Climate litigation based on the constitutional rights of future generations is an emerging and promising approach to enforcing long-term policies based on intergenerational and climate justice. In Germany, a high-profile constitutional judgment triggered by climate activists ruled that the German climate policy infringes future freedom rights. Based on an assessment of legal opportunity structures and interviews with key actors, this research finds that the complainants utilised the opportunity to facilitate a strong public perception of intergenerational injustice set by the Fridays for Future movement. While the court's response in the form of the intertemporal effect doctrine is ambiguous and does not constitute clear fundamental rights of future generations, the complainants reached their strategic goal to directly influence policymakers and draw public attention to the issue of climate protection as an intergenerational responsibility. An interplay of four different legal arguments and numerous actors associated with the climate movement was crucial to triggering this outcome. These findings from a sociolegal bottom-up perspective are of great relevance as they show that impactful climate litigation through intergenerational principles relies on the strategic utilisation of the cultural context beyond the legal sphere. This policy-oriented article explores the sustainability dimension of digitalisation and artificial intelligence (AI). While AI can contribute to halting climate change via targeted applications in specific domains, AI technology in general could also have detrimental effects for climate policy goals. Moreover, digitalisation and AI can have an indirect effect on climate policy via their impact on political processes. It will be argued that, if certain conditions are fulfilled, AI-facilitated digital tools could help with setting up frameworks for bottom-up citizen participation that could generate the legitimacy and popular buy-in required for speedy transformations needed to reach net zero such as radically revamping the energy infrastructure among other crucial elements of the green transition. This could help with ameliorating a potential dilemma of voice versus speed regarding the green transition. The article will further address the nexus between digital applications such as AI and climate justice. Finally, the article will consider whether innovative governance methods could instil new dynamism into the multi-level global climate regime, such as by facilitating interlinkages and integration between different levels. Before implementing innovative governance arrangements, it is crucial to assess whether they do not exacerbate old or even generate new inequalities of access and participation. When do corporations stop ignoring or opposing climate action and start to go green? We focus on the role of corporate boards of directors, which shape firms' positions on internal and external issues of corporate governance and public policy. We argue that board decisions to engage constructively on climate issues are likely to be influenced by the choices and experiences of other firms. Learning, socialization, and competitive dynamics are especially important in highly salient and rapidly evolving policy areas, such as climate change. To test this theory, we construct the network of board memberships for US public corporations and uncover robust evidence that climate innovations diffuse among companies that share board members in common and among companies whose board members interact at separate boards. Few contemporary crises have reshaped public policy as dramatically as the COVID-19 pandemic. In its shadow, policymakers have debated whether other pressing crises—including climate change—should be integrated into COVID-19 policy responses. Public support for such an approach is unclear: the COVID-19 crisis might eclipse public concern for other policy problems, or complementarities between COVID-19 and other issues could boost support for broad government interventions. In this research note, we use a conjoint experiment, panel study, and framing experiment to assess the substitutability or complementarity of COVID-19 and climate change among US and Canadian publics. We find no evidence that the COVID-19 crisis crowds out public concern about the climate crisis. Instead, we find that the publics in both countries prefer that their governments integrate climate action into COVID-19 responses. Traditional analysis of China's policy experimentation has focused on the role of central–local relations and rotating leaders in shaping the local agenda-setting process. Less is known about the role of less mobile mid-level local bureaucrats who serve as bridges in the implementation process. This paper examines why some cities have performed better than others at implementing and maintaining low-carbon policy experiments. Drawing on a comparison of four case cities and over 100 expert interviews, I argue that the availability of bureaucratic entrepreneurs and their resource mobilization capacity determine the level of local engagement in climate policy experimentation. This study shows that the institutionalization of local policy experiments is not only driven by the central government or rotating top local leaders but also by bureaucratic entrepreneurs who help policy experiments survive periodic changes in the bureaucracy. Annual balances of eight alpine glaciers were slightly negative for 1961–90 and highly negative for 1991–2018. We explain this by changes in positive degree-day sums and summer temperatures extrapolated to the median altitudes of the glaciers. We test a new way of calculating degree-day sums that performs better than the traditional method which used daily mean temperatures. Annual degree-day sums are highly correlated with May–September temperatures as suggested in 1866 by Karl von Sonklar. We find moderate correlations between annual balances and degree-day sums, and with May–September temperatures. Calculated degree-day factors for the eight glaciers cover the reported range for snow and ice ablation, while the temperature sensitivity of annual balance is from −0.4 to −1.0 m w.e. for a +1°C temperature change. We accurately predict mean balances for 1991–2018 using May–September temperatures in regression models calibrated for 1961–90. May–September temperatures in the Alps have already increased ~+3°C since 1880 and, if temperatures continue to rise, these glaciers will shrink rapidly. As annual balances are already negative for present-day temperatures, these glaciers will not be 'safe' under the further temperature increase permitted by the Paris Agreement. While nudging has garnered plenty of interdisciplinary attention, the ethics of applying it to climate policy has been little discussed. However, not all ethical considerations surrounding nudging are straightforward to apply to climate nudges. In this article, we overview the state of the debate on the ethics of nudging and highlight themes that are either specific to or particularly important for climate nudges. These include: the justification of nudges that are not self-regarding; how to account for climate change denialists; transparency; knowing the right or best behaviours; justice concerns; and whether the efficacy of nudges is sufficient for nudges to be justified as a response to the climate crisis. Given the need for legislation to protect internally displaced persons, African Heads of State and Government adopted the Convention on the Protection and Assistance of Internally Displaced Persons in Africa in Kampala in October 2009. The convention, which entered into force on 6 December 2012, is an important binding instrument on internal displacement. Article 10 of the convention requires states to prevent displacement caused by development projects, including climate-based development projects. This paper suggests how the regulation of Solar Radiation Management (SRM) field research in Europe could be designed to maximise the possibility of securing legitimacy. It argues that legitimacy is maximised when regulatory frameworks are legal, and also responsive, flexible, deliberative and inclusive. By adopting an 'incorporated' approach to assessing the risk of Solar Radiation Management (SRM) field research, the EU can import elements of 'directly deliberative polyarchy' into its otherwise orthodox constitutional regulatory approach thereby maximising legitimacy. The argument is new in so far as it juxtaposes two conceptions of procedural legitimacy - one institutional and the other functional - in the context of significant scientific uncertainty in the technocratic regulatory paradigm of the EU. The significance of the work is that it draws on these conceptions of legitimacy to advance a pragmatic model of institutional design which comprises procedures that maximise legitimacy with minimal disruption to the EU's institutional balance of powers. Climate engineering in general and solar radiationmanagement (SRM) in particular raise profound and complex political, legal, social, and ethical questions that go well beyond technicalfeasibility issues. We consider three such questions. First, can existing EU decision-making processes accommodate sufficient public engagement to ensure legitimate decisions on SRM? Second, does politics influence the choice of legislative procedure for SRM regulation? Third, does the choice of legislative procedure influence the likelihood of SRMimplementation? Three main conclusions emerge from our analysis. First, existing EU decision-making processes can - given certain conditions - accommodate considerable public engagement and hence ensure legitimate decisions on SRM. Second, politics matters; indeed, the EU's choice of legislative procedure concerning SRM may well become subject to political negotiations. It discusses significant legal parameters derived from EU law from which such a future EU policy would have to arise. . This brief opinion piece draws upon behavioural and cognitive research to argue that the Paris Agreement's goal of keeping global temperature change below 2 degrees Celsius sets a psychologically powerful baseline against which future policy failures can be measured. When international law successfully triggers perception of a baseline, it can lead decisionmakers to perceive deviations from that baseline as "losses." This implicates loss aversion, which provides an additional motivation to achieve international norms. The psychological impacts of this new status quo may end up being more powerful and more durable than either the unusual structure of the document or the domestic implementation questions that have already attracted so much scholarly debate. It is opined that the definitions of climate change under the Paris Agreement's policy and science sphere are inconsistent and apocryphal, which impedes the scientific enterprise of climate research. It is stated that climate science is policy-led instead of climate policy being science-led, as the Paris Agreement seems to require.

The Dutch State has to ensure that the Dutch emissions in the year 2020 will be at least 25% lower than those in 1990. The parties agree that the severity and scope of the climate problem make it necessary to take measures to reduce greenhouse gas emissions. Based on the State's current policy, the Netherlands will achieve a reduction of 17% at most in 2020, which is below the norm of 25% to 40% for developed countries deemed necessary in climate science and international climate policy. With this order, the court has not entered the domain of politics. The court must provide legal protection, also in cases against the government,while respecting the government's scope for policymaking. Departing from the fact that climate change poses localized effects, this article critically considers from a legal perspective the role of local authorities in the South African government's response to climate change. A brief review of the relevance of climate mitigation and adaptation is followed by an explanation of what these concepts mean for local government. The article then discusses the extent to which the country's environmental and local government law and policy framework provides for municipalities' participation and involvement in climate governance. The article identifies strengths and weaknesses in relation to the local sphere of government's formal involvement in climate governance vis-à-vis authorities in the provincial and national spheres. It concludes that, as a result of their proximity to the effects of climate change, municipalities have a critically important role to play in the climate governance effort, despite the patchwork of environmental and local government laws and lack of explicit, consolidated policy and legal arrangements to this effect. This paper analyses Chinese sub-national governments' implementation strategies to meet national energy efficiency targets in the 11th Five-Year Plan (2006-2010). Previous research has focused on the ways governance practices and decision-making structures shape implementation outcomes, yet very little attention has been given to what strategies local leaders actually employ to bridge national priorities with local interests. To illustrate how local leaders work politically, this paper highlights specific implementation methods officials use to strengthen formal incentives and create effective informal incentives to comply with energy efficiency mandates. The analysis is drawn from 53 interviews conducted in June and July of 2010 in Shanxi, a major coal-producing and energy-intensive province. Findings suggest that local government leaders conform to national directives by "bundling" the energy efficiency policy with policies of more pressing local importance or by "bundling" their energy efficiency objectives with the interests of groups with significant political influence. The contradiction between the astonishing dynamic of China's domestic climate policy agenda and its seemingly tenacious position in international climate negotiations presents a puzzle that, on closer inspection, reveals much about a nation at the crossroads, undecided which way to turn. The alterations in China's political interests connected to the issue of climate change are clearly evident in the domestic policy changes China introduced during previous years. However, China's leadership thus far has remained hesitant to translate this new set of interests fully into a coherent position in the international arena. China's mounting difficulties in reconciling its rapidly changing role on the international stage with its altered domestic situation, as well as its traditional foreign policy interests and principles, undermine its ability to pursue a consistent and effective strategy in international climate negotiations. China's reluctance to redefine its role in the international arena has led to a number of inconsistencies that particularly plagued its position during the Copenhagen conference, adding to the overall non-constructive dynamic of the proceedings that ultimately left China, as everyone else, with empty hands. The Copenhagen negotiations demonstrated that China's leadership will have to address these inconsistencies resolutely if it wants to realize the benefits that international climate cooperation offers. This article explores the process by which norms of international climate governance have diffused and evolved over time. The author develops a constructivist explanation for observed normative shifts in international climate governance. This explanation highlights the importance of building and maintaining congruence between domestic conditions and international norms. Due to the inherently fluid nature of both domestic conditions and international norms, it is argued that normative congruence building should be understood as an integral and iterative aspect of the norm diffusion process. This argument is substantiated through an analysis of the norm diffusion process in the context of India: a state commonly identified as an important player in international climate change politics, but one that has received surprisingly little scholarly attention in this area.
