This book explores the role of law and policy in circular economy transitions and their impacts on justice, including on distributional equity and recognition and procedural rights, especially for people already marginalised under the current dominant economic system.Amid increasing demand for virgin raw materials, and unsustainable consumption and waste disposal that are driving the global ecological and climate crisis, there are growing calls to urgently transition to circular economies. Despite an increasing number of circular approaches being adopted, implemented, and integrated in national and local laws and policies, the number of commercially successful business stories remains isolated. Moreover, questions about whether circular economy laws and policies are delivering fair and just global outcomes need to be addressed. This book examines this significant knowledge gap to understand legal experiences, including justice and equity issues in the global context, so that these can inform wider design and implementation. The book begins by explaining the concept of a circular economy and its context within wider issues of sustainable development and justice. The first part of the book then examines the legal context of the circular economy by analysing legal forms in practice and those recommended in wider scholarship before considering how these could impact on existing inequity and injustices globally. The second part delivers an empirical understanding of the implications of the law on circular economy approaches and the global equity and justice dimensions through two case studies on solid waste management and forestry. Building on insights from ecological economics and philosophy of technology, this book offers a novel, interdisciplinary approach to understand the contradictory nature of Solar photovoltaic (PV) technology. Solar photovoltaic (PV) technology is rapidly emerging as a cost-effective option in the world economy. However, reports about miserable working conditions, environmentally deleterious mineral extraction and toxic waste dumps corrode the image of a problem-free future based on solar power. Against this backdrop, Andreas Roos explores whether ‘ecologically unequal exchange'– an asymmetric transfer of labour time and natural resources – is a necessary condition for solar PV development. He demonstrates how the massive increase in solar PV installation over recent years would not have been possible without significant wage/price differences in the world economy - notably between Europe/North America and Asia- and concludes that solar PV development is currently contingent on environmental injustices in the world economy. As a solution, Roos argues that solar technology is best coupled with strategies for degrowth, which allow for a transition away from fossil fuels and towards a socially just and ecologically sustainable future. This book explores the role of feminist activists in The United Nations Framework Convention on Climate Change and highlights the progress they have made in mainstreaming gender as a key issue in global climate governance. It is now commonplace for gender to be framed as a political issue in global climate politics within academic scholarship, but there is typically a lack of robust empirical analysis of existing advocacy approaches. Filling this lacuna, Joanna Flavell interrogates the political strategies of the Women and Gender Constituency (WGC) in the UNFCCC (The United Nations Framework Convention on Climate Change). Through a conceptual framework that integrates climate change with intersectional critical inquiry and political practice, Flavell analyses hundreds of historical documents, coupled with interviews and observations from two UNFCCC conferences. This research uncovers a so-far untold story about the history of the UNFCCC that foregrounds gender and feminist advocacy, highlighting the importance of the WGC in shaping dominant narratives of global climate governance through a series of rhetorical and procedural strategies. Overall, the book draws important conclusions around power in global climate governance and opens up new avenues for advancing a feminist green politics.
