Abstract

La conjugación del Derecho sustantivo y el adjetivo constituye uno de los pilares de la función judicial. Exponente de ello es la Sentencia del Tribunal Supremo de 7 de junio de 2011 objeto de este comentario, en la que el principio de congruencia y el de non reformatio in peius juegan un papel de tal importancia que, unos hechos que el Tribunal califica como constitutivos de una vía de hecho expropiatoria, acaban por ser enjuiciados como si de un procedimiento expropiatorio urgente se tratara. Lo peculiar del caso ofrece la oportunidad de revisar el encaje de dichos principios procesales en la jurisdicción contencioso-administrativa y, en concreto, su engarce por parte del TS al caso en cuestión.

9. Los instrumentos administrativos de garantía de la unidad de mercado

Abstract

The Spanish parliament has recently approved Act 20/2013 of December 9th, on guarantee of market unity. The Act introduces safeguard mechanisms in order to protect freedom of access of economic operators as well as the principle of single license and mutual recognition of administrative authorizations granted by regional authorities. Along with this, the new piece of legislation establishes reaction tools against breaches of legal provisions such as the complain before the Council for Market Unity and the petition of judicial appeal to the National Commission on Markets and Competition (Spanish Competition Authority). Finally, the Act 29/1998 on Administrative Jurisdiction is amended to introduce a special procedure for judicial review of administrative activity afecting market unity., El Parlamento español acaba de aprobar la Ley 20/2013, de 9 de diciembre, de garantía de la unidad de mercado. La Ley introduce mecanismos de garantía de la libertad de acceso de los operadores económicos y el principio de licencia única o reconocimiento mutuo de las autorizaciones administrativas concedidas por Comunidades Autónomas. Junto con ello, se prevén mecanismos de reacción frente a posibles incumplimientos como la denuncia ante el Consejo para la Unidad de Mercado y la petición de impugnación ante la Comisión Nacional de los Mercados y la Competencia. Finalmente, se modifica la Ley de la Jurisdicción Contencioso-Administrativa para introducir un procedimiento especial en materia de unidad de mercado.
