DOI: 10.1590/2179-8966/2022/65752.Resumo A histórica desconsideração de saberes não eurocêntricos configura uma das características do colonialismo, fenômeno que persiste no Brasil sob a vigente Constituição, alcançando o Judiciário. O presente artigo examina como tal desconsideração judicial pode obstar a aplicação dos direitos das populações negras e indígenas. Em seguida, propõe uma virada ontológica no Judiciário, para que este amplie a consideração de diversas formas de conhecimento no exercício de suas funções. Metodologicamente, o artigo é assentado em pesquisa bibliográfica interdisciplinar que se soma a exame de duas iniciativas do Sistema de Justiça, realizados a partir de entrevistas semiestruturadas com seus coordenadores: o Polo Indígena de Conciliação na Comunidade de Maturuca em Roraima e o Projeto Vozes dos Quilombos no Piauí. Sob tal método, o artigo procura inovar utilizando o conceito antropológico de virada ontológica para aplicá-lo juridicamente ao Judiciário. Verificou-se, ao final, que as iniciativas examinadas são aptas a revelar possibilidades de escutas judiciais de populações historicamente colonizadas.Palavras-chave: Judiciário; Colonialismo; Virada ontológica.Abstract The historical disregard of non-Eurocentric knowledge is one of the characteristics of the phenomenon known as colonialism. It persists in Brazil under the current Constitution and reaches the Judiciary. This article examines how such disregard may hinder the judicial application of black and indigenous populations rights. Then, the paper proposes an ontological turn in the judiciary. That means the functioning of a judicial system that expands the consideration of various knowledge in the exercise of its functions. Methodologically, the article is based on interdisciplinary bibliographic research. In addition, it examines two justice system initiatives: the Indigenous Conciliation Center in the Maturuca Community in Roraima and the Vozes dos Quilombos Project in Piauí. The analysis is conducted from semi-structured interviews with the coordinators of those initiatives. Under such method, the article seeks to innovate using the anthropological concept of ontological turn to apply it legally to the judiciary. It was found that the both examined initiatives are able to reveal possibilities of judicial listening in favor of historically colonized populations.Keywords: Judiciary; Colonialism; Ontological turn.

DOI: 10.1590/2179-8966/2021/53437Resumo Neste artigo, a partir do estudo de um caso concreto em que se declarou a possibilidade de ocorrência de “racismo reverso”, busca-se refletir - tendo como chave heurística central uma concepção materialista da colonialidade - sobre como o direito e o poder judiciário se inserem nos processos de construção de subalternização e como leis antidiscriminatórias atuam para relegitimar um sistema penal, historicamente racista, em sua totalidade. Abstract In this article, based on a case study where it has been declared the possibility of “reverse racism”, we aim to reflect - having as a central heuristic key a materialist conception of coloniality - on how law and the judiciary system are inserted in the processes of subalternization construction and how anti-discrimination laws act to re-legitimize a historically racist penal system, in its entirety. From field research and statistical analysis, the purpose is to analyze the behavior of the flow of the public security system and criminal justice system for such crime, emphasizing the processes of classification, filtering and interpretation engineered by police and judicial. Throughout field research it was possible to verify some questions that are contrasted so much with the premise of the equivalence in a common genre of different elements that the criminal types and the crimes predicted in the penal code they propose to do when categorizing human conducts in the same universal category and equal treatment, as well as ensuring a level playing field for parties involved in criminal proceedings and equal treatment of criminal cases during criminal prosecution. The data show that there are unequal institutional treatments in certain criminal cases No presente trabalho descrevo e analiso a administração institucional para os casos de homicídio doloso ao longo da persecução penal, compreendendo as etapas procedimentais e consecutivas do registro de boletim de ocorrência policial, da instauração do inquérito policial, da denúncia do Ministério Público, o desfecho da primeira fase do tribunal do júri e o desfecho da segunda fase do tribunal do júri. A partir de pesquisa de campo e de análises estatísticas, a finalidade é analisar o comportamento do fluxo do sistema de segurança pública e de justiça criminal para tal crime, enfatizando os processos de classificação, filtragem e de interpretação arquitetados pelos operadores da polícia e do judiciário. Durante toda a pesquisa de campo, foi possível constatar algumas questões que contrastam tanto com a premissa da equivalência em um gênero comum de elementos distintos que os tipos penais e os crimes previstos no Código Penal se propõem a fazer ao categorizar condutas humanas numa mesma classificação universalizante e igualitária, quanto com a garantia da igualdade de condições para as partes envolvidas num processo penal e a igualdade de tratamento aos casos penais ao longo da persecução penal. We noted that the fundamentals of culpability and the theories that justify the punishment prioritize the conscience of the illicit acts, which points to a logic that we call the supremacy of the conscious. We point out that the supposition of the subject of the unconscious, a subject who insists, can offer a counterpoint to the logic pointed out and enable the inclusion of this subject. Our hypothesis - based on working with people under alternative penalties and on the contributions of Freud and Lacan - is about the possibility of being offered moments of listening in which there may be opportunities for some elaboration by those who committed the crime in relation to the act considered criminal. We believe that listening to the psychoanalyst can make something of the singularity emerge, allowing, in some cases, conditions for some symbolization of the act by the word and the subjective assent of the sentence. Psychoanalysis, structured from the discovery of unconscious psychic determination, can be a way of contributing to a work implied with subjective responsibility in the judiciary sphere Essa dissertação apresenta uma articulação entre a Psicanálise e o Direito, considerando as possibilidades e dificuldades das contribuições do profissional de formação psicanalítica que trabalha em um Vara que executa Penas e Medidas Alternativas no judiciário, que lida com pessoas que cometeram crimes considerados sem grave ameaça à pessoa. Observamos que o fundamento da culpabilidade e as teorias que justificam as penas priorizam a consciência dos atos ilícitos, apontando assim para uma lógica que denominamos como supremacia do consciente. Apontamos que a suposição do sujeito do inconsciente, um sujeito que insiste, pode oferecer um contraponto à lógica apontada e viabilizar a inclusão desse sujeito. Nossa hipótese baseada no trabalho com pessoas em cumprimento de pena e nas contribuições de Freud e Lacan diz respeito à possibilidade de ser oferecido momentos de escuta nos quais possa haver, por parte daquele que delinquiu, oportunidades de alguma elaboração sobre o ato considerado criminoso. Apostamos que a escuta do psicanalista pode fazer com que algo da singularidade emirja possibilitando, em alguns casos, condições para alguma simbolização sobre o ato por via da palavra, e o assentimento subjetivo da pena. Sendo a psicanálise estruturada a partir da descoberta da determinação psíquica inconsciente, conjecturamos que ela possa ser um caminho de contribuição para um trabalho implicado com a responsabilidade subjetiva no âmbito jurídico

We first bring up the debate on drug policy in Brazil, and especially in Rio de Janeiro, where violence and brutality inherent to armed combat assume the role of a police state in which certain people and certain substances are seen as if they were true entities. We also seek to understand how the processes of feminization of poverty are related to these problems, investigating how the first prohibitionist legislation in the country can be seen as an indication of its racist, classist, and, increasingly, patriarchal side views in the region. Secondly, we approach the deconstruction of law and particularly criminal law, understanding them as correlated to strategies of force that are especially functional for the exercise of the punishment power and which their language and supposedly neutral and sublimated senses tend to overshadow. At this point, experiences in audiences and interviews revealed to us how power relations are established in meshes and how they are responsible for the coloniality that generates hierarchizations, which led us to the third phase of the research. In it, we relate the coloniality of power and being, especially with the constructs of race and privileges involved in our questions, perceiving how racism is an anchor of the selectivity of the penal system and how it is in constant interaction with the whiteness that crosses the judiciary, configurating a state of domination. In the end, we seek to focus on gender studies, taking the paths of feminism, especially the ones since the diaspora and the decolonial ones, as tools that help us to perceive that the experiences of the women we deal with in the fieldwork, magistrates and criminalized women, are imbricated to the systems that reproduce subalternizations and differentiations, which still continue to be reproduced in contemporary coloniality. These theoretical formulations were developed contingent upon our experiences in the fieldwork, when speeches produced in hearings, trials and interviews gave the tone of the research developed. Neste trabalho, exploramos práticas cotidianas do judiciário e discursos, tomando como vetor a investigação de questões e gênero envolvida no processos de criminalização de mulheres, a princípio, varejistas de drogas, juízas mulheres. Trazemos, inicialmente, o debate sobre a brutalidade inerentes ao combate armado assumem função configuradora de um Estado policial, em que certas pessoas e certas substâncias se transformam em verdadeiras entidades. Buscamos, ainda, perceber como os processos de feminização da pobreza se relacionam com a problemática, assumindo a investigação das primeiras legislações proibicionistas no país como indiciária dos seus recortes racistas, classistas e, cada vez mais, patriarcais na região. Em um segundo momento, buscamos a desconstrução do direito e das leis penais, entendendo-os como correlatos a estratégias de força especialmente funcionais para o exercício do poder de punir e que sua linguagem e sentidos pretensamente neutros e sublimados tendem a ofuscar. Nesse ponto, vivências em audiências e entrevistas nos revelaram como relações de poder se estabelecem em malhas e são responsáveis pela colonialidade que gera hierarquizações, o que nos levou a terceira fase da pesquisa. Nela, relacionamos a colonialidade do poder e do ser, principalmente, com os constructos de raça e privilégios envoltos às nossas questões, percebendo como o racismo é âncora da seletividade do sistema penal e está em constante interação com a branquitude que atravessa o judiciário, configurando um estado de dominações. Por fim, buscamos dar enfoque aos estudos de gênero, assumindo os caminhos dos feminismos, sobretudo desde a diáspora e decoloniais, como ferramentas que nos auxiliam a perceber que as experiências das mulheres com que lidamos em campo, magistradas e criminalizadas, são imbricadas aos sistemas matizadores de subalternizações e diferenciações que continuam a ser produzidas na colonialidade contemporânea. Estas formulações teóricas foram desenvolvidas contingentes às nossas experiências em campo, quando discursos produzidos em audiências de instrução e julgamento e entrevistas deram o tom da pesquisa desenvolvida.

First, there is a dearth of empirical research to test whether the Judiciary is in fact applying balancing and the principle of proportionality, the consolidated theoretical models for solving conflicts between free speech, the right to honor and image. Second, the vast majority of studies examines the evolution of elements such as content, impact, speakers and context of expression presuming that courts remain a capable and more efficient arena for solving these cases. I adopt these deficits in scholarship as main research questions and employ predominantly quantitative, but also qualitative methods, in addition to inductive reasoning, in order to answer them. The results show that theory is largely ignored by trial-level judges at the Rio de Janeiro state court, while superior courts suffer with poor procedural conditions of quality to rule in general, and specifically in the field speech. The rulings that represent 70% of all citations to precedent in Brazilian Supreme Court decisions about speech ignore the opportunities to offer useful holdings desperately needed by trial courts. Parallel to this, the decentralized, even if not yet perfectly democratic, communication environment on the internet has afforded opportunities to balance the power to reach an audience in an unprecedented way for the traditional mass-media society. This increasingly egalitarian inclusion of a large share of the population in public debate has resulted in the mobilization of groups against hate speech on and offline. Faced with these results, I make two arguments. First, when evaluating compensation requests for moral damages due to an offense to honor and image or in the context of private law litigation of hate speech, the judge should proceed to review the content of speech only when a first test of the speaker and the offended party s communicative capacity reveals an unbalance favoring the speaker. Second, the moderation of free speech online should be performed predominantly in the context of a new kind of autoregulation. It is characterized by the cooperative relationship between online content platforms and users empowered with a desire and capacity of self-government, leading the task of determining what types of speech are abusive, identifying instances thereof and enforcing their decisions Ao longo da popularização da internet nas últimas duas décadas, a literatura sobre liberdade de expressão, seus limites e restrições avançou de maneira importante em diversas frentes, mas, especialmente no Brasil, é marcada por duas deficiências. Primeiro, há uma escassez aguda de pesquisa empírica que teste a aplicação pelo Judiciário das propostas consolidadas na doutrina de solução de conflitos entre a manifestação do pensamento, honra e imagem, mormente por meio do uso da ponderação e do princípio da proporcionalidade. Segundo, a vasta maioria dos estudos analisa evoluções do conteúdo, impacto, emissores e contexto da expressão, presumindo que os tribunais continuam sendo locus capaz e mais eficiente do que outros para a resolução desses conflitos. Adoto essas duas deficiências como perguntas centrais de pesquisa e utilizo método empírico com técnicas predominantemente quantitativas, porém também qualitativas e método indutivo, para responde-las. Os resultados mostram que a teoria majoritária é largamente ignorada pelas sentenças no 1º grau de jurisdição do TJ-RJ, ao passo que nos tribunais superiores as condições procedimentais de qualidade para decidir são altamente precárias no geral e, especialmente, no campo da liberdade de expressão. As decisões que representam 70% das citações a precedente feitas pelo STF nessa área ignoram oportunidades de oferecer balizas necessárias para a atividade judicial na primeira instância. Em paralelo, o ambiente de comunicação descentralizada, ainda que não perfeitamente democrática, da internet proporcionou oportunidades de equilíbrio do poder de alcançar uma audiência de uma forma jamais vista na sociedade tradicional dos meios de comunicação de massa. Essa inserção mais igualitária de uma grande parcela da população no debate público resultou na mobilização de grupos para coibir o discurso de ódio na internet e fora dela. A partir desses resultados, apresento duas propostas. Primeiro, ao avaliar pedidos de indenização por dano moral em razão de ofensa à honra, imagem ou no contexto de discurso de ódio, o magistrado deve proceder à análise do mérito da manifestação somente quando um primeiro teste da capacidade comunicativa das partes ofensora e ofendida revela um desequilíbrio em favor da parte ofensora. Segundo, a moderação da manifestação do pensamento na internet deve ser exercida precipuamente no contexto de uma nova modalidade de autorregulação. Ela é caracterizada pela relação dialógica entre plataformas de conteúdo e usuários munidos de desejo e capacidade de autonomia e auto-governo, com protagonismo na função de determinar quais os tipos de manifestações abusivas, identificar instâncias delas e tomar medidas concretas para inibi-las

The process of raising awareness about racism as an instrument responsible for the asymmetries between blacks and non-blacks went through the overcoming of a miscegenation discourse as a constitutive mark of Brazilian nationality. Indeed, the nigger sum, and the valorization of African identities are an outcome of the development of a sense of autonomy that could dialogue in conditions of equality with the hegemonic discourse defender of racial democracy. The constitutional framework of 1988, which provided for the criminalization of the racist act, allowed several discriminated persons to create expectations that the State, in the figure of the Judiciary, would mediate racial conflicts, punishing the aggressors. An avenue of studies appears that sees in the action of the judiciary another social phenomenon to be studied and that can extend understandings of the state action in a democratic regime that seeks to provide the needs of the people. In this sense, the criminalization of racism allows an opportune discussion of how the punitive system and criminal law aim to black bodies. Historically, they have seen the black population as the main target of repressive measures. In addition, the racism cases analyzed under the statistical approach reveal, in several studies, significant differences of victories for the benefit of the defendant. Furthermore, those judicial claims are not understood as racial discrimination, but another criminal type that does not gather the same essence of the constitutional provision, which entails losses beyond of those visibly perceived in the procedural trajectory. Given this framework, what is the possibility of assessing the influence of non-legal elements for the outcome of these processes, whose outcome was favorable to the defendants, in majority of the cases? This question is answered based on a set of judgments reviewed by Brazilian courts of second instance. This content guided the development of the thesis that material elements identified as race / color, occupation and socioeconomic condition join with the private interest that magistrates, like any employees who see in the professional career, the form of realization of their personal projects. The first approach therefore draws attention to the parties and the second to the judges, who are persons and not the personification of justice. A criminalização do racismo é produto da ação do Movimento Negro desde a década de 1940 quando percebeu a necessidade de impor limites institucionais a comportamentos discriminatórios que negavam à população negra cidadania. O processo de formação da consciência acerca do racismo como instrumento responsável pelas assimetrias entre negros e não negros passou pela superação de um discurso da miscigenação como marca constitutiva da nacionalidade brasileira. Neste sentido, a assunção da negritude e a valorização das africanidades compreenderam produto do desenvolvimento de um senso de autonomia que pudesse dialogar em condições de igualdade com o discurso hegemônico defensor da democracia racial. O marco constitucional de 1988, que previu a criminalização do ato racista, permitiu que diversas pessoas discriminadas criassem a expectativas que o Estado, na figura do Poder Judiciário, mediasse conflitos raciais, punindo os agressores. Surge, assim, uma avenida de estudos que enxergam na atuação do judiciário mais um fenômeno social a ser estudado e que pode alargar entendimentos da ação estatal em um regime democrático que busque atender as necessidades das pessoas. Neste sentido, a criminalização do racismo confere uma oportuna discussão de como o sistema punitivo e o direito penal dirigem atenção aos corpos negros. Historicamente, eles têm visto a população negra como principal destinatária das medidas repressivas. Ademais, os casos de racismo analisados sob a abordagem estatística revelam, em vários estudos, diferenças significativas de vitórias em benefício do réu e o direcionamento dos atos de racismo para tipo penal que não goza da mesma essência da previsão constitucional, o que acarreta prejuízos além daqueles visivelmente percebidos na trajetória processual. Diante deste quadro, qual a possibilidade de aferir a influência de elementos não jurídicos para o resultado final desses processos, cujo resultado final em sido favorável aos réus? Esta pergunta é respondida tendo como base um conjunto de decisões analisadas de tribunais de justiça brasileiros em sede de segunda instância. Este conteúdo orientou o desenvolvimento da tese de que elementos materiais identificados como raça/cor, ocupação e condição socioeconômica consorciam-se com o interesse particular que magistrados, como quaisquer empregados que veem na carreira profissional, a forma de realização de seus projetos pessoais. A primeira abordagem dirige atenção, pois, às partes e a segunda aos juízes, vistos como pessoas e não como a personificação da justiça.

Initially, problematic situations which have become judicial matters at a juvenile court are described. It was observed that there is a predictability expectation from the psychologist practice, i.e. a demand that the psychological assessment either confirm of refute the incidence of real situations such as child abuse , as well as being an indicator of possible future behavior of the parties involved in the court cases. We have attempted to chart Rio de Janeiro State Court or Justice psychologists fears, wishes and expectations taking into account theoretical framework concerning to science, truth, and power. This cartographic construction has been built through the accounts of five professionals, called heteronomous-interlocutors, interviewed based in the Oral History propositions, as well as in the research-intervention perspective, in which the researcher places himself as a research participant cohort. The accounts have yielded reflections of Foucauldian, Institutional Analysis, the actor-network theory, and the Penal abolitionist theory, among others theoretical perspectives. The judiciary institution was analyzed in its historical dimension and in its articulations with power, which lead to a highly hierarchical and vertical environment regarding its internal affairs. Out of this analysis surfaces the character of the magistrate, who detains a nearly unlimited sort of power, to whom one should hold in high respect. São descritas, inicialmente, algumas situações problemáticas que se transformaram em questões judiciais no âmbito da vara da infância. Observou-se que houve, por parte da instituição, uma expectativa de previsibilidade dirigida ao trabalho do psicólogo, ou seja, a demanda de que a avaliação psicológica pudesse confirmar ou refutar a ocorrência de determinadas situações reais como, por exemplo, o abuso contra crianças , bem como desvelar ocorrências futuras do comportamento das partes envolvidas nos processos. Partindo de considerações teóricas a respeito de ciência, verdade e poder, procuramos cartografar medos, anseios e expectativas dos psicólogos do Poder Judiciário do Estado do Rio de Janeiro. Essa construção cartográfica se estabeleceu através dos relatos de cinco profissionais, chamados de interlocutores-heterônimos, entrevistados com base nas proposições da História Oral, bem como na perspectiva da pesquisa-intervenção, nas quais o pesquisador se coloca como parte do trabalho prospectivo. Os relatos deram ensejo a reflexões de caráter teórico, nas quais foram utilizadas como referências conceituais a genealogia foucaultiana, a Análise Institucional, a Teoria do Ator-Rede e a Teoria do Abolicionismo Penal, entre outras. A instituição judiciária foi analisada com base em sua dimensão histórica e em suas articulações com o poder, que forjam um espaço profundamente hierarquizado e vertical em seu contexto e relações internas. Dessa análise, emerge a figura do magistrado, detentor de um poder quase ilimitado, a quem se deve reverenciar e temer. A pesquisa empreendida teve como objetivo explicitar a dimensão coletiva de uma experiência que costuma ser vivida (e sofrida) de forma particular e isolada, como se somente coubesse aos sujeitos envolvidos a custo de muito sofrimento, tensão e eventualmente descontrole e adoecimento a submissão obediente a imperativos de ordem institucional
