The risk assessment process and the subsequent risk management measures need tobe constantly evaluated, updated and improved. This thesis contributes to that workby considering, and suggesting improvements, regarding aspects like userfriendliness,transparency, accuracy, consistency, data reporting, data selection anddata evaluation.The first paper in this thesis reports from an empirical investigation of themotivations, intentions and expectations underlying the development andimplementation of a voluntary industry owned environmental classification systemfor pharmaceuticals. The results show that the purpose of the classification systemis to provide information, no other risk reduction measures are aimed for.The second paper reports from an evaluation of the accuracy and the consistency ofthe environmental risk assessments conducted within the classification system. Theresults show that the guideline recommendations were not followed in several casesand consequently alternative risk ratios could be determined for six of the 36pharmaceutical substances selected for evaluation in this study. When additionaldata from the open scientific literature was included the risk ratio was altered formore than one-third of the risk assessments. Seven of the 36 substances wereassessed and classified by more than one risk assessor. In two of the seven cases,different producers classified the same substance into different classificationcategories.The third paper addresses the question whether non-standard ecotoxicity data couldbe used systematically in environmental risk assessments of pharmaceuticals. Fourdifferent evaluation methods were used to evaluate nine non-standard studies. Theevaluation result from the different methods varied at surprisingly high rate and theevaluation of the non-standard data concluded that the reliability of the data wasgenerally low., QC 20100929

Experience feedback from accidents is important for preventive work in companies, authorities and other organisations. This thesis focused on experience feedback from accidents that take place in everyday life, in our neighbourhoods, in our workplaces, in our schools, in traffic and transportation. Essay I is an overview of the literature on learning from accidents and incidents. The focus in this essay is on literature that evaluates the effectiveness and usefulness of different methods in accident investigations. Conclusions drawn from this literature review are that the dissemination of results and knowledge from accident investigations must be improved, and experience feedback systems should be integrated into overall systems of risk management. Essay II is based on an evaluation of the investigation board for workplace accidents (HAKO) that was carried out on commission of the Swedish Work Environment Authority. It was concluded that the accident reports published by HAKO had a high qualitative level but the dissemination of results from the investigations was weak. Essay III investigates twenty-eight supervision cases from eleven Swedish local Environment and Health Administrations. The overall goal of the study was to find out how, and to what extent, experience feedback occurs in Swedish municipalities. Two major problems relevant for the experience feedback have been found; namely that the inspectors do not have enough guidance on how to interpret the law and that they would like more information on what happens to legal cases that they have handed over to the public prosecutors and the police. Essay IV is a document study of incident reports from two municipal fire and rescue services. The answer it presents consists of an outline of a liberaltheory of justice in the employment contract based on theory developed in the area of political philosophy. Thethesis also examines issues of efficiency—How should measures to improve working conditions be evaluated?—and the ethical implications of the economic theory of employment contracts and the neoclassical theory of themarket. Paper I: A theoretical framework is introduced for the evaluation of workplace inspections with respect totheir effects on working conditions. The choice of a concept of efficiency is discussed, and its relation to criteriafor a good working environment is clarified. It is concluded that in order to obtain reliable information onthe effects of different inspection methods, it is necessary to perform controlled comparative studies in whichdifferent methods are used on different workplaces. Paper II: This article outlines the structure of a Rawlsian theory of justice in the employment relationship.The theory answers three questions about justice and the workplace. What is the relationship between socialjustice and justice at work? How should we conceive of the problem of justice within the economic sphere?And, what is justice in the workplace? Reasons for a specific construction of a local original position are givenand arguments are presented in support of a principle of local justice in the form of a choice egalitarian localdifference principle. Paper III: The political philosophy of John Rawls is applied to the moral dilemma of whistleblowing, andit is shown that that the requirement of loyalty, in the sense that is needed to create this dilemma, is inconsistentwith that theory. In a discussion and rejection of Richard De George’s criteria on permissible whistleblowing,it is pointed out that the mere rejection of loyalty will not lead to an extreme position; harms can still be takeninto account. The thesis aims at developing approaches to transport policy decisions, based on suggestions and ideas originating from moral philosophy and philosophical decision theory.Paper I analyzes the Swedish transport policy goals, and the problem of combining policygoals with welfare economics. A problem of circularity arises as the Swedish transport policygoals are conflicting, and hence must be subject to trade-offs, while several of the goals themselves entail statements on how to prioritize or restrain goals in case of conflict.Paper II analyzes rationality in road safety policy. Problematic features are identified and discussed. The paper argues that the Swedish road safety goal is rational, since it is actionguiding and achievement-inducing.Paper III includes a model of rational choice under risk with biased risk perception. Under certain plausible conditions, a regulator should raise the population’s risk exposure. By deteriorating the environment the regulator can motivate drivers to choose behaviour that is less biased.Paper IV provides a formal representation of goal systems. The focus is on three properties:consistency, conflict, and coherence. It is argued that consistency is adequately regarded as a property relative to the decision situation or, more specifically, the set of alternatives that the agent faces. Conflict is adequately regarded as a relation over subsets of a given goal systemand should likewise be regarded as relative to the set of alternative that the agent faces.Coherence is given a probabilistic interpretation, based on a support relation over subsets of goal systems.Paper V investigates problems associated with standard deontic logic. A deontic predicate is derived, which avoids some of the major paradoxes in the area. The thesis aims at analyzing the concepts of risk and safety as well as the class of concepts to which they belong, thick concepts, focusing in particular on the normative aspects involved. Essay I analyzes thick concepts, i.e. concepts such as cruelty and kindness that seem to combine descriptive and evaluative features. The traditional account, in which thick concepts are analyzed as the conjunction of a factual description and an evaluation, is criticized. Instead, it is argued that the descriptive and evaluative aspects must be understood as a whole. Furthermore, it is argued that the two main worries evoked against non-naturalism – that non-naturalism cannot account for disagreement and that it is not genuinely explanatory – can be met. Essay II investigates the utilization of the Kripke/Putnam causal theory of reference in relation to the Open Question Argument. It is argued that the Open Question Argument suitably interpreted provides prima facie evidence against the claim that moral kinds are natural kinds, and that the causal theory, as interpreted by leading naturalist defenders, actually underscores this conclusion. Essay III utilizes the interpretation of the Open Question Argument argued for in the previous essay in order to argue against naturalistic reduction of risk, i.e. reduction of risk into natural concepts such as probability and harm. Three different normative aspects of risk and safety are put forward – epistemic uncertainty, distributive normativity and border normativity – and it is argued that these normative aspects cannot be reduced to a natural measure. Essay IV provides a conceptual analysis of safety in the context of societal decision-making, and argues for a notion that explicitly includes epistemic uncertainty, the degree to which we are uncertain of our knowledge of the situation at hand. Essay I develops a new framework for preference relations, that makes further preference relations beyond the trichotomy of preference, dispreference and indifference conceptually possible. The new framework models relations in terms of swaps, which are conceived of as transfers from one alternative state to another. With this new preference framework the essay presents a fitting-attitude analysis of new value relations that avoids some problems of earlier proposals. Essay II examines the small-improvement argument that is usually considered the most powerful argument against comparability, that is, the view that for any two alternatives an agent is rationally required to either prefer one of the alternatives to the other or be indifferent between them. The essay argues that while there might be reasons to believe each of the premises in the small-improvement argument, there is a conflict between these reasons. The conflict is such that we are not provided with a reason to believe the conjunction of the premises. Essay III develops a new measure of freedom of choice based on the proposal that a set offers more freedom of choice than another if, and only if, the expected degree of dissimilarity between a random alternative from the set of possible alternatives and the most similar offered alternative in the set is smaller. Furthermore, a version of this measure is developed that is able to take into account the values of the possible options.

The general framework of this thesis is that of ethical Technology Assessment (eTA). Whereas the first essay proposes an inclusive approach to technology assessment by delineating an ethical checklist, the following essays focus on two of the checklist points, i.e. “privacy” and “control, influence and power”, in relation to workspace surveillance. The core idea of Essay I (written in collaboration with Sven Ove Hansson) is that, due to its strong social impact, new technology and novel use of existing technology should be considered from the perspective of ethics. We suggest that assessments should be conducted on the basis of nine crucial ethical aspects of technology. In Essay II an in-depth analysis of the meaning and value of privacy in the realm of work is undertaken. The meaning and value of privacy is explained as well as why it should be protected. It is argued that two dimensions of privacy should be safeguarded; “informational privacy” and “local privacy” for the reason that workers’ personal autonomy is protected thereby. Essay III is concerned with how workspace surveillance requires that job-applicants claim their privacy interests in employment negotiations to a much larger extent than what was previously the case. In most cases however, a dependency asymmetry between employer and job-candidate makes the latter ill-equipped for doing so. This asymmetry serves as the point of departure for an analysis of the conditions under which consent should be considered a criterion on moral acceptability with regard to employment contracting. The analysis suggests ways of rectifying this imbalance, raising demands on the quality of contractual consent. Essay IV discusses the extent to which it should be morally permissible for current or prospective employees to trade off their privacy in employment negotiations. The overall aim of this thesis is to show how some ideas in Aristotle’s Nicomachean Ethics can be interpreted and used as a productive way to approach a number of pressing issues in bioethics. Articles I-II introduce, and endorse, a social constructivist perspective on rights (as opposed to the more traditional natural rights idea). It is investigated if the existence of property-like rights to biological material would include the moral right to commodification and even commercialisation. Articles III-V discuss similar questions and more specifically champion the application of an Aristotelian virtue ethics perspective. The articles are preceded by an introductory essay on some of the central themes in the Nicomachean Ethics. This section also includes a very brief account of what the connection between virtue ethics and a theory of social construction, including rights, could look like. The thesis seeks to show that if read somewhat creatively many of the ideas in the Nicomachean Ethics make for a highly useful approach to modern moral problems. It should be noted, however, that this thesis in no way claims to be an exegetic, or a complete, study of the Nicomachean Ethics. Article I deals with ownership of biological material from a philosophical, as opposed to a legal, perspective. It is argued that a strand in liberal political theory that treats property relations as socially constructed bundles of rights, as developed by e.g. Felix Cohen and Tony Honoré, is well suited for discussions on ownership of biological material. Article II investigates which differences in biological material might motivate differences in treatment and ownership rights. The article draws on the social constructivist theory of ownership which was developed in Article I. Article III employs virtue ethics to explain why it is morally permissible to donate but not to sell organs such as kidneys. The subject of this licentiate thesis is experience feedback from accidents and incidents. The thesis aims to contribute to an understanding of how the learning processes within organizations, companies and authorities could be improved. Essay I (written together with Sven Ove Hansson) reports on an evaluation carried out in 2004 by the Swedish Work Environment Authority’s Accident Investigation Board, called HAKO (Haverikommissionen). An important outcome of this evaluation shows that HAKO have not been able to manage the dissemination of their written reports, which is unfortunate, since the reports are thoroughly written. Essay II (written with Sven Ove Hansson and Carl Rollenhagen) is an overview of the literature on learning from accidents and incidents. The overall aim of this thesis is to present a model for rational goal-setting and to illustrate how it can be applied in evaluations of public policies, in particular policies concerning sustainable development and environmental quality. The contents of the thesis are divided into two sections: a theoretical section (Papers I-IV) and an empirical section (Papers V-VII). Paper I identifies a set of rationality criteria for single goals and discusses them in relation to the typical function of goals. It is argued that goals are typically set to enhance goal achievement. A goal that successfully furthers its achievement is “achievement-inducing”. It holds for each of the identified criteria that, ceteris paribus, improved satisfaction of a criterion makes a goal better in the achievement-inducing sense.Paper II contains an analysis of the notion of goal system coherence. It is argued that the coherence of a goal system is determined by the relations that hold among the goals in the system, in particular the relations of operationalization, means and ends, support, and conflict. Paper III investigates the rationality of utopian goals. The paper analyzes four arguments that support the normative criterion of attainability: that utopian goals are (1) too imprecise and (2) too far-reaching to guide action effectively, (3) counterproductive, and (4) morally objectionable. A tentative defence of utopian goal-setting is built on counter-arguments that can be put forward to weaken each of the four objections. Paper IV investigates the nature of self-defeating goals. The paper identifies three types of situations in which self-defeating mechanisms obstruct goal achievement: (1) situations in which the goal itself carries the seeds of its own non-fulfilment (self-defeating goals), (2) situations in which the activity of goal-setting contributes to goal failure (self-defeating goal-setting), and (3) situations in which disclosure of the goal interferes with progress (self-defea, QC 20100715

The general aim of this thesis is to present and analyse traffic safety from an ethical perspective and to explore some conceptual and normative aspects of moral responsibility. Paper I presents eight ethical problem areas that should be further analysed in relation to traffic safety. Paper II is focused on the question of who is responsible for traffic safety, taking the distribution of responsibility adopted through the Swedish policy called Vision Zero as its starting point. It is argued that a distinction should be made between backwardlooking and forward-looking responsibility and that Vision Zero should be understood in terms of this distinction. Paper III discusses responsibility ascriptions in relation to public health problems like obesity and lung cancer. It is argued that what makes discussions about who is responsible for such problems complicated is that we have two aims when ascribing responsibility to someone. First, we want responsibility ascriptions to be fair and morally justified. Second, we also want to achieve progress and solve problems through ascribing responsibility to someone. It is argued that the two aims influence debates concerning who is responsible for problems like obesity and lung cancer and that we should attempt at striking a balance that is both perceived as fair and that is efficient. Paper IV discusses two potential arguments against the suggestion that alcohol interlocks should be mandatory in all cars, namely 1) that it displaces the responsibility of individual drivers, and 2) that it constitutes a paternalistic interference with drivers. The first objection is found unconvincing, while the second only has limited bite and may be neutralized if paternalism is accepted for the sake of greater net liberty. It is argued that if technological development can make mandatory interlocks cost-efficient, the policy seems a commendable public health measure. It is argued that a strand in liberal political theory that treats property relations as socially constructed bundles of rights, as developed by e.g. Felix Cohen and Tony Honoré, is well suited for discussions on ownership of biological material. Article II investigates which differences in biological material might motivate differences in treatment and ownership rights. The article draws on the social constructivist theory of ownership which was developed in Article I. Article III employs virtue ethics to explain why it is morally permissible to donate but not to sell organs such as kidneys. The subject of this licentiate thesis is experience feedback from accidents and incidents. The thesis aims to contribute to an understanding of how the learning processes within organizations, companies and authorities could be improved. Essay I (written together with Sven Ove Hansson) reports on an evaluation carried out in 2004 by the Swedish Work Environment Authority’s Accident Investigation Board, called HAKO (Haverikommissionen). An important outcome of this evaluation shows that HAKO have not been able to manage the dissemination of their written reports, which is unfortunate, since the reports are thoroughly written. Essay II (written with Sven Ove Hansson and Carl Rollenhagen) is an overview of the literature on learning from accidents and incidents. The focus in this essay is on literature that evaluates the effectiveness and usefulness of different methods in accident investigations. The conclusions drawn from this literature review are that the dissemination of results and knowledge from accident investigations must be improved, and experience feedback systems should be integrated into overall systems of risk management. The starting point for Essay III was an empirical study conducted in 2005/2006. Twenty-eight supervision cases from eleven local Environment and Health Administrations in Sweden were examined. The overall goal of the study was to find out how, and to what extent, experience feedback occurs between different municipal authorities. Two major problems affecting experience feedback have been found; namely, that the inspectors do not have enough guidance on how to interpret the law, and that they would like more information on what happens to legal cases they have reported to public prosecutors and police., QC 20101118

The overall aim of this thesis is to present a model for rational goal-setting and to illustrate how it can be applied in evaluations of public policies, in particular policies concerning sustainable development and environmental quality. The contents of the thesis are divided into two sections: a theoretical section (Papers I-IV) and an empirical section (Papers V-VII). Paper I identifies a set of rationality criteria for single goals and discusses them in relation to the typical function of goals. It is argued that goals are typically set to enhance goal achievement. A goal that successfully furthers its achievement is “achievement-inducing”. It holds for each of the identified criteria that, ceteris paribus, improved satisfaction of a criterion makes a goal better in the achievement-inducing sense.Paper II contains an analysis of the notion of goal system coherence. It is argued that the coherence of a goal system is determined by the relations that hold among the goals in the system, in particular the relations of operationalization, means and ends, support, and conflict. Paper III investigates the rationality of utopian goals. The paper analyzes four arguments that support the normative criterion of attainability: that utopian goals are (1) too imprecise and (2) too far-reaching to guide action effectively, (3) counterproductive, and (4) morally objectionable. A tentative defence of utopian goal-setting is built on counter-arguments that can be put forward to weaken each of the four objections. Paper IV investigates the nature of self-defeating goals. The paper identifies three types of situations in which self-defeating mechanisms obstruct goal achievement: (1) situations in which the goal itself carries the seeds of its own non-fulfilment (self-defeating goals), (2) situations in which the activity of goal-setting contributes to goal failure (self-defeating goal-setting), and (3) situations in which disclosure of the goal interferes with progress (self-defea, QC 20100715

The general aim of this thesis is to present and analyse traffic safety from an ethical perspective and to explore some conceptual and normative aspects of moral responsibility. Paper I presents eight ethical problem areas that should be further analysed in relation to traffic safety. Paper II is focused on the question of who is responsible for traffic safety, taking the distribution of responsibility adopted through the Swedish policy called Vision Zero as its starting point. It is argued that a distinction should be made between backwardlooking and forward-looking responsibility and that Vision Zero should be understood in terms of this distinction. Paper III discusses responsibility ascriptions in relation to public health problems like obesity and lung cancer. It is argued that what makes discussions about who is responsible for such problems complicated is that we have two aims when ascribing responsibility to someone. First, we want responsibility ascriptions to be fair and morally justified. Second, we also want to achieve progress and solve problems through ascribing responsibility to someone. It is argued that the two aims influence debates concerning who is responsible for problems like obesity and lung cancer and that we should attempt at striking a balance that is both perceived as fair and that is efficient. Paper IV discusses two potential arguments against the suggestion that alcohol interlocks should be mandatory in all cars, namely 1) that it displaces the responsibility of individual drivers, and 2) that it constitutes a paternalistic interference with drivers. The first objection is found unconvincing, while the second only has limited bite and may be neutralized if paternalism is accepted for the sake of greater net liberty. It is argued that if technological development can make mandatory interlocks cost-efficient, the policy seems a commendable public health measure. If toxicological research and testing are affected by systematic errors (bias), this will influence the ensuing risk assessment. In order to improve toxicological risk assessments work must be done both on understanding and dealing with the impact of values and on getting better and more efficient methods for gathering facts. It is argued that a collective weighing of risks and benefits ignores individuals’ rights not to be unfairly exposed to risks in siting scenarios. Article III presents a three-party model tool for ethical risk analysis. The focus in such analysis is a discussion of three parties that are involved in risk decisions: the risk-exposed, the beneficiary, and the decision-maker. Two theories of deliberative democracy are explored. The first focuses on a hypothetical contract, the second argues for the actual inclusion of affected parties. This dissertation is a philosophical contribution to the theories on trust and on risk communication. The importance of trust in risk communication has been argued for and empirically studied since the 80s. However, there is little agreement on the notion of trust and the precise function of trust. This thesis sets out to study both aspects from a philosophical point of view. The dissertation consists of five essays and an introduction. Essay I is a comment on risk perception theory and the psychometric model in particular. The essay argues that sometimes individuals take risks simply because they are in a vulnerable position and have no other choice. Four factors are identified as crucial in risks from vulnerability: poor outset conditions, lack of reasonable options, hope and liability to disinformation. Essay II addresses the democratic approach to risk communication and the ideal of risk communication as a dialogue between more or less equal stakeholders. The essay develops a typology of different risk communication practices and influence distributions and concludes that the form of risk communication most commonly referred to in the literature is of the most imbalanced kind where all three types of influence falls to the same party. Essay III argues that trust can be understood as comfortable defocusing. Trust as comfortable defocusing means that when a person trusts, he or she is comfortable with letting certain things be in the hands or in the control of the trusted other. Departing from this idea a definition of trust is proposed consisting of three elements: (i) the truster’s comfortable defocusing from the trusted person’s part of caring for X, based on a (ii) belief about the trusted person’s care for X, concerning (iii) something of concern to the truster. Environmental goals are commonly set to guide work towards ecological sustainability. The aim of this thesis is to develop a precise terminology for the description of goals in terms of properties that are important in their practical use as decision-guides and to illustrate how it can be used in evaluations of environmental policy. Essay I (written together with Sven Ove Hansson) identifies a set of rationality criteria for individual goals and discusses them in relation to the typical function of goals. For a goal to perform its typical function, i.e., to guide and induce action, it must be precise, evaluable, approachable (attainable), and motivating. Essay II argues that for a goal system to be rational it must not only satisfy the criteria identified in Essay I but should also be coherent. The coherence of a goal system is made up of the relations that hold among the goals, most notably relations of support and conflict, but possibly also relations of operationalization. A major part of the essay consists in a conceptual analysis of the three relations. Essay III contains an investigation into the rationality of five Swedish environmental objectives through an application of the rationality criteria identified in Essays I-II. The paper draws the conclusion that the objectives are not sufficiently rational according to the suggested criteria. Safety is an important topic for a wide range of disciplines, such as engineering, economics, sociology, psychology, political science and philosophy, and plays a central role in risk analysis and risk management. The aim of this thesis is to develop a concept of safety that is relevant for decision-making, and to elucidate its consequences for risk and safety research and practices. Essay I provides a conceptual analysis of safety in the context of societal decision-making, focusing on some fundamental distinctions and aspects, and argues for a more complex notion than what is commonly given. This concept of safety explicitly includes epistemic uncertainty, the degree to which we are uncertain of our knowledge of the situation at hand. It is discussed the extent to which such a concept may be considered an objective concept, and concluded that it is better seen as an intersubjective concept. Some formal versions of a comparative safety concept are also proposed. Essay II explores some consequences of epistemic uncertainty. It is commonly claimed that the public is irrational in its acceptance of risks. An underlying presumption in such a claim is that the public should follow the experts’ advice in recommending an activity whenever the experts have better knowledge of the risk involved. This position is criticised based on considerations from epistemic uncertainty and the goal of safety. Furthermore, it is shown that the scope of the objection covers the entire field of risk research, risk assessment as well as risk management. Essay III analyses the role of epistemic uncertainty for principles of achieving safety in an engineering context. The aim is to show that to account for common engineering principles we need the understanding of safety that has been argued for in Essays I-II. “There is no need to reinvent the wheel” – a cliché, often told when you want to come up with something new that in someway can be connected to something that already exist. This study shows the opposite – that inventions emanate from what is given. It can be a detail, a problem in a thing - a wheel - or a situation that catches the inventor’s attention. It is something that seeks a solution or something that generates an idea, a hint or a clue of something new and useful. The art of invention emerges from the ability and skill to broaden the seeing and put thinking, substance and tradition into motion. An old radio dial generates a new ergonomic steering wheel. The connection of memories between a chestnut, a cello and an early morning at a water pump creates three works of art. The epistemology of this study is based on a dialogue between voices from different times and traditions. Some voices are normative examples, drawn from a dialogue between Swedish inventors. The others are those of philosophers from the Age of Enlightenment, fetched from their original writings. Through that dialogue, perspectives and ideas of inventors and classical philosophers meet and are compared. A deeper understanding thus emerges that shows the essence of invention and in fact the essence of all creative work: i) Freedom – in thought and in action ii) Dialogue - to test and try new ideas and things in the ever changing circumstances. iii) Doubt - not taking established fact and assumptions for granted iv) Action – testing and breaking established praxis and rules. The study also illustrates the need for an alternative scientific form and expression concerning studies in the fields of invention, innovation and other practical work. Invention can not be captured or shaped by exact measurements, concepts, definitions or abstract models. This thesis examines the practice of using safety factors in decision-making under uncertainty, in particular in the areas of toxicology and civil engineering. The aim is to expose and clarify some of the philosophical issues surrounding the practice. Paper I (co-written with Sven Ove Hansson and Fred Nilsson) gives an historical background to the practice of formal safety factor and safety margin use. The notion of an uncertainty function is presented as a more general concept covering safety margins, safety factors and the related uncertainty factors. Three categories of uncertainty functions are identified: explicit, implicit and natural safety reserves. Finally, the problems of countervailing risks and distribution arbitrariness are discussed. Paper II (co-written with John Cantwell) discusses the relation between decision-making with safety factor rules and the ideal of formal normative decision theory. The role of safety factor rules in practical and theoretical reasoning is also examined and certain difficulties regarding normative evaluation of safety factor rules are pointed out. Paper III (co-written with Sven Ove Hansson) looks at two current regulatory systems under development: Eurocodes for construction and REACH for chemicals. The two regulations have many similarities but reactions to them have been highly divergent. The differences are discussed and some hypotheses as to their explanation are suggested., QC 20101110

The present thesis is based on a scientifically-informed, contextualized and historicized reading of Ludwik Fleck. In addition to his monograph, the material studied includes his additional philosophical writings, his internationally-published scientific articles and two, thus-far-unstudied postwar Polish papers related to his Buchenwald experiences. The sources provided by Fleck have been traced back to the time of their origin. Based on the above material, it is argued that, rather than relativizing science and deeply influencing Kuhn, Fleck, attempting to participate in the current debates, is an ardent proponent of science, offering an internal account of its pursuit that accords with his oft-contested epistemic concepts, e.g., Denkzwang, Sinnsehen and Kopplungen. The exposure of his description of the Wassermann reaction discloses a highly selective reading of the sources available at the time, but also reveals its relation to the current debate on Einzelwissenschaften, or the standing of new emerging disciplines versus age-old ones, all occasioned by the remarkable progress of science that has also affected philosophy. The divide between philosophers and scientists on the philosophical implications of modern physics is exposed, as is Fleck’s heuristic use of the latter topic in his epistemology. A more realistic account of his often-valued scientific accomplishments is provided. It is argued that the modern interpretation or received humanist view of Fleck is based on the opposition, at the time Fleck’s monograph was rediscovered, of STS writers to a scientifically-informed reading of his texts. An additional corrective to the received view of Fleck is found in some of his postwar Polish papers related his Buchenwald experiences. The latter might also provide an answer to some of the contradictions inherent in the modern mythology surrounding Fleck. The essay argues that sometimes individuals take risks simply because they are in a vulnerable position and have no other choice. Four factors are identified as crucial in risks from vulnerability: poor outset conditions, lack of reasonable options, hope and liability to disinformation. Essay II addresses the democratic approach to risk communication and the ideal of risk communication as a dialogue between more or less equal stakeholders. The aim of the present thesis is twofold: first, to analyse some practical ethical problems that stem from the workplace and the working environment and to offer guidelines concerning how such problems can be solved; second, to illuminate how the specific nature of work and the working environment is intimately connected to the relation between the employee and the employing entity, as set forth in an employment contract, and how the form and content of such contracts are, among other things, determined by culturally and socially established ideas. The normative question to be addressed is thus: which of these ideas should be maintained? This can be seen as a second-order, or more fundamental, ethical question whose answer depends on determining which normative principles are right. An additional aim of this thesis is thus to illuminate that the contract relation has relevance to practical ethical problems in the workplace context in this second-order mode. The thesis consists of an Introduction and five papers. In Paper I (written together with Sven Ove Hansson) we argue that employees have a prima facie right to privacy, but that this right can be overridden by competing moral principles that follow, explicitly or implicitly, from the contract of employment. A set of ethical criteria is developed and summarized in the form of a guideline for determining the moral status of infringements into workplace privacy. In Paper II these criteria are applied to three broad classes of privacy-intrusive workplace practices: (1) monitoring and surveillance, (2) genetic testing, and (3) drug testing. In relation to some scenarios on these themes, it is shown that it is possible to handle such practical ethical problems systematically by way of the proposed guideline. Paper III deals with the fact that employees are protected by health and safety standards that are less protective than those that apply to the general public. Consistent valuation and societal prioritization of risks presupposes comparability among risks, that is, in order to rank risks in order of severity, and allocate risk preventative resources accordingly, we must be able to determine whether one risk is better or worse than another, and by how much. It is often claimed, however, that some risks are not amenable to this kind of comparison because they are incommensurable, which roughly means that they are not comparable with respect to a common cardinal measure (e.g. money). The aim of this thesis is to i) consider what it means to say that two risks are incommensurable, ii) explore if incomparability - comparison failure with respect to a common ordinal scale - ever occurs, and how to model it if it does. Essay I is a critical examination of the most prominent argument for incomparability, the so-called small improvement argument (SIA). It is argued that the argument fails because it conflates incomparability and a kind of evaluative indeterminacy. Essay II outlines so-called margin of error principles for comparative value judgements. They are based on the idea that if a proposition concerning the value relation between two value-bearing options is true, but there are sufficiently similar cases in which it is false, it is not available to be known. The usefulness of these principles is demonstrated by utilizing them in an epistemological case against SIA. Essay III presents a novel account of incomplete preference orderings which acknowledges that incomparability can vary in degrees. The thesis aims at developing new, alternative approaches and methods based on suggestions and ideas originating from moral philosophy and philosophical decision theory. More precisely, the thesis aims at investigating the rationality of transport policy decisions, including goal-setting and performance evaluation. Paper I discusses rationality in road safety policy. Problematic features are identified and discussed. The paper argues that the Swedish road safety goal is rational, since it is action-guiding and achievement-inducing. This follows by observing that the goal satisfies the criteria of precision, evaluability, approachability, and motivity. The paper states that previous accusations of irrationality have been unnecessarily imprecise, since no reference is made to independently developed criteria of rational goal-setting. Paper II discusses the Swedish transport policy goals, and the role of social welfare in rational policy decisions. Goals often come into conflict and trade-offs must be rationally and consistently managed. Policy decisions are outcomes of political processes. In the case of policy goals and decisions, the agent is society. This introduces the problematic concept of social welfare, which itself is an ambiguous goal with many meanings. Whether a decision is rational or not depends on whose perspective one takes on – that of society as a whole or that of the actual decision makers. This aim of this thesis is to examine ethical aspects of radiation protection from ionizing radiation. Radiation protection is the professional field that deals with the protection of humans and the environment from the harmful effects of radiation. The field is based on scientific knowledge of the health effects of radiation, but also on ethical value judgements. This thesis consists of a summary and three essays. Essay 1 gives an overview of ethical issues in radiation protection. Based on this overview four ethical problem areas are identified as central for radiation protection. The first are ethical problems related to uncertainty and the influence of value judgements, especially in scientific risk assessment. The second problem area is ethical issues regarding distributions of risks and benefits between different individuals, both in space and time. The third general problem area is related to limit-setting. A major problem here is how to set limits in an ethically justifiable way when there is no known level of exposure that is associated with a zero risk. The fourth area concerns procedural justice and social decision-making in radiation protection. Essay 2 discusses ethical problems related to the proposal that individual risks below a certain level should be excluded from the system of radiation protection, without any regard to the number of people exposed. It is concluded that there are at least three problems associated with disregarding very small risks: (1) that many small risks to an individual may add up to a large risk for that individual, (2) that many small risks to many individuals may add up to a large expected value of harm, and (3) that a small risk each to many individuals may add up to a large probability that several people are harmed. It is also argued that the proposal is hard to justify in a rights-based ethical setting. Essay 3 examines what makes one distribution of individual doses better than another. It is argued that a model for risk management needs to be developed that acknowledges several ethical aspects and most crucial among these, the individual’s right not to be unfairly exposed to risks. Article I takes as its starting point the demand frequently expressed in the risk literature for a consistent risk management. Such consistency is often assumed to be in accordance with some kind of cost-benefit analysis. It is maintained that such a model, here called the Standard Model, does not respect the rights of the individual. Two alternative models are outlined in order to better deal with this ethical weakness, the Model of Inviolable Rights and the Model of Procedural Justice. The arguments in the alternative models evolve around the separateness of individuals, rights and fair risk taking. It is claimed that the latter model, which focuses on a fair procedure, seems most fruitful to develop. Article II is a discussion of the NIMBY (Not In My Backyard) conflict, which is well known from situations of siting potentially risky facilities. Of special concern is to investigate what the ethical premises are behind the negative characterization of the NIMBY concept. It is argued that, contrary to the assumption that the total benefit should outweigh the individual’s cost, individuals in siting scenarios have rights not to be unfairly exposed to risks. Article III, which is co-authored with Professor Sven Ove Hansson, presents a three party model as a tool for ethical risk analysis. It is argued that ethical dimensions need to be acknowledged in the analysis of risks and that this is best done through a discussion of three parties that are involved in risk decisions – the risk-exposed, the beneficiary, and the decisionmaker. Environmental goals are commonly set to guide work towards ecological sustainability. The aim of this thesis is to develop a precise terminology for the description of goals in terms of properties that are important in their practical use as decision-guides and to illustrate how it can be used in evaluations of environmental policy. Essay I (written together with Sven Ove Hansson) identifies a set of rationality criteria for individual goals and discusses them in relation to the typical function of goals. For a goal to perform its typical function, i.e., to guide and induce action, it must be precise, evaluable, approachable (attainable), and motivating. Essay II argues that for a goal system to be rational it must not only satisfy the criteria identified in Essay I but should also be coherent. The coherence of a goal system is made up of the relations that hold among the goals, most notably relations of support and conflict, but possibly also relations of operationalization. A major part of the essay consists in a conceptual analysis of the three relations. Essay III contains an investigation into the rationality of five Swedish environmental objectives through an application of the rationality criteria identified in Essays I-II. The paper draws the conclusion that the objectives are not sufficiently rational according to the suggested criteria. Safety is an important topic for a wide range of disciplines, such as engineering, economics, sociology, psychology, political science and philosophy, and plays a central role in risk analysis and risk management. The aim of this thesis is to develop a concept of safety that is relevant for decision-making, and to elucidate its consequences for risk and safety research and practices. Essay I provides a conceptual analysis of safety in the context of societal decision-making, focusing on some fundamental distinctions and aspects, and argues for a more complex notion than what is commonly given. This concept of safety explicitly includes epistemic uncertainty, the degree to which we are uncertain of our knowledge of the situation at hand. It is discussed the extent to which such a concept may be considered an objective concept, and concluded that it is better seen as an intersubjective concept. Some formal versions of a comparative safety concept are also proposed. Essay II explores some consequences of epistemic uncertainty. It is commonly claimed that the public is irrational in its acceptance of risks. An underlying presumption in such a claim is that the public should follow the experts’ advice in recommending an activity whenever the experts have better knowledge of the risk involved. This position is criticised based on considerations from epistemic uncertainty and the goal of safety. Furthermore, it is shown that the scope of the objection covers the entire field of risk research, risk assessment as well as risk management. Essay III analyses the role of epistemic uncertainty for principles of achieving safety in an engineering context. The aim is to show that to account for common engineering principles we need the understanding of safety that has been argued for in Essays I-II. “There is no need to reinvent the wheel” – a cliché, often told when you want to come up with something new that in someway can be connected to something that already exist. This study shows the opposite – that inventions emanate from what is given. It can be a detail, a problem in a thing - a wheel - or a situation that catches the inventor’s attention. It is something that seeks a solution or something that generates an idea, a hint or a clue of something new and useful. The art of invention emerges from the ability and skill to broaden the seeing and put thinking, substance and tradition into motion. An old radio dial generates a new ergonomic steering wheel. The connection of memories between a chestnut, a cello and an early morning at a water pump creates three works of art. The epistemology of this study is based on a dialogue between voices from different times and traditions. Some voices are normative examples, drawn from a dialogue between Swedish inventors. The others are those of philosophers from the Age of Enlightenment, fetched from their original writings. Through that dialogue, perspectives and ideas of inventors and classical philosophers meet and are compared. A deeper understanding thus emerges that shows the essence of invention and in fact the essence of all creative work: i) Freedom – in thought and in action ii) Dialogue - to test and try new ideas and things in the ever changing circumstances. iii) Doubt - not taking established fact and assumptions for granted iv) Action – testing and breaking established praxis and rules. The study also illustrates the need for an alternative scientific form and expression concerning studies in the fields of invention, innovation and other practical work. The present thesis is based on a scientifically-informed, contextualized and historicized reading of Ludwik Fleck. In addition to his monograph, the material studied includes his additional philosophical writings, his internationally-published scientific articles and two, thus-far-unstudied postwar Polish papers related to his Buchenwald experiences. The sources provided by Fleck have been traced back to the time of their origin. Based on the above material, it is argued that, rather than relativizing science and deeply influencing Kuhn, Fleck, attempting to participate in the current debates, is an ardent proponent of science, offering an internal account of its pursuit that accords with his oft-contested epistemic concepts, e.g., Denkzwang, Sinnsehen and Kopplungen. The exposure of his description of the Wassermann reaction discloses a highly selective reading of the sources available at the time, but also reveals its relation to the current debate on Einzelwissenschaften, or the standing of new emerging disciplines versus age-old ones, all occasioned by the remarkable progress of science that has also affected philosophy. The divide between philosophers and scientists on the philosophical implications of modern physics is exposed, as is Fleck’s heuristic use of the latter topic in his epistemology. A more realistic account of his often-valued scientific accomplishments is provided. It is argued that the modern interpretation or received humanist view of Fleck is based on the opposition, at the time Fleck’s monograph was rediscovered, of STS writers to a scientifically-informed reading of his texts. An additional corrective to the received view of Fleck is found in some of his postwar Polish papers related his Buchenwald experiences. The latter might also provide an answer to some of the contradictions inherent in the modern mythology surrounding Fleck. This thesis is a philosophical contribution to the theories on risk communication. The topic of risk communication is approached from several different angles, but with a normative focus on equality and vulnerability. Essay I is a comment on risk perception theory and the psychometric model in particular. In risk perception research individual risk taking is described as either a result of valuing the benefits from risk taking or a failure of comprehending the severity or probability of risks. The essay argues that sometimes individuals take risks simply because they are in a vulnerable position and have no other choice. Four factors are identified as crucial in risks from vulnerability: poor outset conditions, lack of reasonable options, hope and liability to disinformation. Essay II addresses the democratic approach to risk communication and the ideal of risk communication as a dialogue between more or less equal stakeholders. The Essay argues that even the more innovative and dialogue oriented approaches to risk communication are unequal. This is often blurred by the confusion between the described ideal and the description of these newer approaches. This inequality is analysed in a three-fold way: influence over the communication process; influence over and access to information; and influence over risk decisions. The Essay develops a typology of different risk communication practices and influence distributions and concludes that the form of risk communication most commonly referred in the literature is the most imbalanced kind where all three types of influence falls to the same party. Essay III explores the concept of trust, an often-mentioned objective for risk communication. The concept of trust is analyzed from previous philosophical approaches, and the idea of trust as comfortable defocusing is introduced. The thesis aims at developing new, alternative approaches and methods based on suggestions and ideas originating from moral philosophy and philosophical decision theory. More precisely, the thesis aims at investigating the rationality of transport policy decisions, including goal-setting and performance evaluation. Paper I discusses rationality in road safety policy. Problematic features are identified and discussed. The paper argues that the Swedish road safety goal is rational, since it is action-guiding and achievement-inducing. This follows by observing that the goal satisfies the criteria of precision, evaluability, approachability, and motivity. The paper states that previous accusations of irrationality have been unnecessarily imprecise, since no reference is made to independently developed criteria of rational goal-setting. Paper II discusses the Swedish transport policy goals, and the role of social welfare in rational policy decisions. Goals often come into conflict and trade-offs must be rationally and consistently managed. Policy decisions are outcomes of political processes. In the case of policy goals and decisions, the agent is society. This introduces the problematic concept of social welfare, which itself is an ambiguous goal with many meanings. Whether a decision is rational or not depends on whose perspective one takes on – that of society as a whole or that of the actual decision makers. Consistent valuation and societal prioritization of risks presupposes comparability among risks, that is, in order to rank risks in order of severity, and allocate risk preventative resources accordingly, we must be able to determine whether one risk is better or worse than another, and by how much. It is often claimed, however, that some risks are not amenable to this kind of comparison because they are incommensurable, which roughly means that they are not comparable with respect to a common cardinal measure (e.g. money). The aim of this thesis is to i) consider what it means to say that two risks are incommensurable, ii) explore if incomparability - comparison failure with respect to a common ordinal scale - ever occurs, and how to model it if it does. Essay I is a critical examination of the most prominent argument for incomparability, the so-called small improvement argument (SIA). It is argued that the argument fails because it conflates incomparability and a kind of evaluative indeterminacy. Essay II outlines so-called margin of error principles for comparative value judgements. They are based on the idea that if a proposition concerning the value relation between two value-bearing options is true, but there are sufficiently similar cases in which it is false, it is not available to be known. The usefulness of these principles is demonstrated by utilizing them in an epistemological case against SIA. Essay III presents a novel account of incomplete preference orderings which acknowledges that incomparability can vary in degrees. The aim of the present thesis is twofold: first, to analyse some practical ethical problems that stem from the workplace and the working environment and to offer guidelines concerning how such problems can be solved; second, to illuminate how the specific nature of work and the working environment is intimately connected to the relation between the employee and the employing entity, as set forth in an employment contract, and how the form and content of such contracts are, among other things, determined by culturally and socially established ideas. The normative question to be addressed is thus: which of these ideas should be maintained? This can be seen as a second-order, or more fundamental, ethical question whose answer depends on determining which normative principles are right. An additional aim of this thesis is thus to illuminate that the contract relation has relevance to practical ethical problems in the workplace context in this second-order mode. The thesis consists of an Introduction and five papers. In Paper I (written together with Sven Ove Hansson) we argue that employees have a prima facie right to privacy, but that this right can be overridden by competing moral principles that follow, explicitly or implicitly, from the contract of employment. A set of ethical criteria is developed and summarized in the form of a guideline for determining the moral status of infringements into workplace privacy. In Paper II these criteria are applied to three broad classes of privacy-intrusive workplace practices: (1) monitoring and surveillance, (2) genetic testing, and (3) drug testing. In relation to some scenarios on these themes, it is shown that it is possible to handle such practical ethical problems systematically by way of the proposed guideline. Paper III deals with the fact that employees are protected by health and safety standards that are less protective than those that apply to the general public.
