The dissertation examines the recent transformations in the modes of governing the activities of psychiatric hospitals. More specifically, it explores the role of two influential reform processes in France: the introduction of judicial reviews of involuntary commitment and the evolution of the ways public psychiatric institutions are funded. Unequally successful and traversed by heterogeneous institutional logics, from law and economics respectively, both changes aim to shape norms of the legitimate functioning of psychiatric hospitals. Hence, they contribute to changes in professional practices and organisational dynamics. This sociological work draws on interviews, conducted with medical and judicial professionals and policy makers, a set of ethnographic observations carried out in psychiatric hospitals and judicial hearings, as well as a review of written sources. The dissertation analyses the elaboration of public policies in psychiatry and their implementation, focusing on the role of psychiatrists and their interactions with other professionals, particularly in the legal field, as well as with institutional, national or regional actors. This work concludes that psychiatrists have been relatively dispossessed of control over the process of reform of the psychiatric institution over the last decades. However, the deprivation is masked by their ability to partly control the conditions of the implementation of these policies.; La thèse étudie les transformations récentes des modes de gouvernement de l’activité psychiatrique hospitalière. International audience; In France, the duty ‘to protect persons threatened in their country’ is based on an impartial examination of the asylum application, the right to remain on the territory and to dignified reception conditions for the duration of the examination. However, the testimonies collected by the Marseille Asylum Observatory show that there are "systemic failures" in the administrative and logistical processing, which violate the "human dignity" and "integrity" of persons. We will analyse the 60 stories collected from asylum seekers and accompanying persons in 2017-2018 in order to grasp the modalities of wandering and abandonment of people. As a counterpoint, we will update the solidarity initiated by various actors (employees, activists, volunteers, and citizens), which is exercised in extenso by linking the city with vital information concerning access to basic needs. Finally, we will choose five judgements from the administrative Court of appeal of Marseille and the Council of State, which confirm or invalidate the rejection of material reception conditions, while prioritising and proportioning the rights and duties of guests.; En France, le devoir « de protection des personnes menacées dans leur pays » repose sur des principes : une protection élargie, un examen impartial de la demande d’asile, un droit au maintien sur le territoire ainsi qu’à des conditions d’accueil dignes pendant toute la durée de l’examen (CESEDA 2015). Si le pays est responsable de l’examen de la demande d’asile, la personne bénéficie du droit « au maintien sur le territoire » et aux « conditions matérielles d'accueil », qui comprennent des prestations d'information et d'accompagnement, ainsi que le versement d’une allocation financière. Or, les témoignages sur les conditions d’accueil à Marseille recueillis par l’Observatoire Asile de Marseille [OAM, 2018] montre qu’il existe localement des « défaillances systémiques » dans le « traitement » administratif, informatique, logistique, humain des individus, qui contreviennent « à la dignité humaine », « à la vie », « à l’intégrité des personnes ». Nous passerons au tamis de 60 récits collectés en 2017-2018 pour dépeindre l’errance, l’attente et le délaissement des personnes . En contrepoint, nous actualiserons les pratiques solidaires initiées par des acteurs militants, salariés, bénévoles et citoyens dans les lieux publics, associatifs et privés, qui maillent la ville d’informations vitales concernant la distribution de repas ou de vêtements, des lieux de mise à l’abri, d’accès aux soins... Si les solidarités sociétales s’exercent in extenso face aux carences des protections légales, quelles garanties offrent les juges dans le contentieux des « conditions matérielles d’accueil » ? Pour y répondre, nous avons analysé le contentieux administratif à travers 24 jugements de la cour administrative d’appel de Marseille et du Conseil d’Etat entre 2018-20, qui confirment ou infirment le rejet des conditions matérielles d’accueil, en examinant les libertés et les droits des requérants, en hiérarchisant les devoirs des accueillis et des accueillants, tout en proportionnant les obligations légales d’accueil, au sous-dimensionnement chronique du dispositif asile.

The paper aims to analyze the relationship between justice and psychiatry in two different national contexts : France and the United States, from the XIXth century , when psyhchiatry appears in both countries as amongst the most significant ways to treat deviant people.

This chapter examines how a ritual conflict involving supporters of two village deities, with a long history of unsuccessful attempts to resolve it through ritual and administrative proceedings, was eventually brought to court. This shift from a ritual and administrative arena to the judiciary is discussed in reference to the notion of ‘judicialization’, a notion used to indicate the broadening of the court’s sphere of competence at the expense of politicians and/or administrators. By relying both on the legal file and on ethnographic material, the analysis bears on the arguments put forward by one of the gods’ legal representative in order to prove the god’s traditional right to an honorific position, as well as on the reasoning put forward by the judge in his ruling. It suggests that the shift to the courtroom transformed the nature of the case, from a conflict among gods’ supporters over a ritual honour, to a conflict between them and the state administration over a religious right.

The emergence of discourses on the judicialization and legalization of medical matters is evidence of the growing importance of law, understood as a constraint by the doctor. First, though a legal framework is indeed necessary for medical activity, the proliferation of legal rules is deemed akin to downright interference. Then, though applying the principle of responsibility to medicine is indisputable, practitioners see the trial as a sword of Damocles hanging over their heads. We have established that resorting to alternative dispute resolution and the use of pedagogical methods are all possible ways of healing. And yet, these remain insufficient, because they do not make it possible to depart definitely from a constraining vision of law. In fact, doctors’ ignorance in this matter does not enable them to approach law from an angle other than coercive. Law is only a small portion of medical initial and continuing training, even though it has become essential in medical practice. To solve this contradiction, we are committed to seek a paradigm based on the constructive alliance between law and medicine. We have defined a form of access to legal knowledge by the medical community. The physician must receive training that is appropriate to his/her legal practice. Creating a Pole clustering medicine and law should facilitate doctors’ access to law, via making teaching means available to them. Henceforth, law will be regarded as one more resource supporting the physician's action.; L’émergence de discours sur la judiciarisation et la juridicisation de la médecine atteste de la place croissante du droit, appréhendée telle une contrainte par le médecin. D’abord, si l’encadrement juridique de l’activité médicale est nécessaire, le foisonnement de règles juridiques est assimilé à une ingérence. Ensuite, si l’application du principe de responsabilité à la médecine est indiscutable, le médecin entrevoit le procès comme une épée de Damoclès. Nous avons pu établir que le recours aux modes alternatifs de règlement des conflits et l’usage de procédés pédagogiques constituent des voies possibles de guérison. Elles demeurent toutefois insuffisantes puisqu’elles ne permettent pas de se détacher définitivement d’une vision contraignante du droit. En effet, l’ignorance du médecin en cette matière ne lui permet pas d’entrevoir le droit autrement que sous un angle coercitif. Le droit ne représente qu’une portion congrue de la formation initiale et continue alors même qu’il est devenu incontournable dans l’exercice médical. Pour résoudre cette contradiction, nous nous sommes attachés à rechercher un paradigme d’alliance constructive entre droit et médecine. Nous avons défini une forme d’accès du corps médical à la connaissance juridique. Le médecin doit bénéficier d’une formation juridique adaptée à son exercice. La création d’un Pôle médecine et droit doit faciliter l’accès du médecin au droit par la mise à disposition d’outils pédagogiques. Le droit est alors envisagé comme une ressource dans l’action du médecin.

The development of the EU asylum and migration policy is often explained as the result of ‘venue-shopping’, that is, the move by policy-makers to an EU policy venue in order to avoid national constraints. This article demonstrates\ud that, contrary to what would have been expected on the basis of this widespread view, EU co-operation on asylum matters has actually led to a rise in the legal standards\ud applicable to asylum-seekers and refugees. This outcome can be mainly explained by broader changes that have gradually affected the EU ‘system of venues’ and have thereby decreased the likelihood of more restrictive measures being adopted in the EU asylum policy venue. This has important implications for the EU governance of asylum and migration in general.

In Italy, the " years of lead " represent a controversial past: this period of recent history is often mobilized in various contexts and its interpretations divide and oppose different actors. This thesis analyses the public uses of history, from the 1970s until today, and shows how a dominant frame of interpretation of past events has been set. Various empirical materials (interviews, autobiographies, archives, parliamentary debates) allowed to study different areas where narrations of past events have been constructed and controversies are taking place. Differently from works that are explaining recurrent controversies about the past by its "exceptional" or "traumatic" character, this research is focusing on the present. It analyses the actors that are intervening in public debates about the past and on their specific issues: judges, victims, former activists, politicians. It sheds light on how the past is continuously constructed and reconstructed in and by contemporary mobilizations and controversies. Thus, this work associates the study of actors' trajectories and sociopolitical contexts to explain the posterior lives of the 1970s in Italy., Les " années de plomb " en Italie demeurent un passé qui est souvent mobilisée dans des contextes très divers et dont l'interprétation divise et oppose de nombreux acteurs. Cette thèse analyse les usages de ce passé, des années 1970 jusqu'à nos jours, et montre comment s'est élaboré et imposé en Italie un cadre interprétatif dominant des événements de la période. A partir de matériaux empiriques variés (entretiens, autobiographies, archives, débats parlementaires), elle étudie les multiples arènes où s'élaborent les mises en récit des événements passés et les controverses qui marquent leur interprétation. A la différence des travaux qui mettent en avant le caractère " exceptionnel " ou " traumatisant " d'un passé pour rendre compte de sa récurrence dans les débats postérieurs, ce travail déplace la focale du passé au présent. Il porte l'attention sur les acteurs qui interviennent dans les débats sur le passé et sur les enjeux qui leur sont propres : magistrats, victimes, anciens militants, hommes politiques. Il montre comment le passé est construit et reconstruit sans cesse dans et par ces différentes mobilisations et controverses qui se déroulent dans des conjonctures éloignées. C'est donc dans la rencontre entre trajectoire d'acteurs (et groupes d'acteurs) et contextes sociopolitiques que l'on peut saisir et expliquer les vies ultérieures des années 1970 en Italie.

Organisation et direction du panel 155; International audience; Constitutional Courts play an increasing role in contemporary politics in every part of the world. In spite of this fact, research about Courts is under-developed beyond the US case. Research on European Constitutional Courts focused on the Judicialization hypothesis and especially the effects of the abstract review procedure on legislative behaviour (Landfried 1984, Stone 1992. 1999). Only a few articles questioned this position and claimed that Judicialization may at least be regulated by some variables, such as court position or public opinion (e.g. Vanberg 1998, 2001). Main countries under investigation were France and Germany. Additionally, we rarely (Ginsburg 2003) find substantial comparative analyses of Constitutional Courts and their institutional settings even though courts play an important role in most concepts of comparative politics (e.g. Lijphart 1999, Tsebelis 2002). Thus, Scholars are divided about the precise impact of Constitutional Courts as counter-majoritarian institutions or as veto players and the variables controlling it. To understand the role of Constitutional Courts in different political systems accurately, we need to base our knowledge on an explicit comparison between Courts. In order to do so, data, methodologies and theories should be truly and rigorously comparative. The aim of this panel is to focus on data, methods and theories that will stimulate comparative studies on Constitutional Courts. We expect papers focusing on one of these aspects or using the comparative approach to investigate a substantial issue concerning either intra-court decision-making or the role of courts in political systems. Papers on Eastern European Constitutional Courts are especially welcome.

Penitentiary Judicialization : Is Law a Resource in Prison ? The article analyzes the growing place of law in prison and the ways in which prison actors can use it. How can the law take its proper place in an organization accustomed to opaqueness and arbitrary power ? The forms of this process of "judicialization" are analyzed here, particularly the recognition of inmates' rights, the increasing number of appeals, and the presence of lawyers, judges, and mediators in prisons. For inmates, as well guardians, law represents a resource, but also a risk. It has concrete effects on professional practices and, more widely, on prison relations. In the context of a crisis of legitimacy, the prison institution is certainly modified by the law, but how far can its transformation go ?, L'article analyse la place croissante du droit en prison et les manières dont les acteurs carcéraux peuvent l'utiliser. Comment le droit peut-il faire sa place au sein d'une organisation habituée à fonctionner sur le mode de l'opacité et de l'arbitraire ? Les formes de ce processus de judiciarisation sont analysées, en particulier la reconnaissance de droits aux détenus, l'augmentation des recours, la présence en prison d'entrepreneurs du droit. Arme à double tranchant, le droit représente, pour les détenus comme pour les personnels, une ressource qui peut se transformer en risque. L'institution carcérale, dans un contexte de crise de légitimité, est modifiée par le droit, la question étant de savoir jusqu'où peut aller sa transformation.
