Abstract

The authors explore the issue of whether U.S. medical residents should be considered workers or students. They discuss the case of Mayo Foundation for Medical Education and Research, et al. versus United States. They examine the controversy over the 1935 Federal Insurance Contributions Act (FICA). The authors also discuss government lawyers' defense of the Treasury regulation that declares residents to be employees.
