rätten att erhålla skadestånd för den skada som klaganden lidit på grund av en annan privat aktörs brott mot konkurrensreglerna, grundad av EU-domstolen (EUD) i målet Courage, 2001. På senare tid tycks kommissionen anse att målet med en mer effektiv private enforcement rättfärdigar relativt djupa intrång i medlemsstaternas interna rättssystem. I en Vitbok från 2008 föreslog kommissionen flera medel för att förbättra möjligheterna för individer att erhålla kompensation för skada orsakad av konkurrensöverträdelser. Förslagen skulle innebära en harmonisering av vissa processuella regler för att underlätta bland annat skadeståndstalan på nationell nivå. Ett år efter Vitbokens publicering läckte ett annat dokument ut från kommissionen, innehållande ett utkast på ett direktiv som föreslår liknande regler som Vitboken. Detta tyder på att det finns långt skridna planer för att skapa en harmoniserande lagstiftning på EU-nivå. Omfattande kritik har riktats mot kommissionens förslag, mestadels på grunden att processuella regler bör undanhållas från Europeiska Unionens inflytande. Processuella regler anses ofta vara en produkt av noggranna överväganden av nationella särdrag och problem, som under tidens gång lett till ett välbalanserat internt system baserat på gamla rättstraditioner och rättskultur. Trots att nationella regler skulle fortsätta att gälla för rent interna situationer, påstås det att den interna balansen inom de nationella processuella systemen skulle undergrävas vid en harmonisering. Denna magisteruppsats syftar till att analysera huruvida målet med en effektiv private enforcement av Unionens konkurrensregler rättfärdigar en harmonisering av processuella regler, för att underlätta bland annat privata skadeståndstalan i nationella domstolar. Om så visar sig vara fallet skall arbetet även undersöka vilken form en sådan harmonisering borde ta: skall kommissionen initiera en lagstiftningsprocess eller skall det vara upp till EUD att fortsätta utveckla det relevanta rättsläget? Under arbetet används genomgående några viktiga generella EU-rättsliga principer som referensramar. Dessa är bland annat principen om nationell processautonomi, subsidiaritet och likabehandling.

The European Commission has extensive powers to investigate and enforce infringements of EU competition law. Its investigations under Article 101 TFEU may result in extensive fines amounting up to almost a billion euros. In these proceedings the Commission is entrusted with three roles which are usually difficult to combine within one and same institution. It conducts the investigations, decides on sanctions as well as it to a certain extent adopts the rules of conduct for its procedure. The Commission is entrusted with a margin of appreciation which to a certain extent limits the CJEU’s judicial review of its decisions. There seems to be a conflict between the need to protect business secrets and other confidential information and the investigated undertakings’ need to access information in the Commission file in order to effectively exercise their rights of defence. This study examines which protection of the right to access the Commission file undertakings, subject to investigation under Article 101(1) TFEU, have under the fundamental rights of European Union. The study examines the requirements relating to file access under the rights of defence as provided by Article 6 ECHR. The conclusions made are that undertakings’ right to access the Commission file in proceeding under Article 101 TFEU is protected under Article 41, 47 and 48 of the CFREU. The limitations of the investigated undertakings’ right to access the Commission file are not violating their rights of defence, as the Commission’s extensive powers are counterbalanced in several ways. An efficient control of the Commission’s use of its powers is however necessary to avoid a risk for abuse of the powers in question.

The last decade or so the European Commission has put a lot of effort on combating international cartels. The same development can be seen on the other side of the Atlantic in the US and in international foras where focus is put on policy development, such as in the OECD. This master thesis investigates the challenges in enforcing EU competition law to companies situated outside the Union that enter into cartels. Are the non-EU undertakings harder to reach? Public international law and jurisdiction sets some limits for extraterritorial application of EU competition law. Case-law shows that the CJEU has chosen to base jurisdiction to apply EU competition law to non-EU undertakings with reference to the territorial principle, with a requirement that an agreement is implemented and produces a foresee-able, sustainable and immediate effect within the EU. Some say this "implementation doctrine" has a more limited reach than the "effects doctrine" promoted in the US. The method however still provides for legislative jurisdiction over, probably, all internation-al cartels. The enforcement jurisdiction shows to be more limited however and coercive actions cannot be carried out by the Commission outside the EU. Despite this the enforcement record is still good. Since the turn of the millennium the Commission has imposed record level fines on many non-EU undertakings for their participation in global cartels. I have studied some of the more debated Commission decisions on international cartels taken this last decade to see how jurisdictional issues have been dealt with and if the Commission takes into account that undertakings are increasingly being fined for the same cartel also in other jurisdictions. Extraterritorial application of EU competition law seems to be an accepted practice. Arguments made by undertakings that the Commission does not have jurisdiction under public interna-tional law or should have regard to the principle of non-intervention or comity have not been successful, nor arguments that the Commission should have regard to fines im-posed elsewhere in the world.
