Social services directors believe that a High Court ruling in Jun. 1997 that a host authority was responsible for the after care support of an 18-year-old boy when he left foster care went against the spirit of the Children's Act 1989. Local authorities have a duty under the Act to look after children in their care until they reach 18, and any subsequent support is discretionary, but it is widely believed that the local authority remains responsible for care leavers until the age of 21. The case involved Lambeth Council's refusal to provide after care support for David Caddell.
