In recent years, the integration of goods, capital and financial markets has progressed on a global scale. The 66th annual meeting of the Association of German Economics Research Institutes (ARGE) focused on the question of national macroeconomic policies in an environment of increasingly interdependent business cycles. In the first paper of the volume, Koll gives a general introduction to the history of business cycles co-movement. Koll also highlights the responsibility of national governments as global players. The first section deals with the evolution of business cycle synchronization. Flaig, Sturm and Woitek conclude that, while the oil shocks of the 70s induced strong co-movements in business cycles, German unification led to a divergence of national cycles. The paper by Fichtner concentrates not only on business cycle synchronization over time but introduces an analysis on the transmission mechanisms at work. Fichtner finds that common shocks and technology spillovers account for most of the co-movement in output. The second section explains some of the individual transmission mechanisms in greater detail. Horn examines how business confidence carries over from one country to another and finds evidence that positive expectations in the US strengthen German confidence and that this relationship has become stronger over time. Schröder quantifies the role of the transmission of stock market investors'confidence in the relationship between US and German GDP. He distinguishes between the pure investor expectation effect and the direct influence of stock markets on real GDP and finds a direct causal impact. The third section concentrates on economic policy and its implications. Kuhn analyzes the transmission of monetary policy shocks and finds the transmission mechanism via interest rate co-movements to be more important than that via trade and the exchange rate mechanism. Middendorf and Radmacher-Nottelmann explore the importance of multinationals in the transmission of economic business cycles. Macro evidence suggests a synchronization of investment behavior. Micro evidence, however, reveals only a weak impact of multinationals on business cycle synchronization. This AEQ supplement should be essential reading for anyone, whether academic or practitioner, with an interest in future macroeconomic policy options in an increasingly integrated economic environment.

This volume contains, for the most part, the papers and their formal discussions presented at an International Symposium'EUFORIKZ'(EURO, FORINT, KRONE, ZLOTY), held at Gerhard-Mercator-University Duisburg, Germany, on October 26-28, 2001. The focus of the volume lies on the following two questions: Firstly, which lessons can the Visegrad countries draw from exchange rate theory to choose the best strategy for monetary integration into the European Union? Secondly, which specific problems do the Visegrad countries face in their exchange rate policies? The first group of papers includes discussions of the policies of the European Central Bank, a general discussion of possible alternative options for the monetary integration of the accession countries, a discussion of the optimum currency area criteria with an emphasis on the endogeneity hypothesis, a discussion of inflation targeting and the proposal for euroization. The second group of papers analyzes specific problems of Poland, Hungary, the Czech Republic and the Slovak Republic on their way towards the accession to the European Union as well as towards the fulfillment of the Maastricht convergence criteria. Der Tagungsband enthält die Ergebnisse eines Internationalen Symposiums'EUFORIKZ', das vom 26.-28. Oktober 2001 an der Gerhard-Mercator-Universität Duisburg stattfand. Dabei standen folgende Fragen im Vordergrund des Interesses: Erstens, was können die Visegrad Länder von der Wechselkurstheorie für ihre eigene wechselkurspolitische Strategie lernen? How to provide training for youth is one of the fundamental questions a society faces and which must be answered by each generation anew. An ever-changing economic environment poses a constant challenge to both - the content of the training as well as the means by which it is provided. Also, societal preferences are subject to change. How well are the existing institutions of education and training equipped for dealing with and adjusting to the changing requirements, or even for anticipating new ones? This collection of papers takes up the case of the apprenticeship. Since it has proven to be the most important pillar of training for non-college-bound youth in many Western European countries - with other countries considering its implementation as well - the topic of apprenticeship calls for up-to-date in-depth analysis: If so, to what extent is training actually beneficial to the two main parties involved: the trainees and the firm? What prospects do graduating apprentices face on the labor market? What is the relationship between apprenticeship training and early career mobility? What are the costs and benefits to firms offering apprenticeship training? What is the socially optimal amount of training? The release of new and improved datasets allowed many new and interesting questions to be raised that could not have been studied with previously available data. The book provides a valuable resource to anyone interested in apprenticeship training, whether for academic purposes or as practitioner.

It was in the early 1990s, more precisely in 1991 shortly after the end of the Cold War, that the Walther-Schücking-Institute at Kiel University - within the framework of its biennial international conferences - started a series of international symposia which, in retrospect, can be subsumed under the overall heading of »international law at the frontiers«. The aim of these thematically closely related symposia, bringing together eminent international legal scholars, was to explore the structural changes that the international system and its legal order were undergoing due to the forces of globalization and the political upheavals following the end of the ideological division of the world. The present papers and proceedings of the fifth conference of the series of symposia brings this project to an end. The authors are exploring the meaning of the concept of the international law of cooperation and the obligation to cooperate in three important areas of modern international law: the international protection of human rights (Lori Fisler Damrosch, New York) international economic and environmental law (Christian Tietje, Halle) and international dispute settlement (Anne Peters, Basel). The implications of the state obligations to cooperate for the conceptualization of sovereingty in present international law are the subject of the fourth paper (Christoph Schreuer, Wien). Although the host of information, provided by the rapporteurs, revealed the immense importance of obligations to cooperate in international conventional law as a steering tool in international relations it also became clear that a general concretization of the meaning of obligations to cooperate cannot presently be established - if ever. The concrete meaning of the obligation to cooperate has to be interpreted within the actual context in which such obligations are stipulated. It was also concluded that obligations to cooperate surely constitute major restraints on the sovereign freedom of action of states. However, they are not incompatible with the notion of state sovereignty as it is recognized under modern international law. States today are embedded in a network of institutionalized legal regimes under which sovereignty - in contrast to the pre-World War I era - cannot legally be exercised at will. Sovereignty has to be re-conceptualized in the light of the international law of cooperation and the ensuing obligations to cooperate that at are crucial for the development on an International Civil Society under the rule of law.

This publication contains a selection of papers presented at a conference discussing fundamental issues in the economics of transition, aspects of liberalization/privatization/stabilization and the experience of selected countries. The sessions lead to a number of hypotheses: - There is a need to analyze historical and economic aspects of phases of relative success of the socialist system of central planning - Next to the important role of distribution of personal incomes and wealth for the success of the transformation process, the question of'optimal change of personal income and wealth distribution'during the process of transformation has to be raised. - In assessing the costs and benefits of reform policies, any methodological approach should take into account an intertemporal perspective - How much does the EU continue protectionism against countries which will not become its members in the near future? - The role of the institutional environment shall not be neglected when analyzing the process of transition: financial markets e. g. are of great relevance for sound development. - An early status of independence for the central bank from public finance obligations appears to help to eliminate the monetary overhang. - A quick, almost instant liberalization strategy (countries of Central and Eastern Europe) seems to be more successful than gradual liberalization (Russia, Ukraine, Belarus) along with interventionism of trade policy.

Die Zahl an Kartellschadensersatzverfahren hat in den letzten Jahren stetig zugenommen. Gleichzeitig sind die Verfahren mit erheblichem Aufwand verbunden und dürften die Gerichte teils noch über Jahre beschäftigen. Der Autor untersucht das geltende Kartellzivil- und Zivilprozessrecht und kommt zu dem Ergebnis, dass die derzeit bestehenden Instrumente nicht geeignet sind, die Ziele des Kartellrechts zu verwirklichen. Wie der Gesetzgeber im Rahmen der 11. GWB Novelle spricht er sich für eine intensivere Einbindung der Kartellbehörden bei der Aufarbeitung von Kartellschäden aus. Allerdings geht der Gestaltungsvorschlag über eine einfache Abschöpfung von Vorteilen hinaus. Vielmehr begründet er, weshalb die Übernahme der 2017 reformierten strafrechtlichen Einziehung von Taterträgen auch für das Kartellrecht ein geeignetes Modell darstellt. Bei einer Umgestaltung des § 34 GWB nach diesem Vorbild sei eine effektivere und effizientere Kompensation Geschädigter zu erreichen.

The embarrassing living conditions of more than one billion poor people in developing countries in combination with the increasing gap of living standards between the poor and the rich, has provided a strong motivation for development policy to change this situation. From its beginning, policy has aimed for stimulating economic growth in order to improve living conditions for everyone. The endurance of poverty, however, has motivated to extend the traditional »growth is good for the poor« by a more targeted policy that combines growth with a particular emphasis on improving the situation of the poor. This is exactly the objective of »pro-poor growth«, a term that became popular during the late 1990s and which seemed to dominate the stage with the propagation of the Millennium Development Goals, including its goal to halve poverty by 2015. This volume contains six papers that address various core issues of pro-poor growth policies. These papers were presented at the annual meeting of the Research Committee Development Economics (Ausschuss Entwicklungsländer des Vereins für Socialpolitik) in 2005. Papers were lively discussed at the meeting and later on improved by comments from anonymous referees. All authors have done extensive research in the field of pro-poor growth, including field studies. Accordingly, their contributions - reflecting this knowledge and proficiency - pick up recent developments in the field. The discussion of most appropriate pro-poor growth policies is an ongoing process which has been documented by a growing literature. The value added of the present volume is obviously not to be more comprehensive than others but rather to continue the line of work by bringing some recent research findings - with a focus on policy relevance and empirical substantiation - to a broader audience.

The internationalisation of business is creating new needs for effective communication across language and cultural barriers. This collection of articles by distinguished contributors from companies and business schools in 13 European countries offers new insights into the vital issues in the field. Part One focuses on research into the needs of business. Part Two shows how leading business schools are responding to the challenges of preparing their students for a role on the global stage. Part Three examines a range of intercultural communication and language issues arising from internationalisation. Most of the book is in English, with serveral articles in German and one in Spanish. The contribution are selected from papers held at the 10th Conference of ENCoDe (European Network for Communication Development in Business and Education) in Ingolstadt, Germany in March 1998.

Start-ups und junge Unternehmen haben in den letzten Jahren vermehrt Probleme bei der Kapitalgenerierung in Zusammenarbeit mit traditionellen Finanzintermediären. Crowdfunding ist eine alternative Finanzierungsmöglichkeit, die in den jeweiligen Mitgliedstaaten der Europäischen Union bisher nur national umgesetzt wurde. Die ECSP-Verordnung ist der erste Versuch, einen europäischen Crowdfundingmarkt zu schaffen. Der Anwendungsbereich der Verordnung ist allerdings nicht umfassend. Ob die Finanzierungswirklichkeit von jungen Unternehmen verbessert wird, hängt maßgeblich davon ab, in welchem Umfang attraktive Anlageformen in den Anwendungsbereich der Verordnung fallen. Die Arbeit untersucht ausgehend von den Anlageformen im deutschen Recht, inwieweit diese unter das Regime der ECSP-Verordnung fallen und in welchen Fällen weiterhin das nationale Recht Anwendung finden muss. Die Arbeit wurde mit dem Förderpreis der Heinz-Ansmann-Stiftung ausgezeichnet.

Es gibt derzeit wohl kaum einen anderen Gegenstand, der die Finanzmärkte und Bankaufsichtsbehörden intensiver beschäftigt als die Finanzinnovationen, speziell die Derivativ-Geschäfte. Sie stehen im Mittelpunkt des vorliegenden Bandes, der die sechs Referate der 26. Tagung des Ausschusses für Geldtheorie und Geldpolitik des Vereins für Socialpolitik aus dem Jahre 1995 vorlegt. Das Themenspektrum der Beiträge ist weit gespannt: Welche gesamtwirtschaftlichen Wirkungen haben Unterschiede in den nationalen Finanzstrukturen, das rasche Vordringen neuer Finanzprodukte und verschärfte Ansätze der Bankenregulierung? Wie sind die Chancen (und Risiken) der sogenannten aufstrebenden Finanzmärkte zu beurteilen? Welche Konsequenzen ergeben sich daraus für die Geld- und Makropolitik sowie für die Bankenaufsicht? Gestützt auf eine Erhebung der BIZ gelangt Horst Bockelmann mittels Simulationsrechnungen zu dem Ergebnis, daß unterschiedliche nationale Finanzstrukturen - speziell die »typische« Kreditfinanzierung des privaten Sektors - für die geldpolitische Transmission eine wesentliche Rolle spielen. Jürg Blum und Martin Hellwig leiten aus ihrem Makromodell die Schlußfolgerung ab, daß strikte Eigenkapitalvorschriften für Banken gesamtwirtschaftliche Fluktuationen verstärken, wenn negative Schocks der aggregierten Nachfrage die Schuldendienstleistungsfähigkeit der Unternehmen verringern und damit auch die Kreditgewährung und die Investitionstätigkeit. In einer vergleichenden Studie für England und Deutschland testen Werner Gaab und Andy Mullineux die relative Überlegenheit von Divisia-Indices gegenüber Geldmengenaggregaten mit dem Ergebnis, daß sich die englische (weniger ausgeprägt die deutsche) Geldpolitik stärker an Divisia-Indices orientieren sollte. Ausgehend von einer Analyse der ökonomischen Funktionen von Derivaten sehen Otmar Issing und Karlheinz Bischofberger zwar ambivalente Wirkungen im Bereich der Finanzmärkte (effizientere Risikoverteilung versus erhöhte Volatilitä

The problem of the minority voice is an old problem, but one that has not been adequately dealt with. Democracy, in the forms in which it has been institutionalized, has not insured humane prison conditions, equality of the sexes, satisfactory child protection, adequate legal representation, or minority rights; indeed, democracy is often advanced as an excuse for ignoring these issues. The problem of getting a fair and effective hearing for the small, the weak, the poor, and the disadvantaged still lies before us. Such are some of the questions of law, justice and the state toward which the studies in this volume were meant to be directed. They are among the vital questions of our time, and not only in Europe. This volume presents papers which were all delivered at the 16th IVR World Congress in Reykjavík. Many legal theorists, social philosophers and social scientists have done an excellent work on the topics of nationality and nationalism, the state, the evolution of democracy, competing conceptions of justice, and ideologies and strategies for the future.

This volume represents some of the Proceedings of the Annual Meeting of the Research Committee on Development Economics (Ausschuss für Entwicklungsländer) of the German Economic Association (Verein für Socialpolitik) held in Cologne, Germany, in July 2004. The meeting focused on the effectiveness of, and new approaches in, development cooperation. Both issues have become increasingly important in recent years in view of the declining volume of budget funds allocated to development cooperation. The papers discussing the effectiveness of foreign aid shed new light on the issue at a crucial moment where economists have begun to question the recent consensus that the productivity of aid mainly depends on the recipient country's policy environment. As far as the contributions dealing with new approaches in development cooperation are concerned, these are centred on a closer integration of the private sector, by joint action with so-called lead firms in production networks on the one hand, and the mobilization of additional financial resources from international capital markets for bilateral development cooperation, on the other. The authors also make suggestions concerning critical aspects relevant for implementation. The last part of this volume is dedicated to an assessment of low-income countries'pension schemes based on the human capital approach.

The Kaliningrad Oblast is a subject of the Russian Federation which became an EU's enclave upon its Eastern enlargement of 2004. This inquiry examines the intricate position of the Kaliningrad region inside the European Union from a legal and institutional rather than geopolitical perspective. Challenging conventional notions about inclusion of third units into the EU and attempting to bridge a gap in the academic literature on the EU's policy towards Kaliningrad, the paper tests the hypothesis that the Kaliningrad Oblast is to a certain extent included or integrated into the EU. More particularly, while spelling out and assessing the EU's Kaliningrad policy it seeks to answer the main research question as to whether this policy can be qualified as essentially a policy of inclusion. The inquiry proceeds from manifold assumptions of the'insides'and'outsides'of the EU, the growing flexibility of models of integration into the Union as well as the notions of the EU's borders including geopolitical, institutional/legal, transactional and cultural borders which consistently become fuzzier. A substantial part of the paper rests on the study of the bilateral political, legal and institutional relationship between the EU and Russia. Furthermore, the paper scrutinizes the oblast's legal capacity in international relations, as well as its status of Special Economic Zone in the framework of Russian federal policy. It eventually traces and systematizes the EU's activities in its eastern enclave. Although the analysis of the policy by the EU directed towards Kaliningrad does not allow calling it a clear policy of inclusion it still dismisses the idea of the EU treating Kaliningrad as a clear outsider.

The subject of this book is the »Proposal for a Council Directive on Civil Liability for Damage Caused by Waste« which was first presented by the Commission of the European Communities in 1989, then amended in 1991, and which remains under consideration by the Council to this day. The book attempts to look at the Proposal from a comparative point of view, asking what impact the Directive, if implemented as drafted, would have on the law of different Member States of the EC. For this purpose, England (as part of the U. K.) and Germany have been taken as examples. A detailed and comparative outline of the English and German law related to civil liability for waste precedes the examination of the proposed Directive. In this way, the book also contributes to the discussion triggered by the Commission's »Green Paper on Remedying Environmental Damage« of 1993. To the main text of the book, which is written in English, an extensive German summary has been added. Gegenstand dieses Buches ist der von der Kommission der Europäischen Gemeinschaften (jetzt: der Europäischen Union)im Jahre 1989 vorgelegte »Vorschlag für eine Richtlinie des Rates über die zivilrechtliche Haftung für die durch Abfälle verursachten Schäden«, der im Jahre 1991 mit wesentlichen Änderungen versehen wurde und dem Rat nach wie vor zur Prüfung vorliegt. Das Buch beleuchtet den Richtlinienvorschlag rechtsvergleichend, d. h. unter der Fragestellung, wie sich die Richtlinie auf die Rechtslage in verschiedenen Mitgliedsstaaten der EU auswirken würde, wenn sie in ihrer derzeitigen Fassung in Kraft träte. Als Beispiele dienen England (als Teil des Vereinigten Königreiches) und Deutschland. Eine detaillierte und rechtsvergleichende Darstellung des englischen und deutschen Rechts in bezug auf die zivilrechtliche Haftung für Abfälle ist daher der Untersuchung des Richtlinienvorschlages vorangestellt. Auf diese Weise leistet das Buch auch einen Beitrag zu der Diskussion, die das im Jahre 1993 von der Europäischen Kommission vorgelegte »Grünbuch über die Sanierung von Umweltschäden« ausgelöst hat. Dem in englischer Sprache verfaßten Haupttext wurde eine ausführliche deutsche Zusammenfassung beigegeben.

The 1994 symposium of the Kiel Institute of International Law, the papers and proceedings of which are hereby made available to the public, takes up not only the general theme of the 1989 conference, i.e. »Strengthening the World Order: Universalism v. Regionalism. Risks and Opportunities of Regionalization«, but also continues the discussions pursued during the 1992 symposium entitled'The Future of International Law Enforcement. New Scenarios - New Law?'The 1994 symposium also continues the now established tradition of bringing together international legal scholars from the United States, on the one hand, and Germany and other European countries, on the other hand. The Institute is strongly convinced that the transatlantic dialogue on the burning issue of strengthening the international legal order as part of an emerging »New World Order« is essential. It was all the more regrettable that for purely accidental reasons the participation, on the European side, by colleagues invited from Poland and other Central and East European countries could not materialize. The focal point of the 1994 symposium was the question as to whether and to what extent the United Nations as a law enforcement agency can be supplemented by regional arrangements/organizations and the state as a law enforcement agent in the international public interest.

Vor kurzem konnte das 100jährige Jubiläum des Bürgerlichen Gesetzbuches begangen werden. Wie wurde das BGB, dieser Meilenstein der deutschen Rechtswissenschaft, zum Zeitpunkt seines Inkrafttretens jenseits der Grenzen des Kaiserreiches, namentlich in den englischsprachigen Teilen der Welt, wahrgenommen und beurteilt? Bereits vor dem Ersten Weltkrieg bestanden vielfältige Kontakte zwischen deutschen Juristen und ihren Kollegen in Großbritannien und den USA. Wie der Autor zeigt, wurde die Entstehung des BGB dort von Anfang an aufmerksam verfolgt. Einige der bedeutendsten englischen und amerikanischen Juristen der Zeit, unter ihnen F. W. Maitland, Frederic Pollock und Roscoe Pound, nahmen sich des Themas an. In einer Vielzahl von Veröffentlichungen würdigten sie das neue deutsche Zivilrecht ausgiebig und stellten kritische Vergleiche mit dem System des Common Law an. Einzelne Regelungen wurden als sehr fortschrittlich erkannt, andere als unnötig kompliziert, eben »typisch deutsch«. In kurzer Zeit erschienen zwei Übersetzungen des BGB - eine davon überraschenderweise von einem jungen Chinesen verfaßt -, die nicht zuletzt die Schwierigkeiten der Übertragung des ausgefeilten deutschen Fachvokabulars in die englische Sprache illustrieren. In jedem Fall wurde im BGB eine der bedeutendsten Leistungen der Rechtswissenschaft seit dem Code Civil gesehen: »The most carefully considered statement of a nation's law that the world has ever seen« (F. W. Maitland). Auch andere deutsche Kodifikationen wie die Zivilprozeßordnung und das Gerichtsverfassungsgesetz, die Grundbuchordnung, das Wechselrecht und das Handelsgesetzbuch stießen auf ebenso wohlwollendes wie kritisches Interesse. Im Rahmen dieser Untersuchung wird weiterhin den Anfängen der institutionellen Rechtsvergleichung in England und den USA nachgespürt und nicht zuletzt der Frage nachgegangen, welche Rolle dem deutschen Beispiel in der zeitgenössischen Diskussion um eine mögliche Kodifizierung des Common Law zukam.

This work investigates liquidity in European sovereign bond markets. Liquidity in financial markets is often neglected when it is abounded, yet evaporating liquidity results in higher costs of transacting and lower information quality of financial markets. The analysis studies liquidity supplying trading strategies in debt markets and the impact of unconventional central bank policies on the time variations in market liquidity. Unconventional policies have been introduced since the global financial crisis and include asset purchase programs and long-term refinancing operations. The findings show that liquidity supply in European bond market declines during periods of financial stress and uncertainty. Moreover, expansive monetary policies and asset purchases can be associated with an improvement in market liquidity.

This book investigates and resolves some financial and monetary questions regarding Chinese economy. The first chapter examines the role of informal financing in China using a firm-level dataset of manufacture industry, and finds that low-risk informal finance exerts a positive effect on firms'performance. The second and third chapter focus on the measurement and effect of Chinese monetary policy. The autor establishes a new index by using a state space method, reflecting changes in various monetary instruments, which has both theoretical and empirical advantages. Then he investigates the effect of China‘s monetary policy shocks on its close trading partners in developing Asia with the GVAR method. China's influence has highly expanded even by monetary policy perspective.

The analysis of cyclical macroeconomic phenomena is an important field of econometric research. In the recent past, research interests have de-emphasized quantitative forecasting exercises and have addressed the qualitative diagnosis of the relative stance of the economy regarding »upswing«, »recession«, or »boom« periods, i. e. the classification of the state of the economy into a limited number of discrete states. In this context the principal challenge is to reduce the multifaceted and sometimes abundant quantitative information about the business cycle to such qualitative statements in an efficient way. For more than six years this task was the focus of the project »Multivariate determination and analysis of business cycles« within the SFB 475 »Reduction of complexity in multivariate data structures«, funded by the German Research Foundation (DFG). The necessity for complexity reduction is, of course, not unique to business cycle analysis but is studied in many fields and in a number of ways. This broad interest in the reduction of problem dimensionality and in the appropriate combination of data and of theory caused the RWI Essen and the Statistical Department of the University of Dortmund in January 2002 to hold a workshop at the RWI Essen where the findings of this and similar projects were presented and discussed. The present publication collects revised versions of the papers presented at this workshop. Although the workshop took place some five years ago, these papers mark an importent juncture in the development of business cycle research.

This book is a collection of essays presented at the international conference »The Administration of Justice – Past Experience and Challenges for the Future«, held in May 2015 in Cavtat, Croatia in honour of Mirjan Damaška, Sterling Professor of Law at Yale Law School. The conference was co-organized by the University of Zagreb Faculty of Law, Professor Damaška's first academic home, and the Marija and Mirjan Damaška Foundation, established by him and his wife as expression of their affection towards their Alma Mater and Croatia. Twenty-six contributors – leading scholars in common law, civil law and the Far Eastern traditions – re-examine from different angles in an original, profound and insightful way all three key areas of his seminal and path-breaking monumental scholarship. The papers cover comparative and foreign procedure, the law of evidence and international criminal law, revealing the depth, richness and far-reaching nature of Damaška's opus. The conclusion is unanimous. In spite of decades that have passed the ideas and insights expressed in Damaška's scholarship did not lose their freshness and originality, moreover their influence continues today. Visions of Justice is an excellent piece of scholarship in its own right which will be of interest to criminal and evidence lawyers, as well as those with more general comparative interests.

The success of health economics and its guidance for health policy heavily rests on the availability of reliable empirical evidence on the demographic, economic, and epidemiological environment, on behavioral relationships, and on the impact of policy interventions. For Sub-Saharan Africa, especially the epidemiological situation is unclear, since comprehensive systems of mortality and health statistics are often absent. The economic analysis of health naturally places a special focus on the interrelation between health and economic well-being: the overall disease burden decreases when a country grows richer, and the share of communicable diseases decreases in the process of economic development, whereas the share of non-communicable diseases increases. In those parts of Sub-Saharan Africa that are mainly dominated by traditional subsistence farming, however, it is difficult to examine questions of income and health for simple fundamental reasons. A vital prerequisite for an empirical investigation is the thorough and accurate measurement of income. Yet, both the measurement of the burden of disease and the measurement of income are research tasks that are far from being fulfilled for Sub-Saharan Africa. A further issue that is related with economic well-being and health is education. For poor rural regions predominated by traditional subsistence farming it is far from clear whether investments in human capital are worthwhile. The present study addesses this research gap by producing empirical evidence on the measurement of the burden of disease, the structure of income, and returns to education in rural West Africa. Concretely it deals with the collection and analysis of mortality, morbidity, and socio-economic data in the Nouna Health District in the North-West of Burkina Faso. The study was accepted as a doctoral thesis at the University of Heidelberg. Earlier versions of some of its chapters have been published as working papers or in international journals.

For many observers the beginning of a dynamic economic and stock market upswing in the U.S. in the mid 1990s marked the start of a new era, the times of the new economy. This phenomenon has been under intense discussion ever since - both in the political arena as well as among scientists. Thereby the somewhat glamorous term new economy reflects the conviction held by its proponents that the use of new technologies will lead to a never ending acceleration of technological progress and economic welfare. The origins of this development date back a long time: More than 30 years ago, the starting point was the basic innovation »digitilization«. Production as well as application of information and communications technologies (ICT) are based on this principle. At the beginning of the seventies, the first microprocessor was produced. Some ten years later, the first personal computer was brought onto the market. The commercial use of the Internet has begun in the mid nineties. In view of the economic boom in the U.S. accompanying the introduction of the Internet, the question arises as to what extent the new economy actually has exerted lasting positive effects on productivity - not only in the United States, but also worldwide. Inspired by these developments, the Federal Ministry of Economics and Technology commissioned RWI, Essen, to study the driving forces of the new economy. In this report, the trends of the ICT sector and of the use of ICT products are analyzed with respect to the overall economic effects in Germany in comparison to the U.S. Further analyses were carried out regarding the intensity and effects of e-business. Finally, the influence of different methods of price measurement on productivity was analysed, since this is important for international comparisons of total factor productivity. The study culminates in a growth accounting calculation separating the contributions to economic growth by capital, labor, and technological progress.

Spätestens die Aufdeckung des sog. Bierkartells hat vielen Konsumenten verdeutlicht, dass Preisabsprachen Auswirkungen auf ihr tägliches Leben haben. Die zunehmende Anzahl wettbewerbsverzerrender Praktiken belegt, dass der freie Markt in Europa geschützt werden muss. Der immense volkswirtschaftliche Schaden und die Tatsache, dass die manipulierten, überhöhten Preise regelmäßig an die Verbraucher weitergegeben werden verlangen effektive Lösungen zu deren Bekämpfung. Dabei stellt im Hinblick auf die Geltendmachung von Schadensersatz das Nebeneinander von 28 nur zum Teil harmonisierten Zivilrechtsordnungen die Geschädigten vor fast unüberwindbare Hindernisse. Der Autor hat sich nicht nur der wissenschaftlichen und rechtsvergleichenden Aufarbeitung dieser Probleme an der Schnittstelle von Kartellrecht und internationalem Privatrecht gewidmet, sondern auch zahlreiche Rechtsanwälte von internationalen Sozietäten befragt. Darauf fußend hat er ein neues und in sich geschlossenes System zur Verbesserung des private enforcement von Kartellrecht entwickelt.

Der Titel des Konferenzbandes »Interdisziplinarität und Komplexität« greift die beiden bedeutsamen Herausforderungen an die aktuelle kybernetische Forschung auf. Aufgrund der Tatsache, dass die Zerlegung hoch komplexer Problemstellungen in Teilprobleme mit detaillierten Lösungsansätzen oft nicht mehr der Lösung der Gesamtproblematik gerecht werden kann, entsteht eine Nachfrage für einen gesteuerten Umgang mit Komplexität. Vollständige, robuste und nachhaltige Lösungen müssen Komplexität integrieren. So konzentrieren sich die Autoren in ihren Beiträgen auf die unterschiedlichsten Bereiche wie etwa Logistik, Normungsprozedere und Geschäftsmodellentwicklung. Um Wirkungszusammenhänge zu beschreiben, komplexe Prozesse und Strukturen zu analysieren und zu interpretieren, werden in den Forschungsansätzen Wissensgrundlagen aus unterschiedlichen Disziplinen herangezogen. Fachexperten wählten die qualitativ hochwertigen Paper-Beiträge in einem double-blind Reviewprozess aus. Die insgesamt dreizehn Veröffentlichungen bieten so eine stimmige Mischung aus Theorie und Praxis auf dem Gebiet der Wirtschafts- und Sozialkybernetik. Dieser Konferenzband erscheint in der Reihe »Wirtschaftskybernetik und Systemanalyse« und ist das gesammelte Ergebnis der wissenschaftlichen Konferenz für Wirtschafts- und Sozialkybernetik 2012 – KyWi 2012. Das An-Institut für Unternehmenskybernetik e.V. (IfU) der RWTH Aachen richtete vom 28. bis 29. Juni 2012 in Kooperation mit der Gesellschaft für Wirtschafts- und Sozialkybernetik e.V. (GWS) und dem Institut für Betriebswirtschaftslehre (IfB) der Universität St. Gallen erstmalig die KyWi aus. Die KyWi 2012 gilt als ein wichtiger Schritt für die Zusammenführung der wissenschaftlichen Gemeinschaft der Kybernetik im deutschsprachigen Raum – die zweitägige Konferenz ist die derzeit größte deutschsprachige Konferenz auf dem Gebiet der Wirtschafts- und Sozialkybernetik und integriert ebenfalls Themen der technischen Kybernetik. Durch den Konferenzband kann der Leser an den Forschungserkenntnissen der Kybernetikwissenschaftler teilhaben und in die Zukunftsperspektiven der Wirtschafts- und Sozialkybernetik Einblick erhalten.

Teaching and study of law is based on the premises of formal dogma. Discussion centres on what the law says, and less on the Instruments enabling its application, such as legal argumentation and reasoning. The approach to the new legal and institutional challenges facing the European Union is not immune to this problem. Little public attention is paid to actual law emanating from EU institutions, and even less to its application. However, at least three issues of vital importance can easily be seen to originate in this field: (1) Does legal harmonisation among EU countries also mean harmonisation of criteria and forms of justification of judicial reasoning? (2) What is the relationship between each country's internal laws and European law at the application stage? And (3) what is the relationship between the application of law by European-level legal bodies and national bodies, which may, for example, assume differing levels of protection of individual rights? These and other questions concerning application of the law in the European Union were the objective of a European congress, The Judiciary and its Role in the European Construction Process, held in Girona, Spain, from 14 to 16 November 2002. The congress was funded by the European Commission via the Human Potential Programme within the European Community's 5th Framework Programme. It was part of the PhD Euroconferences in Legal Philosophy: Current Challenges to the European Legal Thought project. This book brings together the results of that congress, yet cannot be termed Proceedings, since the papers presented at the congress were later modified by the authors in light of the discussion.

Die Auswirkungen der Globalisierung werden vielfach als Bedrohung für die nationalen (Arbeits)Märkte angesehen. Die 69. Wissenschaftliche Konferenz widmete sich deshalb dem aktuellen Thema'Auswirkungen der Globalisierung auf nationale Arbeitsmärkte: Diagnose und Therapie'. Vor dem Hintergrund hoher Arbeitslosenzahlen wurde mit dieser Konferenz ein Beitrag zur wirtschaftspolitischen Beratung der Bundesregierung geleistet. In den Vorträgen und Diskussionen wurden die Implikationen globalisierter Arbeitsmärkte beispielsweise für die Geld- und Fiskalpolitik, die Bedeutung der (De-)Regulierung in einem globalisierten Arbeitsmarkt und die Arbeitsmarkteffekte durch Outsourcing behandelt. Andere Vorträge widmeten sich dem Thema Einkommensausgleich und Wirtschaftseffizienz, der Förderung des Niedriglohnsektors und der Humankapitalbildung als Bestandteil der Wirtschaftspolitik. Die Vorträge und Diskussionsbeiträge stützten die These, dass die Globalisierung nicht die Hauptursache für die Probleme am deutschen Arbeitsmarkt - insbesondere für die Langzeitarbeitslosigkeit und gering Qualifizierte - darstellt, die Auswirkungen anderer Ursachen aber verstärken. Als Lösungsvorschläge wurden genannt: Flexibilisierungen am Arbeitsmarkt, Ausgestaltung der Sozialleistungen im Zusammenhang mit Arbeitslosigkeit als Hilfen zur Arbeitsaufnahme, Qualifizierung von Arbeitnehmern sowie auch gesteuerte Zuwanderung statt Abschottung der Märkte.
