The phenomenon of gated communities represents a desire of people that seems to transcend the pursuit of security: people seem to want to escape the "malaise of interaction." This context and the advent of Law no. 13.465/17, which facilitated the regularization of gated communities, indicate that this form of "voluntary community" is expanding and needs to be regulated, since this potential causes urban impacts. The result of the study indicates that the urban development instrument of the Neighborhood Impact Study is imposed as a form of regulation of gated communities, and the study identified its degree of regulation and the need for legislative evolution of the municipalities at this point O presente trabalho consiste numa tentativa de compreensão da era atual, a modernidade líquida e do fenômeno dos condomínios fechados e seus impactos nas cidades através de intenso estudo teórico de urbanistas e sociólogos, que forneceram peças de um mosaico perceptivo que aqui é apresentado. O fenômeno dos condomínios fechados representa um desejo das pessoas que parece transcender a busca por segurança: as pessoas parecem querer fugir do mal estar da interação . Este contexto e o advento da Lei nº 13.465/17, que facilitou a regularização dos condomínios fechados, indicam que esta forma de comunidade voluntária está em expansão e precisa ser regulada, já que se apresenta como potencial causadora de impactos urbanísticos. O resultado do estudo indica que o instrumento urbanístico do Estudo de Impacto de Vizinhança se impõe como forma de regulação dos condomínios fechados, tendo o estudo identificado seu grau de regulação e a necessidade de evolução legislativa dos municípios neste ponto

In this context, it is necessary to interpret fiscal balance and its related legal principle from the perspective of a theory of justice that takes individuals seriously and protects rights and the public accounts, but that is also fair for future generations. These generations should be considered a political minority in the context of democratic debate because they are unable to organise politically and form a democratic majority. The present inquiry aims to contribute to the debate by offering a possible interpretation of the fiscal balance, adopting as a theoretical framework one of the most influential theories of contemporary justice: the theory of justice as fairness of the American philosopher John Rawls. It is intended, in the first instance, to present the general outlines of the John Rawls theory of justice and a possible interpretation of the fiscal balance in the context of his theory of intergenerational justice, based on the principle of just saving. It then seeks to analyse some of the rules of the Brazilian legal system, in particular the Constitution of the Federal Republic of Brazil and the Fiscal Responsibility Law in relation to that interpretation of fiscal balance, in order to identify intergenerational justice clauses or clauses that, although considered fundamental rights, violate the precepts of equity between the generations A questão da justiça intergeracional nas finanças públicas tem assumido cada vez mais relevância nos processos políticos e jurídicos das democracias liberais, em particular diante da percepção de que o endividamento público crescente, em especial para atendimento de despesas correntes em benefício exclusivo das gerações atuais, tem gerado injustos encargos para as gerações que estão por vir. Nesse contexto, surge a necessidade de interpretar o equilíbrio fiscal, e o seu correlato princípio jurídico, à luz de uma teoria da justiça que leve os indivíduos a sério, conferindo proteção aos direitos e às contas públicas, mas também às futuras gerações, que devem ser considerados, no contexto do debate democrático, uma minoria política, incapaz de ser organizar politicamente e formar uma maioria democrática. O presente estudo visa contribuir para o debate apresentando uma possível interpretação do equilíbrio fiscal construída a partir do marco teórico de uma das mais influentes teorias da justiça contemporâneas: a teoria da justiça como equidade do filósofo americano John Rawls. Pretende-se, no primeiro momento, apresentar os delineamentos gerais da teoria da justiça como equidade de John Rawls e uma interpretação possível do equilíbrio fiscal a da sua teoria da justiça intergeracional, fundamentada no princípio da poupança justa. Em seguida, busca-se analisar algumas normas do ordenamento jurídico pátrio, em especial da Constituição da República Federal do Brasil e da Lei de Responsabilidade Fiscal à luz daquela interpretação do equilíbrio fiscal, a fim de identificar cláusulas de efetivação da justiça intergeracional ou cláusulas que, embora considerados direitos fundamentais, violariam os preceitos de equidade entre as gerações

Based on the theoretical premises set forth on the fundamental work A Theory of Justice , by John Rawls we seek to discuss the true meaning of equity where the primary social goods are distributed in an very unequal way and how the adoption of public policies oriented by a substantive perspective of justice may become a new paradigm to orient this dynamics. Succeeding this initial line of argument, this work develops into the search of the true meaning of meritocracy, founded, once again, on the unequal distribution of primary social goods or, simply, on the uneven division of opportunities. In the context of these beliefs, we seek to assert that in order to exist in fact meritocracy, it is necessary to have an environment which promotes equal opportunities so that each singular person may seek to develop their life project in accordance with their efforts and individual talents. Finally, distributive public policies may be the instrument to materialize this ideal as long as it is oriented by premises which favor the substantive perspective of Justice and that from a critical view of inequality may pursue a just distribution of primary social. O presente trabalho busca elidir o verdadeiro significa do ideal de justiça distributiva com vistas à criação de um paradigma ético apto a orientar a adoção de políticas públicas e, ao mesmo tempo, ser o vetor interpretativo da sua eficácia e resultados práticos. Com bases nas premissas teóricas assentadas na basilar obra Uma Teoria da Justiça de John Rawls, busca-se discutir qual é o verdadeiro significado da equidade onde os bens primários sociais são divididos de uma forma tão desigual e como a adoção de políticas públicas orientadas por uma vertente substantiva da justiça pode ser um novo paradigma apto a orientar esta dinâmica. Ultrapassada esta linha de argumentação inicial, o trabalho desdobra-se na busca pelo verdadeiro significado de meritocracia, assentada, ainda uma vez, na distribuição desigual de bens primários sociais ou, simplesmente, na divisão desigual de oportunidades. Nesta ordem de convicções, busca-se afirmar que para haver de fato- a meritocracia é necessário haver um ambiente que propicie igualdade de oportunidades para que cada indivíduo singular possa buscar desenvolver seus projetos de vida de acordo com seu esforço e talento individuais. Por fim, as políticas públicas distributivas podem ser o instrumento que materialize este ideal, desde que sejam orientadas por premissas que privilegiem a vertente substantiva da Justiça e que a partir de uma perspectiva crítica da desigualdade possam buscar a distribuição justa dos bens primários sociais.

To Rawls public reason is fundamentally the proper form and content of public debate, as well as the justification of essential decisions of basic justice in a constitutional democracy. In this sense, Rawls claim that the only reasonable justification for state coercion lays on an overlapping consensus regarding the essential choices of a democratic society, which is possible only if public and private actors surpass their own personal moral or philosophical comprehensive doctrines when engaging in public debate of such essential decisions of basic justice. This dissertation thesis aims to verify the rawlsian proposal of public reason in the context of justice as fairness, reflecting whether Rawls proposal fits a post-modern juridical and philosophical reality. The work also aims to analyze if Rawls theory can be effectively applied to modern constitutional states, especially regarding the content and exercise of religious freedom by the citizens of a democratic constitutional state. Em 1993, John Rawls, notável filósofo e professor da distinta Harvard University, publicou seu Political Liberalism, um livro em que pela primeira vez sintetiza sistematicamente o conceito de razão pública, uma ideia chave de sua teoria da justiça como equidade (justice as fairness). Segundo Rawls, a razão pública consiste fundamentalmente no modo e conteúdo adequados ao debate e à fundamentação de escolhas essenciais de justiça no espaço público de uma democracia constitucional. Nesse sentido, Rawls advoga que o único meio razoável de justificação da coerção estatal reside no reconhecimento e/ou obtenção de consensos (overlapping consensus) em relação às escolhas essenciais de uma sociedade democrática, o que só é possível se atores públicos e privados se despojarem de suas respectivas doutrinas filosóficas ou morais abrangentes ao debater e decidir tais questões essenciais de justiça. A presente dissertação tem por objetivo analisar a proposta de razão pública de Rawls, dentro do contexto de sua teoria da justiça como equidade, propondo-se a verificar se o pensamento rawlsiano procede no contexto jurídico-filosófico da pós-modernidade e se a sua teoria pode ser concretamente aplicada aos ordenamentos jurídicos contemporâneos, em especial no que tange ao conteúdo e pleno exercício da liberdade religiosa pelos cidadãos de um estado constitucional democrático.
